While world leaders and delegates at the United Arab Emirate (UAE), UN Conference of Parties COP 28 Climate Change Summit ( 30th November - 12th December), 2023, brainstormed on how to accelerate measures to aggressively eliminate green house emissions through collective drive, the Nigerian President and his team poached for portfolio investments on the sidelines! Nigeria had been complicit in gas flaring for more than 53 years from the time when massive exploration began in the 70s and hard hardly contributed funds to the world body to mitigate the horrible negative effects of greenhouse emission into the climate! In a lack-lustre speech, Tinubu pledged to end gas flaring in Nigeria as part of its contribution to global push to reduce methane emissions. He also said Nigeria has consolidated on gas export and domestic consumption as part partners for renewable energy.
He confessed that though his country was committed to energy mix, he believed that the two biggest economies US and China whom he described as the "biggest culprits" should act real fast because the Earth needed urgent healing!
The theme of COP28 is "Transition to Clean Energy", 123 Countries are in attendance.

Between Wednesday 29th November and Saturday 2nd December 2023, the document has gone through Second Reading of both Chambers for it to meet the annual January to December cycle of Budget Implementation in spite of the fact that it represented a cacophony of the previous ones devoid of all basic dividends through institutional inadequacies and security infrastructures!

HAS ANY FEDERAL ANNUAL NIGERIAN BUDGET EVER BEEN FULLY EXECUTED OR IMPLEMENTED SINCE 1999?

Consecutive corrupt politicians have all become multi-billionaires over the years because no annual budget in 23 years was fully executed or implemented. Year-on-year the ROADS remain impassable, public potable water - a dream pipe; EDUCATION - a mirage; EMPLOYMENT - paper tiger; HOUSING - marked as demolition structures; INDUSTRIAL PRODUCTION - comatose; MANUFACTURING - replaced with imported finished products, including PMS; CAPITAL EXPENDITURE IS FOR - working allowances of politicians and civil servants, salaries/emoluments, imported Sport Utility Vehicles SUVs @ NGN160 million naira each - housing/overseas holiday allowances, domestic staff allowances, etc, etc, all fully paid in billions/trillions of naira on annual basis! President Tinubu presented TWO SUPPLEMENTARY BUDGETS as addendums to the BUHARI'S, 2023 farewell budget to which no accountability had been adduced before the latest 2024 BUDGET OF RENEWED HOPE?
WHAT DID CHINA, SINGAPORE, SOUTH KOREA, JAPAN AND THE ASIAN TIGERS DO DIFFERENTLY TO ATTAIN CURRENT ECONOMIC PROWESS?

In his presentation, he declared, “The 2024 Appropriation has been themed the Budget of Renewed Hope. The proposed budget seeks to achieve job-rich economic growth, macro-economic stability, a better investment environment, enhanced human capital development, as well as poverty reduction and greater access to social security.”
As contained in a document released by the Minister of Budget and Economic Planning, Abubakar Atiku Bagudu, this is the breakdown and highlights of critical allocations in the 2024 budget.

EDUCATION: N2.18 Trillion (7.9% of Budget)
Breakdown
N1.23 trillion – Amount provisioned for Federal Ministry of Education and its agencies (Recurrent & Capital expenditure)
N251.47 billion – Amount provisioned for Universal Basic Education Commission (UBEC)
N700.0 billion – Transfers to the Tertiary Education Trust Fund (TETFUND) for infrastructure projects in Tertiary institutions

HEALTH: N1.33 Trillion (5% of Budget)
N1.07 trillion – Amount provisioned for Federal Ministry of Health and its agencies (Recurrent & Capital expenditure)
N137.21 billion – Gavi/ Immunization funds, including Counterpart Funding for Donor Supported Programmes
N125.74 billion – Transfer to Basic Healthcare Provision Fund (BHCPF) 1% of CRF

Squandermania seemed to have gripped the Federal Capital Territory Administration since former Rivers State Governor, Nyesom Wike, took office as minister.

