This is not double-jeopardy and the Supreme Court will not retry the case.They will not take any new evidence or pleadings .What they will simply look at are what the Appeal Court decided and see if there was any material error on the part of the AC. Its good that LASG decided to go all the way to the SC.Thats how its done in any sane clime.I doubt that the AC judgement will be overturned by the SC though.Based on the law,i think they were right. |

Delafruita: sharia law is not the law of reference with regards to marriage.there is the marriage act which deals with all types of marriages in nigeria and nowhere in the entire marriage act is underaged marriage mentioned nor allowed.Bros,please read S.277 of the 1999 Constitution.I'm sure you'll agree that the provisions of the constitution supercedes any other law. |

Okay,so I decided to weigh in on this “Child Marriage” debate going on in Nigeria right now.I know it’s largely a waste of time,because the average intelligence of most Nairalanders is that of a gnat and most of you have made up your narrow minds without verifying any fact.Yes I’m talking about people like Delors,Kamsy10,Julieeccentric(smh)Fitzy4real that just read the headlines on newspapers and just run with it. For the avoidance of any doubt, I’m a Yoruba guy from a strong Christian background and I abhor old men marrying kids as much as the next guy.But can you people please show where and how the current amendment of S.29 leads to the marriage of under age kids ? As Naptu has taken great pains to explain what the Section of the Constitution says is: 29. (1) Any citizen of Nigeria of full age who wishes to renounce his Nigerian citizenship shall make a declaration in the prescribed manner for the renunciation. (4) For the purposes of subsection (1) of this section. (a) "full age" means the age of eighteen years and above; (b) any woman who is married shall be deemed to be of full age. The amendment is seeking to delete (b) above and that’s what Yerima objected against and argued that its against Islamic Law. Now for the sake of argument, lets assume that the sub-section is deleted. THE FACT STILL REMAINS THAT S.29 IS TALKING ABOUT RENUNCIATION OF CITIZENSHIP AND NOT MARRIAGE. How hard is that to understand? So “FULL AGE” here is talking about age to renounce.Thats what this sub-section is talking about..the CAPACITY to renounce citizenship. Now talking about AGE TO MARRY, the fact remains that whether we like it or not, for states that have adopted Sharia Law, this is the Law that applies. We may not like it(I certainly do not), but that’s the law as prescribed by this same 1999 Constitution. As long as Sharia Law allows underage marriage, it’s going to continue. That’s what S.277 and S.278 of the Constitution has guaranteed. 277. (1) The Sharia Court of Appeal of a State shall, in addition to such other jurisdiction as may be conferred upon it by the law of the State, exercise such appellate and supervisory jurisdiction in civil proceedings involving questions of Islamic personal Law which the court is competent to decide in accordance with the provisions of subsection (2) of this section. (2) For the purposes of subsection (1) of this section, the Sharia Court of Appeal shall be competent to decide - (a) any question of Islamic personal Law regarding a marriage concluded in accordance with that Law, including a question relating to the validity or dissolution of such a marriage or a question that depends on such a marriage and relating to family relationship or the guardianship of an infant; This is the Constitution. It supersedes any other law of the land including the Child Rights Act of 2003 makes it unlawful for anyone under 18 to marry. SO,JUST SO YOU KNOW,THE CONSTITUTION OF NIGERIA AS IT STANDS TODAY ALLOWS CHILD MARRIAGE UNDER SHARIA LAW. So if you want to outlaw child marriages, start writing to your Senators and HOR members to amend S.277 and to make sure that the Sharia Courts of Appeal of a State are precluded from having jurisdiction over the validity of marriages, removing the matter from Sharia Law and placing the issue of age and capacity to marry firmly under the Child Rights Act 2003 ,instead of jumping on the bandwagon of people without common sense like Stella Damascus or whatever her name is that stated that she read extensively on the issue. Begs that question that what exactly did she read ?? Go on youtube and make a video,go on twitter and retweet frequently.But make sure that you are actually talking about the relevant issue and not about a person’s age and capacity to renounce citizenship. |

eldoradoxx: Nigeria is a constitutional democracy where law and order and not sentiment reigns. By our laws waterways of such category belong to and are managed by the Federal Government of Nigeria. Therefore by simple interpretation of law and using some principles of law quid quid plantatur solo solo cedis, he who owns the land (water in this case) owns everything on it. Since the water on which the bridge was built belongs to Federal Government of Nigeria, the bridge is deemed to belong to Federal Government of Nigeria and Lagos state cannot by any means toll that road or even control traffic there. I share similar case here in Edo where Edo State Traffic Management Agency now impound vehicles on Federal Highways in Benin. Recently they impounded mine for traffic violation though after a street fight with their officers and serious debate with their boss in their office, they reduced their fine of 20k to zero kobo. But I have decided to go to Court to challenge the action of Edo state government in permitting its agencies to regulate traffick, impose fines for traffick violation on a Federal Highway. It is illegal.My friend stop quoting latin maxims from your GNS class..The FG were fully aware that LASG was builiding a bridge on their water ways and they stood by and did nothing.The fact that the bridge is going to be tolled was widely publicised.Go read up on Promissory Estoppel.The FB cant turn around now and say this is our bridge.In the alternative,if the FG want to claim the bridge,they'll have to pay up the whole cost of the bridge to LASG and then untoll it ir knock it down as they see fit... |

I started working 3 weeks after moving to the West (and one of the best countries here), my salary was about 1 M / month within 1 year, so what do you have to say about that? Asking students to pay hall dues (90 Naira) in 1995 is oppression abi ? Students in Halls of Residence in UI were living like kings at that time paying dues of 600 Naira...Hardly an earth shattering figure.But for that you get 2 toilet rolls every week,cable in the halls of residence where you watch soccer every weekend in the comfort of your halls,toilets and bathrooms cleaned 3 times a day by outside contactors ! But no,Ife students and their numbskull SUG must have their Aluta and therefore live like animals! When i got inside Faj for the first time i was well and truly shocked of the living conditions! Ife and the stupid culture of we must have Aluta every year whether we had a genuine grievance or not was very childish! The only session that was drama free was when Vakama was president but when you hear Awo boys talk about him,youd think that guy was a leper..All because he did not wage a meaningless war against the school! I was there when an Awo boy dragged a Quarters boy outta of his car and slapped him...what was his offence ? He was "oppressing" the rest of the other students with his BMW during Aluta...thats the kind of oppression you talking about abi ? And FYI i live in one of the best countries in the Western world too and meet loads of other Nigerians doing very well in the professions...guess what ? Majority of them did not go to Ife... |

Every Session,each SUG government must have something to fight about.Very Stupid and immature students!So all Aluta in the middle of nowhere in Ife,what has it achieved ?!It has cured the corruption in Naija abi ? Ife students want constant electricity,water,lawns to be mowed everything to be in perfect condition and then they dont want to pay anything in fees.Afterwards they finish and the go pay 12,000 pounds a year for MSc in England! All of you hailing Tony Fash,were you there when he was begging all over the school,him and Obe Sere for them to take him back after expulsion ?! When he was wandering all over Lagos,looking unkempt like a tout ? No,all you you had completed your degrees and moved on with your lives!! |
