PoliticsRe: SERAP Drags Senate To UN Over CCT Amendment by eodavids(m): 10:43am On Apr 18, 2016
princemillla:
Lawyers in the house, if CCT establishement acts is amended, can the case be transferred to another court of high jurisdiction like supreme Court?

Just asking.....
DANLADI SHOULD ACT WISE
If the Saraki-led senate repeal or re-enact the CCT Act, it will not operate retroactively, rather its operation begings the day it became a law. Sarakin's alleged offences are in the past and governed by the law in force when the offences were committed.
So chill!
PoliticsRe: SERAP Drags Senate To UN Over CCT Amendment by eodavids(m): 10:34am On Apr 18, 2016
The CFRN 1999 (as amnended) provides for legislative powers to reside on the National assembly.

We (Nigeria) recognize and operate separation of powers between the three arms (legislature, Executive and Judiciary) of Nigerian Government.

The classical approach to the doctrine of separation of powers (in the days of Locke) would have been that absolute discretion and non-inteference. But the refining of the above doctrine holds that except power is checked, it shall be abused.

Knowledge of Administrative law (even in Nigeria) has shown that checks and balances exist and thrives to prevent and, or rectify any abuse of power by any arm, tier, agency, parastatals, person or body of persons in the use of power or discharge of their duties.

There is what is called judicial review and it is aimed at rectifying whatever misdeed or ultra vires acts by any power-wielder.
Having said that, there is no cause for alarm.

The courts, a competent cocurt with the requisite jurisdiction, will pronounce on the exercise currently being carried out by the senate, so that where necessary, such exercise will be reviewed in the interest of justice.

MOST IMPOrTANTLY: laws when made do not operate retrospectively, rather laws can only begin to have force the day it was assented to by the pesident or the day that NASS override the presidential veto (if the president vetoed the bill).
It should be acknowledged that Saraki's alleged offences are in the past and laws made today cannot apply. The law(s) in force when an offence was committed will apply.

Saraki belongs to the legislature, but the ìnterpeters of laws is the judiciary. No fear nor favour applies in there.

Lies! There is no iota of veracity in these claims.

There's no single place in the Bible where the death of any of the original apostles was recorded except Judas who hanged himself. Any other claims outside the Supreme authority of the Bible are mere conjectures and utter fallacy.

Besides, how can God allow His first apostles to die such gruesome deaths? I refuse to believe these myths.
Are you a Christian?
If yes, are you a modern Thomas?

Be wise

The piece you're castigating is common knowledge among adherents.

Who are the poor?
Who and who will access the so called #500 bn for the poor?

I still remember the year 1999-2001 when the then Nigerian government of OBJ introduced poverty alleviation programme by which people were paid monthly salaries when they weren't working for the pay.

It wasn't a bad idea that the then government introduced the scheme; but what was bad (and still remains bad) is the fact that it was 'the well to do' and the NON-POOR that accessed that money.

Personnally I know many people who were already controlling millions that were collecting the then monthly pay in the guise of poverty alleviation; but the poor (including myself)) could not access it.

Pls, I must say this even though my opinion is worthless:
PMB must make sure that this does not go the way of the former.
What is meant for the poor can only get to the poor if the rich and influencial will not directly or indirecly be in charge.

God bless PMB

Before now and uptill now, the US has not made it easy for government of Nigeria to access and import all the necessary weapons for use in this important war against terror.

How comes it was easy for individual to access and import arm from the same US?

Importation of foods and necessaries had been put on hold by the present administratoion, which has resulted into hike in prices of all commodities; how could arms succeed in being brought in?

These are few of many questions begging for answer.

Well....I must confess, my igbo brothers are blessed and gifted! They are Nigeria's hope when it comes to industrilization and technology advancement!

But still...I don't understand their hatred for we Yorubas....they just seems to be obsessed with anything Yoruba!

Hatred is anti - progressive, it only keeps the hater stagnated!
There are not much Igbos that dislike Yorubas.
The truth is: Yorubas have strategically been helpfull to the Igbos.
So its safe to say that Igbos are (to an extent) indebted to the Yorubas.

But to say how much a tribe has been helpful and benefitial to another tribe In Nigeria is to state the obvious because we are all interdependent one upon anotherr.