Appropriation documents seen by THE WHISTLER showed that the renovation of the minister’s official residence at Lifecamp initially planned to be executed with N150 million through restricted tendering, was awarded by Wike to Julius Berger at the cost of N3,762,500,000 three months ago.

After the exit of the former Minister of FCT, Mohammed Bello in May, THE WHISTLER learnt that those in charge of renovating the residence gave a cost of N150 million which was initially included in the supplementary budget proposal.

Sources in the office of the minister revealed that the figure was removed and awarded to Julius Berger on the instruction of Wike at the new cost.

Wike was said to have given out the contract to Julius Berger hiding under the “Emergency Procurement” clause contained in the Procurement Act and directed payment of N2 billion mobilization fee.

The minister’s alleged irrational decision did not go down well with many top civil servants who felt it was a waste of funds and a violation of procurement law which specified contracts that fall under emergency procurement.
According to Section 43(1) of the Procurement Act, emergency procurement can only be carried out when the country is threatened or confronted with a war or natural disaster.

Some civil servants who spoke to THE WHISTLER on condition of anonymity said there was no emergency in the renovation of the minister’s residence since there was no damage to the property.

“Emergency procurement gives room for fraud because the contractor will just do the work and submit his bill to you; it’s whatever he says he’s spent that you will pay,” said a civil engineer in the FCDA.

Another engineer, who expressed suspicion that funds may be syphoned through such contracts award, said if the contract was done through selective bidding, it would be far cheaper and would have been completed within three months.

Renovation works on the residence of the minister, according to civil engineers, involve painting, piping works, electrical and furnishings.
The renovation was part of budget items in the FCT 2023 Supplementary appropriation bill sent to the National Assembly, a copy of which is in possession of THE WHISTLER.

But when the National Assembly passed the bill, the renovation of the minister’s residence was removed while the cost was lumped together with others under “Renovation and Completion of Critical Infrastructure in the FCT,” with the total cost put at N13,762,500,000.

A legislative aide told THE WHISTLER that the lawmakers could have done that to protect the minister due to the alleged unjustifiable renovation contract sum.

Coalition of over 10,000 indigenes of the Federal Capital Territory (FCT) and civil society groups, on Wednesday called for the resignation of Wike as Minister of FCT, accusing him among others, of land grabbing and “misguided actions.”

A former senator, Ifeanyi Ararume, has called on President Bola Tinubu to reverse his appointment of a new board and management team for the Nigerian National Petroleum Company Limited (NNPCL).

Ararume stated that the move by President Tinubu is in breach of an order of court.


Ararume hinged his demand on a court judgement he obtained in April this year.


He was appointed as the board chairman of the NNPCL in September 2021 and then abruptly removed shortly before the inauguration of the board of the company in January 2022 by then-President Muhammadu Buhari.

After his abrupt removal, Mr Ararume sued Mr Buhari and the NNPCL at the Federal High Court in Abuja on 12 September 2022, challenging his removal about eight months earlier.

In a statement dated 30 November, Mr Ararume’s lawyer, Ogwu Onoja, a Senior Advocate of Nigeria (SAN), warned the public against having any dealings with the Akinyelure-led new board.

Mr Onoja said the 27 November appointment of the NNPCL management team was in “utter violation of the judgment and order of the Federal High Court, Abuja dated 18 April 2023.”

He said the court restrained the president from removing Mr Araraume’s name from the Corporate Affairs Commission as a Non-Executive Director of NNPC Ltd.

“This judgment remains valid and subsisting until this moment without being set aside.

“We state that the purported appointment amounts to a flagrant disobedience of court order and brazen disregard of the judgment of a court of competent jurisdiction. We are appalled and shocked that the President could brazenly disobey the court judgment by purporting to appoint a New Board and Management Team for NNPC Ltd instead of giving implementation to the said judgment of the Federal High Court delivered by Justice Inyang Ekwo on the 18 April 2023.”


Mr Onoja expressed shock that Mr Tinubu “has taken the laws into his hands to overrule the courts and usurp the jurisdiction of the Court of Appeal before whom the President has filed an appeal which is pending.”


