Politics / Re: The Real Reason Behind Inec’s Postponement Of The Election By Nonso Ozoemena by K2asure: 11:24am On Feb 16, 2019
FLASHBACK: In 2011, INEC moved elections after voting had started!
Many Nigerians have expressed disappointment that the 2019 general election was postponed by the Independent National Electoral Commission (INEC) less than 10 hours to the commencement of the voting process.

What about this? In 2011, voting had actually started in some parts of the country when INEC announced that the election had been moved by two days!

The national assembly elections were scheduled for April 2, 2011 and had commenced smoothly in states such as Lagos, Kaduna, Kebbi, Delta, Zamfara and Enugu when Attahiru Jega, a professor and INEC chairman, announced the postponement. Reason: late deployment of electoral materials.

Four years later, Jega would move the elections again, this time by six weeks following pressure from the security chiefs who said they needed time to “diminish Boko Haram”.

TheCable has gone into the archives for the text of the address made by Jega on April 2, 2011 announcing the shift in dates. This is reproduced below.

‘What is worth doing is worth doing well’
Dear Compatriots, since this Commission started work in July 2010, I have repeatedly promised Nigerians that in carrying out our duties we shall always be sincere and truthful with Nigerians. I have always said that this INEC will be upfront with Nigerians, telling you exactly how things are – sharing both our successes and difficulties with you.

This is one such occasion. Indeed, it is an emergency. As you know the National Assembly (House of Representatives and Senate) elections are supposed to be taking place as I speak. You would also have noticed that things have not proceeded smoothly as expected with the elections. The reason for this is the unanticipated emergency we have experienced with late arrival of result sheets in many parts of the country. The result sheets are central to the elections and their integrity. Accordingly, in many places, our officials have not reported at the polling units, making it now difficult to implement the Modified Open Ballot Procedure that we have adopted. Not only do we have to enter the results in the sheets, the number of accredited voters is also to be entered in the result sheet. While we could have proceeded with the elections in a few States of the country, where all the materials are available, such as Lagos, Kaduna, Kebbi, Delta, Zamfara and Enugu, among others, in order to maintain the integrity of the elections and retain effective overall control of the process, the Commission has taken the difficult but necessary decision to postpone the National Assembly elections to Monday, April 4, 2011.

I appeal to all Nigerians for their understanding in this difficult situation. We as a Commission appreciate the profound sacrifice that you have all made not just in turning out today, but also throughout this election season. We are greatly encouraged by you and our appeal is that you remain steadfast in this last lap of this electoral process in the interest of all Nigerians and in the cause of democracy.

The Commission will immediately be contacting all political parties, as major stakeholders to explain the situation. I appeal for their support in explaining the situation to their members and supporters.

May I also appeal to all other stakeholders, particularly national and international observers and our development partners for continued understanding. I realize that they have committed enormous resources to this process, especially in deploying observers in the field. However, we think that what is worth doing is worth doing well.

Finally, while we deeply regret this situation and apologise to Nigerians for the hardship this may have created, I would like to reiterate that we are fully committed to conducting free, fair and credible elections for Nigerians. The decision the Commission has taken is weighty; but it is also a very important step in further ensuring the credibility of the elections.

In 2011 election was cancelled after we have finished counted the ballot papers because their in no network in DAT area to communicate to us until we reach our ward collation centre told us that it has been cancelled the reason JEGA gave that time is the same logistics issues means sensitive materials have not reach some area. To me its has been happened don't let us been bias. Some have been kill in Kaduna yesterday night.

