The judgement says if you agree to be a member of a voluntary organisation, some of your rights can be forfeit andthe court cant interfere because you have the choice of leaving

Is she a member yet? No she's not.

But that aside, the call to bar is to enroll into the Supreme Court and practice there or at other courts. Now if she is not treated equally in the like of others especially in her unique observance of her religion then she is being discriminated against.

Thats an infringement of her human rights.

These are valid points you have made. I assume you are looking at the lacuna of the CLE, in that it did not state categorically that no one wears hijab to call to bar ceremonies. However, I think the court would have to make pronouncement( probably up to the Supreme Court), because, the Rules says you must appear in your wig & gown & suits, so she would have to argue that she can wear something underneath the wig & that would not amount to disobedience to the Rules.

There are actually no formal rules on dressing. It's more of tradition

Wrong. According to the judgment, if you agree to be a member of these association, your constitutional rights can be shifted and is not binding.

Being a lawyer is a privilege and not a right

Upon what basis doesn't your second paragraph stand on?

There is a difference between laws of an association and crime

You omitted to address whether voluntary associations can violate human rights without hindrance

BlueRayDick:

Am happy you were able to dish the bastar..d some good hood slap. Those SARS are the most useless security outfit with no regard for the law they are supposed to up hold

I remembered when they arrested a church uncle who happens to be a transporter. They stopped him and wanted to use his bus for their useless raid they go for without buying him fuel nor compensating him for the man hours he will lose in the course of their useless raid of innocent people. So he declined and politely told them he was on his hustle and he has a target to meet in order to feed his family and remain a law abiding citizen.

They changed it for him, threatened fire and brimstone and said they want to search his vehicle. That was how they planted a bullet shell casing in the vehicle and called each other to come and see what they found. They said he was a thief and his vehicle is usually taken on robbery expedition.

They took him in to their office at ikeja and it was a serious case. He spent several months in cells like cage. I mean cells so small they couldn't sit upright in it. He narrated how people would be asked to go and pick something in the corridor and they are used as target practise by trigger happy daredevil sars officers. He recounted numbers of his fellow inmates that died in such fashion.

We prayed and prayed, got him a lawyer and forced them to take him to court after several months. The judge just threw the case out of court for lack of evidence, ordered his bus be returned (the bus was now in a bad shape cos they keep using it for raid without maintaining it since the owner is in their custody).

He had to be admitted in the hospital after his release and the daredevil sars guys just walked free. Smh

You have a touching story.

Why didn't you pursue a law suit? You clearly have a basis for doing so. If Nigerians regularly enforce their rights it would force these SARS to be rights conscious.

You've not stated how he raped you all I am seeing here is relationship gone sour.

Tactical blackmail to get the normal lady sympathetic Favour in sexual related cases.

Maybe she was taken the man for a fool, collecting goodies from him and keep on postponing pay back time. Every worker is hoping for his wages at the end of the day, people should know that there is nothing like free gift, for every gift a price is attached to it.

Invariably the wise men collect their "dues" in sex from women for the dinners cinemas and ice cream they buy for women right?

I believe there are some hidden truths in this one-sided story

When will ladies ever admit they actually had sex because they wanted it and stop blaming it on men for coercing them into it

Do you suggest that for every rape case the police gets, they should adopt your view that the women's stories are one sided and untrue?? And therefore do nothing about it in turn forcing the women to social media for justice?

When answering, consider if your mother was raped and she was subjected to this treatment.

Actually no. Law school grading is very unusual. You are graded with you lowest grade, so;

5As-first class; 4As and 1B+ is a 2:1; 4As and 1B is a 2:2 and 4As and 1C is a pass.

Basically a 2:2 could be 5Bs and a pass could be 4As and 1C or 3As, 1B+ and 1C.

Can you prove it? Do you have any document showing the law school's policies openly grading students with their lowest scores?

Mynd44:

These are how to make sure things like you being accused dont happen. A lot of men use the "she came on to me" excuse or "she said no but her body said yes" excuse.

A lot of rape cases are beacause the men read meanings wrongly. Yes there are cases where the man is wrongly/falsely accused but it is a small %

Yea you are right however when we judge other men for their actions it should be fair. And they should judge on how reasonable person perceives consent in the everyday human language. Invariably we agree that consent like every human message can be abstract and can be misunderstood. In fact a verbal "no" with hesitant body language can be proof of withdrawn consent. So what happens when the message is garbled and the recipient gets it otherwise. Who is ultimately responsible. Because communication is made in the context of background.

I will rather do a test for withdrawn consent.

If she says "no", dont go in
If she says "no" but means yes, dont go in
If she is drunk, dont go in
If she is high, dont go in
If she gives signs of struggling, dont go in
If she came on to you and you guys are making out and she suddenly says "no", dont go in
If you pay her for the sex and she says no, dont go in. Demand a refund instead

I hope you get the point now?

You can even go as far as asking "are you sure you want to do this? I dont want to take advantage of you"

Wise guidelines for a prospective suitor.

However for serious circumstances like a criminal trial or public trial where a man's freedom or life or career is at stake finding whether genuine consent passed is paramount. A pre emptive tip like the ones you have wouldn't not only be unhelpful but harmful. Because a burden of proof is laden on him to prove he is innocent and not guilty. Which would be unfair.

No you can't.

If I come to your house with a gun, rob you and then midway into the robbery you say "please take all the money" is it still a robbery?

