Some stakeholders of the All Progressives Congress in Ahoada East Local Government Area of Rivers State have insisted that the ultimatum given to the Minister of Transportation, Rotimi Amaechi and Senator Magnus Abe to reconcile within three months or face drastic actions still stands. Leader of the stakeholders, Ibiso Nwuche, said this while addressing journalists in Port Harcourt on Tuesday. Nwuche said the group was neither taking sides with Amaechi nor the Abe camp but was interested in seeing an end to the crisis in the party. Recall that some members of the party loyal to Amaechi had attacked Nwuche over his comments, saying he did not speak for the APC in the state. But Nwuche, a former member of the Rivers State House of Assembly, said the reactions were expected. He called on the two political leaders to heed the call, saying if they failed to do so, they would be held responsible for any misfortune that befalls the party ahead of the 2023 general elections. He said, “The reactions to our position on the ultimatum given to Rotimi Amaechi and Magnus Abe are expected, including from sponsored personal aides. “But I pray the Minister of Transportation and Magnus Abe heed our call to reconcile or they and those who continue to support them would have themselves to blame for the misfortune that shall further befall the Rivers APC towards 2023.” Speaking on Amaechi’s zoning of the governorship ticket to the riverine area, Nwuche wondered how an individual could contemplate zoning elective position in the party that has no structures in the state. He added, “On the issue of zoning of the governorship ticket of the APC as declared by the Minister of Transportation, in my opinion, that is neither here nor there. “How can any individual contemplate zoning an elective position in a party that is without state structures and riddled with factions?”

Emmanuel Addeh in Abuja A chieftain of the All Progressives Congress (APC) and former senator representing Rivers South-east, Senator Magnus Abe, yesterday raised the alarm that the party in the state was clearly heading for imminent danger due to impunity and clear disregard for political realities. Abe, who was responding to claims by Senator Andrew Uchendu who belongs to a faction of APC in the state loyal to the Minister of Transportation, Mr. Rotimi Amaechi, said it was sad that he (Uchendu) was not seeing the danger befalling the party in the state. Uchendu had mockingly urged Abe to “stop crying” and join hands to rebuild the party in the state. But in a statement he personally signed, Abe, a board member of the Nigerian National Petroleum Corporation (NNPC), told Uchendu that he could not continue to keep quiet when the party was clearly heading for imminent danger. He posited that as an experienced politician, Uchendu should know that Rivers APC was being run with impunity in clear disregard for political and historical realities, a development he said poses serious risks to the party. However, he argued that the senator would rather lie and pretend that all is well to please the powers that be, instead of speaking up like he (Abe) is doing. He alleged that after spending 12 years in the House of Representatives, Uchendu stood before the people of Etche at a public rally to promise the people that he would only run for Senate once, and support the people of Etche. “When the next time came around, Uchendu shamelessly snatched the party ticket under the nose of the same people and told them that he was ordered by the party to go back to the senate. He could not tell the party, of which he claimed to be a leader that it was unfair, unjust and indeed dishonourable to lie publicly to the people of Etche. “Chief Uchendu was at a meeting, with myself and others when we agreed in 2015 that our governorship ticket in the APC would go to the Rivers South-east Senatorial District as the only senatorial district in the state that is yet to produce a chief executive in Rivers State,” Abe maintained. He insisted that if the senator could not keep his word to the Etche people, he could not keep his commitment before his own family, and wondered how he can then tell the truth about zoning in the APC. “Where was Chief Uchendu when the minister unilaterally changed the agreed zoning from Rivers South-east senatorial district, to riverine and upland in order to bring in his friend and partner who was a total stranger to the politics of Rivers State?. “If he had the courage to cry out in any of these circumstances perhaps things would be different today in the APC,” Abe stated. He alleged that just as Uchendu could not speak up for the people of Etche, he also could not speak up for the party and therefore failed the test of leadership, noting that ultimately the truth will triumph over deceit. He vowed to continue to speak the truth, saying that Uchendu’s failure and manifest inability to behave as a father and a leader is at the heart of the crisis that continues to bedevil