Politics / Re: Osun Election: Why Adeleke Should Have Been Declared Winner – Ozekhome by K2asure: 8:47pm On Sep 24, 2018
ukpono10:
The Proposed Rerun Election in Osun State and the
Law
Preamble
It is now official that INEC has taken a decision to
conduct a rerun election in some polling units in
Osun State before declaring the 2018 Gubernatorial
Election conclusive. From the press release signed
by Solomon Soyebi, National Commissioner and
Chairman, Information and Voter Education
Committee of INEC, the reason for the decision is
given as follows: ”Based on the result by the
Returning Officer, the margin between the two
leading candidates is 353 which is lower than the
number of registered voters in the affected areas.
Extant law and INEC Guidelines and Regulations
provide that where such a situation occurs, a
declaration may not be made.” (See page 2,
paragraph 2 of INEC’s letter of Sunday 23rd
September, 2018).
It is important to note that the said letter has not
cited any section or provision of the ‘extant law and
INEC Guidelines and Regulations’ to enable readers
be on the same page with the Commission on the
issue. However, in announcing the decision to
declare the election inconclusive, Prof. Joseph
Adeola Fuwape, Returning Officer and Vice
Chancellor of the Federal University of Technology,
Akure was more specific when he said that the
decision is made pursuant to INEC’s Guidelines for
Election. He said that according to the Guidelines,
where the margin of victory at an election is less
than the number of votes cancelled in the same
election, a rerun must be conducted in the affected
polling units to determine the actual winner of the
election. The Professor did not also mention the
exact section of the Guidelines but, his submission
is clear and we can work with it for purpose of legal
exposition on the issue at hand.
What Does the Constitution say on When A
Candidate is Deemed to Have been Duly Elected?
Election into any public office in Nigeria is an issue
of law and the most superior law in the Federal
Republic of Nigeria today is the 1999 Constitution.
Section 179 (2) provides what is required to declare
a person winner in a gubernatorial election. It
provides thus:
”179(2) A candidate for an election to the office of
Governor of a State shall be deemedto have been
duly elected where, there being two or more
candidates –
(a) he has the highest number of votes castat the
election; and
(b) he has not less than one-quarter of all the votes
cast in each of at least two-thirds of all the Local
Government Area in the State.”
What the law contemplates here is simple majority
of votes cast. That means, even a hundred votes or
less will be sufficient for one to emerge as winner of
a gubernatorial election.
The Legal Question
The legal question here is, has the Governorship
candidate of the PDP met the above conditions of
the law? INEC has affirmed that after a thorough
counting of the votes cast, the result shows that
while the APC Candidate polled 254,345 votes, the
PDP Candidate polled 254,698 votes leaving a
difference or victory margin of 353 votes. By this
confirmation Adeleke of the PDP has won that
election with 353 votes. He has also won in not less
than two-thirds majority of all the 30 Local
Government Areas of the State.
Going by the provision of section 179(2) of the 1999
Constitution, Adeleke of the PDP has emerged the
winner of the 2018 Gubernatorial Election conducted
in Osun State.
There is nothing in that section to accommodate the
excuse given by INEC.
But the Constitution Recognizes a Rerun in the
following Circumstances
By section 179(3) of the same Constitution, a rerun
only becomes necessary where there is no
candidate with the highest number of votes in the
election. For instance if the candidate of the APC
and that of the PDP had equal number of votes, the
Constitution allows INEC to conduct a rerun within 7
days from the announcement of the result. Also,
where the candidate with the highest number of
votes does not have at least one-quarter of all the
votes cast in each of at least two-thirds of all the
LGAs in the State, a rerun becomes inevitable.
These are not the reasons given by INEC for the
proposed rerun election. The implication of this is
that the reasons given by INEC are not within the
contemplation of the Constitution.
When the Provisions of a Guideline is in Conflict
with the Provisions of the Constitution, what
Happens
Clearly, the provision of the INEC Guidelines and
Regulation which says that where the margin of
victory at an election is less than the number of
votes cancelled in the same election, a rerun must
be conducted in the affected polling units to
determine the eventual winner of the election, is in
conflict with the provisions of section 179(2) of the
1999 Constitution on when a candidate is deemed to
have emerged the winner in a gubernatorial
election. The Constitution does not have any such
provision or reason as given by INEC.
By section 1(1) of the Constitution it is provided as
follows: ”This Constitution is supreme and its
provisions shall have binding force on all authorities
and persons throughout the Federal Republic of
Nigeria”INEC is included in the phrase ”all
authorities and persons’‘. By section 1(3) it is
provided thus: ”If any other law is inconsistent with
the provision of this Constitution, this Constitution
shall prevail, and that other law shall, to the extent
of its inconsistency be void.”
By the above section on supremacy of the
Constitution, the provision of the INEC Guidelines
under review is null and void and have no effect
whatsoever having conflicted with the clear
provisions of section 179(2) of the Constitution.
Does the Law Have Any Business with Cancelled
Votes?
The law has no business with cancelled votes.
Once declared ‘cancelled’, such votes have no
further business in the electoral process and
cannot form the basis for the nullification of the
majority of lawful votes cast to warrant a rerun.
They ought not to form part of the counting process
and should not in any way influence the outcome of
the election. In the celebrated case of Adams
Oshiomole v. Prof. Osunbor, cancelled votes were
added to the scores of the Peoples’ Democratic
Party which saw to the emergence of Prof. Osunbor
as the Governor of Edo State. Adams Oshiomole
challenged the action in court and it was held that
cancelled votes had no role to play in the election
and should not have been counted for Prof. Osunbor
or any party whatsoever. The court then deducted
the votes and Adams Oshimole was declared the
winner.
When the cancelled votes in Osun are deducted
from the total number of valid votes cast, Adeleke
has, by operation of law, emerged the winner of the
election in issue.
What INEC Should Do in the Circumstance
INEC should rescind its decision on the rerun and
declare Adeleke the winner of the Osun State
Election in view of the fact that the reason given by
the Commission is not in sync with the provisions of
the Constitution. INEC should pay attention to the
language of the Constitution which provides that a
candidate for an election to the office of Governor of
a State shall be deemed to have been duly elected
…. By this phrase, a legal event has already
occurred; the Constitution has already deemed
Adeleke winner of the election. INEC has no further
say on this than to do the needful and call off the
proposed rerun.

