President Goodluck Jonathan pleasantly surprised many Nigerians last week when he declared a state of emergency in three North-Eastern states, namely, Borno, Yobe and Adamawa.

That announcement was surprising for some reasons: One, Jonathan had refrained from taking that same action for over two years. This had attracted strong criticism to him from his supporters and opponents, who saw it as sign of weakness. Two, a few days before, the Presidency had denied a news story published by a sister publication, Saturday PUNCH, that there was a plan to declare a state of emergency in any part of Nigeria. Three, a few weeks before, the President had inaugurated the Presidential Committee on Dialogue and Peaceful Resolution on Security Challenges in the North. Four, many people had never seen Jonathan speak with such force and in such a voice before. Five, for the first time, Jonathan called members of the Boko Haram sect “terrorists”.

Even before the National Assembly had given the required approval, soldiers had moved into the three states. A Reuters report quoted a Maiduguri, Borno resident as saying that he had never seen such a number of soldiers in his life before.

Immediately after that the President’s broadcast on Tuesday, May 13, 2013, both the social media and the traditional media platforms were awash with comments in praise of Jonathan’s action, with many people saying that it was long overdue.

Predictably, a few groups like the opposition Action Congress of Nigeria and the Northern Elders Forum condemned it. While the ACN said it was “lacking in original thinking,” the NEF said it was a declaration of war on the North and a derailment of the amnesty programme.

But one aspect of the declaration of the state of emergency that many members of society did not initially agree with – even though that position was based on ignorance of the provision of the Constitution – was that the President did not dismiss the governors of the affected states as well as their respective Houses of Assembly as was the case in the past. Lawyers like Mr. Femi Falana (SAN) promptly published comments that confirmed that the President was right in not sacking the governors and Houses of Assembly, as no part of the Constitution gave such a provision. That further boosted the image of Jonathan as a respecter of the Constitution to which he swore to protect.

Before now, many saw President Jonathan as timorous and irresolute. Most Nigerians had expected that a state of emergency should have been declared in some states since 2011 when the Boko Haram insurgency went out of hand. Even though more than 3,000 people are reported to have been killed over the Boko Haram insurgency, the President had looked on as if he expected the appeals and cries of the people to touch the Boko Haram sect.

Rather, when Jonathan decided to declare a state of emergency on December 31, 2011, following the Christmas Day bombing of St Theresa’s Church, Madalla, Niger State a week earlier, he did so in some 16 local governments of some states in the North: Borno, Yobe, Niger and Plateau. That was seen as a half-hearted declaration. Nigerians did not notice any decrease in the bloodletting after that declaration. On the contrary, that partial measure seemed to have emboldened Boko Haram to increase the scope and intensity of its attacks.

The insurgency cast the Nigerian state as helpless, spineless and dazed. The nation watched as Boko Haram wreaked havoc almost on a daily basis at one location after another in the North, hoisting its flag in its conquered territories and threatening more attacks. Military barracks, police stations, prisons, churches, mosques, markets, schools, media houses, motor parks, the United Nations’ building and others were not spared. It was a clear declaration of war on Nigeria.

The frequent response Nigerians got after each bloody attack from an evidently bamboozled security architecture was: “We are on top of the situation.” Many Nigerians turned the expression into a joke.

When the Federal Government was pressurised and blackmailed into accepting to offer the sect amnesty early this year, the fears of most Nigerians seemed to be confirmed that the government had no answer to the insurgents’ threat. But Boko Haram put the Federal Government to more ridicule by saying that it should be the one to offer Nigeria amnesty, and not the other way round.

As if to register its anger at the “effrontery” of the Federal Government to ever think of an offer of amnesty, the Boko Haram sect bombed Bama in Borno State and sacked a police station with dozens killed. Its leader Abubakar Shekau boasted in a video clip that the sect was responsible for the earlier attack on Baga, a border town in Borno State, where the response of the soldiers had elicited an outcry for being like killing an ant with a sledgehammer. On the same Tuesday night that the President announced the state of emergency, Boko Haram visited the home of the Borno State’s secretary of the Christian Association of Nigeria and shot him dead in spite of all the pleas of his family members. Two days after the declaration of the state of emergency, the sect attacked Daura, the hometown of Maj.-Gen. Muhammadu Buhari in Katsina State, burning a police station and four banks and killing some people.