the APC in Rivers state. He insisted the members of the party have not been allowed to participate or benefit from the party in the state since the leader declared in Uchendu’s presence have been told that they were no longer members of the party, contrary to the constitution of the party. “When they paid for forms to participate in the party congresses, they were summarily excluded by the minister of transportation for supporting Senator Abe, and Senator Uchendu could not open his mouth as a leader to say it was wrong. “These are the people that Uchendu expects to go and revalidate their membership as part of the circus now going on in the APC in Rivers state. What has Uchendu done as a leader to assure them that things will be different this time around?,” he queried. He explained that he had not revalidated his membership of the APC because he would like to receive clear and unambiguous assurances from the party that himself and his supporters would be treated differently this time around. “The choice is open to us all. The All Progressives Congress (APC) in Ahoada Local Government Area of Rivers State has issued a three-month ultimatum to the Minister of Transportation, Rotimi Amaechi; and Senator Magnus Abe to resolve their differences or face sanctions. This was contained in a statement issued on Monday, by the leader of the APC Chapter, Ibiso Nwuche after an extra-ordinary meeting of the party held in Ahoada East Local Government Area of the state. Nwuche said the ultimatum was due to the failure of the APC leadership in the state to resolve the crisis rocking the party. “Having not had any benefit from the party due to failed leadership from the state and the grassroots levels in Ahoada East, we resolved and gave them (Amaechi and Abe), till July this year to reconcile themselves at the top and move the party forward before we take next action,” Nwuche said. A statement by Amaechi directing the riverine part of the state to prepare and produce the APC governorship candidate to take over power in 2023 was his personal opinion, the APC leader also explained. Former Senator Magnus Abe has chastised Rotimi Amaechi, the Minister of Transportation, for agreeing to zone the All Progressives Congress (APC) governorship ticket to the state’s riverine region. It was announced that during a meeting with party supporters in Ogu-bolo, Amaechi urged residents of the state’s riverine region to prepare for the zoning of the governorship ticket to the region. Abe responded by disagreeing with the minister’s comment, claiming that it was too early to speculate about which zone would produce the party’s next governorship candidate. In a speech to his supporters in Port Harcourt on Tuesday, Abe argued that the APC had yet to develop its administrative structures, claiming that no single person could impose or zone governorship ticket for the party. “When the minister of transportation arrived in Khana, he made a strong impression. He said that every member of the party would be involved in the decision-making process. Last week, the same minister was in Ogu bolo, where he announced that the party’s governorship candidate will hail from the state’s riverine region. I’d like to point out that the minister’s Ogu bolo zoning remark was his own opinion. “As a person, he cannot choose the region or zone from which the party’s governorship candidate will emerge. Senator Magnus Ngei has slated it clear that nobody has the power to pick up a mic to zone to unzone and unzone to zone the governorship of Rivers State. The people that are being zoned in must understand why they are being zoned in, and the people who are being zoned out must understand why they are being zoned out. If you just stand, carry a microphone and begin to zone to “unzone”, and “unzone” to zone, everybody knows what you are doing, and I want to stand here and say that it will not work. If that was an attempt to set the riverine people against the rest of the state, I want to stand here to say that the riverine people I know are smarter than those who are trying to use them. It is a poisoned chalice. It is a Greek gift. It will get you nothing, because it is not well intended, and it is not well intentioned. The mind is behind every action of man. Once the mind of somebody who is giving you something is not clear, whatever you are being given you know that it will not be good for you. Don’t take it. No tribe, no group in Rivers State can produce a Governor without the support and cooperation of others, without consultation with other groups in the state. No one individual has that power. And definitely, the former Governor of Rivers State, Rt Hon Chibuike Rotimi Amaechi does not have that power as far as Rivers State is concerned. We have to be very factual and honest with one another. Without honesty, we cannot make progress. Without respect for one another we cannot make progress. How can anybody get up, in a party where we are to do registration, we have not even concluded the registration, we have not chosen one ward chairman, we have not chosen one ward ex-officio, we have not chosen a local government chairman, we have not elected a chairman of the party in the state, and even before we do any of that, somebody has come out to zone governorship of the party. Is that a sensible political action? Will it help the APC to win in Rivers State? It is an action that is doomed to lead to another round of failure, and we should not allow it. To that extent, let me say it here, loud and clear, what the Minister expressed in OGU-Bolo, singlehandedly zoning the governorship of Rivers State 2023, is his personal opinion, he does not speak for all of us in the APC