I love your analysis but inconclusive is not new in Nigeria because during PDP regime they pass the law. let me remind you of Bayelsa(PDP vs APC), Kogi( APC vs PDP)and Abia(PDP vs APGA). in Kogi APC was leading by 43000plus but cancelled votes are 49000plus at end is inconclusive then their is law that backing it but now no law again don't let us be bias all of them should find way to gain more electorate for the rerun.

The ignorants don't understand the 101s of Politics.
I dislike zoning in politics but practicality is reality. As it is, if you understand Nigerian politics you know that PDP must present a northern candidate to stand even a slight chance of defeating Buhari. The implication of that is another 8-year term for a northern candidate. The major reason why the quest for restructuring and decentralization has no chance under Buhari or any other real northern leader is the fact that we had a southern Obasanjo for 8 years and a southern Goodluck Jonathan for 5+ years and they did not make those important issues a reality and now we expect it to happen under a northerner, are we crazy or is he crazy?
If PDP wins, we have another northerner for 8 years. Forget your restructuring agenda or referendum for at least 10 years! If you want a closer deal, Buhari leaves in less than 5 years or better still - forget status quo and fight for real change instead of chasing shadows... go for someone like Sowore who I see as our best option but our expertise at majoring on the minor stuff and not knowing our real friends or enemies will never make us support people like him.
If you can't stand real change with real radicals for the Nigerian project then you have a choice between 5 years or 9 years wait! You can keep making empty noise like Fayose till kingdom come, the choices are as simple as that!
God will bless you for me for this message up their, Let us look at situation of thing now all tangible capital projects have move to north from new power plant, roads, big dams, militant based and heavy equipment rate of developing that areas with NGO agricultural empowerment and the rest but we stand here somebody move from APC to PDP aaaaaaaaaah,If PDP win 2019 election another 8yrs of waiting because Obasanjo 8yrs, Jonathan 6yrs, this one 4yrs still counting.

