CCT fixes Thursday for judgment in Onnoghen’s case By Unini Chioma - Apr 15, 2019 0 The Code of Conduct Tribunal on Monday fixed April 18 to deliver its final judgment in the charges of false and non-declaration of assets instituted against Walter Onnoghen. Mr Onnoghen, in a letter on April 4, notified President Muhammadu Buhari of his decision to vacate office as the Chief Justice of Nigeria. On Monday at the CCT, the three-member panel, led by Danladi Umar, fixed the date for judgment after the prosecution led by Aliyu Umar, a Senior Advocate of Nigeria (SAN), and the defence, led by Okon Efut, adopted their final addresses. During the proceedings, Mr Efut, in his final arguments, maintained that the prosecution failed to prove the six counts charge beyond reasonable doubt as required by law. He, therefore, urged the tribunal to dismiss the case. Mr Efut maintained that the statement made by Mr Onnoghen to the Code of Conduct Bureau was not confessional, as alleged by the prosecution. “This case is about the declaration of assets and the first charge complains of non-declaration. The second to sixth counts complain of false declaration,” the lawyer said. He argued that the charges are “contradictory and mutually exclusive.” “The two cannot go together. We urge the court to dismiss all six counts,” the defence counsel argued. He added that the charges were incompetent and unconstitutional as they were based on the provisions of the Code of Conduct Tribunal and Bureau Act which were in conflict with the relevant provisions of the Constitution. The complainant had submitted that by the content in exhibit 6 (Mr Onnoghen’s statement to the CCB), the defendant is deemed to have confessed or admitted to the charge. “That is incorrect in law, confession in law means admitting to all the essential elements of the charge,” he said, adding that there was nothing to signify that the defendant admitted to the charges. “Section 11 of the Code of Conduct Tribunal Act, the section upon which the charges are premised, is unconstitutional.” Mr Umar, the prosecutor, however, said the defence team was only attempting to redefine what constituted “proof beyond a reasonable doubt”. He then urged the tribunal to hold that the prosecution indeed proved the case beyond reasonable doubt and “return a guilty verdict”. In adjourning till Thursday for the final judgment, the tribunal chairman said the verdict would be delivered along with two pending rulings on Mr Onnoghen’s applications. One of such application is that challenging the jurisdiction of the tribunal to hear the case. Court Orders INEC To Prosecute Prof M.N. Umenweke For Declaring Mr. Ifeanyi Ubah As Winner Of Senatorial Seat In Anambra State By Unini Chioma - Mar 28, 2019 A Federal High Court sitting in Awka, Anambra State has ordered the Independent National Electoral Commission (INEC) to prosecute the returning officer in the Anambra South senatorial election, Prof M.N. Umenweke, for declaring Mr. Ifeanyi Ubah winner of the election, Thisday reports Ubah and Umenweke are facing criminal allegations levelled against them in the February 23 poll in the area by the candidate of the Peoples Democratic Party (PDP), Chris Uba. Uba had approached the court, praying for an order of mandamus compelling INEC to prosecute Ifeanyi Ubah of the Young Progressives Party (YPP) and others allegedly involved in the disorderly conduct that took place on February 23, 2019 at the Nnewi North Local Government Area headquarters, Nnewi that led to the announcement of the result of the inconclusive election held on the same day. Umenweke had raised alarm while declaring the election result, which was won by Ifeanyi Ubah, saying he was doing so under duress, but later recanted. Justice I.B. Gafaia, while presiding over the court in an application of mandamus sought from the court by Chris Uba in suit number: FHC/AWK/CS/29/2019, asked INEC to within 14 days conduct investigation into the matter for the purpose of prosecuting the respondents. The order read in part: “Upon the honourable court having delivered a considered judgement today, it hereby ordered as follows: The 1st respondent (INEC) shall within 14 days from today conduct or cause investigation into the criminal allegations of the applicant (Chris Uba). “Prosecute, if the investigation result so warrants, the 3rd respondent (Ifeanyi Uba) and any other person(s) implicated in its investigation. “Where it considers it inexpedient to prosecute through its legal officers, consider at its liberty, the appointment of the applicant’s solicitors in this suit for the purpose of such prosecution.” Uba had also asked for “a further order of mandamus compelling the 1st respondent to prosecute the 2nd (Prof M.N. Umenweke) for announcing or publishing a false result to the effect that the 3rd respondent had won the election held on the said 23/2/2019 even when they both knew that the said election was inconclusive and from which no genuine result had thereby been generated. “And order of mandamus compelling the 1st respondent to prosecute the 2nd respondent for the offence of delivering or causing to be delivered to the 3rd respondent a false declaration of result/return to the effect that he won the election to the Senate of the Federal Republic of Nigeria to represent Anambra South Senatorial District in the Senate even as he knew that the said election was still inconclusive. “Alternatively and where it be inexpedient or impossible for the 1st respondent to undertake the prosecution, an order of mandamus compelling her to issue out an authority to any counsel in the law firm of the applicant to undertake the prosecution on the 1st respondent’s behalf”. ehissi:Justice Abang keeps lawyers on their toe at all times. I have appeared before him in Asaba and his Court was quite sober the day I appeared before him. His reputation must have made Lawyers in court to come prepared. And he's now here in Abuja with us, he now presides over Justice Dimgba's former court. Olatoregun is a sound judge, but man... you don't want to make a mistake in her court or say something that doesn't sit right with her. She will tear you to shreds and leave your day in smithereens. |