So, Boko Haram has not shown any sign that it wants amnesty. If the sect wanted amnesty, it would have suspended all hostilities and waited to see the seriousness or otherwise of government.

It is even doubtful if the original Boko Haram, led by Shekau, will ever accept amnesty. Before one can choose to commit suicide for any cause, one must be propelled by a force higher than money or a desire for “settlement”. My mind tells me that the political Boko Haram will accept amnesty, because it is fighting against perceived injustice, but the original, religious Boko Haram will not accept amnesty because it perceives its cause as “divine”.

In retrospect, it was good that the government acceded to the demand to grant amnesty to Boko Haram, which helped to prove that the sect does not want any amnesty. If the Federal Government had continued to insist on no amnesty, many would have said that its recalcitrance was the cause of the continued unrest in some parts of Northern Nigeria.

I believe that the amnesty programme, as controversial as it is, should go on, while the military continues its war against the Boko Haram elements that continue to wage war against Nigeria. Only the government of a Banana Republic will fold its arms while a group kills its citizens in droves and burns its cities with glee. If Boko Haram is interested in amnesty and peace, it should be the party asking for a ceasefire, not the government. Even if government will negotiate with Boko Haram, it should not be from the point of weakness, but of strength.

But government must not concentrate all its efforts in the three states where a state of emergency was declared. Boko Haram’s first-ever attack in Katsina State last week shows that if the three states of Borno, Yobe and Adamawa become too hot, members of the sect will naturally relocate to other Northern states and continue their campaign of terror.

Beyond the approval that followed the declaration of state of emergency in the three states and the prompt action of the soldiers, one prays that President Jonathan will not shoot himself in the foot in a matter of days with a comment or action that will attract an avalanche of criticism.

It is now abundantly clear that President Jonathan has finally bared his fangs confirming what was widely speculated. By declaring a state of emergency in Borno, Yobe and Adamawa, he has intimidated and emasculated the governors of these States. We are witnessing a dangerous trend in the art of governance and a deliberate ploy to subvert constitutional democracy.

The body language of the Jonathan administration leads any keen watcher of events with unmistakable conclusion of the existence of a surreptitious but barely disguised intention to muzzle the elected governments of these states for what is clearly a display of unpardonable mediocrity and diabolic partisanship geared towards 2015.

Borno and Yobe states have been literally under armies of occupation with the attendant excruciating hardship experienced daily by the indigenes and residents of these areas. This government now wants to use the excuse of the security challenges faced by the Governors to remove them from the states considered hostile to the 2015 PDP/Jonathan project.

Let me be quick to say that this administration will be setting in motion a chain of events the end of which nobody can predict. Experience has shown clearly that actions, such as this one under consideration, often give root to radical ideologies and extremist tendencies, a direct opposite of the intended outcome of unwarranted and unintelligent meddlesomeness. The present scenario playing out in the country reminds one of the classical case of a mediocre craftsman who continually blames the tools of his trade for his serial failure but refuses to look at his pitiable state with a view to adjusting.

It has become crystal clear, even to the most incurable optimist, that the country is adrift. That the ship of the Nigerian state is rudderless is clearly evident in the consistent and continual attacks ferociously executed by elements often referred to as the insurgents in some northern states of the federation, particularly Borno and Yobe states respectively.

Indeed, no part of the country is immune from the virulent but easy attacks, veritable indices of a failing state. Unfortunately, the tenuous and uncoordinated approach adopted by this government betrays a grossly incompetent disposition which stands at variance with current realities in the country, nay the international community where acts of terrorism are engaged and contained. No Governor of a state in Nigeria is the Chief Security Officer. Putting the blame on the Governors, who have been effectively emasculated, for the abysmal performance of the government at the centre which controls all these security agencies, smacks of ignorance and mischief.

Terrorist acts are perpetrated routinely and the government at the centre appears incapable of stemming the tide of the horrendous crimes unleashed on the hapless populace. The considerable ease, with which lives and property are destroyed on a daily basis, should excite deep introspection on the part of a government truly desirous of finding a lasting solution.

The Constitution provides that the safety and welfare of citizens shall be the primary purpose of having that structure of any political leadership in the first instance. This Government, through acts of omission and commission, has fallen far short of expectation. It actively encourages schisms and all manner of divisive tendencies for parochial expediency. Ethnicity and religion become handy weapons of domination. Things have never been this bad.

