A Federal High Court sitting in Gusau, Zamfara, on Monday struck out the suit filed against Gov Bello Matawalle and four others for defecting from Peoples Democratic Party to the All Progressives Congress (APC) in June 2021.

Justice Aminu Bappah Aliyu while ruling on the suit on Monday said the court lacked jurisdiction to entertain the matter.

The News Agency of Nigeria (NAN) reports that the organising summons in the suit no FHC/GS/CS/14/2021 was filed by one Alhaji Bashir Saleh, Ibrahim Muhammed Turaki and Andulhamid Haruna in the Federal High Court sitting in Gusau, Zamfara.

The plaintiffs had prayed the court to declare that the first and second defendants, Gov Bello Matawalle and Alhaji Mahdi Aliyu Gusau who won the election on the platform of PDP to vacate office following their defection to the APC on June 29, 2021.

The plaintiffs, through their counsel, J. C Shaka, however, amended the originating summon and excluded the second defendant and deputy governor for remaining in the PDP.

The plaintiffs had joined the Independent National Electoral Commission (INEC), APC and Attorney General of the Federation as third, fourth and fifth defendants respectively in the suit.

They had asked the court to restrain the fourth and fifth defendants from recognizing and dealing the first and second defendants among other prayers.

In his ruling, Aliyu, said that the original summons filed by the plaintiffs lacked merit as the matter before the court was neither election matter nor election process.

Aliyu ruled that the Federal High Court lacked jurisdiction to entertain the reliefs sought by the plaintiffs.

He further ruled that the Constitution of the Peoples Democratic Party, PDP, and the Constitution of the Federal Republic of Nigeria did not, in any way, prohibit any person from joining any association or political party of his choice.

Aliyu said it was only an election tribunal or state House of Assembly that could remove a governor from office.

The court, therefore, awarded the cost of N1m to each of the defendants to be paid by the plaintiffs.

Mike Ezeokhome, SAN who represented the Gov Matawalle and the APC commended the court for ruling in favour of his clients, while J.C Shaka said the plaintiffs would study the judgment for further action.

Governor Udom Emmanuel of Akwa Ibom State has said he prefers Mr Umo Eno, Commissioner for Land and Water Resources, as his successor because he is convinced that he would continue with his developmental strides in the state.

Speaking in Uyo, the state capital, during the commissioning of Spectrum Television, the first private cable television station in the state, Emmanuel said he meant well for the state.

“Let me say this emphatically, I mean well for this State, that is why I waited for God to show me the man who would continue with the pace of developmental strides we have started in the last six plus years and then move the needle even further.

“Pastor Umo Eno is a highly respected person; he has enormous capacity, is an epitome of humility, and is blessed with the common touch, a compelling story and is God- fearing.

“He is a successful entrepreneur who has employed our people, lifted thousands from poverty to prosperity.

“He will be coming to the office of Governor with an economic blueprint that will further guarantee employment, development, and economic prosperity for our people.

“He is a man of peace and will ensure that the peace and security of life we have enjoyed in the last six plus years will be maintained. His life story resonates with the story of most ordinary Akwa Ibom people,” he stated.

The Governor said Eno’s story is a testament to the Dakkada philosophy of the state, “one that will inspire and motivate our youths”.

He noted that through hard work, Eno overcame his early difficulties and became an entrepreneur, one of the biggest employers of labour in the state.

He revealed that he never looked for a surrogate to do a third term but rather was looking for a man of exceptional capacity, of peace and humility and urged all peace loving and progress minded Akwa Ibom citizens to rally round and support God’s choice.

Barely three hours after Governor Udom Emmanuel disclosed the Commissioner for Lands and Water Resources in Akwa Ibom State, Umo Eno, as his preferred successor for governor in 2023, a federal lawmaker in the state has defiantly reacted, saying, “my aspiration to serve the state in the capacity of the Governor remains on course.”

The lawmaker, Onofiok Luke, who represents Etinan Federal Constituency in the House of Representatives, is also aspiring to succeed Mr Emmanuel as governor in 2023.

