Earlier today, I exclusively posted pictures showing the spraying of 'Colas A Emulsion' in the now viral road development infrastructure along Naze/Poly-Nekede Road taken a month ago and been constructed by Governor Hope Uzodinma led APC government in Imo State.

I'm surprised seeing same picture across social media being projected by the opposition elements in Imo state as road painting ahead of Nigeria President Muhammadu Buhari visit to Imo on Thursday September 9th, 2021. What a mischief and blackmail taken too far.


While I won't join issues with the promoters of the mischief and blackmail targeted at Imo State Government and Governor Hope Uzodinma in particular, I elate to state the facts as always.

What is seen in the picture is Colas "A" emulsion sprayed on the surface of the binding course before laying of the wearing course Asphalt pavement.

The main essence for spraying this emulsion is to serve as a binder between the existing course.

In a more literal understanding, after the first layer of ashpalt on the Naze-Poly-Nekede road, a "COLAS A EMULSION" is sprayed before the 2nd layer of ashpalt (Overlay) is done. It's called a binding course which holds the first and second layers of ashpalt together to ensure durability of the road. It's the best engineering professional practice across the globe.

My good friend and engineer of repute and a chieftain of the Peoples Democratic Party, PDP, Engr Onwubiko Kingsley, can explain better for the ignorant social media terrorists, who doesn't see anything good in Imo except it benefits them personally or the political gods.

The Delta State High Court in Asaba did not restrain Yobe State Governor Mai Mala Buni and others from parading themselves as the All Progressives Congress (APC) Caretaker/Extraordinary Convention Planning Committee (CECPC) members.

A section of the media (not The Nation) reported on Thursday that the court restrained Buni and the CECPC members from conducting the local government and state congresses slated for tomorrow in Delta.


APC State Deputy Chairman Elvis Ayomanor and other officials are challenging the outcome of the ward congress in the state.

In an ex-parte application, they prayed for, among others: “An order of interim injunction of this court restraining the second to 14th defendants/respondents from further acting or parading themselves as the members of the CECPC of the first defendant (APC) pending the hearing and determination of the motion on notice already filed and served in the suit.

“Alternatively, an order of interim injunction of this court restraining the second to 14th defendants/respondents from conducting the local government and state congresses slated for September 4, 2021, or any other date, and other congresses of the first defendant in Delta State, pending the hearing and determination of the Motion on Notice already filed and served.”

Rather than granting the reliefs as prayed, Justice Onome Marshal-Umukoro ruled: “Reliefs 1, 2, 3 and 4 have to do with issues of services of processes on all the parties in this suit. Reliefs 5, 6 and 7 are injunctive reliefs being sought in the interim…

“Reliefs 1, 2, 3, 4 and alternative prayer 5 of the motion ex-parte are hereby granted. Alternative Prayer 5 is granted only in relation to the 15th defendant…”

The alternative prayer five is for the court to restrain the second to 14th defendants/respondents from further acting or parading themselves as CECPC members.

The 15th defendant in the suit is Jones Ode Erue, who was sued in his capacity as caretaker chairman of the APC in Delta.

He was not captured in the plaintiffs/applicants reliefs, which covered the second to 14th defendants.

The implication of the order is that Erue cannot conduct the congresses because he was restrained, but Buni can because the injunction, “which shall abate after seven days”, does not apply to him.

The CECPC yesterday warned members against taking the party to court or risk sanction.

The warning followed a legal action taken by some aggrieved members in the Delta State chapter.

On Thursday, the party expelled its caretaker chairman in Yola South Local Government, Alhaji Sulaiman Adamu for making uncomplimentary remarks about President Muhammadu Buhari.

Buni, who inaugurated the Local Government Congress Committees for tomorrow’s exercise said the Caretaker Committee was determined to carry out the directive of the December 5 National Executive Committee (NEC), which forbids members from taking the party to court.