THE SUPREME COURT JUDGMENTS ON THE APC RIVERS STATE CRISES: OUR POSITION On Friday, March 05, 2021, the Supreme Court of Nigeria handed down a series of judgments on the lingering crises in the Rivers State chapter of the All Progressives Congress, the APC. Their Lordships, in their judgments, held that the matters should not have been litigated in the first place but ought to have been resolved by the Leadership of the party, political parties being voluntary associations. As law-abiding citizens with faith in our country, its Constitution and its Institution, especially as Nigeria’s Final Court, we accept the judgments of the Supreme Court in good faith. The Court, by the judgments, sustained the Isaac Ogbobula Caretaker Executive Committee as the Executive Committee of the party in the State. We congratulate Barr. Ogbobula and his team and advise all our members with conflicting claims to any alternative structures, within the APC in the State to immediately drop all such claims and all alternate party offices in the name of APC across the State should revert to private use. We extend our hand of fellowship to the Barr. Ogbobula’s EXCO and we wish them well. However it is important for Nigerians and the leadership of the All Progressives Congress (APC), to remember, well and truly, that the crisis that engulfed the party was never about party structure which was actually not in dispute. It was rather, about the treatment meted out to party members who felt betrayed when the very reason for which they voluntarily joined the party in pursuit of justice, fairness and respect for their rights, were dismissed, with impunity, by the leadership. Party members, you will all recall, who paid monies for forms were not only denied their rights to participate in the congresses contrary to the Constitution of the party and for which they parted with their monies for the forms, but were tear-gassed, and summarily excluded from all party activities and denied every privilege of membership. It was this exclusion and this treatment that led to the emergence of alternative structures within the party. The battle to establish their rights and have the APC to acknowledge its wrong-doing, led to the crises and to the Courts. The party, as all of us know, paid dearly, almost fatally, for this indiscretion. The rest, as they say, is history. We agree with the Learned Justices that those issues cannot be finally and effectively resolved by the Courts for, the Courts, themselves, several times, pronounced on them, condemned the actions of the party, and acknowledged the injustice meted out to the members contrary to the Party’s own Rules and Norms. Indeed, all Courts in this Country, from the High Court to the Court of Appeal and the Supreme Court, itself, pronounced on these issues, condemned them, yet every pronouncements of the Court ended in frustration as the party, to this day, has never acknowledged any wrong-doing neither has the summary exclusion and expulsion of party members been addressed. Indeed, the millions of Naria collected from the party members for the forms which were never issued to them after collecting their monies, remain with the party till this day. While the Friday, March 05, 2021 pronouncements of the Supreme Court are now viewed, rightly, as conclusive on the issue of Party Structure, earlier pronouncements by the Courts, including the Supreme Court, have equally resolved, long before now, the originating issues of mistreatment of members with underhand tactics. It is for the party to possess the humility and political will to address these originating issues. In the coming days and weeks, we will carefully watch the statements and actions and utterances of the party as it is the resolution of these issues that will bring lasting peace to the party and restore its standing, not only amongst its members, but also in the eyes of the Justice-loving Nigerian public especially Rivers men and women. Finally, I want to thank members of the party who have been resolute in their demand for justice, fairness, and internal democracy within the party. It is clear that there are other political options to achieving our desires. Let us remain united and open-minded. We are politicians. We are politicians. We