No room for hate please, fellow Nigerians.

You have done well @Op.

If God and His dictates is of any concern to the sons of man in this age: tatoo would not had been permitted in the society.

How could it become a normal thing that celebities and people of modern popularity now inflict themselves with scars that make them look like suffering from skin disease, and the societiis across te globe welcomes it?

Op, this tatoo thing originated from dark source, periood.

In my view, things that are non of God must have their source from the evil one.

PoliticsRe: "Pressure On Buhari To Stop Anti-Corruption War" - VP Yemi Osinbajo by eodavids(m): 8:56am On Feb 05, 2016
There is need to do those things that are needful without concentrating on one at the detriment of other most important ones.

PMB's anti corruption war is a welcome effort. But if the economy must remain in shambles to the extent that the masses will have to get poorer on the proccess; then something is wrong somewhere.

During the past 16years reffered to, evidene on the ground shows that much looting occured. But the fact still remains that the same masses PMB is supposed to be figthing for were more bouyant and richer than they actually have been while this Buhari presidency lasts.

It has so far remained ironic that the government of PMB/PYO which stands a better chance of making the Nigerian nation better as well as her citizens getting happier, so far the naton can only count on "hope" and the masses are now in despair because of penury.

This thing obviously happen often in life that expectations do not always come through; but PMB/PYO presidency should not be allowed to go that line.

Pls, some one somehow must tell the powers that be not to bank on "ON THE LONG RUN" because by then this very tenure in issue will not matter.

What matters is what has been happening and what will happen next while PMB/PYO tenure is in pendency.

God bless PMB/PYO!
God bless Nigeria.
PoliticsRe: Wailing Wailers; Buharists And That Disgraceful 2016 Budget- Japhet Omojuwa by eodavids(m): 1:10pm On Feb 04, 2016
President Mohammed Buhari should be given the necessary supports first. He assumed the office less than a year ago, it is only rational enough to say encouraging words for him and about him as a way of supporting his good nntentions.

When the president is abut completing his tenure, then Nigerians can start evaluation on him.

Which of yu Nairalanders was examined in school at the beginng of term or semester (as the case may be)?
Isn't it at the tale-end of a term/semester that students are made to undergo evaluations?

Habba Nigerians, good people of great nation:
Let's support Buhari first. When he enjoyed all our suport and completes his tenure (atleast the 1st tenure); then we may come down on him with our praise/criticisms.
God bless Nairaland;
God bless PMB;
God bless the FRN.

Mixty, Mixty, Mixty,
I had to call you three times because repeatition is meant to emphasize a point.
Common sense should tell you that justice was done in the states you mentioned because we all know now is not the time for coercing the judiciary or bribing and if there should arise any such case, the party in power at the centre shoulbe be firstly suspected. PMB has been silent and can be presumed to be neutral-but you as an apc supporter and others like you should learn to respect The Supreme cuort of Nigeria because the SC Justices are beyond your criticisms.

I admire APC;
I admire change;
I like what President Buhari Represents and stands for (against corrruption and criminality);
I like Nigeria to get to our collective resonable desired destination.

What I do not like which also every well-meaning Nigerian should hate is reckless speeches and reckless actions.
The APC chair has just shown that if he is the president, he will pounce on the supreme Court irrespective of the fact that he is a lay man when legal issues are discussed.

Please Nairalander, some one should tell the APC chair that the supreme court also sat on Lagos state and upheld Ambode as the elected Governor of Lagos state- the APC had no problem with that.
Now APC has come to see supreme court as needing investigation simply. Because they are not favoured.
That is purely a biase view and The APC may have to change their chairman, otherwise they will land in trouble because of his biased and ugurded speeches against constituted and respected authorities.
PoliticsRe: Pro-Biafra Militants Free Hijacked Ship, Hold 5 Crew Members Hostage by eodavids(m): 9:12am On Feb 04, 2016
This is criminality and has nothing to do with agitation for any Biafra.

If a group of people speak or protest for their intention to secceed; they may hide behind fundamental Human Rights provisions both in Nigerian Constitution and in the UN charters. Legally, they will garner support from well mening and reasonable co-citizens.
If on the other hand such agitators goes into kidnapping and hostage-taking of any kind; they becomes thieves, hoodlums and "enemis of the state"