Represented by CECPC Secretary, Senator John Akpanudoedehe, the he declared that the Local Government Congresses and the July 31 nationwide Ward Congresses were “legally protected.”

The Chairman urged committee members to go to their states of primary assignment with confidence, dignity, commitment, and pride.

He said: “We also use this opportunity to reiterate the resolution of NEC of our party to severely sanction members and their sponsors who take the party to court. His Excellency (Hon) Mai Mala Buni is determined to carry out to the letter the instructions of our leader, President Muhammadu Buhari, which is to rebuild the party, button-up. The process has reached an advanced ground stage.

“Rest assured that your assignment, as well as the earlier Ward Congresses nationwide, is legally protected. We are on solid ground.

“Consequently, the CECPC ratifies and adopts the results of the party’s earlier nationwide Ward Congresses held on Saturday, July 31st, 2021, however, any State Caretaker Committee who swears in any person or group of persons who are not elected through a congress conducted by the designated National Congress Committee of the Party is null, void and of no effect. However, where there are still complaints, the CECPC would be fair to all.

“Accordingly, the CECPC hereby directs you all to go and conduct nationwide Local Government (LGA) Congresses on Saturday, September 4, 2021, as contained in the official timetable/schedule of activities released by the party.”

The Director-General of Voice of Nigeria, Osita Okechukwu, who spoke on behalf of the LG Congress Committees promised to conduct the exercise in line with the Constitution of the party and the vision of the founding fathers of the party.

A new twist has been added to the leadership crisis plaguing the Peoples Democratic Party as another court in Calabar, Cross River State has restrained the embattled National Chairman, Prince Uche Secondus, from presiding over the National Executive Committee (NEC) meeting of the party billed for Saturday (today).

The injunction granted by a Cross River High Court also barred the PDP from allowing Secondus to function as national chairman or preside over the NEC meeting of the party.

The interim order was issued by the court, presided over by Justice Edem Kufre, on Friday upon an application brought by a member of the party, Enang Wani, ahead of the PDP NEC.

The PDP NEC is expected to start 12 noon Saturday at the National Secretariat of the party.

Secondus had obtained a Kebbi High Court order to reinstate him as national chairman last Thursday following an earlier injunction obtained against him from a Rivers State High Court.

The Rivers High Court interim order in the suit No HC/240/2021, specifically restrained Secondus from assuming the office of National Chairman of the 2nd Defendant, (Peoples Democratic Party, PDP).

He was also specifically barred from the NEC meeting holding on Saturday.

The NEC meeting is expected to end the Secondus era with the affirmation of plans for the National Convention now agreed to hold in October.

Breaking: Kebbi High Court reinstates Secondus as Chairman of PDP, orders him to resume office immediately.

A Kebbi State High Court has ordered Prince Uche Secondus to return to his position as the National Chairman of the Peoples Democratic Party (PDP).

A vacation Judge, Justice Nusrat Umar, gave the order in a suit brought before her in Birinin Kebbi, the state capital.

In the case, cited as KB/AC/M. 170/2021, Justice Umar said she was satisfied after reading the affidavit of the respondents.

She said it was necessary to issue an interim order on the purported suspension of Prince Secondus pending the determination of the case.

The order reads as follows: “An order of this Honourable court granting leave to the first respondent (Uche Secondus) to continue exercising all the constitutional powers of the office of Chairman of PDP (second defendant) as enshrined in both 1999 Constitution of Nigeria as amended and the Peoples Democratic Party’s constitution pending the hearing and final determination of applicant’s motion on notice.

“Any further order(s) as this Honourable Court may deem fit to make in the circumstances.”

Three concerned members of the party, Yahaya Usman, Abubakar Mohammed and Bashar Suleman are the claimants/Applicant in the case while Prince Secondus and the PDP are the defendants/Respondents.

Two factions have emerged in the Peoples Democratic Party (PDP) following the suspension of the party National Chairman, Prince Uche Secondus, by a Port Harcourt High Court.

