The Akwa Ibom governorship tribunal has ordered fresh election to be conducted in 18 Local governments in its judgement today, but also went on to rule that PDP’s Udom Emmanuel remains the governor. The Tribunal ruled that the petitioners were unable to demonstrate that card reader alone can be relied upon for accreditation throughout the state while also stating that INEC press release cannot override section 41 of the Electoral Act on accreditation as the card reader was not contemplated by section 49 of the Act on accreditation. The Tribunal disclosed that it was satisfied that election held in all the polling units in the state while further revealing that the election held substantially complied with the provisions of the law and therefore resolved that the 1st respondent scored the highest number of valid votes cast. The Tribunal in its judgement holds that presumption of regularity is in favour of INEC while also deriding the supposed experts called by the APC candidate, Obong Umana, are not experts as they denied being so, therefore, they cannot express opinion as ordinary witnesses as the Evidence Act does not allow such by the Evidence Act only expert opinions are admissible. Ruling the Tribunal judged that PW49 evidence is not an expert and could not even demonstrate how he came about his finding. The Tribunal holds that the petitioners should have tendered the ballot papers scanned. That assuming it relies on the ballot papers scanned and alleged to have been invalid, the 1st respondent would have still won with a wide margin votes. Tribunal holds that right to vote is a constitutional guaranteed right and nobody should be disenfranchised. It says there was disenfranchisement of voters in some PUs in the state and sequel to this the election in Uyo LGA was inconclusive. Election in Ibesikpo Asutan LGA was also inconclusive. The Court therefore ordered a rerun in 18 local government areas of Akwa Ibom state, with the Tribunal insisting that Udom Emmanuel remains the Governor of Akwa Ibom State. It held that 566,436 voters were disenfranchised as against the 890,000 voters in favour of Udom in 18 LGAs. The tribunal ordered a re-run election in 18 out of 31 LGAs of Akwa Ibom, as election only held in 13 LGAs with Udom Emmanuel leading in the 13 LGAs with a very wide margin. http://www.opinionriver.com/akwaibom-tribunal-orders-election-re-run-in-18-lga-udom-emmanuel-remains-governor/
