A 52-year-old herbalist ended his life tragically as he committed suicide yesterday in Abeokuta, the Ogun State capital. The herbalist, Kamoru Gbogbolegbo took his life after the controversy which trailed the delivery of a baby boy in his maternity home in Oke-Ido, Abeokuta North Local Government area of the state capital.
The controversy had led to the detention of the late herbalist at a police station at Ibara for five days. He regained his freedom on Sunday only to take his life in the early hours of yesterday.

His lifeless body was found by one of his wives with whom he passed the night before committing the dastardly act.
Gbogbolegbo had used an empty drum to aid his hanging on the ceiling with a rope in his bungalow which curious residents has turned into a Mecca of sorts.

Before his death, Daily Sun learnt that Kamoru had allegedly committed a criminal act by giving a baby boy who he delivered of a woman last week to another woman.
One of his neighbours further told Daily Sun that one of his customers had brought the wife of her son to the herbalist for ante-natal.

“Gbogbolegbo was a popular herbalist in this area who also operates a maternity home. We learnt one of his customers had paid him to take care of her sister-in law who successfully delivered a baby boy sometime last week.
“We learnt that after the successful delivery of the woman, the herbalist exchanged the baby for money by giving him to another woman who was not pregnant, but was amonghis client.

“After the naming and celebration by the fake mother, the genuine mother of the new born baby was said to have accosted the fake mother and challenged her about the maternity of the baby she was carrying about.
It was further gathered that the genuine mother also accused the herbalist of selling his baby boy to another mother.
‘’After much pressure by the genuine mother, the herbalist was said to have told her that the baby boy she delivered died at birth and had been buried.
The allegation of selling a baby was said to have led to the arrest of the late herbalist who was subsequently detained for few days before his release on bail on Sunday.

As people thronged the area to catch a glimpse of the late herbalist, many of his colleagues have described his death as courageous.
A senior herbalist in the council area who spoke with Daily Sun on condition of anonymity said: “He has died a courageous death. It is better to die honourably than allow his image which he built for several years to be dragged to the mud. No matter what anybody or group says, he has behaved well by taking his own life.

“We can’t deny him in death. He was one of us. In spite of the circumstances that led to his death and how he died, we shall accord him the necessary rites so as to prevent re-occurrence of such among us.”
Meanwhile, the police from the Ibara Divisional Police Headquarters had removed his body from the ceiling and laid it on his bed where people struggled to catch a glimpse before his burial later in the day.

The Federal Government is planning to increase electricity supply in nine key economic cities, as part of the move to encourage Foreign Direct Investment in the country.

The Minister of Power, Professor Barth Nnaji, made the disclosure on Monday in Abuja at a press conference to mark 50 years of capital market regulation in Nigeria, organised by the Securities and Exchange Commission (SEC).

The cities are Lagos, Onitsha, Port Harcourt, Ibadan, Kano, Kaduna, Enugu and Aba.

Professor Nnaji noted that the country had made tremendous progress in the area of electricity generation having achieved 4,000 megawatts.

He, however, declared that this did not call for celebration considering the over 150million population of Nigeria and the fact that some countries in the West African sub region could boast of higher megawatts.

The minister further said that the various investments going on in the sector were aimed at improving electricity generation.

It was a joyful reunion when a 14 year-old, Ranti Opeloye, earlier abducted by a syndicate involved in ritual killings in Ado Ekiti, regained her freedom and returned home after four days sojourn in the ritualists’ den.

Ranti, a student of All Soul’s Anglican Grammar School, Ado Ekiti, was seized by a six-man gang of ritualists from where she had gone to buy vegetable at Basiri area of the state capital around 4 p.m.

They took her to an unknown destination, after being charmed.

Apparently rejected by the oracle in the forest where she was taken to, the young girl was later dumped at a remote area in Ado Ekiti the following Thursday after spending four days with her abductors

Narrating her ordeal to newsmen, Ranti recounted how she was ordered by members of the gang to enter a waiting vehicle which was used for the operation.

The teenager, whose father , Mr Kolade Omolade, a native of Afao Ekiti is a Traffic Warden with the Ekiti State Police Command said, the men immediately covered her face with a black hood and drove her into a bush, where she was tied to a tree alongside several other old and young victims.

Continuing, she said she saw a deep cave where the ritualists took the next victim to and got an envelope in exchange, which she suspected to be money after the victim had been certified to be appropriate for the ritual.

The released victim suspected the two students kidnapped alongside with her to be students of Christ’s Girl School, Ado Ekiti, adding that the students had not been killed when she was relased. .

“The three of us were hung outside the cave, but I knew that those that were the real ritualists were inside the cave.

“When a victim is taking into the cave and he is good for ritual, they will give the kidnappers an envelope, which I think contains huge amount of money”.

Explaining how she finally escaped she said; “On Thursday when I was to be killed, I struggled with them as they were dragging me into the cave and a man just emerged and ordered them to take me to where they picked me without giving the reasons and that was how I was charmed again and I became unconscious until I was brought into this Church”.

