The court says FRSC could not turn itself into a court of law by punishing motorists.

A federal high court in Lagos has declared void powers of the Federal Road Safety Corps (FRSC) to impose fines on motorists for traffic offences.

John Tsoho, a judge, held that the commission could not turn itself into a court of law by punishing those who commit traffic offences.

Tope Alabi, a lawyer, had approached the court to declare that only a court of competent jurisdiction could pronounce a person guilty under section 10 (4) and 28 (2) of the FRSC Act 2007.

Other defendant in the suit was the attorney-general of the federation.

The judge also awarded N1million damages in favour of the plaintiff because officials of the FRSC had confiscated his vehicle and driver’s licence.


Tosho said while FRSC was statutorily empowered to arrest and fine traffic offenders, a closer look at the definition of the word “fine” meant a pecuniary criminal punishment or civil penalty payable to the public treasury.

“In the instant case, however, the involvement of the element of arrest takes the imposition of fine by the FRSC to the realm of criminal punishment,” he said.

“From these definitions, it is obvious that the act of sentencing is a judicial action or exercise, and imposition of fine connotes conviction for an alleged offence.

“It is, thus, very clear that the FRSC, not being a court of law, cannot impose fine, especially as it has no powers to conduct trial.

“Hence, the exercise of the statutory powers given to the defendant under the Act as pertain to imposition of fine is clearly a usurpation of judicial powers exclusively vested in the courts.

“In the circumstances, I endorse the plaintiff’s submission that by virtue of section 1(3) of the constitution, the power to impose fines conferred on FRSC by the enabling act is null and void to the extent of its inconsistency with the constitution.”


Tsoho held that the FRSC resorted to “legislative absurdity” when it imposed a fine of 3,000 on the plaintiff, rather than the N2,000 statutorily prescribed.

“FRSC’s function should not go beyond issuance of mere notices of offence,” he ruled.

“It is a cardinal principle of natural justice that no person can be condemned without being heard.

“It is in observance of this that a person alleged to have committed an offence has to respond to such allegations before a court of law during trial.”

According to the judge, the plaintiff was issued a notice of offence Sheet on April 4, 2013, but FRSC did not take him to court for five months before the plaintiff filed his suit on September 9, 2013.

“The vital question to ask is how long would it take the FRSC to reasonably commence prosecution of a traffic offence?” he asked.

“The plaintiff was not under obligation to wait indefinitely for redress due to FRSC’s inaction or laxity.

“I hold the view that the confiscation of the vehicle was unnecessary in the first place, though the FRSC spiritedly sought to justify it.”


The judge then granted11 of the 14 reliefs sought by the plaintiff, awarding N1million in his favour instead of the N10 million prayed for.

Following the border closure policy which has deteriorated ties between Nigeria and Benin Republic, the Federal Government of Nigeria has accused its African counterpart of planning to smuggle a substantial amount of imported rice into the country.

Nigeria’s Minister of Information and Culture, Alhaji Lai Mohammed raised the alarm yesterday in a press conference alongside the Minister of Foreign Affairs, Geoffrey Onyeama; Minister of Interior, Rauf Aregbesola; Minister of State for Finance, Budget and National Planning, Clement Agba; National Security Adviser (NSA), Maj. Gen. Bangida Monguno (rtd) and the Comptroller General of the Nigerian Immigration Service (NIS), Muhammed Babandede, when they visited the border outpost in Seme.

According to the Minister, the Federal Government had uncovered details that there were ships berthing in Benin waters and loaded with 105,000 metric tonnes of foreign rice, with the intention to smuggle the commodity into Nigeria for the Yuletide period. He listed the loaded ships and their contents as MV Africana Jacana, 40,000mt; MV Zilos, 20,000 mt and MV Sam Jarguar 45,000 mt.

Revealing that the Republic of Benin had concluded an arrangement with Japan to import rice valued at $30 million, Lai Mohammed said that it was obvious that the destination of the imported rice was Nigeria, owing to the fact that shipment was beyond what could be consumed by the Benin population of less than 25 million people.

The Minister also accused Benin and Niger of circumventing the ECOWAS protocol on transit, which requires that when a transit container berths at a seaport, the receiving country is mandated to escort the same without tampering with the seal to the border of the destination country.

“Unfortunately, experience has shown that our neighbors do not comply with this protocol. Rather, they break the seals of containers at their ports and trans-load goods meant for Nigeria,” he said.

Lai Mohammed said that the closure of the borders was also to curb the entry of kidnappers and terrorists who smuggle arms and illicit drugs into the country.

In his remarks, 95% of the illicit drugs and weapons being used to perpetrate terrorism and kidnapping in Nigeria arrived through porous borders, saying that the ongoing Operations Swift Exercise and border closure effected by the government had led to arrests and seizure of goods worth N3.5billion.

The Minister further stated that since the partial closure, the acts had drastically reduced. “The partial closure had also curbed the smuggling of foreign rice into the country, in addition to other prohibited items. Our series of interactions and engagements with Rice Miller Association of Nigeria since the commencement of this exercise has shown that the border closure has enhanced more production and milling of Nigerian Rice.” He said.

The National Youth Service Corps has arrested a 200L student who allegedly obtained a fake degree certificate and was undergoing the orientation exercise at the Zamfara State camp.

Our correspondent learnt that the NYSC last Friday apprehended the student, identified as Rose, who was a 200L Journalism undergraduate at a university in Benin Republic.
The NYSC Director-General, Brig. Gen. Shuaibu Ibrahim, confirmed the arrest of the student to our correspondent.
He said that the Benin Republic university wrote to the scheme when its officials discovered her on the social media, posting her photographs in the NYSC uniform in the Zamfara camp.
She was undergoing the Batch C Stream 1 orientation course before she was arrested.
The DG noted that the student had been brought to the Federal Capital Territory, Abuja, and handed over to officials of the Department of State Services for further investigations.
Ibrahim warned that the NYSC would clamp down any fake graduates and certificates, adding that anyone arrested would be handed over for prosecution without showing mercy.
The DG said, “The clampdown on fake graduates and certificates is yielding bad results. On Friday, one of the universities in Cotonou, Benin Republic saw their 200level student in the NYSC uniform on the social media. She is supposed to be a 200-level of the university studying journalism.
But she went and purchased a fake certificate from another Benin Republic university and now served in the camp in Zamfara. So, her classmates saw her on the social media and raised the alarm to the university, which then alerted and wrote me.
“The university said they recognised the efforts of the scheme in nabbing fake graduates and they were not a party to her fake certificate. So we got her arrested in Zamfara. She was brought to Abuja and we have arranged with the DSS to take her away.”

Hey guys I need your help regarding this:

My girlfriend and i weren't on talking terms for a while, six months to be precise, but last week she started talking to me all of a sudden and we kinda shared one or two mutual feelings that led, to sex.

But while she was about to leave, I kind of saw some drugs in her bag, when I asked her the purpose of the drugs she replied that they were for infection.

Meanwhile she previously told me that same morning that she needed some money to threat virginal infection. But one occurent led to one another that made me to suspect her only purpose for showing up was to infect me with HIV or some other STDs.

I don't know what to do regarding this issue but I'm planning on dealing with her if i get to find out she infected me with any STD on purpose...
