Simply put constructive dismissal is the changing of an employee's job or working conditions with the aim of forcing their resignation. It is resignation because of the employer creating a hostile work environment. Since the resignation was not truly voluntary, it is in fact, a termination. An example of constructive dismissal might be a situation where an employer forces a senior officer to take instructions from his juniors (where the senior officer is clearly more experienced and competent) or any such other related actions in an attempt to frustrate the employee to the point of resignation. Employers might wish to know that the concept of constructive dismissal, though not often heard of in Nigerian labour and employment issues is no longer alien to this clime. This is especially as the third alteration to the 1999 constitution empowers the National Industrial Court of Nigeria (“NICN”) to apply international best practices in labour in arriving at its decision. Also, noteworthy in this regard is the provision of section 19(d) of the NICN Act (2006) which provides that: “The court may in all other cases and where appropriate make any order including; an award of compensation or damages in any circumstance contemplated by this Act or any other Act of the National Assembly dealing with any matter that the court has jurisdiction to hear”. In Miss Ebere Ukoji v. Standard Alliance Life Assurance Co. Ltd [2014] 47 NLLR (Pt. 154) 531 NIC, the court held that to attempt to have the employee resign, rather than outright firing the employee means that the employer is trying to create a constructive discharge.[ii] Generally, an employee bringing a claim of constructive dismissal must (1) show that his employer created a hostile work environment in a bid to get him to resign; and (2) that the hostile work environment led to his resignation. Jombojombo:Bros nor vex, this is one area APC has truely succeeded. At least they took 3 million jobs from the formal sector into the informal sector such as kidnapping, agbero, Buhari Media Team, Masquerading ( this got a chunk of the jobs) you can ask your minister for information and communication if you think I am lying. They have tried , it's just that they work anti clockwise. |
Kindly help my wife with a job in any fashion making outfit around the mainland. Mainly ikeja, ogba and agege environs. She just has this passion for dress making and I am proud to say she is good at what she does. She designed 95% of all native attire in my wardrobe. She eats, breaths, sleeps and thinks fashion . I feel I should give her all the support I can, by encouraging her passion regardless of what my friends will think or say. Thanks. |
Bombshell from Bro. Gbile Akanni, read with an open heart and the Lord shall ignite a fire of discontentment in you. *MESSAGE TO MINISTERS OF THE GOSPEL* *IF WE ARE DEPENDING ON THIS BABYLONIAN TRANSACTIONS GOING ON ON OUR PULPITS TODAY, IT MEANS THAT BEFORE OUR EYES , WE WILL LOSE AFRICA TO ISLAM IN OUR TIME...* In one of the Assemblies of God churches, in Aba District, where my late dad pastored in the 1980s, I remember when a young man came very early in the morning and told my father: "Pastor, what did I do to you? Why do you hate me so much? I have been born again for almost 1 year and I have won many people to Christ, but why have you not recommended me to join others to go for missions work in the northern States of the country... " His singlet was torn... And with his zeal, he was crying profusely... My father did not know what to say... The young man kept crying:" Pastor, why are you doing this to me... Why are you doing this to me? " My father told him: "Nna, I know very well that you want to serve God... But you are the only son of your mother and your father is late... If anything happens to you, who will look after your mother and younger ones?... The boy started crying the more... "Pastor, I am the only son and yet I was an arm robber... I am the only son, yet, I was attending meetings in the midnight with native doctors, where many of friends could not wake up alive after diabolically fortifying ourselves against police bullets... " " Pastor, what would have happened to my mother if I had died in one of those armed robbery attacks? Who would have taken care of her? If I risked my life when I was serving Satan, why will I not risk it now that I am serving Jesus Christ? " My father was speechless for almost 30minutes... And it was not long, we saw tears rolling down his eyes... He held the young man and both of them were crying together... How can I forget such scenes that God allowed to play out before my eyes? ... My father recommended him to join some missionaries that came in the area for missions work... The day he was leaving with them, the mother and his younger ones were crying... Knowing that they might not see him again, both live or dead... But I can still remember that excitement on his face... Lord, how can I forget? Brother, let us go to our Bible schools and listen to the conversation of those young men and women who have joined ministry and you will know that many of them have no single passion