A renowned lawyer and senior advocate of Nigeria Femi Falana have condemned President Muhammadu Buhari for not disclosed the status of his health condition to Nigeria.

Falana said Nigerians have the right to know the health status of a sitting president.

Speaking on a Channel television’s programme, Falana said even if the law does not mandate the president to make such disclosures, Nigerians deserve to know his health status.

“Under the Freedom of Information Act, the right to health is supposed to be shrouded in secrecy but I am saying now that henceforth, this situation calls for a review of the law so that we won’t be left guessing next time,” Falana said.

“We are talking of the President. Many state governors go in and out of the country, some for a month or two, some for three months without anybody asking any question and without any handover to their deputies,” he said.

The senior lawyer said the system has been structured in a manner that a public office holder does not have to be secretive about issues concerning him.

Falana said: “But I am saying that with what we are going through now, we must come to appreciate that if you are going into public office, you have no secrecy.”

“It is our duty and right and the President took cognizance of that last year when he disclosed to Nigerians what he was going abroad for. This year should not be an exception.

“This is what has given room to a lot of rumours and speculation which are totally uncalled for,” he said.

President Muhammadu Buhari had written to the Senate to extend his initial 10-days’ vacation.

However, the president’s letter has raised controversies with Nigerians calling for a total disclosure of the Buhari present health status

Meanwhile, the vice president Yemi Osinbajo has assumed duty as the acting president of Nigeria.

ABUJA – The Save Nigeria Group, SNG, Tuesday, issued a 74 hours ultimatum within to the the presidency to furnish it with full information on the health situation of President Muhammadu Buhari, who is currently believe to be receiving medical attention in London.

The SNG, which made the request via a letter, entitled “Request for information on President Muhammadu Buhari’s health status” and addressed to the Attorney General and Minister of Justice, Abubakar Malami, urged to be availed information urgently in order to reduce tension on state of Mr. President’s health.

According to the letter containing the request which was acknowledged to have been received on February 7, 2017 by the office of the Attorney General and Minister of Justice and made available to Vanguard in Abuja, the group warned that it will take all other necessary legitimate and legal steps should the authorities ignore the request.


According to the letter signed by Barrister Benedict Ezeagu, the National Coordinator, SNG, “This ugly development, including denial, conditional admission and restriction of access to President Buhari and the true information on his health status is reminiscence of the late President Yar’Adua’s incident which our revered organisation was at the forefront of its peaceful resolution and this is not good for Nigeria at this critical period of economic downturn , nationwide insecurity, and political strife.

“As you may know, the lack of clearness in handling the ‘vacation’ turned ‘medical trip’ of Mr. President has heightened the rumours and speculations about his health, the most frightening of which is that President Muhammadu Buhari had passed on or he has been in coma or on life-supporting machine, and thus increasing the political tension in the country.

“Since Mr. President is not a private citizen but a public servant whose health bills are currently being paid from the country’s treasury, Nigerians deserves the right to know the true state of his health as obtainable in enlightened republics.

“In the light of the foregoing Sir, while we join other Nigerians to pray for Mr. President in line with the request of the Presidency, we herby demand for full information on the health status of President Muhammadu Buhari in exercise of the rights granted us by section 39 of the Constitution of the Federal Republic of Nigeria as amended, the freedom of information Act and Article 9 of African charter on Human and people’s rights, as this will help dispel these rumours and speculations and reduce the current political tension in the country.

“Please sir, take notice that if we are not availed of the requested information within 74 hours of your receipt of this letter, we will have no alternative than to take all other necessary legitimate and legal steps, including approaching the National Assembly to activate relevant sections of the Constitution with regard to the health of a Nigerian president as well as institute court actions and organise peaceful protests among others, to ensure that we are availed of these rights guaranteed Nigerians by the laws.

The Indigenous People of Biafra (IPOB) has recognized a European Union Parliament member as its trusted advocate.

The IPOB said Julie Ward has made remarkable efforts to speak against injustice and dehumanization against the group, its leadership and members.

A statement signed by IPOB’s spokesperson Powerful Emma, the group called on all its members worldwide to show appreciation to the EU parliament member.

