Politics › FG Blames Energy Crisis On Population Growth by erunz(op): 3:54pm On Oct 30, 2015
The Federal Government has blamed high population growth for the country’s inability to meet the energy needs of its citizens and business outfits.

The Secretary to the Government of the Federation, Mr. Babachi Lawal, who laid the blame in a speech at the inauguration of the Nigeria Energy Calculator developed by the Energy Council of Nigeria in Abuja on Wednesday, said effective planning was strategic to sustainable energy development in the country.

Lawal, who was represented at the event by the Director of Public Relations, SGF office, Ijeoma Onuagu, said concerted efforts must be made by all stakeholders to address the nation’s intractable energy crisis.

He said, “The growth in energy demand far exceeds supply principally due to high population growth rate and expansion of economic activities. It is in realisation of the dire need for enhanced energy security in the country that the Federal Government adopted the dual strategy of increasing capacity as well as diversifying the energy supply base.

“In line with the government’s agenda for change, this administration is committed to ensuring that all national resources are optimally mobilised to power our development aspiration.”

Politics › How Obanikoro’s Senate Screening Differs Greatly From That Of Amaechi by erunz(op): 10:21am On Oct 30, 2015
By @DemolaRewaju

Senator Musiliu Obanikoro served his state and country at the highest legislative office in the hallowed chambers of the Senate between 2003 and 2007. On the 9th of February ten years ago in 2005, Obanikoro moved a motion calling for an investigation into the destruction and disrepair of the Velodrome at the National Stadium in Abuja. In January 2014, Obanikoro was nominated by the then President of the Federal Republic of Nigeria to become a minister and he was duly screened and confirmed as a Minister by the Senate which included members of the newly formed opposition party APC and those of the then governing party PDP.

After serving as Minister until October 2014, Obanikoro resigned to contest for the PDP gubernatorial ticket in Lagos, lost it to Mr. Jimi Agbaje and was recalled by President Jonathan to return as Minister. This recall threw up a small legal dilemma with some legal experts saying Obanikoro did not need to be screened and confirmed by the Senate having undergone same procedure about a year before while others said another round of screening and confirmation was necessary. In complying with a need to be above board, Obanikoro’s name was sent to the Senate for screening.

In June of 2014, Ekiti had gone to the polls to elect a governor and the PDP candidate Ayo Fayose soundly and roundly defeated the then incumbent Kayode Fayemi in a free and fair election. Kayode Fayemi is a highly cerebral man but whose interactions with the Ekiti people he governed proved to be his undoing as he was seen as haughty and arrogant. Fayose on the other hand was down-to-earth. Fayemi conceded the elections and congratulated the man who defeated him but his party insisted that Ekitis had voted for ‘Stomach Infrastructure’. Not done yet, the party claimed further that INEC had colluded with PDP and used a special ink that disappears once a voter votes for APC while replacing it with PDP – these allegations were thrown out by the tribunal.

The last strand of reality denial by APC was an audio recording, alleging that the voices were those of candidate Ayo Fayose and others including Obanikoro. These recordings made no reference to rigging and if anything, one of the voices actually alleged that the military was colluding with the incumbent Governor Fayemi to sabotage the election. This recording became the casus belli of a few senators to oppose Obanikoro’s second nomination as minister, despite the fact that it was unverified and inadmissible as evidence by any law court. This recording was never tendered as evidence at the Ekiti gubernatorial tribunal and Fayose’s election was not only upheld by the Appeal Court but the man subsequently proved his dominance of Ekiti politics by leading PDP to victory in EVERY election thereafter.

Obanikoro reached out to all his party members in the senate for support and secured it. He further reached out to two Southwestern Governors who had served alongside him in the Senate between 2003 and 2007 and were now governors of their states. They supported him and the ranks of the APC senators were broken.

On the day of the screening as Obanikoro walked in among his former peers, Senator Oluremi Tinubu stood and unleashed derogatory words on him as he graciously bowed to her and strolled away to the podium. Senator Mudashiru Hussein took off his cap and headed towards the PDP side of the senate as if to attack Senator Smart Adeyemi who was making his point. At the end of the day, few APC Senators walked out, the Senate President took a voice vote and Obanikoro was confirmed. Several APC senators remained sitting to participate in the voice vote.

The case against Rotimi Amaechi are allegations of corruption and cannot be compared with that of Obanikoro. The case against Amaechi is a matter that was investigated by a Senate Committee and the report was clear in its submission. The entire PDP Senate caucus rose in opposition to Amaechi’s confirmation, they neither participated in his screening nor in his confirmation as they all walked out, leaving the APC alone in its negation of the campaign promise of Change.