are not against anyone but we must remain committed to our ideals. Time and History are on our side. You have fought a valiant, dogged battle for justice. Your sacrifice will not be in vain. I urge you all to ignore the hatred and theatrics you see on social media. It is part of modern politics. The part, loss of the legal option is not a repudiation of your rights but a recognition of the reality which we all now know: that the party should treat its members with dignity and respect and according to its Constitution and Norms. We will do all we legitimately can to focus on working politically to ensure that our values are reflected across the political landscape. After 6 years of internal crisis, the Supreme Court has cleared all the hurdles hampering the progress of the All Progressives Congress (APC) in Rivers State. By Clever Advertising The apex Court after years of painstaking litigation between two factions of the APC led by the Minister of Transportation, Rotimi Amaechi and Senator Magnus Abe respectively resolved that the party and her decisions are supreme. Consequently, the Court in a judgement read by Amina Adamu Augie, JSC, upheld the ruling of the Appeal Court and declared Isaac Abbot-Ogbogbula, Chairman of the APC in Rivers State following his appointment by the National leadership of the party. Justice Augie on Igo Aguma v All Progressives Congress & 2 Ors (SC.17/2021) resolved that the decision of the trial court presided over by Justice George Omereji (rtd) of the Rivers State High Court was out of place because the court lacked the jurisdiction to hear the matter. “A political party is Supreme over its own affairs. The Appeal is meritorious. Onuoha v. Okafor; A party is like a club with voluntary membership to be so bound by its own rules. The issue of leadership is an internal domestic affair and the jurisdiction of the Court is ousted. The subject matter of the Appeal is not justifiable. The Cross Appeal is struck out,” the court declared. On the suit by Dele Moses & Others, the court said the matter was not heard on its merit. On Monday An All Progressives Congress Chieftain, Chukwuemeka Eze, has said that those contemplating peace moves with Magnus Abe and Igo Aguma are enemies of the Minister of Transport, Chibuike Rotimi Amaechi. He has asked such persons to reconsider their decisions of intervening. Former Senator Abe and Igo Aguma have been at loggerheads with Rotimi Amaechi over the control of the soul of the All Progressive Congress, APC, in Rivers State. In a statement made available to newsmen, Eze said he called for a rethink because such moves would not produce positive results as the former lawmaker is allegedly a mere messenger working for powerful overlords. The ex-PDP national spokesman said negotiating with the overlords would be far easier to get a better outcome. Eze, a close associate of the Transportation Minister, suggested that every negotiation be directed towards the overlords and not to Abe who acts only at the master’s command. According to the Party Chieftain, “this struggle has gone beyond Abe and his cohorts as they are just mere pawns in the hands of very powerful internal and external forces, so those who are contemplating any peace move with Abe should rather have a rethink as the former lawmaker is but a mere fief working for a powerful overlord”. “All efforts made by both Amaechi and the party to appease Abe since 2015 even till now have proved abortive as he is hell-bent to ensure that APC doesn’t exist in Rivers State in obedience to those sponsoring him. On Wednesday the Supreme Court has fixed March 5 for judgment in a suit filed by the All Progressives Congress (APC) challenging the ruling of the lower court in favour of Mr Dele Moses and ten others. Justice Amina Augie, who led a five-member panel of justices fixed the date after listening to counsels’ arguments in the matter. Recall that on December 20, 2020, a Rivers High Court ruled that those who bought forms during the 2018 Congresses but were denied participation rights should be incorporated in any new Congress of the party without them paying for new forms. The ruling was delivered by Justice George Omereji in the suit filed by some Chieftains of the All Progressive Congress APC, Dele Moses and nine others, against the party and its National Chairman, Adams Oshiomhole. Moses and nine others had prayed the court to order APC not to sell ward, Local Government and State Congresses nomination forms but should declare them the authentic party members which they claimed were the decision of the supreme court in the matter instituted by one Ibrahim Umar and twenty-two others. “Should Rivers APC attempt to conduct a Congress, both Dele Moses and nine others and Rivers APC have equal rights to partake, and none should buy any fresh forms,” he said. The court, however, denied their prayers requesting to be declared authentic members of APC and to be entitled to own the leadership of Rivers APC.

