You are asking this question because you never lived abroad. If a bank forgot to remove your tax, all they need to do is simply remove the tax from your account without penalising the client. Bank usually will be let off if they can give reasons for their delay in removing the tax for government. Tinubu was not penalised. The tax was just simply removed. That’s all.

If you read Kevin Moss' statement to the court, he was still investigating Tinubu but it became hard for him to bring up hard evidence to prosecute him, he had financial evidence for money laundering from proceeds of Drugs, but Tinubu was not forthcoming with enough information to call for extradition, for you to charge someone with drug offence there has to be some amount of drugs caught in his possession, since they had his money with them, they opted for the easy way to at least get some of that proceeds of illicit funds from him, if he was in the U.S it would have been a different ball game...
That’s not correct. If there is a prima facie case of money laundry, it is a valid reason for extradition process. Just like they did for Hush Puppie and others. If Tinubu is not forthcoming and they have enough reasons to extradite him they would have done so. They simply had no strong evidence to link him to money laundry and proceeds of crime. That’s why he was not charged or arrested or convicted.

Okay. I've this burden on my chest for over a year now and they say a problem shared is a problem half solved (or multiplied)

So, I've this friend who lives with a woman and her little son. He and the lady are of the same age group. The husband, who is in the US is fully aware of this situation. My main purpose of creating this thread is not to pass judgement on anybody but to seek your opinions. As a married man, will you be comfortable with your unmarried friend staying with your wife while you're overseas. As an unmarried guy, will you be comfortable living with your friend's wife.

5. In the next twenty years, Nigeria would experience another civil war. This time, your properties would not be seized but razed down. Last time, you got 20 pounds. By 2040-2050, one pound or even one kobo, you would not see. Again, as an Igbo person, move your wealth outside Nigeria. Open offshore accounts. Buy citizenships of other countries. In this case, do it strategically. Don’t buy that of St Nevis but Grenada as it leads to the EB1 visa of the US. Get insured, but this is for the short term. The long-term is offshoring every money you have. Do not put all your wealth, savings and assets in Nigeria. 2023: OBI, ATIKU, NO MANDATE TO RECLAIM

Without prejudice to the ongoing litigations on the 2023 presidential election outcome, it is important to call Peter Obi and Atiku Abubakar to order. And very seriously so. The two failed candidates DO NOT have monopoly to call out Nigerians either to protest or disrupt public peace. The fact that the President-elect has chosen the path of decorum and public discipline to maintain calm and quiet should not be mistaken for weakness and meekness. If Obi calls out his Obi-dients, and the President-elect calls out his BATified, there is the likelihood that there would be a breakdown of law and order. This is why Peter Obi MUST apply sense and reason to manage the situation we find ourselves to avoid any implosion.

Obi does not have following more than Tinubu, the President-elect, nor does he have a better street sense than the Jagaban himself, a man who was a pro-democracy activist in the years of the military. That the President-elect has elected to maintain peace and order amongst his numerous followers is a function of maturity, leadership responsibility and respect for public order in the country. If Peter Obi takes law into his hands, the necessary sanctions would apply. He needs to have a country, first and foremost, before thinking about leading it.

Talking about a mandate to reclaim makes me ponder if there is another election to be contested in due course. Or perhaps, another INEC has been born that would organise a “Peter Obi-friendly” election that would declare him winner to please his followers. Having run down INEC with all manner of foul language, some libellous and scandalous, others very profane and unguarded, I am wondering if Obi would accept another election contest under INEC as its umpire.

Having condemned INEC in such whimsical manner, derided its chairman with so much vile and bile, I am wondering if Peter Obi would accept the outcome of an election supervised by the electoral umpire, if the pendulum were to have swung in his favour. You cannot build something on nothing. How can you blame an electoral umpire on the one hand and attempt to profit from an election they conducted on the other hand, and for which you already wrote them off and called them unprintable names?

That is pure hypocrisy, self righteous indignation, another name for double standard. There is no mandate to claim anywhere. The mandate was freely and truly given to the rightful winner in line with the laws of the land. Obi and Atiku, need to search further for their own mandate, but if it was the election of February 25th, we have since crossed the threshold.

For me, there is no harm in seeking legal redress where you feel your own hands are clean and you are entering the equity platform with clean hands. In seeking redress, you must be sitting on a moral high ground such that would free yourself and your party from any accusation of incredulous conduct. The first point at issue is the fact that Obi’s candidature would be subjected to the crucible and will fail the integrity test flatly. Peter Obi was not a candidate in that election. He left the PDP when he saw that his chances at clinching the ticket had become impossible. He joined Labour Party having participated in the process of primaries of the PDP.