That APC can recall acts of PDP as justification of its own actions is a misnomer in itself – where then is the change? How is it change if the best defence of APC actions are neither logical nor commonsensical but a spurious and condescending “PDP also did it”? If PDP realistically admitted to a culture of patronage as a reality of political horsetrading and APC condemned it to the highest heavens, why then would a President elected on the APC platform take four months to prepare a list that compensates those who worked for him in not only the 201 elections but as far back as the 2003 elections!

The standard for judging APC can not, must not be what PDP did or did not do but rather the standard that it set for itself – its own campaign promise of Change for which 15 million Nigerians voted for them while a little more than 12 million voted for PDP. APC was not voted into office to perfect whatever PDP was doing but to deliver a #PromiseOfChange. So far, this is looking like a #ChangeOfPromise.

Many residents are feared killed in a fresh attack by the Islamic sect, Boko Haram, at Bara town of Gulani local government area of Yobe State.

The town is about 109km from Damaturu, the state capital.

The incident, which occurred on Wednesday night, according to residents, was the fiercest attack in recent time.

Speaking to newsmen on Thursday in Damaturu, residents said the militants burnt down houses, shops, foodstuffs, among other valuables using Improvised Explosive Devices (IEDs).

“They stormed the town chanting ‘Allahu Akbar’ as locals took to their heels into the bushes for safety”, a resident Mallam Sule Yaji told newsmen in Damaturu.

He disclosed that the insurgents, who arrived the town in large number burnt several houses during the coordinated attack.

He said that some of the residents caught up in the houses set ablaze were receiving treatment at Bajoga Hospital in neighbouring Gombe State.

A top police officer, who confirmed the attack, said that the Yobe State Commissioner of Police, Zannah Ibrahim, had since rushed to the scene of the attack to assess the extent of havoc caused in the town.

Casualty figure, according to him, was not yet known.

The town currently lacks basic amenities and telecom services, which have been vandalised by the militants.

Despite Justice Ambrosa-led Tribunal judgement on Rivers State Governorship Election, behold the position of the Court of Appeal on Card reader which the hatchet tribunal based its judgment;

Agbaje v Ambode : Court of Appeal says Non-use of card reader or malfunctioning of card readers cannot invalidate an election

*Appeal Court explains that the Electoral Act predates the card reader

The Court of Appeal sitting in Lagos upheld the election of Lagos State Governor, Akinwunmi Ambode stating that the non-use of the card readers or the dysfunctional nature of the card readers cannot invalidate the Lagos State Governorship Election.

The court held that the Electoral Act (2010) as amended does not recognise the malfunctioning of a card reader as one of the factors that can lead to the nullification of an election.

This, the appellate court held, is because the Electoral Act predates the introduction of the card reader.

The Court of Appeal stated this in a verdict on a cross-appeal filed by the All Progressives Congress (APC) challenging parts of the Governorship Election Tribunal’s verdict in the case of Jimi Agbaje versus Governor Akinwunmi Ambode and others.

APC filed the cross-appeal on two grounds. In the first ground, it said the tribunal erred in law when, having held that Paragraph 14 of Agbaje’s petition challenged Ambode’s nomination, went ahead to hold that it was a valid ground.

The party said any complaint about a pre-election issue falls within the jurisdiction of the Federal or Lagos State High Court, therefore, the tribunal ought to have declined jurisdiction.

The party also asked that Agbaje’s petition be struck out because its paragraph 13b which complained about faulty card readers did not qualify as a ground to challenge the April 11 election.

The Court of Appeal, in a judgment by Justice Obande Festus Ogbuinya, resolved the first issue in Agbaje and PDP’s favour, and the second issue in APC’s favour.

A copy of the judgment, delivered on August 26, was obtained by our correspondent yesterday. Other justices on the panel were A. J. Abdulkadir, Mohammed Danjuma, Emmenuel Agim and Saidu Hussaini.

Agbaje, the PDP, the Independent National Electoral Commission (INEC), Ambode and the Resident Electoral Commissioner (REC) were the cross-respondents.

The appellate court held that both the High Courts and the tribunal have concurrent jurisdiction over the issue of a candidate’s qualification/disqualification.

Justice Ogbuinyi held: “The cross-appellant (APC) implored this court to declare the paragraph 14 a pre-election matter cognisable only in the regular courts because it alluded to 21 days notice decreed in Section 85 (1) of the Electoral Act. The cross-appellant made heavy weather of this point.

“The paragraph 14 of the petition qualifies as a valid ground for querying the qualification of the fourth cross-respondent (Ambode) to contest the election.