I'm soo sorry i meant to say that could she release her consent midway into the intercourse. Apparently your answer seems to have addressed it. If i am to answer your answer/question i would raise the stakes and say such consent to robbery was not genuine or true. Hence genuine/true consent must be given before there can be intercourse.

Orgasms are involuntary actions that happen when peculiar parts of a human's private parts are stimulated. Every lady has her own path to orgasm, might be the Clitoris, Vulva or labia majora etc. If that part that gets her an orgasm is stimulated, she will get one.

Now, the difference between rape and non-rape activity is simply consent. As far as one party did not consent to it, it is rape so yes, a woman can get wet, moan, scream, squirt and even have an orgasm from a rape ordeal the same way a man cannot hold ejaculation if his sex organs are stimulated enough

Can you release her consent mid way into the intercourse?

Very shocking & shameful.

So sexual gratification only is the reason why she went into marriage. God gave her a caring husband but she despises his joystick.

This woman is so ungrateful!

Useless & worthless piece of trash.

But it was a brave decision to resist the temptation of adultery which is more grievous. She knows her body better and rather than incur the wrath of God and of man she left.

Aside from her bravery her truthfulness and bluntness is admirable. Rather than being passive aggressive she was forthcoming with her feelings. Marriage shouldn't be an endurance race

Trust me if the government ban the activities of carrying cow's from place to place solution for ranches will come up.

The two main questions were not answered. How do Americans ranch and whether tsetse fly is an issue for their ranching methods. When those questions are answered especially positively we can import the idea with the required modifications

By what means do you intend to monitor such restructuring of the mind, how many people will restructure their minds before we have a critical mass that can post verifiable results. And just how does restructuring of the mind help in advancing the course of Nigeria as a nation.

Socialism destroyed Nigeria. The moment the Nigerian governments both at the federal and regional levels saw themselves as direct actors in Nigeria's economic fortunes the entire economy had to submit itself to the will of the government.

The government got larger and larger and it controlled everything. With its size comes the propensity for corruption. Because it is enormous in size it's efforts at curbing corruption would be in vain

Lord Lugard didn't need your consent because it was a conquest. It was an empire building process which is amongst the catalyst for nationhood. India for example was never a reality until it's conquest by the British. Similarly France until it's inclusion into the Roman Empire.

Besides Nigerians of today are radically different from their ancestors because of our present level of consciousness. None of our ancestors at the time of the British conquests identified themselves as particularly Hausa or Igbo or Yoruba. Those identities were distilled during colonialism and into independence

The problem with your ilk is that you fail appreciate the dynamism of history.

Not only tax is IGR, Ondo and others should go for mechanised farming, they have enough land and need not to wait for FG. Those Governor are very lazy and Federal Allocation dependants.

Isn't it easier for private hands to deal with that business and the govt would merely tax them? Does a govt have the entrepreneurial spirit to run a business where it's profits are applied to state affairs?

Na so e suppose be.

Over here, we started with primary schools. Government totally abandoned them and private took over.

Then we moved to secondary schools, our government secondary schools look like shanties. Apart from a few with good principals and alumni and the Catholic run ones, we are left with leaking roofs, no seats, terrible, under qualified and unpaid teachers.

Now, it's the turn of universities. Politicians and government officials' children school abroad. They've reduced funding for public schools. Curriculum never gets updated. ASUU strike is getting more frequent as the years go by. Lectures' allowances aren't paid amd lecture halls are inadequate and unwholesome. The hostels are another matter, be looking like slaughter houses. I know cause I stayed in one for five years.

Very soon, if you want quality tertiary institution for your ward, you'll have to go private. Public universities will become redundant the way it is going.

Why not, because politicians, just like secondary schools, now own universities.

What do you think is the root cause?

Things we are getting freed from

1) Hausa Fulani internal colonialism

2) Fulani herdsmen terrorism

3) Unitary system of Nigeria

4) Elites using Abuja police, military and touts street urchins to protect their corruption by suppressing peaceful protest using security officers recruited from antagonizing tribes eg Charly boy example.

If one pierces through your claims one would find emptiness.

1. There is no real meaning behind Hausa Fulani internal colonism. Rather bigotry towards the multi diverse North. If you were asked which Hausa Fulani is oppressing you, you wouldn't have a response.

2. Deep research shows that Fulani herdsmen crisis is a symptom of a larger problem. There is a high population density with fewer lands free from cultivation and the nomadic method of raising cattle is unviable. The old ways which had worked for centuries before now are lost in the new age. No leader has sought to address the issue which has triggered this present crisis.

3. What's wrong with a unitary system? Besides Nigeria runs a federal system. Now if it is lopsided in favor of the central govt it still doesn't make it unitary.

That the stupid senseless situation we find ourselves here in the Nigeria. The ND resources are NOT national resources. The same way the ND can't lay claim to the agricultural produce of the north or the sea ports of Lagos. It's that simple.

We are tried of feeding Nigeria when our people are desperately poor. And before u lay blame on the governors remember the FG has done worse!

I wonder if the northerners take pride in being called parasites.... they should cultivate whatever they have to sustain themselves. Who knows they may even be more successful than the ND.

Then don't dress up your proposal as an economic miracle or break through. The problems that deprive Nigeria from enjoying the natural wealth of the Niger Delta would still plague a regional govt. The lack of accountability to show how the resources was expended. It's not a Northern problem or Southwest problem.

Trying to solve issues of corruption with tribalism is merely side stepping the issue.

Besides oil and gas require huge capital outlays to extract the resource. Merely having it in the ground is useless.