Both Mr Luke and Governor Emmanuel’s preferred successor, Mr Eno hail from the same Local Government Area – Nsit Ubium.

Mr Luke said he was neither against the choice of the governor coming from his local government area nor the aspiration of Mr Eno whom he described as his “brother”.

Mr Luke, who is a former speaker of the Akwa Ibom House of Assembly said he, however, disagreed with the way Mr Eno was presented.

In his seven-paragraph statement on the development, Mr Luke said, “I honoured an innocent meeting (invitation) from the governor out of respect and as a loyal party man.

“It was at the said meeting that I heard of the agenda and choice for the first time and no one held any discussion with me prior to the meeting.”

Mr Luke is the first aspirant to publicly react to the presentation of Mr Eno as Governor Emmanuel’s successor.

“My supporters and those sympathetic to my cause should please note that we are as resolute as ever in our desire to give our people purposeful leadership in the office of the Governor come 2023,” he said.

PREMIUM TIMES earlier reported the spokesperson to Governor Emmanuel, Ekerete Udoh, confirming the presentation of Mr Eno as the governor’s preferred successor, on Sunday evening in the Government House, Uyo.

“Yes, completely truthfully, correct. Governor Emmanuel this evening at the PDP stakeholders meeting that took place at the lodge, Government House, presented Mr Eno as his preferred candidate to succeed him.”


“He was thereafter presented to the PDP stakeholders that were present, by former governor, Victor Attah, and it was widely received,” Mr Udoh said.

Apart from Mr Luke, the senator representing Akwa Ibom North East District, Bassey Albert, and a former vice chairman of Mobil Producing Nigeria Unlimited, Udom Inoyo, are in the governorship race.

About three other commissioners in Mr Emmanuel’s cabinet are also aspiring to succeed him.

Bauchi State, Governor, Bala Mohammed, has said he told former Vice President, Atiku Abubakar, to allow him contest the presidency because he is old and fatigued with Nigeria.

He said this in his speech while receiving the report of a Contact and Consultation Committee which he established for his presidential ambition which held on Friday at the Old Banquet Hall of the Government House, Bauchi.

SUNDAY PUNCH reports that the Committee, headed by Senator Adamu Gumba, which was inaugurated 15th August, 2021, visited 16 northern states where it interacted with various stakeholders in those states.

Mohammed said, “I am aware that even in Bauchi, people are divided, my elder brother, Bala Hadith, had the courage to tell me that people of Bauchi don’t want me to go to the center and I appreciate him. This is because this is the opinion of Bauchi which is the appreciation of what we are doing together. Bauchi can be better if I’m at the center.

“But certainly, we have to manage the two together (Bauchi and the Presidential campaign). I told my younger brother and my colleague (deputy governor) that he should not be happy to send me forth so that he will take over the governorship, I will do the two together.

“One of my brothers, a formidable and astute politician, Matawalle Sokoto (Aminu Tambuwal) did it before, so we are going to also test it. And I will not give (the governorship seat) to hold forth, such a big man, he will not give me back when I come back, but if he will give me, I will give it to him.

“There is no need for us to be greedy; of course, my presidency will not cause division. You can see that at the heat of the time that my elder brother, Malam Adamu was going round, we invited our elder statesman, the one that we respect so much, the Waziri Adamawa (Atiku Abubakar), we named a road after him.

“We invited him to Bauchi and we interacted and I told him that in this game, I know he’s the most senior, he’s very qualified but because of his age and fatigue that he has suffered so much for Nigeria, he should allow his younger brother to be his spare tyre not to take over just like that. But if Nigerians prefer him, I will support him. I am not too desperate but he should know that Nigerians like me too. And whatever he wants, I will do it for him, so this is our agreement, he has the highest respect from me.”

The former minister of the Federal Capital Territory said that Nigerians are disillusioned and in poverty adding that the selection process is one of the problems in the country.