Corroborating, Ranti’s sister, Mrs Kemi Olayiwola, who sighted her where she was dropped and brought her to a Church said, she could neither stand nor speak when she was brought to the Church.

Adding that members of the family had searched for the victim everywhere in the State capital without success before she was found.

Speaking in the same manner, the leader of the Church, Pastor Lanre Idowu told the newsmen that he had to hurriedly assemble the Church’s prayer warriors for a special prayer session before Ranti could regain her consciousness.

“She behaved like a slowpoke when she was brought here, but after about one hour of prayers , she began to regain her consciousness”.

THREE days after he was granted bail by Justice Olanrewaju Mabekoje of an Abeokuta High Court, fresh facts have emerged that the $4 million alleged to have been converted to his personal use by former Governor Gbenga Daniel of Ogun State was actually paid as workers' salaries in the Gateway State. The 16-count charge filed by the Economic and Financial Crimes Commission (EFCC) against the former governor accused him of converting the sum to his personal use, converting Judges' Quarters to his use, acquiring hectares of land for his business interests and converting council funds.

The EFCC had announced that Daniel was involved in a N58 billion scam but the amount involved in the charges before Justice Mabekoje was less than N5 billion.

Fresh findings yesterday showed that the $4 million was actually converted into naira and paid into state government's accounts for workers' salaries.

In the first count of the charge filed against Daniel, he was alleged to have fraudulently converted the sum of $1 million state funds deposited in the Ogun State Government domiciliary account with First City Monument Bank to acquire shares of Glanvill Enthoven and Company (Nigeria) Limited, contrary to Section 390 (4) (f) of the Criminal Code, Cap 29, Laws of Ogun State, 1978.

The second count charge indicated that Daniel on or about April 8, 2010 fraudulently converted an aggregate sum of $2 million state funds deposited in the Ogun State Government's domiciliary account with First City Monument Bank to acquire shares of Glanvill Enthoven and Company (Nigeria) Ltd, contrary to Section 390 (4) (f) of the Criminal Code Law, Cap 29, Laws of Ogun State, 1978.

Count three of the charge stated that Daniel on April 8, 2010 fraudulently converted the sum of $1 million state funds deposited in the Ogun State Government domiciliary account with First City Monument Bank to acquire shares of 21st Century Technology Limited, contrary to Section 390 (4) (f) of the Criminal Code Law, Cap 29, Laws of Ogun State, 1978.

But, the fresh findings revealed that the $1 million was credited to account no 0130775028 (21st Century Technologies Limited) same day with teller no 3221602 by same person. The State Government salary account no 0142070200787001 was credited with the sum of N152 million cash deposited by Azeez N44.8 million (teller no 4063398); Mustapha N27.2 million (4063360); Tunde N38 million (4063397); Mohammed N42 million (4063400), on the 17th March, 2010.

Also, on March 31, 2010, an instruction was received from the Office of the Accountant-General to release the cash sum of $1 million to Mr O.A Olaleye. The $1 million was credited to account no 0343881024 (Granville Consultancy Limited) same day with teller no 3123708 by same person. The State Government salary account no 0142070200787001 was credited same day with the sum of N138 million transferred from Granville Consultancy Ltd.

On April 8, 2010, two instructions were received from the Office of the Accountant-General to release the cash sum of $1 million each to Mr O.A Olaleye. The $2 million was credited to account no 0343881024 (Granville Consultancy Limited) same day with teller nos 414840 & 4141843 by same person. The State Government salary account no 0142070200787001 was credited same day with the sum of N290 million as cash deposited by Yakubu N170 million (teller no 2988823) and Wahab N120 million (teller no 3988824).

With the facts, it is obvious that the total sum of $4 million for which the former governor was charged to court was actually not missing.

It has also been revealed that he is not close to Wale Ajisebutu, the Managing Director of 21st Century Technology Limited.

A Federal High Court sitting in Abuja will on December 19, decide whether or not to quash the 16-count criminal charge filed against the ex-speaker of the House of Representatives, Dimeji Bankole by the Economic and Financial Crimes Commission (EFCC).

Besides, Justice Donatus Okorowo will deliver his ruling on the motion filed by the embattled former speaker seeking to disqualify activist lawyer, Festus Keyamo, from prosecuting him.

Bankole was docked before a Federal High Court on a 16-count charge of contract inflation amounting to the sum of N894 million by the EFCC.
However, the former speaker is challenging the competence of the charges against him on the grounds that the Proof of Evidence attached to the charges did not establish any shred of criminality against him.

Moving the applications to quash the charges, counsel to Bankole, Chief Adegboyega Awomolo (SAN) in company with Dr. Anwa Kalu (SAN) divided the charges into three parts in his bid to convince the court that there was nothing in the charge linking his client with the offence.
According to him, “the first part relates to counts 1, 4, 7, 10 and 11, the second part relates to inflation of bulk prices of supply as contained in counts 2, 5 and 8 while the third part relates to counts 3, 9, 12, 13, 14,15 and 16 respectively.”

With respect to the first category of charges, Awomolo argued that it fell under Section 58 of the Public Procurement Act and only specific persons like contractors, suppliers, consultants and procurement officers could be charged under the provision.
According to him, there was no shred of evidence in the proof of evidence that his client conspired with contractors, suppliers, or officers of the National Assembly like procurement officers to commit the alleged offence.