He went on: “With the said judgment still valid and subsisting, it is clear as crystal even to the common man that the appointment of the new Board and Management of the NNPC Ltd by the President on the 27 November 2023, is illegal, wrongful, null and void and of no legal consequence.

“By this Notice, the general public is therefore warned to beware of those illegal appointments in their own interest. The public is urged to avoid having any dealings whatsoever with the new Board and Management of the NNPC Ltd as anyone who goes ahead to do any business or transactions with them will be doing so at his or her own peril.

“We hereby call on Mr President, who is a huge beneficiary of judicial pronouncements and rule of law, to reverse his decision and allow the flow of the rule of law.

“Mr President should have known that respect for rule of law is equally a strong factor in the attraction of Foreign Direct Investment (FOI), which he has been travelling all over the world to promote.”

Having earlier renounced his Nigerian citizenship, Edwin Ijeoma, a professor of public sector economics at the University of Fort Hare, was left in the cold after his South African citizenship was revoked by the country’s ministry of home affairs. He is now stateless.

Mr Ijeoma, who arrived in South Africa from Nigeria on a study permit in 1998 to study at the University of Pretoria, was found guilty of fraudulently relying on a bigamous marriage to a South African woman to obtain citizenship by naturalization, local media Times Live reported.

The don was granted permanent residency in the southern African country the same year he graduated from the University of Pretoria, after being exempted from immigration restrictions due to his marriage to a local woman two years earlier.

By 2005, the academic, who obtained a PhD in economics in 2003, was granted South African citizenship through naturalisation, but in 2007 he divorced his South African wife, ostensibly because the couple was unable to conceive a child, according to Times.

Thereafter, the newspaper added, he was joined in South Africa by a Nigerian woman, Anne Tomo, who, in her application for permanent residence, attached a copy of her 1993 marriage to him in Nigeria, tipping off home affairs officials that Mr Ijeoma had committed bigamy.

Officials said on both occasions when Mr Ijeoma made submissions to immigration authorities in South Africa, when he was asked to indicate an immediate family member still residing in Nigeria, he listed Anne Ijeoma as his sister – not his wife.

Officials held that Mr Ijeoma’s sole mission in marrying the South African woman was to acquire citizenship, and he has now had his citizenship revoked by the ministry of home affairs.

The verdict followed a suit he filed against the home affairs ministry before the Bhisho high court.

The court’s acting judge, Mickey Mfenyana, upheld the initial judgment from 2020 which found Mr Ijeoma guilty of falsifying his marital status to the department, thereby making his South African citizenship null and void.

The judge further held that her ruling cannot be appealed, adding that another court will not differ from her finding as Mr Ijeoma “was disingenuous, if not dishonest, and that there was no reason to interfere with the minister’s decision.”

Ms Mfenyana further held that Mr Ijeoma had presented contradictory reasons for his bigamous actions.

“That as an African man, he believed he was entitled to marry more than one wife; and that he represented himself as single because he was not aware that South Africa recognised customary marriages,” Times quoted Ms Mfenyana as saying.

The judge noted that Mr Ijeoma concealed his marriage in Nigeria from officials on three occasions: when he applied for permanent residence in South Africa, when he got married in the country and when he applied for citizenship.

That, the judge held, was highly improbable for an academic, “who by his own admission is of good and sound mind and an intellectual giant,” to have remained “ignorant of the implications of not disclosing his Nigerian marriage” throughout his stay in the country and his encounters with immigration matters.

In defence, Mr Ijeoma told the court he obtained a permanent residence permit because of his “good and sound character” rather than his marriage to the South African woman.

He argued that the human affairs ministry failed to consider his intellectual contribution to the country as a result of his research as an academic, and his role at the Africa Union’s New Partnership for Africa’s Development (NEPAD), where, according to his LinkedIn profile, he is a pioneer research specialist.

Ms Mfenyana rebuffed this saying it was stated in the exemption certificate he got that marriage was the basis for his exemption. She also recalled that in 2015, Mr Ijeoma pleaded to home affairs to have compassion on him, that he obtained citizenship by naturalisation as a result of the marriage