“We have a lot of insecurity, we have a lot of poverty, people are disillusioned, governance has never been like before, even the centre is confused because our leadership recruitment is very poor. And today, for some of us that know, we have been trained in this job as federalists, we know the civil service, we know the bureaucracy, we know the institutions of the federal government and the states, we know the parliament, we know the politicians and the politics, so we should be given the opportunity.

“Reward system has never been so poor, politics is not the winner takes all. Even before we come in, we will make sure that there is complete redistribution of the national resources. There must be equitable distribution; nepotism should be done away with. We have so many positions other than the presidency which will make all the federating entities to be happy.

“All the presidential aspirants from all the sections of the country are eminently qualified, so we should be left to discuss with each other. At this moment, we should be most concerned with our unity and the economics of the country.”

“It will not just be the group of Bala Mohammed, we will change the narrative, we will make sure we get the best and those people that that will be going back to their micro-constituencies to drop something. Not those kind of people we have today that are sitting in Abuja, we don’t see them. We have to change the governance, the selection, the distribution, the mannerism and the reward system, this is how we need to do it.

“I am happy that I see so many people joining the PDP because that is where the hope is. We should be able to come into politics with hindsight of mandate from the people,” he stated.

Court strikes out suit challenging legality of Buni-led CECPC, backs Supreme Court’s validation of committee

A Federal High Court sitting in Port-Harcourt, Rivers State, has struck out a suit challenging the competence of the Governor Mai Mala Buni-led Caretaker Extra-Ordinary Convention Planning Committee (CECPC) of the All Progressives Congress.

Delivering judgement on the suit no: FHC/ABJ/857/2021, Justice Pheobe Msuen Ayua struck out the name of the National Chairman of the All Progressives Congress, the APC National Working Committee, and the National Secretary, CECPC, sued as second, third and fourth Defendants, respectively, for being non-juristic persons.

A Delta State High Court, had on October 15, 2021, struck out an action filed by Elvis Ayomanor and others, challenging the APC Ward, LGA and State Congresses.

Another Delta State High Court, presided over by Justice G.B Briki-Okolosi, had also, on December 22, 2021, struck out Suit No: A/139/ 2021, between Chukwusa Edafe Matthew and 14 others Vs. APC and others, to set aside the APC Ward, LGA and State Congresses in Delta State.

The Court held that the action was non-justiciable and incurably incompetent, noting that the substratum of the matter bordered on the internal affairs of the APC.

The Federal High Court ruling has, therefore, put to rest issues surrounding the legality of the Buni-led Caretaker Extra-Ordinary Convention Planning Committee.

The ruling corroborates a Supreme Court judgement, which held “that the National Executive Committee (NEC) of the party is empowered to create, elect and appoint Committees (including the instant CECPC) or any other committee it may deem necessary to act in any capacity.”


Recall that the ruling party has been enmeshed in crisis, with leaders divided into power blocs, as the struggle for the control of the party structure hots up, ahead of the 2023 elections.

However, a chieftain of the party and Commissioner for Information and Communications in Kogi State, Kingsley Fanwo, has dismissed the notion of a crisis in the party.

Fanwo, who made the clarifications while speaking to the media on Friday, said what was happening in the party should be expected.

“The party is not in any form of crisis. What we have is an attrition of interests, which is normal in a ruling party that many believe, will continue to lead Nigeria beyond 2023.

“The Mai Mala Buni leadership of the party has done very well in stabilising the party and attracting political heavyweights into the party. PDP is saying there is a problem in APC, and their Governors, Senators and other heavyweights are dumping their party for the ruling APC. Who is in crisis here?

“Crisis ridden parties are not naturally attractive, so Nigerians know which party is struggling and lamenting. If they think Nigerians have forgotten how they destroyed this country, they will know better in 2023,” he stated.

It had little to do with Buni.
Direct Primary was held and the Committee was chaired by Dapo Abiodun. They did it the "direct Primary" way by writing fictitious results, which Moghalu, Ikeazor and Ngige (the Abuja politicians) didn't let sliding down.

