He should go and ask the people he has called thieves,greedy,jobless for over 3 years for support.the same people and their supporters who are card carrying members of your party. You fight for the removal of the national chairman your mentor.who has enormous support among party members in Edo. You fight against every edo person appointed who would have benefited your party people,the same people who will vote in a primary. You fight against political Titans entering the party. You fight majority of elected lawmakers from your state.forgetting they also have supporters. And you want the same party ticket. Well-done. I wish him luck even though I know it will be of no use to Obaseki.

I hope u read the judgement yesterday. They won't even bother to look at it. The Supreme Court judgement is final.no matter how bad.it can make amend in another case.but not on the same case. That is the reality

There is no error in Bayelsa judgement. The certificates are different. So, why do you think the judge will be reverse.

As for IMO, the supreme court made a lot of mistake and if the judgement stands many election fraud will occur. Politicians will have the gut to write results for cancelled polling units and give to police to present in court. Again, accredited voters, collected PVC and number of votes cast won't matter in determining the winner. Just to declare the highest number.

Ok. I guess democracy will be in danger if the wish of PDP is not granted. Lol.
Honestly even if the supreme court observes flaws in its judgement it cannot reverse itself in the same case. That will be done in future case.
Reversing it self in the same case will open a flood gate it cannot control.
That essentially was the reason for Bayelsa today. PDP is just amusing us as usual with its conspiracy theories.

How unserious can a party be? They want a review of all election cases they lost at the Supreme Court because Apc is seeking a review of Bayelsa.
They should save enough money for lawyers. If they feel they have good grounds that is wonderful. They cannot blackmail the Apc or the Supreme Court. Or Bayelsans.

The appeal against the Appeal Court judgement was filed after results of the election has been declared.that is Falana argument. That at that point it automatically becomes post election.the case was not at the Supreme Court during the election.
Secondly as a matter of fact by the electoral law.the courts or tribunal do not have the powers to declare a winner if the actual winner was disqualified.
But the truth is the law is only what the Supreme Court interprets it to be however myopic.

Frankly I did have high hopes for Apc federal government. Due largely to the acumen of people who formed the Apc. But sadly Bulgari has abdicated running of government to a few selfish individuals who were not elected by the people. It is sad. And in all honesty the blame should rest at his feet.
The biggest threat to thE survival of Apc in 2023 is president Buhari. Because the Apc will have to run sorely on his performance because he will not be on the ballot.
When the government cannot handle security and members of his inner circle are fighting openly on what smells like corruption I wonder what the issues to highlight will be.
However there is still time to recalibrate.

It is the Judiciary which grants those prayers. Worse case scenario should be a rerun for the people to make another choice haven disqualified their choice for whatever reason. The people should not be punished for the mistakes of parties or candidates. Justice should supersede law. Justice is the essence of law.

They are like Oranges and apple Sir. The point been that even though Obi declined. The party which was the owner of the ticket still has to be on the ballot. They can replace her. That was what the Supreme Court interpreted in the case of Bello. For example God forbid if Degi had passed away God forbid after the election before inauguration would the APC ticket had become invalid? No. The Apc as the owner of the ticket would have nominated someone else just like it happened in Kogi and affirmed by the Supreme Court. That is the point am trying to make.

I beg to disagree. In the case of Yahaya Bello. He ran even without a deputy because Faleke refused to run with him. The same Supreme Court upheld that election and said it is the party on the ballot and not the Candidate. The Governor elect then nominated a deputy who was never on the ballot. But like you said it is the Supreme Court.

I am not a lawyer, but do well to read section 36 of the electoral act. Yes, he was elected but the joint ticket only cease to bind them after they’ve been sworn in. Even though you and i know that it would be impossible for anyone to instigate litigation against the governor and the deputy because they enjoy immunity.

Meanwhile, the same right the APC has to appeal the High Court’s judgement is the same right PDP has to appeal the appellate court’s judgement at the Supreme Court. After all, it wasn’t a post-senatorial election matter that only ends at the Court of Appeal level.

Even if the SC erred on there judgement, I’m afraid it might not be upturned as there was no precedence in that regard. But then, anything can happen. We can only keep our fingers crossed as events unfolds in weeks to come.

That is the case Falana made. The appeal to supreme court was filed after the election. Which automatically should have made it a tribunal case haven conducted the election already.

The time allowed for litigation and decision on the Imo state governorship election I think has lapsed. The case is already statute barred
I do seriously doubt if the supreme court will delve into the merit of the case.

My brother that is the dangerous precedent Inec and the judiciary is setting. Assuming pdp looses the court case instituted by Alaibe.
It then means both apc and pdp votes will be voided. That leaves 2K votes.
A day will come when a party will score 670K votes to defeat another which score 70K votes and for whatever reason the winner will be disqualified. Instead of a fresh or rerun election. With this precedent it is going to be dark.

Very nice of you. What if the number of voided votes in this case 350K is more than the margin of win 140K should a winner be declared?
Also if for any reason the court upholds other per election matters against pdp will this same principle of void votes hold? It then means about 2K people will elect a governor.

In the aftermath of Supreme Court judgement which nullified the election of APC candidates in the last gubernatorial polls in Bayelsa State, Comrade Adams Oshiomole, in his usual superimposing mannerism hit the headline by positing that the Candidate of PDP did not meet constitutional requirements in terms of geagraohical spread to be sworn in as the duly elected governor of the Oil producing State. The APC Chair either mischievously or in an attempt to turn the judgement on its head chose to ingnore part of the judgement which unambiguously nuliified the election of the APC candidates owing to acts of certificate infractions. Oshiomole failed to come to term with the incontrovertible fact that in the eyes of the law both the APC governorship candidate and his deputy as a result of their disqualification did not exist before the polls. Since we cannot build something on nothing, all the votes attributed to APC as announced by INEC after the elections automatically become null and void. In this regard, only the votes scored by the PDP candidate and other contestants would be considered in determining who emerges as the winner by number of votes and geographical spread as pronounced by the Apex Court.

Of course Apc deserved what they got. My concern is would a better justice not have been to allow the people choose a new leader and not punish them for Apc mistake?
Like I said. If Alaibe case goes through and Supreme Court say pdp did not conduct primaries properly.just hypothetically. Does this mean Apc and Pdp votes will be subtracted leaving 3K votes balance? Hope you get my point

Exactly and the 180 days does not lapse till mid March. What happens if a disqualification of either the governor or deputy occurs before then.not praying for such though.
My concern is the precedent of next person taking over a mandate.it leaves the electorate at the mercy of someone they have rejected.
Not just for Bayelsa but moving forward.

I would want us to reason this. As has been brought to notice still on this Bayelsa issue that Timi Alaibe still has a case challenging the Primaries of the newly sworn in governor and also that the new deputy has a certificate case pending. If these case gets to the supreme court and the ruling is against the governor or deputy what then happens?
Will INEC and the supreme court sustain their wasted vote theory and the next person takes over?
Because this will mean about 3K people will have elected a governor for Bayelsa.Because the Apc and Pdp account for about 497k out of 499K votes.
My Opinion is that on issues like this a rerun should be ordered because the people should not be punished for things not in their control rather only the party which should be bared from a rerun. To me that is justice to the people.

Such nonsense. Was Oshiomhole the one who nominated Degi? When the election was won these same fellows swore it had nothing to do with the leadership of Oshiomhole. And now suddenly it has everything to do with him.
When genuine members of Apc are pulling together in order to ensure the people of Bayelsa have the opportunity of picking a leader via a rerun these ones are here trying to return Obaseki or trying to position for 2023.