The new Electoral Law forbids anyone to participate in more than one primary election. The Law also requires that a copy of the Party’s register of members be domiciled with INEC not later than 30 days before the primaries. By the time Peter Obi joined the Labour Party, this threshold was already in breach. The party had submitted its register of members in line with the provisions of the Electoral Act. By that time, Peter Obi was not a member of the Labour Party, and how he emerged later as its Presidential Candidate without being its member has since become another kettle of fish. That would be an interesting angle to the whole process of jurisprudence. Interrogating the processes leading to the outcome will be another way to deepen democracy and the rule of law.

The other issue for me has to do with self examination. Has Peter Obi done a clinical analysis of his party across board to be sure the party is not culpable of the same issues he is raising in court? From some of the amateur videos that we have seen on social media, the voting process in the South East raises more posers for any discerning mind than expected. It will be good to subject the outcome of the election in the South East to forensic analysis in order to properly situate the voting pattern and the actual outcome that gave Peter Obi so much votes effortlessly. We have seen result sheets where other parties scored zero except Obi’s Labour Party.

Even in Imo state that has a Governor of the APC, and Ebonyi state, the outcome reflected similar pattern. It will make sense to interrogate and forensically analyse the results in Anambra, Abia, Enugu and Imo, to be sure they were earned by Peter Obi and his Labour Party. How possible Peter Obi scored over 534,000 votes in Anambra state, a state that is notorious for low Voters’ turn-out at elections; its recent Gubernatorial election outcome is a point of reference. By the time all those results and bogus figures are forensically examined, Peter Obi might come short of the figure already announced. Litigations on election outcomes are usually very herculean and the months ahead would be very interesting.

I have only concentrated on the Labour Party because the PDP and its beleaguered candidate contested against the run of play. The zoning principle in its party’s constitution was too sacrosanct to be ignored. The party apparatchiks wore its conspiratorial garment and twisted the whole logic of the propriety of the zoning formula. At the end of the day, Five Governors of the opposition PDP easily called G-5, pulled out their support for the PDP candidate; a rehash of 2015 scenario.

That, in itself, diminished its opportunity and chances at the election, which makes the claim of a mandate appears curious. What mandate does the PDP intend to claim? How can two candidates be laying claim to be the winner of an election they have so much complained about? While they condemned the outcome, they celebrate their Party candidates that won senatorial seats into the Upper Chamber of the National Assembly as well as the Lower Chamber.

That alone puts a question mark on the propriety of their claim. If you score the Senate and House of Representatives election high, election that followed same process, same day, same hour, and you condemn that of presidential outcome, you are at best trying to hide behind a finger. The truth of the matter is that, the victory of the President-elect and his party follows the pattern of outcome of the Senate and House of Reps. The APC has more Senators than LP and PDP. The party also has more House of Reps members than PDP and LP. Will it now be logical to input that having won more seats in both categories, the party will then lose the presidential?

The truth of the matter is that there is no mandate that was stolen. There is certainly no mandate to be reclaimed. The trajectory of the election does not support the scramble for reclaiming any mandate you never got ab initio. But there is good optics for its comic relief. At least, for the first time, I saw Atiku Abubakar doing “aluta continua” in a piece of T-shirt and Jeans. That was good optics. Unlike in the 2019 presidential election when Alhaji Atiku Abubakar ran away to Dubai, thus exposing some of us to the security goons for harassment, this time, he seems poised to do some “aluta continua” probably before he escapes again. Next time, PDP will learn to stand by its own rules and regulations, and its constitution.

When conspiracy drives a process, this is what you get. How can Alhaji Atiku Abubakar claim to be seeking electoral redress when he shot himself in the foot ab initio, allowing the G-5 to freely be on transfer market. Those who value them sought their support. Simplicita!!. Peter Obi and Atiku Abubakar, should bury their pride and behave like sportsmen for once by congratulating the President-elect. In the interest of the country, they should grab the opportunity given to them by the President-elect to negotiate some consensions for their parties and followers in the spirit of Government of National Unity- GNU. This to me is a better way to extract a commitment from the process than wasting precious time in the Tribunal up to the Supreme Court in wild goose chase. Certainly, there is no mandate to be claimed, not the 2023 election any way!.

So I have been hearing different versions of Tinubu's drug case in the U.S and was curious to know why LP decided to petition him on that case to get him disqualified.

I had to look for the document to read for myself and I found it, I had to read the entire 58 pages to know what exactly happened, so In other not to bore anyone with a long write up, I will try and summarize the entire story.

Please note that this is the testimony that was written in the document by Kevin Moss tendered to the court in the course of his investigation.

Here we go:

A big drug burst was embarked on by the FBI, DEA and other security Agencies in the United states, an undercover agent who posed as a drug dealer was able to nab one of the kingpin who wasn't a Nigerian, the kingpin entered a plea deal to give information about his other kingpins.

These other kingpins were Nigerians and the same undercover agent posed again as a drug dealer and arrested these kingpins, during the course of investigation on them was where Tinubu's name was mentioned.

Tinubu's Investigation Starts

Since the other kingpins were in their net already with evidence of drug dealings, Kevin Moss wanted to know who Tinubu was and his involvement with these Kingpins. So I will list Kevin Moss' findings as much as I can remember now.

