NJC ISSUES STERN WARNING TO ANAMBRA JUDGE FOR MISCONDUCT. Justice V. N. Agbata of the Ogidi High Court in Anambra state has narrowly escaped being sacked by the National Judicial Council (N.J.C) following the judicial indictment over a petition filed by a former Chairman of the Nigerian Bar Association, Onitsha Branch, Chuka, Obele-Chuka against him for acts of gross misconduct, and judicial corruption. The N.J.C slammed him with a letter of stern warning. The sanction was imposed on the strength of his indictment by a second 3-man investigative Committee set up by the N.J.C to investigate Justice Agbata. The first headed by the controversial Chief Judge of the Federal High Court, Justice Ibrahim Auta, was disbanded by the disciplinary body under circumstances said to have been raised by the petitioner who expressed serious reservation about the qualification of Justice Auta to sit as an investigator. Justice V. N. Agbata’s name appeared in the list of 7 Judges being investigated by the disciplinary body. Other Judges investigated then and who were later indicted and sacked included Justice Nasir Gunmi of Zamfara State High Court, Justice Ononogbo of Abia State, and Justice Mohammed Yunusa of the Federal High Court, Lagos. Obele-Chuka had accused Justice Agbata of being unfit to continue to occupy the high office of a judge as a result of the latter’s use of foul language, indecorous and violent language against him by referring to him as a terrorist, in a letter dated 16th day of June 2014 which the judge published to other judges as well as falsification of his record of proceedings, and judicial corruption. The N.J.C refused to look into the allegations of corrupt practices leveled against the judge on the ground that they were not contained in the former Onitsha Bar Chairman’s petition but in his subsequent reply to Justice Agbata’s Defence. The lawyer was said to have given an indication to appropriately place the allegations corruption before the N.J.C for a panel to be constituted on them. The N.J.C in its letter titled “LETTER OF STERN WARNING” dated 8th March 2017 to Justice Agbata communicating his punishment had said: “The National Judicial Council set up a “Three man fact finding Committee under the Chairmanship of Hon. Justice Nasiru Aljanah, CON, the Hon. Chief Judge of Kogi State, to investigate the allegations of judicial misconduct against Your Lordship by Chuka Obele-Chuka Esq, in Suit NO. HID/49/2016”. “After investigation, the Committee before which you appeared and was heard submitted a Report to the National Judicial Council, which was deliberated upon during its meeting which was held on 23rd February 2017. At the end of deliberation, Council accepted the Findings of the Committee particularly that the words used by you in the letter dated 16/6/2014 were undignified, inappropriate, improper and unbefitting to be used by a Judge on a Counsel appearing in his Court. Council also found that the words expressed by you in the said letter have rendered you incapable of being considered fair in your dealings with the petitioner”. When contacted for a reaction, two Anambra-based Senior Advocates who requested to remain anonymous decried the day to day conduct and behavior of the indicted judge in the court and cited series of judgments and rulings that have given out the judge to allegations of corruption. In fact, one of them affirmed that the indictment if true has dented the judge’s hope of elevation. “He is likely to stagnate on the high court bench if he survives any other subsequent trip to the N.J.C.” one of them, who practices in Onitsha, opined. However, two Awka-based legal practitioners who appear to be sympathetic to the judge claimed that the N.J.C. had in a letter written to the judge exonerated him of all the allegations of misconduct. They could not however confirm seeing the said letter but quoted sources close to the judge. A source close to the fiery former Bar leader suggests that he may be preparing a fresh battle before the Economic and Financial Crimes Commission where he is said to have submitted a petition against the judge.

Missclassy did a very nice job, but she would have saved me and other readers a great deal of heart ache by telling us the yardstick used in drawing up this list.