for the lost... They are just getting ready to rent halls in the city where they will be rolling out posters and handbills, laying greedy hands on people, collecting offering and tithe... That's all in their hearts... Congratulations for your big auditorium... I am happy for your 10th time services... But if heaven cannot find such men in your church,... Young men and women who will say: "Lets go to that village and tell them that Jesus is no more in the grave... Even If we don't have to come back alive... Let it be so..." If you don't have such calibre of members among your congregation, then, sir, with due respect, it's a big shame! .. This end time agenda has no need of you and your kind! A Muslim suicide bomber doesn't need tithe and offering to carry out a bloody assignment, in defence of his faith ... They don't need adverts or media stunts.. But here, we have young men who are in the pulpit, being driven by tithe, offering and honorarium.... If there is no 5star hotel reservation, they will not honour the invitation to preach ... And yet, they are General Overseers... Overseeing passionless men and women who are like them... Where as, their mates in Islam has burnt their school certificates, refused juicy contracts, abandoned wonderful jobs and everyday they are sleeping in the bush and starving for months, receiving trainings, how to carry out terrorist attacks, all in defence of belief... And we are here looking for churches where they will use convoy to come and pick us up from the airport... And you wonder why people feel like vomiting when they hear them calling you a voice in the land... A voice because you went to a program and stole committed members from your host church and you came back and gave them positions in the choir, sowing different uniforms for them every Sunday... None of them can quote any scripture... They have not gone for evangelism for any day, after many years of following you... All of them were members you stole and now you are using juju to keep them from running away... And they are calling you a voice in the land! ... What a ridicule! What a noise! Brother, if this is the generation that will usher in a move of God in our days, then, those who have not forgotten what they saw in the church in the 80s and 90s must not keep quiet in a time like this... The greatest hindrance of revival in our time is not Islam... The pulpit in our time is the greatest enemy of the expected move of God in our days... If not for the decline of truth on the pulpits in our time, long ago, we would have seen what we saw in the days of our fathers... And now we are blaming Muslim fanatics, who are defending with their lives what they believe in... When else are we going to see young men from our churches, after hearing our messages, getting so angry in the spirit that they make up their minds to convert 10 unbelievers to Christianity every month month? And the next place you will see them will be in camps or mountains, preparing, praying for Power? But how can we hear such when the only thing we teach them is about how to be rich and how to suspect detect enemies? I am tired of hearing testimonies of miracle jobs some of our ladies slept with company directors to get... I am tired of seeing car dedications my brothers used fraudulent businesses to buy... When are we going to start dedicating converted souls on our Sunday mornings? Lord, where are all the men that saw what we saw in the days of our fathers? This is not the time to keep quiet... This is not the time to care about who likes or hates you... If there is a time to beg for pulpit, soldier, it is not in a time like this! No pulpit hosted John the Baptist... They preached against him... That He was old fashioned... And that he was envying them who were running 10 times services... That because he doesn't get any like or comment on his Facebook wall, that he is jealous of them that have huge online followership... That because he is not anointed and that is why nobody was hosting him in their churches... But brother, when his time came and he began to roar from the wilderness, those demonic General Overseers who were using marine powers to run ministry knew that indeed, in every generation, God has a breed He is preparing ... Yes, they knew that "there was a man sent from God"... Man of God, if you were sent from God, why are you allowing yourself to be influenced by men who were 'sent from Bible schools' ? Some of the men you are competing with in ministry were 'sent from demonic covens in some parts of Africa' ... If we came from God, let us look more for God... He will soon show up... You are almost getting to the time when members of many 'mega' churches will be secretly and openly coming to you, to hear this gospel from your mouth... Because they would have gotten tired of fake testimonies that leaves them powerless and very vulnerable... Men who have not bowed to baal are very few in our days... Men who have not sold out their souls for mammon are rare to find now that we are here... God depends on you for this end time work... Why are you bothered because someone somewhere is calling you names