They petitioned the Party that there was no Primary. INEC report leaked that there was no Primary, yet they went ahead to accept the Primary.

Moghalu took the Party to Court and he just won. Uba is not a Buni person....let's not get it twisted.

This is the failings of the State Chapter of the Party to put its house in order, just like Zamfara in 2019.

Simple and Short. Nothing more to add

It is a dangerous error and INEC doesn't have the power to disqualify any candidate, only the Courts.

However, I believe with the right technicality he will scale through....we saw this in APC v Obaseki and AGI v PDP.


Here we go again. Technicality is a double edged sword that can go either way.

He erroneously applied for a different seat as alluded by his attorney, Onyechi Ikpeazu SAN. This is what Soludo's attorney said:

Lawyer for APGA and Soludo, Onyechi Ikpeazu (SAN), argued that the suit was without merit and that the court lacked jurisdiction.

Ikpeazu contended that error in an affidavit cannot be a basis to disqualify a candidate from election, noting that the false information contemplated in Section 31 of the Electoral Act was criminal in nature.


Worse still, his own deputy also filled Awka South 2, from reports.

It is a dangerous error and INEC doesn't have the power to disqualify any candidate, only the Courts.

But nomination forms or mistakes surrounding that affidavit are criminal in nature.


How can my own Prof and Lecturer be making this kind of mistake?

The candidate of the All Progressives Congress (APC), Andy Uba, has won his polling unit in the ongoing Anambra governorship election.

INEC officials, who announced the results on Saturday, said Uba had 80 votes in Ward 16, Polling Unit 17 in Uga, Aguata Local Government Area.

The flagbearer of the ruling All Progressives Grand Alliance (APGA), Chukwuma Soludo, scored 10 votes while the candidate of the Young Progressive Party (YPP), Ifeanyi Uba, polled five votes.

Valentine Ozigbo of the Peoples Democratic Party (PDP) got two votes.

Before now, INEC had extended the voting time for the election to 4:00 pm on Saturday following challenges with the accreditation of voters.

In a statement, the commission explained that those who are on the queue by 4:00 pm will be allowed to cast their ballot in the race to pick Governor Willie Obiano’s successor.

“The extension of time arose out of several field reports that voters have had problems with accreditation,” INEC said.

“The Commission is currently investigating the reason the accreditation devices, Bimodal Voter Accreditation System (BVAS), have worked perfectly in some Polling Units, but not in others.”

An Edo State High Court sitting in Benin has restrained the National Vice Chairman (South-South) of the Peoples Democratic Party, Chief Dan Orbih, and the State Secretary of the party, Hilary Otsu, from participating in the forthcoming convention of the party scheduled for October 30 and 31, 2021.

Justice Joy Okeaya-Inneh gave the interim injunction on Friday in a motion ex-parte filed by Chief Idehen Manfred Ekundayo, Mr Stanley Iduoze and Odior Omadimhe (Claimants) in the suit marked B/218/os/2021.

The court listed Hon. Samuel Saiki, Vincent Ekpomhoriri Umoru, Leslie Ebozoje, David Okoh Aigbodion (also known as Arizona) and Abdulkareem Kassim as Defendants in the suit.

Others are Kayode Ogunubi, Hon. Omoregie Ogbeide Ihama (House of Representatives member representing Oredo Federal Constituency), Mr Oduwa Igbinosun and Mr Friday Enaruna, excluding the PDP, which was also listed as 12th Defendant in the suit.

Justice Okeaya-Inneh restrained the Defendants from attending, participating or voting at the National Convention of the 12th Defendant herein to elect members of its National Working Committee, NWC or another Governing body, which Convention is fixed for the 30th and 31st of October 2021 or fixed for any other date, pending the hearing and determination of the Motion on Notice.