The response to the pervasive chaos in the Northern region of the country has been militarisation, mass arrests and extra judicial killings by the Joint Task Force, JTF, a convenient euphemism for an army of occupation seemingly set loose on the people of the localities concerned. The tenor of the State of Emergency declared by the Federal Government yesterday portends danger for the polity. The full militarisation of security operations in these states will compound the already tense situation.

Both local and international media are awash with news of reckless attitudes of the invading forces. The fact that security operatives are killed cheaply and reprisals from the state find expressions in organised pogroms in the immediate communities is sure evidence of a government which lacks basic understanding to appreciate the enormity of the current security challenges. If development is about the people, all measures put in place for the sustenance and maintenance of the super-structure of the society must take into cognisance local contents.

It is evident from the grim experiences in recent times that this government has failed, or does not know that it is necessary for it to avail itself of the benefits accruable from exchange of ideas and notes on the latest in terms of technology and human resources among nations of the modern world, especially those which have been fighting terrorist organisations over the years, on the most effective mode of combating this menace. Technologically advanced countries of the world will never discard the idea on the need for the establishment of an effective local intelligence outfit.

Our suggestions along this path have always been met with suspicion and acerbic criticisms from both the informed and the ignorant alike. A government which stoutly defends its opposition to the decentralisation of the police force from its present over-centralised command structure is already experimenting with all manner of means patently extra-legal.

The massacres of local communities attendant upon the attacks on security agents by unknown elements will further alienate the people who should, ordinarily, partner with the government in securing their immediate environments. An army which invades a community maiming, raping and killing defenceless civilians will end up radicalising the youths whose parents and young ones have been wiped out most cowardly and recklessly. This government should concentrate more on encouraging the development of local intelligence which will, inexorably, lead to the practice of true federalism. Adopting the use of excessive force against those perceived as harbouring terrorists does not portray this government as possessing the wherewithal to find abiding solutions to the lingering security challenges.
The President’s pronouncement, which seeks to abridge or has the potential of totally scuttling the constitutional functions of Governors and other elected representatives of the people, will be counterproductive in the long run. A State of Emergency already exists in the states where JTF operates. Residents of these communities live in constant fear. Their rights are violated with impunity under the guise of searching for terrorists in their respective domains.

Hiding under some nebulous claims which border on the intractability of the security challenges posed by Boko Haram or some acclaimed traditionalists who have killed some policemen to render ineffective the constitutional powers vested in elected Governors and other representatives of the people, perceived as not amenable to manipulation for the 2015 project amounts to reducing serious issues bordering on the survival of the country to partisan politics.

Let all those who love this country genuinely advise the federal government not to tinker with the mandates of these Governors under any guise. It is a potentially destructive path to take. If security of a society is about the protection of lives and property of the citizenry, the involvement of the people is a sine qua non to effective intelligence gathering. Any measures put in place which alienate the people, in particular their elected representatives, should be considered as fundamentally defective by every right thinking person in the country.

A casino refused to pay $11 million about 1.7 billion naira in winnings to a top poker player, according to reports.

American poker player Phil Ivey, who won $11.7 million at a London casino, has been referred to the British Gambling Commission, a source familiar with the casino confirmed Monday after media reports surfaced that the payment was being withheld.

Ivey hit a lucky run of over two nights playing punto banco at Crockfords, at the oldest private gambling club in Britain, according to a local newspaper. The source, who requested anonymity because he was not appointed by Crockfords to talk about the case, confirmed the accuracy of the report in the local newspaper.

The source did not give details of why the winnings was referred to the committee, which regulates commercial gambling, and said the casino has had no contact with legal representatives of Ivey.

Both the game commission and Crockfords declined to comment on the ongoing case.

Punto Banco is a form of baccarat card game favored among the high rollers. Ivey, 35, has won eight World Series of Poker bracelets and more than $6.2 million during his career. With his sixth place in the ranking of the WSOP and his penchant for high-stakes game, the organization calls him "possibly the best poker player in the world."

No fewer than 600 ex-militants in the Niger Delta yesterday threatened to invade the National Assembly over the summon of the Chairman of the Amnesty Implementation Committee, Kingsley Kuku and the former militant leader, Mujaheed Asari- Dokubo, over their remarks on the 2015 presidential election.