online? ... Churches are everywhere around us, yet, there is a spiritual famine in Africa... The power of the gospel is suffering bankruptcy in our time... This is not the same gospel the apostles preached... Something has happened to the Word of God in our mouths... We are only showing the form of godliness, but hell has hijacked the power thereof... And in our carnality, we are celebrating strange Fires... Polluted Fire! Moribund Fire! But brother, I know that God will never leave Africa this way! If the pulpit has failed, then,, He will bypass us and go down to the pews... And raise people for Himself... If our pews have become so frozen, He will go outside... He will look for drunkards and prostitutes.... He will get hold of witches and wizards... And those arm robbers on the highways, He will Clean them up and fill them up with Himself and use them mightily in this end time... Yes, if those who came out from Bible schools are now using their certificates to raise only funds, God will bypass them and use those who has not gone to Bible schools... This is the most critical time since the world began... Islam is preparing to take over nations,... They are putting funds together which they will use to buy churches and pay their staff off... Brother, in few years from now, if there is no genuine revival, many of our members today would have become Muslims... You will see many pastors who will convert their churches into mosques, for a huge financial reward... That time is not far... Has it not even started? When a pastor is collecting powers to grow his church from a Muslim native doctor, is that not handing over the Fire to the children of the bond woman? The days we are in is terrible... God knows and that is why He is raising an army that will stand to defend the gospel that was handed over to us, even if they have to lose everything for it... That young man came back from the missions field, after a year, and later joined the Bible school... Became a pastor and God used him to win communities for Jesus... Before my eyes, I saw God using him to sack evil spirits out from villages... His name became a terror in that area, to the point that deities began to complain about how his presence in the community had rendered them powerless... Halaluya ! Those are the kind of testimonies we were hearing everyday in the days of our fathers that we want to be hearing again in our time... But alas, here is Ichabod ! Imagine if every church in every community can boast of 10 of such members! Imagine when many of our followers would have gotten broken enough, by God, that they don't mind what they lose again for God's sake... Terrorists will no more be bombing our churches.. Because they would have known that already our churches are filled with people who are ready to die, anytime for the gospel ... You don't have to waste your bomb on a man who is already dead! But, why they will keep threatening to kill us is because they know that we love our cars and landed properties more than the CHRIST we say that died for us... Prophet Mohammed was not killed on the Cross shamefully, yet, they can die for him publicly... What would have happened if their prophet Mohammed was crucified on the cross? But where are the men and women who claims that Jesus died for them? Oh Sister, it is time to take our Christian life to another level.... It is time to get 'fanatical' about this Kingdom thing... Enough of the prayer topics of: "God give me this and do that for me!" This weekend, take your friends to the next Street and preach the gospel... Next week, continue with it... Why are we ashamed to tell people about the Man that conquered the grave? Why can't we preach about the man that created the heaven and the earth?... Mohammed did not do any single miracle, but his followers are dying for him... He did not raise anybody from the dead... He died and that was his end... Yet, they can give everything to spread his belief... How can we be ashamed of Jesus that spoke to the storm and their was peace? He opened the blind eyes... He interrupted funerals and raised the dead back to life... Is He not enough to tell people about? Did He not do enough to make you let everybody that knows you know that you are not ashamed of the gospel? When will you be done with hiding from your friends when you want to speak in tongues, so that they will not laugh at you? Brother, why are you ashamed of identifying with the Man who is the hope of the whole world? As for me, I am done with religion, till I die.. I cannot stand Christianity by church sticker alone any more ... Jesus did not die for you to only be attending choir rehearsals and changing uniforms every Sunday.... I hope God is not looking at you from heaven now and regretting why He did not let those people that died of accident to replace you since you are useless to Him on earth... Many in the hospital now, with few days to live are begging and crying, if God can give them a little more time, that they will preach this gospel under the rain and sun... And they mean it... Brother, you that is healthy, what will God be saying about you when He sees that they are begging