On Tuesday the Appeal Court sitting in Port Harcourt has reserved judgment on a day to be communicated to parties on five appeals brought by the All Progressives Congress in Rivers State against five sets of respondents in different suits. The Appeals reserved for judgment include one by the APC against Emma Deeyah and four others, another against Bariaye Normagin and five others and another appeal by the APC against Sunday Hokkins and four others, APC against Nna Okpara-Egburuka and Gilbert Kilsi as well as APC and Victor Giadom’s appeal against Chiduo Ogbonna, Igo Aguma and two others. The three-man appeal panel led by Justice H.S Tzammani reserved judgment after parties adopted their written address and brief of argument on preliminary objections and substantive matters. Meanwhile, the court could not grant a stay of execution of the order by a lower court as sought by the APC on the appeal against Nna Okpara-Egburuka and Gilbert Kilsi, following a motion brought by counsel to the respondents challenging the Jurisdiction of the court to hear the suit. The three-man panel said they will rule on the issue of stay of execution alongside the other matter on a date to be communicated to parties.

Members of the faction of All Progressives Congress, APC, in Rivers loyal to Rotimi Amaechi, the Minister of Transportation have applauded the Supreme Court for throwing out the case filed by Igo Aguma over the Chairmanship of the party’s Caretaker Committee in the state. Aguma, a is a member of a faction of the party loyal to Senator Magnus Abe had challenged the appointment of Isaac Abott Ogbobula, a member of the Amaechi faction as the Caretaker Committee of Rivers APC by the National Secretariat of the party. Reacting to the judgment, spokesman of Amaechi’s faction of the party, Chief Ogbonna Nwuke said the ruling of the apex court has shown that the Abe faction of the party did not have any basis for laying claim to the chairmanship of the party in the first place. “The truth has come to light. The truth is that Hon Igo Aguma did not have the locus standi to declare himself as Chairman. It also demonstrates that the presiding Judge who planted Igo Aguma as Chairman of the Caretaker Committee erred in law in reaching that decision. Nwuke also said with the ruling of the apex court, an end has come to Aguma’s reliance on manipulation of the law in his quest for power with the judgment. “We have always known that Igo Aguma and his co-travelers were out to waste the time of the court. “We are glad that the Supreme Court has seen through the antics of the Pro-Abe group and accordingly thrown out the matter. “The APC National Secretariat acted well within its powers when it appointed the Caretaker Committee headed by Isaac Abott Ogbobula. “It is now clear to all that the Port Harcourt High Court presided over by Justice George Omereji, (now retired), erred in law when it introduced a meddlesome interloper in the person of Hon. Igo Aguma as the Caretaker Committee Chairman of the Rivers APC in total disregard of the provisions of the party’s Constitution which bestows that right exclusively on the National Secretariat. “We hope that Hon. Golden Ben Chioma who is masquerading as a chairman or acting chairman would get the message. He came with Igo Aguma. He should quietly pack up his bags and leave now that the head of the hydra-headed snake has been cut off. “On the whole, it is a bright new day for the Rivers APC and a positive indication that better days are coming”, the statement concluded. However, Livingstone Wechie, the media adviser to Aguma, said what happened at the apex court was that the request of his boss to withdraw his earliest appeal on the grounds that it has become statute barred being a pre-election matter was granted. He noted that the lawyer to the appellant had two motions. The first of the two being a motion on notice seeking a stay of further proceedings at the lower Court filed on July 15, 2020 and the second was a motion seeking to serve the first respondent by means of substituted service. The All Progressives Congress (APC) Caretaker Committee (CTC) Chairman in Rivers, Mr Isaac Ogbobula, has said the party will not participate in the forthcoming local government council elections in the state. Ogbobula, in an interview with the News Agency of Nigeria (NAN) on Saturday in Port Harcourt, alleged that the “electoral process is faulty’’. He further alleged that the constitution of the membership of the Rivers Independent Electoral Commission (RSIEC) was faulty because some of the members were card-carrying members of the Peoples Democratic Party (PDP). “The electoral process is already faulty with the constitution of the commission’s membership, so they cannot conduct a free and fair local government council elections. “We decided that as a party that we are not going to contest to give credit to an illegitimate process, and we have the backing of the national secretariat of our party,’’ Ogbobula said. He urged APC members in Rivers to ignore statements and actions of “some persons without the power and authority to participate in the elections’’. “I call on our party members to continue to go about their activities without bothering whether anybody wants to give the impression that they are going to partake in the elections,’’ he added. According to him, the APC in Rivers is focused on sensitising and mobilising its members for the forthcoming membership revalidation and registration of new members. “We have a court judgment backing us to carry out the exercise and our interest is to have a hitch-free and successful exercise in the state. “There is no court order stopping All Progressives Congress in Rivers from participating in the party’s membership registration and revalidation,’’ he stated. Ogbobula urged APC members and intending members to participate in the exercise in preparation for the 2023 general elections.