The ex-militant leaders described the House of Representatives summon on the duo as divisive and attempt to foment trouble in the country. This was contained in separate statements issued yesterday in Yenagoa by the President, Leadership, Peace and Cultural Development Initiative LPCDI, Reuben Wilson and a former member of the Movement for the Emancipation of the Niger Delta, MEND, Eris Paul alias Gen. Ogunboss.

The ex-militants said their decision to invade the National Assembly was based on the perceived ethnic and parochial intent behind the action of the members of the lower chamber of the Assembly. Paul described such summon as a show of undemocratic tendency on the part of a serving governor, who believed he was protecting the unity of an already ‘disorganised society’ by some ‘northern cabals.’ In the same vein, Wilson argued that the summon by the House of Representatives was a show of bias and double standard in the monitoring of alleged volatile posture of the political class ahead of the 2015 poll.

He said: “We observed that irrespective of the decision made by the House of Representatives, they should know that their inability to arrest the likes of former Head of State, Muhammadu Buhari, over his comment in the Vanguard newspaper of May 15, 2012 and the National Coordinator of the Coalition of Northern Politicians, Academics, Professionals and Businessmen, Dr. Junaidu Mohammed, in The Nation newspaper of March 17, 2013 and Abu King Shuluwa in the Daily Independent of March 8, 2013, made it impossible to arrest Kuku and Asari-Dokubo.”

Paul alleged that the Niger State governor, Aliyu Babangida, was bias and ‘wicked’ in his comments on the political situation in the country.

He said: “It doesn’t make sense for a serving governor, who thinks he is protecting the unity of an already disorganised society by some northern cabals. “If Aliyu thinks he was sincere enough to protect the nation from an impending doom, let him call on the security agencies to begin their investigation on Muhammadu Buhari and others.”

Youths of Nigeria’s oil-rich Niger-Delta on Thursday stormed Abuja in a large number to warn the Speaker of the House of Representatives not to investigate the duo of Asari Dokubo and Presidential Adviser on Niger Delta, Mr. Kingsley Kuku, who both claimed that ‘there would be no peace’ in Nigeria if President Jonathan loses the 2015 polls.

The youths under the aegis of South-South Restoration Forum, asked President Jonathan and the leadership of the Peoples Democratic Party to call the Speaker to order so as not to provoke their anger.

Speaking to newsmen, leader of the SSRF, Mr. Selekaye Ben, said Tambuwal was bias against the people of the South-South judging by his disposition to issues involving the region. He also queried the speaker for daring to invite and investigate Dokubo and Kuku over their inflammatory statements without seeing anything wrong with similar provocative statements by leading northern political actors and commentators.

Recalling several newspaper reports by prominent northerners, such as Gen Muhammadu Buhari, Dr. Junaid Mohammed, Lawal Kaita, Bello Kirfi and Abu Shalluwa, all threatening to cause trouble if Jonathan attempted to seek re-election in 2015, the SSRF wondered why Tambuwal had not deemed it necessary to question them or raise a motion to invite them for sanctions over their utterances.

Ben, who was accompanied by the national secretary of SSRF, Mr. Ofana Paul Santon, warned that if the House of Representatives moves against the two Ijaw men, youths in the region would march into the premises with them so as to make it impossible for them to operate.

He also said the youths of the Niger-Delta region would no longer take it kindly with any individual or groups of persons who continue to suppress or intimidate the people of the South-South, who he said, have been paying the supreme price of keeping the nation running with their oil resources over the years.

“We call on the President, Dr. Goodluck Jonathan, the national leadership of the PDP and the President of the Senate to call the Speaker of the House of Representatives, Aminu Tambuwal and his team to put an end to any form of intimidation of the people of the South-South zone of Nigeria on National issues.

“Every Nigerian irrespective of tribe, language, region or religion has equal right to freedom of expression as enshrined in our constitution, and no individual or group has the sole right to intimidate another group or region under the guise of carrying out his functions.

“Who told Tambuwal and his gang that one ethnic group or people are superior to others? How come Tambuwal and Ali Sani Madaki never called for investigation or arrest of Gen. Ibrahim Babangida when he publicly called on Tambuwal to seek for a higher office in 2015 when he knew that there was no vacancy in the Aso Villa?