The court also granted “an order of interim injunction, directing the 12th Defendant (PDP), its servants, officers, agents, or otherwise whosoever to deny admittance to the 1st-11th Defendants at the National Convention of the 12th Defendant (PDP) scheduled for 30th and 31st October 2021 or any other day and ensure that the 1st-11th Defendants do not vote or participate in any shape or form at the National Convention of the 12th Defendants scheduled for 30th and 31st October 2021 or scheduled for any other date(s), pending the hearing and determination of the Motion on Notice herein”.

According to the enrolment order of the court, Justice Okeaya-Inneh granted leave to the Claimants to serve the concurrent originating summons on the 12th Defendant, outside the jurisdiction of the court at the Federal Capital Territory, FCT, namely at the National Headquarters of the 12th Defendant (PDP) being Plot 1970 Michael Okpara Street, Wadata Plaza, Wuse Zone 5, Abuja.

The court also granted leave to the Claimants/Applicants to serve the originating summons and all other accompanying processes in the suit on the 1st-11th Defendants by substituted means, to wit, by advertisement in a National Newspaper.

Justice Joy Okeaya-Inneh of a Benin City High Court on Friday issued an interim injunction restraining embattled National Vice Chairman (South-South) of the Peoples Democratic Party (PDP), Chief Dan Orbih, the State Secretary of the party, Hilary Otsu and nine others from participating in the national convention of the party, scheduled to hold from 30 to 31 October, 2021 in Abuja.

Others restrained from participating in the convention by the court order in the suit marked B/218/os/2021, include the member representing Oredo Federal Constituency, Omoregie Ogbeide-Ihama, Hon. Samuel Saiki, Vincent Ekpomhoriri Umoru, Leslie Ebozoje, David Okoh Aigbodion (also known as Arizona) and Abdulkareem Kassim.

Others are Kayode Ogunubi, Mr. Oduwa Igbinosun and Mr. Friday Enaruna and the PDP which was listed as the 12th Defendant.

Justice Okeaya-Inneh while ruling on the motion ex-parte filed by Chief Idehen Manfred Ekundayo, Mr. Stanley Iduoze and Odior Omadimhe, restrained 1st to 11th Defendants from attending, participating, or voting at the National Convention of the PDP, the 12th defendant in the suit.

The court also granted “an order of interim injunction, directing the 12th Defendant (PDP), its servants, officers, agents, or otherwise whosoever, to deny admittance to the 1st-11th Defendants at the National Convention of the 12th Defendant (PDP) scheduled for 30th and 31st October 2021 or any other day and ensure that the 1st-11th Defendants do not vote or participate in any shape or form at the National Convention of the 12th Defendants scheduled for 30th and 31st October 2021 or scheduled for any other date(s), pending the hearing and determination of the Motion on Notice herein”.

According to the enrolment order of the court, Justice Okeaya-Inneh granted leave to the Claimants to serve the concurrent originating summons on the 12th Defendant, outside the jurisdiction of the court at the Federal Capital Territory, FCT, namely at the National Headquarters of the 12th Defendant (PDP) being Plot 1970 Michael Okpara street, Wadata Plaza, Wuse Zone 5, Abuja.

The court also granted leave to the Claimants/Applicants to serve the originating summons and all other accompanying processes in the suit on the 1st-11th Defendants by substituted means, to wit, by Advertisement in a National Newspaper.

He is using money he should use for campaign to bribe people to decamp, he has not started campaign till now in Anambra, you can't see his poster anywhere.

I don't believe its money. There must be something else going and working for him.

When we took our call to set New Agenda to Anambra East LGA yesterday, it was like a home to me. At Umueri, I told them that;

“I am coming to prove that Nwanne di na Mba. I seek your votes for us to partner and create a govt that will work for Ndi Anambra, irrespective of where you hail from. I have played diverse roles in shaping leaders from this LGA. Today, I seek a renewal of our friendship from the great people of Omambala for the greater development of Anambra. There won't be a ‘new agenda setting’ in which my campaign is anchored upon without unlocking the potentials of Anambra East LGA. We have the political will to open the economy of this LGA and inject the needed physical infrastructure for the good of the people, and our state."