you to go to church? The time is early enough to ask God for mercy and for Him to revive His walk in your life. .. God is looking for people that will risk their lives for Him in our time... Let it not be that He is preparing someone who is at the point of death in the hospital bed to come and replace you.... This is scary... But it is a serious matter! Have you not played so much with the opportunities God has given you? How much longer do we have to be in sin for grace to abound? The Holy Spirit is speaking to you now... He is reminding you of your distance from God... Imagine if you had died in your sins yesterday morning... You would have gone to hell, and stay there, from now till the next 2billion years... And yet, that will be just the beginning... Sister, don't be locked out of grace further... Don't postpone any longer the hour of your salvation... Right now, hearken to the voice of mercy ... And where you are sitting is good enough to kneel down and ask God for a revival ... I am very sure that He will clean you up and give you a new.... Lord, let there be revival of true soul winning and genuine christian living In Jesus Mighty Name." Bro Gbile Akanni. |

SURElee:Now your last paragraph makes sense. Marriage is give and take and its about balancing everything. I stand to be corrected if both parties will first communicate, secondly. Listen to each other and lastly take advice from each other and work on it.Marriage will be fun. Parties must be ready to play the fool and timing again matters. If you don't do it when he/she needs it, another will and if and whenever you decide to change your mind, it becomes immaterial cos the deed is already done. |
SURElee:But some don't care jare. I do counselling too. So I know what I am saying. An example I encountered recently. The man loves skimpy shorts when around the house.at least loves her to wear em, make her hair and look sexy the only Saturdays he has to spend at home. But she will have none of it cos she is a senior worker in the church and it is wrong biblically for her to do that. Now let's go outting for weddings, namings and birthdays, she won't cos Sunday's as for church and family while Saturday is for house chores and fellowship. Now he started attending all his functions alone cos he was tired of complaining. He got to a point , he had his secretary go with him to occassions and then the secretary's friend whom he fell for. It took a pastor for the woman to realise her errors but then was it not too late? Let's leave what happened for another day. Hope you now understand my point. In marriage things are different. |
Amberon:There are lots of them just that they don't seem to care and Lagos that cares does not want to lose. If there is a lite speed rail from ota to oshodi/apapa towards island or connecting to the other major rail from badagry to ajah/epe, the problem is Lagos traffic is solved. Cos many people will relocate from yaba, ajao, isolo and environs to mile 2. Even if I work on the island, I see no point paying millions in rent when I could live in ota and from ota to oshodi by rail is 35-50mins. Neither should I live in ajah or lekki and suffer when I can live in a serene and comfortable estate with little less or even owe the building self. Well if the Govt of Oyo and Ogun especially Ogun is ready to benefit from the overflows in Lagos and steal the show in few months , she can but are they ready? |
kimbra:Are you married? Guess if you are and you think the man has flawed values you should think again. You women are quick to change once you have settled down in his house in the name of marriage and then leave him out in the cold. You would check up on him whilst dating him every second, send him dirty pics and videos while he is at work to ensure he comes home immediately after work. Give him everything you know he likes and perhaps he decides to marry you not only out of love but those other perks (side attractions) you display. Like an equivicator, you instill the desire while dating him, only to take away the performance when you become his wife. Not knowing that's when you are supposed to do more to keep him at home. The husband is used to the perks you offer him, it is now a habit for him. You no longer fill that void. Example; while dating him, you clubbed, partied and had wild adventurous sex (romantic) games with him.He enjoyed it just fine and knowing he has a high appetite for sex, decided to marry you. Now you wear wrapper all day, no longer attractive, no so churchy you no longer go out with him to have fun, the sex life is practically dead, once I 3months that if he is lucky to have any at all. And all through the act you lie like a log of wood. Now what exactly is he suppose to do? Become old too or churchy cos you chose to be? Life is just starting for him and don't make him look old. No man is happy to cheat or cheats happily whether emotionally or otherwise. For most men that cheat, there is always a wife that failed in her duties same with women that cheats. |
Any news from sars without proof I take with pinch of salt. Not after the APO 6 and being sent to an early grave unjustly. That guy don't look robber . But God knows best. I rise. |

