bakila: He is not a lawyer, his post hardly qualifies for the views of a part three law student. Issues of attending court by an accused person is basic criminal law. Although one may say that the CCT may be liberal in such matters but not when the accused is on bail, which is one contract with the court that breach of has severe consequence for his liberties and reputation. Secondly, no law in Nigeria mandates an accused to be in court after the writs have been exchanged except to give evidence of which he can refuse and remain silent. Compelling him to appear in court is a violation of section 41 of the constitution. I hate to say this but its apparent you are either a student or a quack. If you are a lawyer then there is a big problem because you will deliberately lead your Clients' to a blind alley. Nairalanders beware. Since you are audacious I have a duty to alert every one on this forum not to take you seriously. I have put in 15 solid years in this profession to the glory of God. lawflec: Not at all. Dsp will not preside, it will be Saraki. Firstly, Amechi and others would be screened tomorrow not Wednesday. Secondly, if the screening is on Wednesday, he can. still preside because the judicial interpretation of section 36 is that an accused must be represented during his trial either in person or through a legal practitioner of his choice. And it implies. Both in civil or criminal matters. That is why even in election petitions the respondent must not be in court. However, Saraki being an intelligent man would rather go to court than sit in the house and watch Amechi loose his bid to become a minster. Please permit me to correct you there sir. Election petitions are civil in nature thus Petitioners and Respondents need not necessarily appear except to give evidence. However in Criminal matters the Accused MUST appear in person no matter how HIGHLY placed. The CCT has ruled that it has criminal jurisdiction so how is it for you that Saraki can elect not to attend? I find your position strange with due respect to you. Thank you |

huche: What are they waiting for?? These things do happen and it's not a strange occurrence to us in the field. There are several reasons why the Judgment could not be ready. But it definitely would be read when their Lordships are set to do so. But because this matter has political undertone from inception all kinds of meanings and conjectures would begin to fly around as reasons for the delay when it might not be exactly so. To the uninformed, the legal profession is one of the most misunderstood. |

With the kind permission of the MODS, I hope this is the right section to post this. I have observed silently that most times forumites have legal issues or challenges and do not seem to know what their legal remedies and or options are in most cases. Most times they post the issues here and the advise they're given are wide off the mark. All would like to do is enlighten us as much as my time would permit on not too complicated legal challenges or burning issues you all may need clarifications on. Other colleagues are welcome to rub minds with me here as the idea is to learn from each others experiences. If the MODs find this ok, then lets proceed. NgeneUkwenu: In criminal cases, the accused must be present and also sit in the dock until the trial is over. So he will be attending court anytime the case is called. . This is the official position. It's what the law says and not what some of you think"ought to happen". In ALL criminal trials the accused person MUST be present. If he cannot due to ill health perhaps, his lawyer must tender a medical report in support. No other excuse will be tenable including ministerial screening. Thank you |

adeaks: In theory, he has to appear in court to face his trial but I fully expect him not to appear in court that day. This is a man who twice had bench warrants issued against him and nothing happened. Saraki would also say that he has a pressing national assignment and because of that he can't afford to appear in court. Truth is that he is higher than the court. The CCT is like a dog that can only bark without biting. You definitely can't be serious. Please don't misinform others here. The kind of stuff I read on naira land these days....smh |

This is Nigeria and not that documentary you are watching. If you were in the military as a commanding officer in Lagos and on that day the robbers struck festival town you DARE deploy as little as 5 men without AUTHORIZATION from your superiors, by now you'd be in hand cuffs under going interrogation by the DMI.
