bentenny: The most important thing is that Bamidele admitted just like others that a forfeiture happened! A simple definition of Civil forfeiture implies a crime actually transpired...... A crime must not always occur in a civil forfeiture. |

The many FBI agents who sat on the case constituted a JURY. Okay but APC just presented an FBI report from 2007 that states there was no criminal case against Tinubu. |

it's alright That's it. Money laundering. Tinubu could either be guilty of money laundering or Tinubu was trying to do him a favour for also helping him live in an apartment close to him a long time ago when he was stranded in Chicago but the guy used Tinubu for his money laundering. There are many possibilities. |

do u know why? that account was used to collect 500k from a kidnapped victim.
how tell me again , why did they arrest the two guys? they re not the kidnappers. infact the second guy only escorted his good friend to get his ATM Exactly. The two guys were arrested by the police but in court only the guilty one would be convicted. |

1stGenAmerican: You’re right. This all started when the DEA set up a sting operation which netted Tinubu and his co-defendants. I’m realizing that some of these monikers don’t understand sealing or expunging records after a criminal conviction. The forfeiture of drug proceeds stems from criminal cases. If for the sake of argument, the record was expunged then what evidence is Obi bringing against him in court to show he was a criminal? Also you are yet to provide evidence he was in Illinois when the case began. That probably also came from your ass. |

One Mr. Bonner wrote a letter in plain English on behalf of the American Embassy in Nigeria in which he said that Tinubu had NOT been INDICTED or CONVICTED of ANY crime.
This means that Tinubu was neither formally charged to court or convicted by any court of law for drug or drug related offences or indeed any other offences at all in America after what I am sure was a thorough criminal investigation into the source of his funds.https://www.thisdaylive.com/index.php/2022/11/20/understanding-tinubus-us-case?amp=1 |

The confession of Bamidele has further smashed Tinubu. Stop narrative twisting. It won't work. Okay so are you saying a drug criminal would not have his file with the FBI? Politics › Re: Forfeited $460,000 Was A Civil Matter: Tinubu's Witness, Bamidele Tells Tribunal by GeneralDae: 6:24pm On Jul 05, 2023 |
1stGenAmerican: Just because he entered the US doesn’t mean that he wasn’t convicted or sentenced. Expungement removes visa roadblocks stemming from criminal records. The records are now sealed, only the forfeiture remains. Why was there a case and how could it have dented his career unless it was criminal? A case has to have origins and this didn’t start as a civil matter. The forfeiture was a judicial forfeiture stemming from a criminal case. How do you know the records are now sealed? I told you to post similar examples in a drug case that involved forfeiting thousands of dollars, you didn't. There's nothing sealed. His friend Akande who was a politician living in America and was close to his wife's relatives, first sent him money to open a joint business account in Lagos. Akande at a time also sent him 8000 dollars and he bought a car from it. 80,000 dollars was also sent again by Akande later on. At that time, Tinubu was a Treasurer in Mobil Nigeria. Akande's brothers were later arrested for drug peddling. Money traced and Tinubu's accounts were frozen. |

M4A1carbine: All these useless Olanikpekun (SAN) wannabes.
A straight case of forfeiture of drug proceeds has just been proven by Bamidele. He was an APC witness who was brought in as an American trained lawyer to come and save a drowning Tinubu.
He instead, Nailed the Agbado Lord totally by admittance of the fact truly the forfeiture was DRUG related. As long as the case is drug related, Ogbeni Tinubu has just indicted himself.
So all these lowlife Olanikpekun (SANs) on Nairaland should just rest. Tinubu will be booted out. Keep playing with your kindergarten Propaganda...mtcheeew! Then why doesn't he have a criminal record with the FBI, if the forfeiture was penalty for crime? |

Badgers14: Even during Ronald Reagans tenure with his war on drugs approach..
There were plea deals in drug cases..
Again, everything depends on the circumstances and facts surrounding a case.. what prosecutors have to work with.... Give me examples of these plea deals similar to Tinubu's case. Again you are the one bringing plea deal into this. |
Politics › Re: Forfeited $460,000 Was A Civil Matter: Tinubu's Witness, Bamidele Tells Tribunal by GeneralDae: 6:10pm On Jul 05, 2023 |
1stGenAmerican: In the majority of drug cases, when there’s a judicial forfeiture, the defendant is prosecuted and sentenced—this case included. The forfeiture can mean a lighter jail sentence but that’s not guaranteed. There’s no proof that he wasn’t convicted or that he didn’t serve time because a successful expungement seals the records from a criminal case, including sentencing and time served. The question people should be asking is why someone who wasn’t convicted of a crime file for an expungement of his records. 😏 But he wasn't sentenced at all. He worked in mobil at that time and wasn't sacked. He travelled to the U.S frequently after that like he did previously and was even invited to Obama's coronation in 2012 by the Democrats. As to why he agreed to forfeit, his lawyer at the time (who was also his nephew) said he advised him to forfeit and not to drag the case for too long because this was a fight against the U.S with all the resources they had, it could eventually dent his career. |

Badgers14: 'Supposedly' that's hypothetical.
Again, recall in one of my posts I mentioned the guidelines 30 years ago and now are not usually the same.. Again, there might be other circumstances surrounding a case that are not captured in court papers or maybe it was captured..
All we see online was the final disposition of the case and not the court transcript of what happened day to day in court and during investigation of the case. In 1993 guidelines against drug cases were even stricter. You are just bringing guesswork into court processes. Court only deals with facts on ground. The facts available, not what we think could have happened. |

1stGenAmerican: Once again, I don’t have any stake in this but Tinubu filed for and was granted an expungement—how can people say that he was not prosecuted or convicted if the records from the case were expunged? Are there similar cases in America you could show us where there was an expungement in a big drug case and the person only forfeited and didn't go to jail? |
Politics › Re: Forfeited $460,000 Was A Civil Matter: Tinubu's Witness, Bamidele Tells Tribunal by GeneralDae: 5:49pm On Jul 05, 2023 |
Novarisammy2: In Abacha v F.R.N. 2014 6 N.W.L.R. part 1402 Page 43 per Kekere-Ekun JSC and Ariwoola JSC (now CJN), the Supreme Court quoted the definition of Forfeiture in Black’s Law Dictionary 8th & 9th Edition thus: “1. The divestiture of property without compensation. 2. The loss of a right, privilege or property because of a crime, breach of obligation or neglect of duty”. The Apex Court further held that: "Therefore, forfeiture connotes punishment for a crime committed, and it’s effect is instantaneous”. In American law, there is criminal forfeiture and civil forfeiture, so this one you posted here is useless in this case. |

Badgers14: I never said their was.
The purpose of my post was to say that it could be a possibility.
Also plea deal are 'not always' advertised in court documents..
Recall, the court case was over 30 years ago and the guidelines then and now are not always the same. So you just imposed plea deal on the case. If there is no evidence of a plea deal, there's no need to suppose it. Court deals only with facts. Besides, in a drug crime case, a plea deal doesn't mean you wouldn't serve your prison terms. If you have examples to the contrary, you can post it here. |

Badgers14: I am not arguing with anyone.. I just stated my opinion... you can state yours as well and we can always agree to disagree..
In real life scenario, prosecutors often offers a plea deal with a suspect.. basically if you make their life easy... they make yours easy as well..
Someone that was picked up as a suspect in a crime depending on the complexity of the case and the corporation of the suspect.. prosecution sometimes offer them a soft landing.. But there is no evidence of any plea deal in the court papers. We all know what a plea deal is. |