Luwaluwa:Loosing 1000 birds is an awful loss of revenue. Do a proximate analysis of the feed you have in stock. If you ran a post mortem that indicted the Chikun feed you have in stock, then you are likely to recoup the revenue you lost to their poorly formulated feed. Brief your lawyer and prepare to meet them in Court. 1000 birds is an estimated 2 million plus, no be moi moi as pidgin philosophers would say. |

First, you can't privatise all gov't parastatals. Let's take the Corporate Affairs Commission for example, who steps in to fill the vacuum created by a privatisation of the CAC? A private firm? How then do we balance the conflict of interest that's bound to arise in the event that your proposed privatisation is carried out? Again, who carries out the duties of parastatals like NERC, NAFDAC and other sector based regulators? How do you tackle the risk of conflict of interest associated with leaving such agencies at the hands of private corporate entities? A cursory look at my submissions would show that your argument on privatisation caves in upon itself at the slightest critical assessment. Oh... on a lighter note and for the sake of a little banter, shey na your Baba be President and your party dey majority for legislature, make you reach out to them see whether them go try implement your point on emoluments. |

Prof. Umenweke is the classical bad ass Prof. He taught me Criminal Law and he doesn't fit the bill of someone that can easily be intimidated, but what do I know? I'm yet to find myself in one of those your life or your principles situations. |

presiade:I did administer antibiotics and anti coccidiosis when I got them. I also resumed administration of antibiotics and anti cocci after gumboro, but those didn't stop the malaise. |
ezkimow:Same thing happened with the batch I got. They were already dropping red and ochre coloured poop by the time they arrived my place. Sorry for your loss. Mine grew well, but the loss suffered within 5 days of getting the birds negatived any profit I made from the sales. |

Pray tell, does a quality hatchery churn out birds with coccidiosis? Their birds grow fine, but the conditions under which their birds are hatched *MAY* not be the best in town. I got a carton of Cascada broilers from Turks and didn't lose a single bird while they were day olds. |
bispope:I hope this isn't coming too late. Run away from Zartech birds. I'm yet to get over my experience with their birds. The birds grow fast, but risk of disease from the hatchery is sky high. You can try Agrited, Cascada or even Chikun (they also stock Cobb 500 strain like Zartech). Poor quality birds aside, Zartech has the nastiest customer complaint system. They only came down from their high horse the day I sent them a letter with my law firm letterhead. |

Turks:The birds are all doing fine. The only mortality I recorded was as a result of stampede in the enclosure I used for brooding. I administered Gumboro yesterday. I don't give them drugs, I use ginger, garlic and bitter leaf extract for their drug needs at the moment. The ginger and garlic are ever present in their water, while I've only administered bitterleaf extract twice. I also mix dry crushed pawpaw leaf and bitterleaf in their feed. |
ezkimow:I tried Zartech once and saw "nwii". I lost 7 birds within 8 days. I got the birds on the 22nd of October and started noticing brown/red droppings on the 24th of the same October. I pray yours do well. Zartech birds grow well, they stock fast growing Cobbs, but I no do again. Currently raising a carton of Cascada birds I got from oga Turks. All 49 birds are healthy, the one that died succumbed to stress. I will upload a picture of them when I go to see them tomorrow. Modified; I just saw a pic of a curious bird from the cascada batch I got from Turks. The birds were 5 days old in this shot.

ezkimow:The birds are six weeks and 5 days old. Their droppings are clay coloured with white cap I noticed two green droppings last night, but I fed them pawpaw leaves so it could have influenced the colour of their droppings. The ones I isolated are active, but I don't plan on reintroducing them to the flock since they came in contact with the two birds with twisted necks in the course of their isolation. The inactive bird doesn't feed that much, it also doesn't drink that much and it's loosing weight. It is always in a broody position. Attached below are pictures of the inactive bird.

Good evening all, a number of my birds have been acting funny recently. Their wings droop and they walk with their wings spread apart like they are feeling hot. I first noticed the most recent case of droopy wings yesterday morning when I was cleaning their cage. I had to isolate two birds in the past due to NDV. I have administered lasota vaccine twice, the last dose was given this past Saturday. Could the droopy wings be caused by NDV or some other disease is at play here? Thanks for the anticipated timely response. Modified* The birds with droopy wings normally act lethargic at first and don't show any interest in feeding but start eating after a while. I isolate them the moment I notice the droopy wings. |