First , I am a male, in my young 20s , married to the most beautiful woman in the world, I am learned and I travel a lot. My wife on the other hand is still leaving when it comes to my taste and desire for variaties in the kitchen. I know how to cook as I learnt from mum and maybe curiosity has made me take it a little bit farther. Each food I eat or see eating outside, I always steal the recipe and wish to try it at home for her. She knows how to cook local made dish which she grew up with. Saturdays are my days in the kitchen if I like. I have been down for some days and despite her early pregnancy she indeed pampared me and treated me as she would a kid. I am no different from a kid when sick cos I indeed behave like a spoilt kid when sick. Now to the main reason for this, I wish to make egg and crayfish stew with some tomatoes, carrot, diced meat, green bean and fresh pepper with yam chips. My question is this, how do I go about it? Should I boil the yam before frying, and how do I go about making the stew. I don't want her input, in fact I wanna lock my self in the kitchen while at it. Just figured it as my own litttle way of saying thank you. Also smoothie, fresh orange juice or a cup of coffee which of the aforementioned will go with the food for breakfast. Please I need your urgent help breakfast is to be served before 9:30am Saturdays. Thanks |
Brazil’s foreign minister resigns — to prepare for ‘medical treatments’ Jose Serra, Brazil’s foreign minister, has resigned from his post to attend to health-related issues. Serra, in a letter to Brazil President Michel Temer, said he needed to take care of his health and prepare for upcoming medical treatments, CNN reports. The foreign minister expressed sadness over his decision to step down but noted that his doctors told him he would need “at least four months” to adequately recuperate. Serra was said to have personally given Temer the letter which was published by state-run news agency Agencia Brasil. The 74-year-old had only been on the job for less than a year. Serra assumed the role after former president Dilma Rousseff was suspended in May 2016. https://www.thecable.ng/brazils-foreign-minister-resigns-to-prepare-for-medical-treatments |

It's a two way thing boss. Guess you can't have it all. I am married to a woman I tort we but shared same interest but after marriage turns out we no longer do for reasons I can't fantum. You can't always have it all. Sit her down and talk to her. She is the conservative type and that will means he will raise your kids well , while you are busy having your business meetings and away for weeks or months. That I am sure of. No cheating, stress and wahala that comes with it. Relax guess things will eventually work it self out. It's better than marrying a cheat , disrespectful and troublesome woman who won't allow you a moment of peace. If you can leave your woman for months and yet she ain't distracted or tempted to cheat and won't make trouble for you , and she loves God, puts you first and prays for you always . Boss marry her. Only disadvantage is you will remain a married bachelor at times when you guys ain't discussing topics of mutual interest. |

Rolls-Royce reports record loss of £4.6bn A bribery settlement and the fall in the pound have pushed engineering giant Rolls-Royce to a record loss. The jet engine maker reported a loss before tax of £4.6bn for 2016. Earlier this year, the company agreed to pay £671m to settle corruption cases with UK and US authorities. As most aerospace deals are done in dollars it was hit hard by the post-Brexit vote slump in the pound, and it has written off £4.4bn from currency related contracts. Underlying profits, which strip out one-off costs, fell to £813m, down from £1.4bn the previous year, although the fall was much less than many analysts had forecast. Advertisement The company said the outlook for this year was for a "modest performance improvement", while chief executive Warren East said more needed to be done to improve profit margins. It is in the process of carrying out a major cost-cutting drive. "We must ensure our wide ranging business transformation programme delivers the full benefits expected, not only in terms of cost savings but also the cultural and behavioural changes necessary to ensure the transformation is sustained and high standards of business conduct are maintained," said Mr East. "These are essential if we are to become a more trusted, resilient company." Rolls-Royce has apologised "unreservedly" for the corruption cases, which spanned 25 years, and involved illegally using local middlemen and paying bribes to win deals in Indonesia, Thailand, China and Russia. http://www.bbc.com/news/business-38966165?ocid=socialflow_facebook&ns_mchannel=social&ns_campaign=bbcnews&ns_source=facebook