“Äre all these and many more statements that have been publicly made by people from the north not provocative enough for Tambuwal and his cohorts to call for their arrest and investigation?

“We, the people of the South-South know Tambuwal’s game plan and who he is working for but they should know that we as a people cannot be intimidated by anybody or group in this country,” Ben said.

The Enugu State government has debunked the rumors making the round that governor Sullivan Chime has passed away.

Chime was reported to have passed on at an Indian hospital on Saturday, after battling an undisclosed ailment for some months.

The State Commissioner for Information, Mr Chucks Ugwuoke who confirmed this to Vanguard on Sunday, described the news as unfounded.

Meanwhile, the latest information reaching us was that The PUNCH’s Enugu State correspondent, Ozioma Ubabukoh, was harassed by seven men who claimed to be security agents in front of his apartment in Enugu around 11.45pm on Saturday after the news was first reported.

The men seized Ubabukoh’s phone and his laptop in order to stop him from sending stories to the head office.

As at press time, the men were still in Ubabukoh’s apartment and insisted that they were not leaving until 3am.

Efforts to get across to some commissioners in the state were not successful as their phones were switched off.

Please, I seriously need advice on this issue. It's been haunting me and tearing my conscience apart since I got married 5 years ago.

After my university education, I did everything possible to ensure I got posted to Abuja and to National Assembly to be precise. I was a very pretty girl with all the right curves in the right places and I didn't want to waste that.

I knew exactly what I wanted to do at the National Assembly I wanted to make money, lots of money and I knew that the quickest and easiest way was to date Senators. So, as a young, sèxy and extremely beautiful 23 year old graduate, I set out on my journey.

At first, it was easy, I got to date senators and they spoilt me with a lot of money but before long, many more girls, even university girls were entering into the business and things began to dwindle. I spoke with one of my (co aristo) friends on how she still manages to have so many senators, white men and very rich politicians dating and spoiling her with so much money.

She introduced me to a very expensive native doctor in the suburbs of Abuja who gave me a tiny string of beads to tie around my waist after some incantations. At first I didn't believe in it's power and reluctantly paid the N250k that I was charge but on my next outing, I was surprised at how much Baba's jazz seemed to have worked.

In 2 years, I had acquired a piece of land in Abuja and developed it. I stayed in a nice rented apartment in Asokoro and drove a Prado Jeep. I had travelled to as many countries as I wanted. Whenever I was in Lagos, I was chauffeured by one of my 'uncles' drivers. In other words, I was a big Abuja girl by all standards and was living very large. Meanwhile, I never spent a kobo from my salary.

I had abortions so many times that it became normal for me. I told myself that if it's still in the first trimester, it was just blood clots and nothing to feel bad about. Inshort, I killed my conscience.

When I was 28, I met this really nice guy who incidentally was also from my home-town. We dated for a while and he proposed. I happily accepted. One week before my traditional wedding, my mother, who knew how I made so much money without discouraging me, died mysteriously.

Before my wedding, I handed over all my aristos to my younger sister who was already 24 at the time and whom I'd introduced to the lucrative business, she had also gone to visit Baba.

Now, it's been 5 years since I got married and I've never been pregnant. Instead, those aristos I dated keep visiting me in my dreams and having sèx with me. Sometime, I see the Baba pursuing me and at other times, I see babies laughing at me with money in their mouths.

We've visited different hospital several time but the doctors keep saying we're both ok and we should just be patient. We've done so many tests and tried IVF both in Nigeria and in the US but they've never successful.

I'm so worried, sometimes, I think I'm going crazy. I feel this has to do with my past which I've never disclosed to my husband who is a good Christian. Sometimes, I wish he'll marry another woman or at least get another woman pregnant. I really don't know what to do, I feel I'm being unfair to him. I really love my husband and will hate to hurt him.

Do I disclose my dirty past to him and face his anger and disappointment or do I keep praying for the fruit of womb. Will it ever happen to me? I very much desire to have a child of my own.

Please don't judge me, I'm not proud of my past and I know what I did was wrong. I already judge myself. All I want is genuine advice before I go crazy.

A man was arrested after beating his 2-year-old daughter to death for forgetting to go to the toilet, according to reports in the news media.

The Detroit, Michigan man was so obsessed about potty training his daughter he fatally beat his 2-year-old daughter when she had an accident, a prosecutor said in the opening address to the jury in the murder trial of the man for first degree murder.