On Monday, the court restrained Secondus from parading himself as PDP helmsman.

Sequel to this, the Deputy National Chairman (South), Elder Yemi Akinwonmi, laid claim to the leadership of the party.

But the Deputy National Chairman (North), Senator Suleiman Nazif, also said he is in charge of the party.

The Nazif led faction of the party has fixed Friday August 27, for the party’s National Executive Committee (NEC) meeting.

MEMBERS of the Peoples Democratic Party House of Representatives caucus, have demanded the immediate resignation of the National Chairman of the party, Uche Secondus, to save it from collapse.

This was part of a two-point resolution arrived at after a virtual meeting of the caucus in Abuja, on Saturday.

It was contained in a document titled, “Resolutions reached at an online meeting of the PDP caucus of the House of Representatives on Saturday, 7th august, 2021 in respect of current concerns over party leadership, which was obtained by The PUNCH, in Abuja, on Sunday.

The document was signed by the Leader and Deputy Leader of the caucus, Kingsley Chinda, Chukwuka Onyema, respectively.

It read in part, “Members of the PDP House of Reps Caucus met and deliberated extensively on various aspects of concern being expressed by members of the party across the federation.

“Specifically, on the current charge of inept leadership against our national Chairman (Prince Uche Secondus) and Honourable members note as follows:

Whereas members of the Peoples Democratic Party (PDP) and millions of Nigerians nationwide anticipate vigorous and well-coordinated issue based national opposition; preparations towards a national convention as well as the 2023 general elections, much confusion, finger-pointing and needless noise around the party’s national headquarters have obfuscated the noble objectives and lofty ideals of the PDP and democratic opposition politics in Nigeria.

“Notes that to many, the National Chairman seems much more content with occupying the office and therefore preoccupied with holding onto his position rather than preparing for next elections; this explains for his inexplicably missing endless opportunities that ought to have been utilized for consolidating a viable opposition; skewing party congresses to favour personal future ambition and frustrating genuine party members across states which has resulted in mass exit of party members at the National Assembly.”

“The two-point resolution read; the it was “Resolved that the PDP House Caucus:

“Formally asks the BoT and the Governors Forum of the PDP to ensure immediate and firm resolution of current challenges so as to enable a re-engineering, re-focusing process that would restore party members and millions of other Nigerians’ hope and confidence in the PDP as an alternative to the current dysfunctional, irresponsive and rudderless government of APC with its attendant suffering, miseries, political deceit, economic woes, insecurity and all-round disappointment foisted on favor millions of Nigerian families across the federation, and;

“Urge the current National Chairman Prince Uche Secondus) to consider making the necessary personal sacrifice worthy of a leader in the party’s current and future interest with a firm assurance of honourable regard and appreciation by the party leadership now and in years to come, by honourably resigning his position as party chairman immediately, to allow the party an early start.”

Meanwhile, governors elected on the platform of the party have scheduled a meeting to deliberate on the crisis with the party and take a position ahead of Tuesday’s meeting with the Board of Trustees.

A notice of the meeting was sent out to governors on Sunday. Chairman of the PDP Governors Forum and Sokoto State Governor, Aminu Tambuwal, and his Adamawa State counterpart, Ahmadu Fintiri, met with Secondus at his Maitama Residence, Abuja

The Supreme Court on Wednesday in a split decision of four to three upheld the re-election of Rotimi Akeredolu as Governor of Ondo state.

However three other justices disagreed with the majority judgement, insisting that Akeredolu’s candidacy in that election is a nullity.

The minority judgement held the view that the appeal has merit and ought not to be struck out by the appeal court.

The minority judgment led by Justice Mary Peter-Odili, held that since APC was the principal and was made a party, there was no need to join Buni in the suit.

Akeredolu was the candidate of the All Progressives Congress (APC) in October 10, 2020, Governorship election in Ondo State.