Says It’s The Same Pattern Of Violence Waged Against Wike In 2015 Lamenting that Amaechi and his followers were not using federal forces with reckless abandon, Abe in the statement alleged that youths led by an associate of Hon Ojukaye Amachree, an acolyte of the Minister of Transportation, Rt. Hon. Rotimi Amaechi invaded the venue of a peaceful gathering of APC members in Buguma City with dangerous weapons, inflicting serious injuries on several persons including women. The statement reads in parts: “The Rivers State version of Federal might was yesterday visited on Hon. Ben Horsfall and some members of the APC in Buguma City. This is ominous beginning to the new year in Rivers State and a clear sign of what is ahead for Rivers People. Nigerians will do well to remember that it was the same Hon. Ben Horsfall who risked life and limb and physically served the court papers of the now-famous case of Amaechi Vs. INEC on the then sitting Governor of Rivers State, Sir Celestine Omehia. It was Hon. Ben Horsfall’s courage and his conviction to disagree with the powers that be at that time, that made the case possible. Ben Horsfall was never assaulted, attacked, or brutalized for his open confrontation with then Governor Omehia. Today, for daring to hold a different view from Amaechi, but for the grace of God, Hon Ben Horsfall, himself and several others could have died. Nigerians will do well to remember that the political violence that engulfed Rivers State and claimed so many lives before the 2015 elections actually started with attacks on supporters of the Grassroots Democratic Initiative, then led by the Minister of State for Education, Barrister Nyesom Wike. Nigerians will also recollect that the first place the GDI peacefully held a rally in Rivers State was in Gokana Local Government Area (my home local government), because I flatly refused despite orders from above to allow violence on Rivers people of any political persuasion. When the response to violence came, the originators and original sponsors were the ones now holding rallies and demonstrations to call attention to escalating violence in Rivers State. Amaechi’s Group Warns No More Mercy For Abe’s ‘Hydra-Headed Snakes’ At the end of the day, the recourse violence did not alter the result of the contest. We are treading the same path once again, from the violence visited on party members at Old Party Secretariat, to attack on the State Judiciary, the attack on the State Party Secretariat at Waterlines Junction, and yesterday’s attack on Rivers people in Asari Toru Local Government Area; the temptation and the belief of the Minister and his supporters that violence offers a short cut to the resolution of the situation in the party has become evident. I have been restrained in my reactions, in the belief that we cannot all lose our heads at the same time, but the lack of effective response to these issues by the security agencies, is leading these criminals and their sponsors to the conclusion that they are above the law, and now becoming emboldened and unrestrained. Noting that security agents do not bother with the supporters of the minister who are on the loose in Rivers, he said: When the security agencies allow political crime to reign unchallenged, they should not be surprised when violent crime ravages the society; for these politically protected, and privileged criminals are the same ones tormenting our society today because they can act with impunity and are being protected for their political roles. A stitch in time they say saves nine. The matter, (like the previous cases before it) has again been reported to the security agencies who were actually witnesses to the event. This is a test case for Rivers State ahead of 2023. The political issues in the APC in Rivers State cannot be resolved by violence. Even if we succeed in killing one another, will that bring peace to the party? Will that endear the party to the majority of Rivers people? All leaders of Rivers State must stand up in clear condemnation of the resort to violence, for at the end of the day anyone can become a victim when violence reigns. The response of the security agencies must be swift, effective and definitive, to avoid another era of political bloodletting in Rivers politics.