I'm not a politician but I would do everything not to have PDP in Government in Nigeria.
The greatest tragedy that can befall a nation is for her citizens to suffer collective amnesia. I believe PDP believes Nigerians have short memories, if not, Ibori would not have been included in their convention committee and Jonathan would not have been allowed to talk (He ended up indicting himself as usual anyway).

Kwankwaso decamp to PDP
Police lay siege on Saraki's residences
Saraki announced the defection of 15 Senators from APC to PDP
Super Eagles Chief Coach, Salisu Yusuf caught on Camera taking Bribe.
Oshiomhole threatens to Sack Ngige
More to come......................

People underestimated Buhari in a hurry. Journalists jailed under his administration.
Nnamdi Kanu still missing.
Zakzaki still unlawfully detained.

In the 80’s, it was Tai Solarin, Alex Ekwueme, and oh we forgot the attempted Umaru Dikko extradition. There is more evil to come. In a country like Nigeria, a man’s cry against injustice is well often ignored. “Na them sabi” or “it is well” is the popular chorus. Evil is progressive. Hopefully they will rise to clamp SARS’ wings if they successfully win this battle. The ‘common’ man has bled enough.

Sokoto: Bafarawa + Wammako + Tambuwal.

Adamawa: Atiku + Nyako + Bamanga.

Kano: Shekarau + Kwankwasiyya.

Kwara: Saraki.

Benue: Gemade + David Mark + Ortom.

All in PDP!!

I wait to see the magic that will replicate 2015 numbers for Buhari in these states. Popularity can only draw crowds to rallies, it doesn't translate to votes. Takes a lot political machinations to win votes locally. I wait to see how Tinubu would help Buhari win the domains and states of these defecting Senators.

The 15 Senators just defected to PDP

Sen. Tejouso
Sen. Lafiagi
Sen. Gemade
Sen. Melaye.
Sen. Shittu Ubali
Sen. Ibrahim
Sen. Shitu Ubali
Sen. Isa Misau
Sen. Hunkuyi
Sen. Monsurat
Sen. Danbaba
Sen. Nafada
Sen. Nazif
Sen. Kwankwaso
Sen. Nyako

Now PDP 64,
APC 44
APGA 1

HOUSE OF REP
33 PDP
4 ADC
Out of 15 decamp 13 to PDP and 2 to ADC ( Monsura and Nyako).

APC is not party but new national chairman change the plan of voting there candidate in but some still decamp to another party when dey know that from there constituency member we not vote for them again based on new part voting plan of no delegate and change to all carrying card member because is not possible of bribe all the card carrying member in there various constituency.
Based on there agenda to PDP is changing of party name and automatic ticket for defector. If changing of party name possible, what of automatic ticket for decamp they should think about it. Why Saraki still doing in APC?

I really do not understand people rejoicing of paddy paddy moves. They are all one and the same. Politics is their only source of livelihood. They are positioning themselves to be relevant come 2019 ignorant people are here jubilating. People with no values just permanent interests. If 2019 APC manage to win again by rigging or otherwise, these same people will come flooding back without shame or guilt as long as it guarantees them relevance. Even if a New Party e.g New Nigeria Party NNP comes out and wins in 3 months it will become a mega party with these same people. I pity our stupidity.
God will bless you we are in the same road neither Saraki or Rabiu cannot be the president come 2019 because they just cajoled them to decamp and out of 15 of them only two have guarantee as at now to come back.

The long awaited death of the evil party is near, praise be to God.
I knew the God that delivered the Israelites would deliver Nigeria from the hands of the satanic party known as APC.
A party that has death as its official mantra.

God delivered you from PDP in 2015 to APC from killing your economy to fighting corruption.
Which one did you prefer PDP 16yrs and APC 4yrs?