The PDP and its candidate, Eyitayo Jegede had earlier approached the appeal court to challenge the candidacy of Akeredolu, insisting that his nomination form was signed by a sitting Governor Mai Buni who doubles as the Acting National Chairman of the party.

The appeal was based on the constitutional provision which forbids sitting Governors from holding executive positions outside their statutory position as governors.

They prayed the court to nullify Akeredolu’s candidacy, but the Court of Appeal in Akure, Ondo State capital, on June 16, struck out the appeal for lack of merit.

At the Supreme Court, the outcome was the same for the PDP as the majority judgement backed the decision of the appeal court.

A seven-member panel of the Supreme Court, led by Justice Mary Peter-Odili chose the time for the court’s decision after taking final arguments a moment ago, from lawyers representing parties.

The main appeal, filed by Jegede and his party, are challenging the competence of APC’s sponsorship of Akeredolu for the election. There are also three cross-appeals by the Independent National Electoral Commission (INEC), APC and Akeredolu.

Maybe not...but the parties should have envisaged this and got ready.

The APC also have cases against Uba.....Max Okoye's own will be on Sept 22.....Moghalu's own is still there.

I am hopeful that the Court will settle it quickly, so that every other person can go back to campaign when the time comes.

APC cases are not complicated as PDP and APGA cases where unvacated court orders are flying left, right and centre. Guess you know what this unvacated orders can do.... Coupled internal factionalization.

My attention has been drawn to a statement credited to the National Publicity Secretary of the Peoples Democratic Party (PDP), Mr. Kola Ologbodiyan, cautioning banks and other financial institutions to be wary of financial transactions with Governor A.A. Bello Matawalle of Zamfara State on the ground that Governor Matawalle has ‘vacated’ his office as Governor by defecting to the APC. The PDP also stated in very clear terms that the Deputy Governor, Mahdi Aliyu Gusau, now holds the Zamfara Governorship mandate and ought to be accorded the protection and privileges due the office of Governor as the formal process for his official declaration as substantive Governor of Zamfara State has commenced at the Federal High Court.

I was tempted to dismiss this statement by the PDP with a wave of the hand as a joke but I quickly realized that some of the tumultuous moments we have had as a country began as seemingly innocent jokes. My intervention is therefore borne out of patriotism (yes, I admit, maybe partisanship too) and a duty to set the records straight.

To give its illogical assertions some veil of constitutionality, the PDP placed reliance on Section 221 of the 1999 Constitution (as amended) as well as the judgment of the Supreme Court in Faleke v. INEC.

Unfortunately for the PDP, the Supreme Court decision in Faleke v. INEC does not relate to the consequence of the defection of a Governor from one political party to the other. A more apt instance will be the Atiku Abubakar scenario wherein Atiku Abubakar as Vice President, elected under the PDP, defected to the then Action Congress. President Olusegun Obasanjo attempted to declare his office vacant in circumstances similar to the Zamfara scenario and the dispute ended in Court. I was part of the legal team at the time. It is trite that under the 1999 constitution, provisions relating to removal of the President/Vice President are replicated with respect to Governors/Deputy Governors. The position of the Supreme Court was reported as ATTORNEY GENERAL OF THE FEDERATION V. ABUBAKAR (2007) 10 NWLR (PART 1041) 1. At page 124 of the Report, Honourable Justice Onnoghen set down the position thus:

“There is no where in the 1999 Constitution where it is stated that the President or Vice President of the Federal Republic of Nigeria shall be removed or is removable from that office if he defects from the political party on whose platform he was elected to that office and joins another political party. It is the Constitutional responsibility of the Legislature to make or amend the laws including the Constitution, where the need arises, while that of the judiciary remains to interpret and apply the laws so made or amended. The courts can therefore not add to nor subtract from the law as enacted by the Legislature under the guise of judicial interpretation of the Constitution or Statute which the appellant desires this court to do in the instant case on appeal.”

