Whether there is an agreement in place or not, as long as his rent has expired and he has overstayed for three months, he can only give 7 days notice to recover property and after that begin a court case to both retrieve his rent and recover all the accrued rent the tenant is owing.

I repeat, if the rentis paid yearly.The Landlord must give notice for up to 6 months for tenant to leave.,once this xpires the tenant now has 7 days. However most persons don't live, the negotiate with landlords for xtra 3 months, there is nothing in the law that states that you should have xtra three months, its up to you and landlord to have a gentleman's agreement and you must pay this three months up front!

Small time they will say landlords should take monthly rents like they do in UK, US and other oyinbo countries. Unfortunately, they don't know that in most cases you start with a security deposit (usually one month's rent), which means you are paying 2 months rent in your first month of stay. Then, your subsequent rent is due on the 1st of the month with a grace period of 3 days. Once you don't pay after 4th, you start incurring penalties. If you don't pay by the 15th, you are already looking at eviction. Meanwhile, by the time the landlord sends you out at the end of the month, they are not really out of pocket because they technically have the month's rent.

We are very close there cos as it is, man on the street cannot pay N2million for a 2bed flat easy.so the average city rent in Nigeria is N120k per month so you need to earn at least n300k plus.

yes he is right, the landlord should have served him a 6 months notice whether he is owing or not. But there is a different side to this, if the tenant has no legal written contract then the tenant has no ground to stand, The tenant can only demand for 6 months notice if he has a written agreement that's states so!

ou are absolutely right, however you will still need to pay for the three months, Im sure you are thinking it would be free but by the end of the tenancy since OP now has 6 months notice, he only needs 7 days to vacate the property!this is due t how long it take to pass judgement, ask that your Owerri lawyer!

My honest advice to you is to you is to vacate his property in peace for him. No need to drag anything with him or try to prove your papa or mama na SAN. Try and get a place on or before the expiration date.

Talking from experience, my tenants wanted to play smart on me, they will never finish saying what they face afterwards. Some landlords are not smiling when it comes to someone wanting to drag their property.

Be a good tenant and God will also make you a landlord too, choose the path of Peace instead.

i think the only responsibility the man has is 2wards his child this is why the money you pay to ex wife is called child benefit money not Mum benefit money. How much you are told to pay and how much you can afford to pay is a different matter. Good evening guys, please I need an urgent legal advisors in the forum to assist my cousin brother.
He had divorced and sent her wife back to the village for the past six months ago.

But the court asked him to be paying a certain amount of money monthly for the child's wellbeing which he has been doing.

But unfortunately the effect of the money has never been significant by looking at the physical appearance of the child.

He always sends relatives to check on the child of which several reports have reached him about how the boy is always been abandoned to be wandering about alone while the mother will be hanging out with friends.

What strucked him to his nerves was the recent report about the child been seriously sick and rumours that the mother now deals with several sexual partners while still breastfeeding the child....
He travelled from Abuja immediately to his hometown to retrieve the boy via court order but unfortunately the court denied him because the baby is believed to be too young at 1 year and 3 months old.

Now that the court had adjourned the case till 28th this month, he however decided to stay put in his hometown to treat the baby. The baby was taken to the hospital. the doctor took off his clothes and to our greatest suprise, the child's body looks so rough, rashes and boils all over her armpit down to his genital region.

Laboratory test was carried out and the report showed that the child have sexually transmitted infections. Fungi infection (,jock itch) and candidiasis.

All these evidences have been push to the judge phone and what we are afraid of, is the possibility of the judge cautioning her to take care of the child and allow her to continue taking the child's custody.
Can he take the child forcefully after having all these evidences against the mother?

they should engage NGOs that deal with stuff like this together with the court herring .Kudos to Dad for following up with his child, I can bet my left balls loads of men would have just given up and 4goten about mother and child by now!

People just like to be difficult and cheat other people out of their sweat. That is why they misinterpret laws and take undue and ungodly advantage of loopholes.

We should all aspire to be the kind of tenant we would want when we become a landlord.

When I had a similar situation, I ensured that I was as Godly as much as I could.
- Agent increased rent, but it was too close to the expiration of my tenancy. I told him to give me 6 months to move out and I paid for the 6 months at the going rate. Eventually, I was too busy and I didn't move out as planned. So I asked for another 3 months but I paid the new rate.
- He asked me to paint the flat after moving out. I told him I would paint only after removing the new wiring, mosquito nets and other improvements that I installed. He quickly told me to forget it.

He may not like me, but he could not fault what I did. I would also not cry foul if a tenant did the same thing to me in the future. in fact I would be extremely grateful if I had my type of person as a tenant.

It is absolutely not correct, and your explanation makes it worse. Every other thing being equal, you should renew your tenancy (pay your rent) before the tenancy expires. So, unless there are other issues (such as financial problems), quit notice is highly likely to come when your tenancy is still valid. Once you stop paying your rent, you are no longer a tenant and that is almost another discussion on its own.

You will be a landlord one day.

The way people talk about law will make you laugh and fall down,imagine enjoy rent and the serve 6months notice untop no rent.I wish these guys know how much it cost to build houses nowadays, Nigeria will turn to places like Uk where individuals now cant build and instead rent or buy via mortgage!

Tenants should not take a rent which their 2months income cannot cover.

Also, Landlords should not give rent to a tenant whose two months income cannot cumulate their annual rent.

I saw the way the operate, cos i had loads of them come down, and some are very aggressive and intimidating. But nah my area i dey.The rents Im collecting has no significant bearing relative to the amount spent on the house so I am not leveraging on it,I just wanted quiet reasonable and responsible family o stay!

The 6 months notice to quit should come from the court. After 6 months and the tenant has not moved out, 7 days notice to quit is served. After 7 days and the tenant has not moved out, the bailif can now execute the eviction.

Assumptions, The 6 months notice is statutory by law, no court order needed. You will need a court order if eviction is to take place.

Read the post again, He has 6 months notice meaning 6 months b4 his rent expires. Best option is to negotiate with landlord, for him to allow him move his stuff while renovation is going on then move back in but ofcos me and you know rent is going to increase!

Una go dey talk wetin una nor know, if someone goes by the proper channel you will be evicted. Once you are served notice to increase rent, the option would be A Pay or B move out if you dont pay, then the court can order you to move out and if you refuse the beliefs move in.and they can take your property to storage and you will have to pay for it,This all can be done within 6 months

bross let me be honest with you, the landlord is very fair, he has given you 6 months notice, that's half of your tenancy agreement, Six months is enough to make arrangement to move out..it would be better to move out in good blood than bad blood. Moving out is not the end of the world, it might just be the kick start you need for you to start building your own home.