1. Tinubu's interaction with these kingpins in the United States started from 1988 and it may have been earlier than that in Nigeria.

2. Tinubu received funds from these kingpins in hundreds of thousands of dollars at various occasions.

3. Tinubu spent from the monies sent from these kingpins at various times, He bought different brand new latest cars at different times from these monies with his wife.

4. Tinubu listed his wife(Remi Tinubu) as a house wife who was not working but was spending and receiving hundreds of thousands of dollars even when his salary was only 2400 dollars a month meaning there was no contribution of any sort of business from his wife.

5. The company he worked for in Nigeria was contacted by Kevin Moss and they denied ever giving Tinubu such amount of monies, in fact they said his position doesn't involve handling any cash for them though he was in the finance department and they have never given him money to deposit on their behalf.

6. Tinubu evaded paying tax on the huge amount of monies he was receiving.

7. Tinubu at some point falsified documents and address.

8. Tinubu met constantly with these kingpins at various occasions and even shared different addresses with them in various documents

9. Kevin Moss admitted in the document that he knows how the drug cartel works and the case involving Tinubu has attributes that looks exactly like one.

10. Tinubu opened various accounts he later refused claiming ownership of, even when there were deposits he made to them in hundreds of thousands of dollars.

11. Kevin Moss never met with Tinubu throughout the course of his investigation because Tinubu remained in Nigeria all through, Kevin Moss had to get Tinubu's contact from his U.S bank to call him in Nigeria.

12. Tinubu initially claimed to know the 2 Kingpins in his first conversation with Kevin Moss over the phone, but later started denying knowing them after like the 3rd time of conversation.

13. This conversations with Tinubu were for a period of about a year or more.

14. Documents found by Kevin Moss showed that Tinubu opened about about 2 investment companies that listed the 2 kingpins as Directors of the companies.

15. The total money that was frozen in all of Tinubu's accounts were about 1.4 million dollars.

16. The court gave Tinubu chance to come and clear his name about the proceeds of the funds and why the money should not be forfeited, Tinubu did not show up.

17. Tinubu never showed evidence to the court or Kevin Moss how he got the monies except the evidence Kevin Moss had from transfers from unknown sources, from Tinubu himself and the ones from the kingpins into Tinubu's account .

18. Tinubu through his U.S lawyer then files a claim for the money using his family, his mother( Alhaja Mogaji) and one K.O Tinubu laying claims to the ownership of the monies, the case dragged a bit then both parties agreed that the one belonging to Tinubu(Since he was denying the other monies) which is about $460,000 should be forfeited and rest released to the other family members with a disclaimer that the Tinubu family cannot in the future charge the U.S or its agencies or anyone involved in the forfeiture.

19. And that is where the case ends, this is according to Kevin Moss and court documents published.


From my findings Tinubu's case is similar to Abba Kyari's case, he was supposed to be in the United states to clear himself instead he chose a plea bargain to avoid investigation and /or prosecution.
There is half truth in your summary. Can you tell us why the prosecution released the rest money and made them sign a disclaimer that they cannot sue the government or its agencies? Does that not indicate that they too felt vulnerable that they can be culpable in future for wrongful confiscation of legitimate funds? And on what basis did Tinubu lose some money to them? Was it on the basis on illegally obtained money or proceeds of crime? Or was it as interest paid on his money in bank? I saw that you mentioned not or evading paying interest on his funds. Was that the interest he did not pay on his funds in bank or was it proceeds of illicit activity. You clouded everything together in that final section. Answer my queries.

Akande had a strong and well-connected narcotics business, whose proceeds were substantial and kept in the forfeited bank accounts, the document shows.
The affidavit revealed that the defendant’s—Tinubu funds—represented a substantial part of the proceeds from this operation or property involved in money laundering. Judge Michael believes based on indisputable evidence that the funds belonging to Tinubu stashed in his Citibank and First Heritage Bank accounts were proceeds from Akande and other narcotraffickers’ heroin operations.

In 1999, the same Tinubu was elected Governor of Lagos State, just a mere 6 years after he was convicted of criminal charges of drug dealing. Unknown to Nigerians and his then opponents, this criminal presided over the affairs of Lagos state in utter violation of Section 182(e) of the Nigeria Constitution. For the avoidance of any doubts, Section 182(e) states as follows: “No person shall be qualified for election to the office of Governor of a State if … “within a period of less than ten years before the date of election to the office of Governor of a State he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the code of Conduct”.

The fact that Tinubu did not disclose his narcotic sentencing in 1999, is direct violation of the constitution. Further than that he even swore on Oath that he was never convicted of any crime, which is perjury. So, when I see people quoting section 137, and hallucinating that Tinubu's narcotic case is status barred base on section 137 (e), I pity them.

So, fellow Nigerians, do you still believe that Tinubu was qualified to run for the presidency in utter violation of the Nigeria Constitution?