D'Andre Lane is also accused of child molestation for the disappearance of Bianca Jones, whose body has never been found. Lane told police that the child was kidnapped during a carjacking. The car was found less than an hour later, but she was not in it.

Lane, who had seven children with seven women, is accused of beating to death Bianca with a stick and towel wrapped in duct tape, and disposed of her body. Lane told officers during questioning that he hit the child for wetting herself. "He believes that if a two year old has an accident they should be physically punished," Assistant Wayne County Prosecutor Carin Goldfarb told jurors. "The accused staged a carjacking to cover up the death of his baby."

Lane put the child's body in the car the next day, when he went to take a daughter and a nephew to school, Goldfarb said. Defense attorney Terry Johnson said prosecutors have no evidence against Lane and the "case rests on the argument on what he taught."

Johnson told the jury that there was no evidence of physical abuse and while Lane may have hit the child with a stick, it had a protective cover to prevent injury. Johnson also said Lane was distressed by the disappearance of his daughter and has cooperated with police. "They want to paint him as evil," Johnson said.

The defense attorney told the jury that the prosecution is asking them to make a "leap of faith" and convict Lane.
"I do not want to take a leap of faith, and I want you to walk through this case step by step," Johnson said.
Lane was sentenced to life in prison for the death of his daughter.

FOR peace to reign in Nigeria, the Boko Haram Amnesty Committee raised by the Federal Government must prevail on the sect to stop killing Christians and destroying their places of worship, the Primate of Anglican Communion, Most Rev. Nicholas Okoh, has cautioned.

Okoh’s admonition is contained in a position paper released by the church and made available to Vanguard last night.

In the document entitled ‘The rough edges of the amnesty proposition’, the primate noted with concern the rush to grant amnesty to the BH sect without any form of truth and reconciliation, which he noted, should have preceded amnesty.

The Anglican Communion noted that although the motive of the Federal Government was to achieve peace in the north, ignoring the first steps that should have been taken would only result in the attainment of what it called ‘half peace’.

The church said: “If the Federal Government goes ahead through the amnesty committee to make peace on BH’s terms, it would have inadvertently and effectively banned Christians and Christianity from the North. In the amnesty committee, who will speak for the right of the church, not to be tolerated, but as Nigerian Christians to exist side by side with Islam and Muslims, build churches, worship freely, move about freely without being hunted down with all sorts of weapons?

”Will the amnesty committee ensure that Christians are not merely tolerated in the north but are allowed to live abundant life as Muslims as Christians do in other parts of the country?”

ABUJA — THE Federal Government has ordered the retrenchment of no fewer than 20,000 workers of the Power Holding Company of Nigeria, PHCN, ahead of takeover by successful bidders of its assets.

Vanguard gathered that the Bureau for Public Enterprises, BPE, issued the directive to the Chief Executive Officers, CEOs, of the 18 successor companies to PHCN at a meeting in Abuja, to compile names and drastically reduce the 50,000 strong workforce before the new investors take over.

It was gathered that new investors demanded that the workforce must be pruned before government hands off.

Labour kicks, warns on danger of action
Though it is not clear how government arrived at this figure, however, General Secretary of the National Union of Electricity Employees, NUEE, Mr Joe Ajaero, who confirmed the directive to massively retrench the workforce, said it was obvious that the Federal Government had decided to truncate the implementation of the collective agreement reached with the unions.

Already, organised labour had kicked against the move and warned the government against such action even as the agreement reached between both parties in December 2012 on the terminal benefits of workers had not been implemented.

The Senior Staff Association of Electricity and Allied Companies, SSAEAC, has petitioned the government through the Federal Ministry of Labour to explain the dangers and futility of government action when agreement on terminal benefits had not been honoured by the government.

On its part, NUEE directed members to shut down the power sector once any worker is issued a retrenchment letter without a financial back up in line with the December 2012 agreement.

NUEE, in a statement by Ajaero, rejected the planned retrenchment of workers without honouring the agreement the government entered into with the workers.

According to NUEE, “our attention has been drawn to the nocturnal meetings being held between Federal Government and all chief executive officers in Power Holding Company of Nigeria, PHCN, where a mandate to retrench workers in the power sector has been handed down to them. It is rather unfortunate and provoking that the Federal Government is hatching such obnoxious idea when agreement reached with the unions on payment of severance benefit is yet to be implemented.