On the second category of the charges, Awomolo argued that they fell within the provisions of Section 58(4)(b) of the Public Procurement Act and required the prosecutor to show two different prices, i.e the legitimate price and the inflated price for the accused to see, which the prosecution had failed to do.
He said the third category related to alleged rigging of the bidding process which was covered by Section 23-34 of the Act and argued that his client was not involved in the bidding process.

Awomolo cited the Supreme Court decision in Abacha Vs State where it was held that the court had no duty to infer or assume that everything must be contained in the proof of evidence and urged the court to hold that the Proof of Evidence as presently constituted would not justify subjecting his client to criminal trial.

On his application seeking to disqualify Keyamo from prosecuting Bankole, Awomolo claimed that his client would not get fair trial from Keyamo as demanded by law. He said the prosecutor would engage in persecution having been biased against him already and asked the court to disqualify Keyamo or in the alternative order him to disqualify himself in the interest of justice and fair play.
He drew the attention of the court to a letter purportedly written by Keyamo to Bankole accusing him of fraud on the purchase of vehicles for members of the National Assembly.

In the said letter, Awomolo alleged that Keyamo called his client several names and called his integrity into question, adding that with that petition, Keyamo was morally and legally incompetent to be the one that would prosecute him in the case at hand.
However, in a swift reaction, Keyamo asked the court to ignore Bankole on the ground that Bankole was chasing shadows at the expense of the real issue. He admitted accusing the former speaker of fraud in the past but insisted that his petition against him could not remove him from prosecuting the case on behalf of the EFCC.

Keyamo cited the case of Gani Fawehinmi and Halilu Alilu, the former director of military intelligence, adding that in spite of Gani Fawehinmi’s accusation, the Supreme Court still allowed him to prosecute Akilu.
He argued further that by the provisions of Section 167 of the Criminal Procedure Act, the accused person having taken part in the proceedings by taking his plea and arguing his bail application could not now challenge the competence of the prosecutor as it was too late in the day to so do.
On this, he cited the cases of Amadi Vs FRN, Magaji Vs Nigerian Army and Bode George Vs FRN (Supra) to support his arguments.

On whether Bankole could not be tried under the Procurement Act as argued by his counsel, Keyamo cited the case of FRN Vs Bode George and Section 7 of the Criminal Code to hold that all parties to the commission of a crime were liable and could be tried by aiding and abetting the commission of the crime.
He argued that the prosecution was not restrictive by the Proof of Evidence attached to a charge and the non-failure to provide different prices of the items could not render the charge sheet defective.
The 16-count charge against Bankole are built around allegations bordering on contract inflation for the purchase of sundry items including but not limited to electronic gadgets, vehicles and other accessories.
According to the Proof of Evidence attached to the charge sheet, the EFCC is expected to call four witnesses to prove the allegation of fraud against the former Speaker.

Besides, the Commission will further rely on contract documents for the purchase of all items contained in the charge, minutes of meeting of May 28, 2008 of Body of Principal Officers, Statement of witnesses and those of the accused persons.
Some of the charges read:

“That you, Dimeji Bankole and others now at large on or about the 28th of May, within the jurisdiction of the Federal High Court, being Body of Principal officers of the House of Representatives responsible for the approval of contracts in the House of Representatives, with intent to defraud, did conspire amongst yourselves to inflate the cost of 400 units of 40-inch Samsung (LNS.3410 Television sets by approval the purchase of the said item at the rate of N525, 000.00 per unit, instead of the prevailing market price of N295, 000.00 and thereby committed an offense contrary to Section 58 (4) (a) of the public Procurement Act No. 14 of 2007 and punishable under Section 58 (5) of the same Act.

“That you, Dimeji Bankole and others now at large, on or about the 28th of May, 2008 within the jurisdiction of the Federal High Court being body of Principal officers of the House of Representatives responsible for the approval of contracts in the House of Representatives , with intent to defraud, rigged the bid for the purchase of 100 units of Sharp Digital Copier 5316 by refusal to follow all the procedures prescribed for public procurements in Sections 17 to 56 of the Public Procurement Act N0.14 of 2007, leading to a loss of value to the national treasury and thereby committed an offence contrary to Section 58 (4) (e) of the Public Procurement Act, No.14 of 2007 and punishable under Section 58 (5) of the same Act.”

“That you, Dimeji Bankole and others now at large, on or about the 28th of May, 2008 within the jurisdiction of the Federal High Court being body of Principal officers of the House of Representatives responsible for the approval of contracts in the House of Representatives , with intent to defraud, rigged the bid for the purchase of 3 units of Mercedes Benz S-600 cars by refusal to follow all the procedures prescribed for public procurements in Sections 17 to 56 of the Public Procurement Act No.14 of 2007, leading to a loss of value to the national treasury and thereby committed an offence contrary to Section 58 (4) (e) of the Public Procurement Act, No.14 of 2007 and punishable under Section 58 (5) of the same Act.”