Additionally, Section 221 of the 1999 Constitution does not avail the PDP any protection and is not remotely applicable to the present situation in Zamfara State. Section 221 of the 1999 Constitution merely deals with the prohibition of political activities by associations other than political parties. The attempt by the PDP to import the provisions of section 68 of the 1999 Constitution into section 221 of the 1999 Constitution smacks of mischief. If the intent of the draftsmen was to prohibit the defection of Governors to other political parties, it would have been so expressly stated like in the case of lawmakers. The provisions of the 1999 Constitution are very clear on the grounds for the removal of an Executive Governor of a State from office and defection to another political party is not one of such grounds. The Constitution has ‘covered the field’. However, in its characteristic manner, the PDP has interpreted the law to suit its mischief. At Page 179 of AGF v. ABUBAKAR (supra), Honourable Justice Aderemi went further to add as follows:

“It is manifest from the above quoted constitutional provisions that the law-makers intended to and indeed have made punishable the defection of an elected member, from the political party that sponsored him, to another political party before the expiration of the period for which the House was elected by declaring his seat vacant. No similar provision was made for the Vice President even for the President. If the legislators had intended the Vice President or even the President to suffer the same fate, they would have inserted that provision in clear terms……I have earlier said in this judgment that the removal of the President and/or Vice President from office is an exclusive function of the National Assembly. To stealthily read words in the terms of Section 68(1)(g) or Section 109(1)(g) of the 1999 Constitution into Section 146(3)(c) of the same Constitution and hold that, by his conduct, the Vice President has voluntarily vacated his office will paint a picture of the judiciary foraging into the exclusive territory of the legislators.”

It is extremely laughable that the PDP that celebrated the defection of Governor Samuel Ortom of Benue State and Governor Godwin Obaseki of Edo State from the APC to the PDP with such elaborate ballyhoo and fanfare would muster the effrontery to attempt to remove Governor Bello Matawalle from office for defecting to the APC. Once again, it is simply ridiculous.

One interesting point the Supreme Court also made in the Atiku Abubakar’s case which must have been lost on the PDP is that once a candidate is elected as President or Vice-President (in this case, a Governor) he automatically drops the ticket upon which he/she rode to power and becomes a President or Vice-President of the FEDERAL REPUBLIC OF NIGERIA, and not of that political party. The ticket is only a VEHICLE to get elected. Once elected, the Governor drops that party ticket and becomes a free agent for EVERYONE in that State. He is therefore free to associate (and decamp) as he likes to any political party. The Supreme Court judgment on Zamfara did not proscribe APC as a political party in the State. It only prohibited it from sponsoring candidates AT THE ELECTION (and not from receiving members to its fold subsequently). Perhaps, the PDP is assuming that it continues to sponsor Matawale IN OFFICE as Governor. No. That SPONSORSHIP ended the MOMENT Gov. Matawale was elected. In fact, to stretch the matter further, belonging to a political party is ONLY for the purpose of ELECTION for President, Vice-President, Governor and Deputy Governor (this may not apply to Legislators as they must continue to belong to a political party whilst in office). So, a Governor, upon being elected can even decide not to belong to a Political Party. In fact to follow the warped logic of PDP on this issue, all a political party needs to do to get rid of a Governor from office is to expel the Governor from the Party!

I also wonder the audacity the PDP has to directly instruct banks not to transact any business with a duly elected Governor. This is such a joke that it portrays the PDP as a comedy troupe. It is also very seditious to attempt to shut down or take over the Government of Zamfara State without a court order and by unconstitutional means. This must be deprecated by all Nigerians.

The PDP should realise that its infantile and illogical position in the case of ZAMFARA appears as a joke, but it has the capability of causing chaos in the State by inciting the uninformed ones in that great State to resort to lawlessness. My advice for the PDP is to concentrate on calming its rocking boat and not to be chasing a horse that has already bolted from the stable.