“Information reaching us reveals that arrangement to close down PHCN’s Corporate Headquarters has been put in place. While people are still working, government plans to kill their management.

“It was equally gathered that the Federal Government has concluded plans not to pay pension or transfer money to the Pension Fund Administrators, PFAs, all in the name of driving workers to their early graves. We are worried that the government could be privatizing without cash backing, as information at our disposal suggests that about N43 billion is available out of the over N400 billion agreed with the unions.

“At the moment, agreement on certain indices to be used in calculating entitlements like life expectancy which the Federal Government put at 14 years is yet to be reconciled.

“By this posture, it is obvious that the Federal Government has decided to truncate the implementation of collective agreement reached with the unions. Nigerians should, therefore, hold government responsible for any reaction this action may generate.

“While there is still opportunity for the Federal Government to follow due process, we wish to state unequivocally that PHCN workers will legitimately resist every attempt to shave their hair in their absence. Should the Federal Government make good its threat to retrench workers in the sector when labour issues have not been settled, all members are advised to stop work, while those monies paid into their accounts should be seen as free money. The hour has come for you to defend your rights.”

FG set to pay off workers —Igali

Meanwhile, the Federal Government has said it is now set to pay off the staff of PHCN. The Permanent Secretary, Federal Ministry of Power, Ambassador Godknows Igali disclosed this, weekend.

Igali told journalists in Abuja that the fund for the payment of the workers’ severance package was ready and that in a matter of weeks, they would be paid as part of the process of the takeover of the sector by private investors.

His words: ”What we have done so far is to try to ensure that the entitlement of these people and their severance package is well calculated from the point of their engagement to the point where the government is bringing the private people to take over.

“We have agreed on virtually everything. Government is preparing towards the formal takeover by the private sector. We expect the process to be seamless. So far, there is no major problem; the fund required to pay the people is available.”

…assures workers

The Permanent Secretary expressed satisfaction at the resolution of the issues surrounding the disengagement with the PHCN staff as well as casual workers and assured that the Federal Government was working to ensure that they were all happily disengaged.

According to him, the new owners would certainly re-engage many of the workers as it would be practically impossible to operate without the old staff. He said the private sector operators would be made to adhere to the nation’s labour laws.

His words: “The people that are working in these power plants are Nigerians, and when the private people take over, they are not going to bring workers from Jupiter, Mercury or China; most of their workers would remain Nigerians.

“The only difference is that they have been government workers up till now and as the government finishes with them, they will transfer their services to private operators who are driving the sector now. But the private sector will still follow the Labour law of this country.

“So, it is not a situation of whether there is going to be mass exodus of people out of the sector. Most of these workers have been very competent; they have been serving the country very well with commitment. And you cannot just replace those who have been on the job for many years.”

Training and retraining of workers

For those who would not be re-employed by the new owners and those who may choose to go into private business, Igali said: “Government also has a very robust programme to train and retrain the workers of most of these companies. Retraining them is at two levels: first is to retrain people in such a way that they can fit into a new nature of the sector. Before it was public service but now, we have private people taking over.

“So we are retraining them so that those who will continue working on contract basis will fit into the system properly. The second training is directed at those who would opt for private life. A lot of people may want to go into consultancy; like I said, the private people coming in cannot go out of the country to import thousands upon thousands of workers to take over our electricity sector. They will still need these same people.

“Government from the highest political authority has assured people of their commitment to ensure that all parties are satisfied with the way the issues are resolved.”

He added that the power reform transaction signing summit presided over by President Goodluck Jonathan, last Monday, was an eloquent demonstration of highest commitment by the government to ensure a successful conclusion of the power transaction.

The Perm Sec said $600 million (about N94 billion) was realised from the 25 per cent initial payments by the investors in the power sector and that they were equally determined to make the transactions successful with some even ready to make 100 per cent payment of their bid prices ahead of the 90-day stipulated payment period.

He said: “Some are ready to pay 100 per cent but 25 per cent was what was required at this stage and the total amount from the information we have from BPE is about $600m.”

Igali said power generation had risen to over 4,500 and that the Federal government’s target of 9-10,000 at the end of the year was still intact.

He claimed that some major cities of the nation now enjoy about 16 hours of electricity daily.
