I am afraid to let you know that Lawyers are trained in the art of legislative drafting in the same bargain. Consequently, the broad hint is that the legislature has next to nothing to do with your making a will. It's a civil law affairs.
Even if lawyers are drafting it in reality, theoretically the law makers decide what goes into the law. The substance of the law is actually decided by the lay man lawmaker. And the courts will interpret the law in accordance to the intents of the Law maker. I learnt courts in England go as far as relying on Hansard along with the letters of the law.

In respect to the will, a legislation governs it and consequently the lawmakers with the aid of some unknown lawyers have decided on the substance of a typical will. Right?

from the way you are sounding, I now understand u are not a lawyer nor anything related to being a law student

i will be overspending my time if I continue this legal intercourse with you.

my final advice is, "don't ever think that lawyers spent 6 yrs in Sch and read for the rest of his life for nothing or for something a layman can do".
Go back and read the case I referred u to pls
I never claimed to be a lawyer or law student and it would be preposterous for me to claim the wealth of knowledge a trained lawyer toiled to accumulate.

Nonetheless the courts and lawyers play the role of applying the laws made by the legislature who are representatives of the general public. These representatives have the duty to create and fashion laws to suit the needs and ends of the public that elected them. Legal training is neither a prerequisite for law making but common sense and a sense of responsibility.

That is why when I argued with you about wills, the legislature had in mind the effect of satisfying the wishes of a dying man and not create a legal web of forms and hurdles which could truncate the purpose the legislature had having regards to wills.

please avoid Strawmaning my Argument as u attempt to refute p1 and 2 , if u can't u should concede to the argument and prolly become and Atheist that believes in ID if that's even possible lol, good luck Atheist smiley
The key premise stated all codes of a known origin are products of intelligence. Your minor premise merely stated that DNA is a code and it did not go further to state if DNA had a known origin.

The minor premise ought to find its validity to the extent the major premise allows. Therefore your conclusion is wrong

I am not talking about reflecting the testator's intentions, I am talking about meeting the legal requirements for such a will to be valid. not even all lawyers engage in succession practice talk more of ordinary men to know nity gritty of all they need to do to draft a valid will....who will he even give the Will to keep?

secondly, law designate lawyers to draft some documents because those must comply with some requirements which lawyers know

Why don't you also ask why only doctors are licenced to treat some sicknesses? or why must selling drugs require a licenced chemist/pharmacist?
I like your example with doctors. Doctors need to be licensed because creates an authority to authenticates the professional and competent doctors which is a form of service to the general public. However for lawyers, of what use of the legal requirements of a will other than giving the true desires and wishes of the dying man. That's the true validity of a will everything else is secondary.

Except lawyers use the law to their ends to make business for themselves at the expense of the general public

Interesting... the provisions of the code that call for professionalism are express. The expectations of professionalism are universal, every profession has these expectations, you won't find an exhaustive list in any "express provision". They aren't informed by my 'own personal belief' or a decision of an 'appellate court' (even though there are several that talk about unprofessional conduct for lawyers). I don't have to be a lawyer to know that paying money to a judge is unprofessional.
The issue of advertising is left to them determine. It is regulated by their law in the same way that advertisement of tobacco, drugs and pharma products are regulated by law. You will find out that some professions have restrictions as to the way and manner in which they advertise. I think the restriction for lawyers is quite outdated because the uk permits restricted advertising.
I understand that the code of conduct lays express provisions relating to professionalism but I extracted a particular conduct namely referring a case beyond a lawyer's competence to a specialist in that area. My question was is that particular conduct expressly provided for in the code of conduct for lawyers?

We can reason that giving bribes to judges is unprofessional because we decipher that morally. It is immoral to give bribes and that easily translates to an unprofessional conduct. But for borderline cases it is harder to come to such a quick conclusion.

I think referring cases beyond a lawyer's competence to a specialist could be a borderline case as well.

Rainmaker69:
The rules require lawyers to handle their briefs professionally. This includes reaching out to specialists or doing the necessary research when the lawyer is out of his depth. A lawyer's duty is not to know every law but to know where to find the law.
The same rules of conduct in Nigeria prohibit advertising.
When you said the rule requires lawyers to handle their briefs professionally which includes reaching out to specialists, is it your own personal belief that acting professionally carries the implicit meaning that specialists ought to reached when the situation arises or you are relying on an express provision from the code saying so or a case decided by an appellate court stating so.

Which is it?

Why should advertising be prohibited? Imagine if other professions of comparable value to the general public like medicine restricted their advertising. Or pharmaceutical companies refuse to advertise life saving medicine how devastating would that be?

The problem with most posts on NL is that they talk past the post they are replying to. You didn't address my concerns about the public good derived from having only lawyers draft deeds.