“The trial tribunal is the forum competens for the first and second cross-respondents (Agbaje and PDP) to ventilate their grouse on his (Ambode’s) qualification/disqualification. Put simply, the trial tribunal was clothed with jurisdiction over paragraph 14 of the petition.

“In the end, I have no option than to resolve issue one against the cross-appellant and in favour of the first and second cross-respondents.”

Resolving the second issue in APC’s favour, the appellate court held: “The paragraph (13b) displays a vitriolic attack on the irregularities germinating from the improper or non-use of the smart card readers in the polling units.

“As it is, it has no life of its own as a ground. It endeavours to introduce the defects in the use of smart card readers. The evolution of the concept of smart card reader is a familiar one. It came to being during the last general election. On this score, it is a nascent procedure injected into our infant and fledgling electoral system to ensure credible and transparent election.

“The extant Electoral Act (2010) which predates the concept (of card reader) is not its parent or progenitor. Since it is not the progeny of the Electoral Act, fronting it as a ground to challenge any election does not have its (the Electoral Act’s) blessing, nay Section 138 (1) of it.

“Put simply, a petitioner cannot project the non-presence or improper use of smart card reader as a ground for questioning an election. It does not qualify as one.

“On the whole, having resolved the two issues for and against the cross-appellant, the fate of the cross-appeal is obvious. It is partially-meritorious and succeeds in part. Consequently, I allow the cross-appeal in part.

“Accordingly, I affirm the portion of the trial tribunal’s decision declaring paragraph 14 of the petition as competent and triable by it. I set aside its part of the decision which approved paragraph 13 (b) as a competent ground for presenting a petition.”

Travel › Street Slangs You Must Know When You Are In Lagos by erunz(op): 1:26pm On Oct 28, 2015
Lagos is the heartbeat of Nigeria-economically, socially and otherwise. From the comical to the puzzling and the most shocking, it all happens in this city of over 15 million people. It is a fascinating place to be.

Due to the complexities that make Lagos unique, people have evolved different ways to communicate, interact and pass along messages which can only be understood by people who are familiar with these slangs.

As a first time visitor in Lagos, you need to keep these slangs at your finger-tips as they may come handy at any time. Jovago.com, Africa’s No 1 hotel booking portal shares 5 street parlance you must know if you are resident in the centre of excellence.

Johnny Just Come

Also known as JJC, it is an argot used to describe someone who is naive because they are visiting an unfamiliar terrain for the first time. If people find this to be your status, they may want to take advantage of you. So, do not act like a JJC especially when you are inside a public bus or transacting business.

Akube

Amongst traders of Igbo extraction, Akube refers to goods or products that have little quality or have been previously used. Interestingly, many people have come to associate themselves with Akube products as its affordability attracts higher purchase.

Shine Your Eyes

Shine your eyes simply admonish you to be very vigilant. This is because Lagos is a crowded city and nearly everyone is in a hurry. You should be vigilant and conscious. By the you do not need to worry too much because Lagos is safe but ensure that you shine your eyes always.

On You Own

Oyo is a state in South-west Nigeria. However, when ear catches that word, they are not referring to Oyo Staterather it simply means you are On Your Own. For example, if you want to borrow money from a friend, he uses the acronym Oyo, it means it is not possible. It is often used to express negation.

Owambe

Even though Owambe is a Yoruba slang, it is now a universal expression for partying. So, when next you hear Owambe, get your traditional wear ready, you are going for a christening, birthday or wedding and ensure that you enjoy yourself.

By Ibrahim Shuaibu in Kano

Kano state chairman of indigenous contractors, Alhaji Abduwa Maitangaran, has disclosed that over 50 members of their association are currently in prison due to former Governor Kwankwaso's inability to pay their contract funds.

Speaking with journalists in Kano on Tuesday, he claimed that 40 of their members also died due to frustration they went through for the non-payment of their contract money by the Kwankwaso administration.

He wondered why how the former governor refused to settle the contractors after sending him over 26 letters and sat with him more than 20 times, but he only made promises that he could not fulfill.

'Former governor make sure that we were all broke before he left us un-attended. For your information many things that were done at the so-called new cities of Kwankwasiyya, Amana and Bandirawo were outside the Bill of Quantity (BQ)'.

According to him, the former Governor need to be probe for shoddy deals in the execution of many projects in the state during his tenure.

He said: “Instead of him to borrow from banks or other government departments, Kwankwaso used our money and executed those projects. To the surprise of all, not even 30% of our payments was effected before he left government house.”

He commended the present governor of the state, Dr Abdullahi Umar Ganduje, for giving them N200m to be able to settle some of the debts on their shoulders