“We salute the courage of Julie Ward [MEP] for her stance and the defence of human rights of Biafrans as she remains our trusted advocate at the European Parliament as the EU once again answers an urgent question on the continued human rights abuses meted out on our leader Nnamdi Kanu and all our brothers being incarcerated with him and in the different secret cells in the contraption called Nigeria,” Emma said.

Emma added: “Biafrans, please go to the twitter platform and show appreciation to MP Julie Ward [MEP] @julie4nw and able assistant, Eleanor Quinn for their resilience and kindness.”

On behalf of the IPOB, Emma commended Ward, her assistant and other members of the parliament for their resilience in seeking answers from the European Union on the detention of Nnamdi Kanu and other members of the group.

Subject: VP/HR - Unlawful detention of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), and continued violence against Biafran supporters by the Nigerian Government

Since 14 October 2015, Nnamdi Kanu has been illegally held in prison by the Nigerian Government, despite being acquitted of all charges.

In addition, the Nigerian Government is reportedly violating the human rights of Biafran activists. Amnesty International has documented cases of arrest, enforced disappearance, torture and killing of supporters.

1. Will the VP/HR advocate for the immediate and unconditional release of Nnamdi Kanu and co-defendants Benjamin Madubugwu and David Nwawuisi, and challenge the actions of the Nigerian Government?

2. Will the VP/HR denounce the violence carried out against Biafran supporters by Nigerian security forces and call for an impartial investigation into the arrest, enforced disappearance, torture and killing of supporters and members of pro-Biafran groups?

The European Union (EU) is concerned about the violence that has erupted in relation to the Biafra movement.

The EU follows closely the fate of Nwannekaenyi “Nnamdi” Kenny Okwu Kanu, Benjamin Madubugwu and David Nwawuisi since their arrest in October 2015 and, more broadly, pays close attention to the treatment of the pro-Biafra movement by Nigerian authorities.

The EU supports individuals' right to protest and express them freely, as long as this right is exercised in a peaceful manner. Potential prosecutions should also be carried out in a manner compatible with the rule of law.

The EU raises human rights issues at every opportunity with the Nigerian authorities, to encourage them to respect human rights, and to improve the rule of law. This issue will be on the agenda of the next EU – Nigeria Ministerial Dialogue due to take place in Abuja this spring.

In the implementation of the European Development Fund, the Commission is also engaged in building capacities to enable Nigeria to fulfil its human rights commitments, as “rule of law, governance and democracy” is one of the three sectors of concentration of the National Indicative Programme for Nigeria.

Governor Ayodele Fayose of Ekiti state and chairman of the Peoples Democratic Party (PDP) Governors’ Forum, has said the police cannot stop the planned protest by Nigerian singer, Innocent Idibia, better known as 2Baba.

2Baba is planning a massive protest against the government of President Muhammadu Buhari on February 6 following the harsh economic reality that has gripped the country.

The police had said it would scuttle the protest in Lagos state, but Fayose said apart from section 40 of the 1999 constitution, which provided that every person shall be entitled to assemble freely and associate with other persons, the Court of Appeal already affirmed that protests or gatherings do not require police permit or interference.

The governor described the claim by the Lagos state police commissioner, Fatai Owoseni, that criminals might hijack the process as puerile.

He added: “The duty of the police to secure Nigerians is mandatory, and not optional. Therefore, if there is any intelligence report suggesting the possibility of criminals hijacking the process, it is the duty of the police to provide security cover for the protesters."

The governor, in a statement issued by his special assistant on public communications and new media, Lere Olayinka, noted that the APC-led federal government must be made to understand that “leadership is about accountability. To be accountable, leaders must listen to public opinion either by civil or peaceful protest.

“Court of Appeal affirmed in its judgement in Inspector General of Police Vs All Nigerians Peoples Party that protest or gathering do not require police permit or interference as obtainable in advanced democracy.

“Most importantly, the protest is said to be for and about good governance. So who is afraid of the protest? Who does the police represents or is representing in this issue?"

While justifying the protest, Fayose said “Nigerians are hungry and angry, our currency is now above N500 to $1.

"If Nigerians want to show their anger, no one should prevent them. Nepotism, extra judicial killings, disobedience to court order and human rights abuses must stop.

“The conscience is an open wound and the guilty is afraid. If the APC-led federal government is now acting as if the protest is against it, it means the federal government has accepted to be guilty as charged.

“Like I said before, I support the protest.”