In respect to a will, a holographic will doesn't have to be registered. The purpose of a will is to fulfill the wishes of a dying man to this loved ones. How personal can that be

If op had bothered to even glance through, he would have been properly guided. I just weak for the op, nice title, ridiculous content- this is obviously a recipe for front page.
There's a reason we have professionals in various fields and even specializations within professions. If this fact is lost on the op, then I rest my case.
Does the code of conduct oblige a lawyer to reject a brief he cannot handle? And why aren't lawyers especially specialists advertising their skills to the general public? If I need a maritime lawyer would a regular Joe in the legal profession suffice?

many errors in this post, though some are true.

You have the right to draft documents yourself including Wills but if you think you can draft it, then go and read Savannah Bank v Ajilo (1989) 1NWLR Pt. 97, p. 305. You then understand that lawyers didn't spend 6 years reading for nothing. Meanwhile, all professional field share almost the true ones among the secrets you listed

Thank you
What if the supposed client drafted a will or agreement that truly reflected his intentions in the ordinary use of language? The courts wouldn't respect that?

Also why should laws particularly designate lawyers as the lawful drafters of an agreement? What is the benefit of such a weird law to the general public?

Im so shocked many people ardently follow this filthy programme that seeks to promote moral decadence among our youths and younger ones. To think that a girl unabashedly let out her bosoms for a guy to suck like a baby who has been starved of breast milk since birth on national tv, while nigerians applaud and watch in sheer admiration, shows you how far deep our nation has sank into the pit of shamelessness and immorality. At a time when the nation is consistently being raped from all sides by clueless kleptomaniacal politicians, the youths prefer to sit back as arm chair critics and tag as cowards, those who choose to speak up for not going into aso rock to remove the clueless one, while they comfortably gossip online.

But you forgot to define what love is.

I understand that love to many people is of great value to them but for love to stand out amongst other emotions it must tap into man's unique qualities as an animal above all other animals. Love must stimulate man's consciousness, reasoning and spirituality. It should define and serve the purpose of man.

This high aspiration for love probably crashes when love is reduced to just another base emotion like anger which overtakes man, overrides his reasoning and places him in danger of his very own life and purpose. The worse fate for love is for it to be shared as a common instinct with other animals.

I have seen a hen risk its life to save one of its chicks. That display obviously reminded me of motherly love but i was horrified to deduce that the valuable motherly love can be shared as an instinct with animals when it ought to be a sacred value.

The love God has for man must be spiritual not emotional because God is not man with raw passions and emotions. And it must cater for man's spiritual needs.

Sometimes i feel Nigeria need a holistic cleansing like having a military dictator sieze power, have all these ex governors, ex ministers, directors, perm secs, deputies, senior advocates of Nigeria corruption, ex etc, rounded up and made to "disapear" just like that, then conduct an election in which he wont be contesting, and then disappear after a winner is announced.

Nigerians would live to ever be grateful to such a person.

The system is just too darn rotten. The rot surpases everything else and that is why it is nearly impossible getting any real traction in this campaign against corruption.

The only two persons we could beat our chest about as per their sincerity in my oopinion would be Ribadu and Akunyili; anything else na wash.
The dictator would have to wipe out the entire civil service across all levels of government. Corruption has penetrated into the very bottom of the barrel

By following the deeds and acts of Jesus or merely going to church and publicly identifying as a "Christian"?

Thank God for giving us His only begotten son who came to this sinful world, redeemed and made us sons and daughters of God Almighty though we were sinful! I think you miss the point of redemption. Redemption should not merely be a ritual or a one time thing rather it should be permanent. Jesus's sacrifice on the cross is of no use when it doesn't change the flawed human nature that makes sin possible. The sacrifice did not make angels out of humans rather the illusion of salvation which it promotes makes humans even worse. It makes Christians even worse because they believe they are privileged to persist with their sins because they are "covered" when they ought to change that flawed human nature

Of course, and consciousness leads to empathy.

That said, atheists can make moral choices as with any other human being. You really don't need to be religious to have morality. Morality stems from the conscious intellect humans possess.
I take empathy as a feeling of another human's (object) inner feeling. What about a case where the other human (object) is incapable of emotions due to a mental deficiency can empathy be experienced with empty object?

1. Is there any use trying to fill the ocean with jerrycans and buckets? Of what use is human praise to a self existent being who with his imagination created a universe. Such attempts at massaging a divine ego is self evidently useless.

Such uselessness doesn't deserve to be of human purpose.

2. Studying the bible or the word of God can not be a cause unto itself. It must be of practical value to us such as assisting us to live a moral life et al. Therefore it comes as a surprise to me when you suggest that a guide to life is a purpose onto itself.

In order to judge Islam solely on its merits we require a deep understanding and insight of the historical background of the religion as well as the competing theologies and perspectives within the religion.

For me there is hardly the expertise within this forum to judge Islam or a united perspective within Islam to form the basis of a criticism against it.