Buhari Down, EFCC Up: Coincidence? NewsRescue It’s gotten quite noticeable that whenever Buhari or his government is “down” the Economic Financial Crimes Commission, EFCC is “up.” Once there are major headlines that cast the Buhari government in bad light, the EFCC takes over the headlines with updates on its activities against the corruption of the Jonathan past administration with predilection for PDP party members, their families and associates who did not switch to the ruling APC party. Initially Nigerians observed that as the dollar rate and economy worsened, quite unrelated to the global oil price which has since recovered to over $50/barrel without the expected parallel recovery of the Naira, the Buhari government directly blamed the Jonathan administration for the tanking of the economy. But as time went by and Nigerians started to comment that it was time the Buhari government accepted its share of blame in the failed policies ruining Nigeria’s economy; with CBN governor Godwin Emefiele’s cabal-enriching forex policies and subsidy established under Buhari as a major focus point, the Buhari government had to stop using the “Blame-Joe” defense/excuse and suddenly this new trend seemed to become the focus. August ending last year, the headlines had it that Nigeria’s economy had fallen into a full recession. September was greeted with the EFCC finding some $31.4 million in accounts of Jonathan aides. Of course it was Patience Jonathan’s money and she came after it, and the EFCC found some more money of hers and on and on, the headlines were inundated with the EFCC-Patience scandal. Interestingly a Vanguard article exposed the time-staging of the EFCC releases that September. The September 24, 2016 article was captioned, “$31.4m Cash Deposit: How Patience Jonathan forced EFCC to expose matter,” and had highlights “EFFC had knowledge of fund since July” and “Why action was not taken earlier.” It was quite convenient. Patience Jonathan made the headlines for the next couple of months instead of the biting recession. It was one find upon the other. September 22, 2016: “$15m scandal: EFCC freezes Patience Jonathan’s personal account,” October 29, 2016: “EFCC to confiscate Patience Jonathan’s property nationwide,” etc, etc. Hungry Nigerians were entertained or conveniently distracted till 2016 ended. Remember, Buhari took over since May of 2015. And now again as the scandal over president Muhammadu Buhari’s sickness or “hale-and-hearty” lack of it, in-spite-of his absconding to the UK, makes headlines and as Nigerians begin to protest against the government, the EFCC is “Up” again. 3 days after Buhari failed to resume work following his 18-day vacation to the Queen’s England, February 9th, 2016 saw headlines: “EFCC raids home of former NNPC GMD, Andrew Yakubu, recovers $9.2m.” These have rapidly been followed up with more headlines in the same class; February 11, 2017: “EFCC in another breakthrough discovers $37.5m in Diezani’s Lagos mansion,” and we can expect many more to come, back-to-back with the EFCC reliably keeping Nigerians conveniently distracted as the economy is wrecked and the Commander in chief “absconds.” Perhaps it’s just a coincidence; but most importantly, we will not be distracted by headlines of the EFCC doing its job the way Obasanjo set it up to: as a political machine against foe and the perceived opposition, leaving out similarly indicted Presidency officers, ministers, heads of security agencies, and other ruling party men. Charly Boy tagged the protests #OurMumuDonDo. I agree. Dr. Peregrino Brimah; @EveryNigerian http://newsrescue.com/buhari-efcc-coincidence/#axzz4YOeMnagz |
By Rotimi Ojomoyela Barely two days after some assailants trailed a farmer from Orisunmibare in Oye Local Government Area to his farm and had his head and hands chopped off, a herdsman, Ahmed Dele was yesterday beheaded by unidentified persons in Omu town, in the same local government. The victim, it was learnt was pursued by his assailants while on grazing expedition before they caught up with him few kilometers away from the town where he was killed and his head removed. Confirming the incident, Secretary Jamunati Fulbe Association of Nigeria, Ekiti State Chapter, Idris Salaudeen said the victim was a member of the association. According to him, Dele, 26, a Fulani from Kwara State was declared missing by his boss, Jimoh Dele last Monday, after he failed to return home with his Cattle. He added that the victim’ body was later discovered around 4.30 am in the bush, two kilometers away from the town. Salaudeen disclosed that with this ugly incident, many of them were afraid of going about with their legitimate business since they didn’t known the motive behind the gruesome killing of one of their members. The Fulani’s scribe therefore called on Federal Government and security agencies to save the Fulani community from “unprovoked and unwarranted attack by unmasking the killers and bring them to justice.” “This is a very sad frightening development considering what the country is going through in terms of insecurity. There has been a lot of misconceptions and negative reports about the activities of Fulani herdsmen in recent time. But I want to tell you that we are peace loving people and we have been living peacefully with our various host communities in Ekiti State.” Also speaking, the traditional ruler of the community, the Olomu of Omu,Oba JA Ogundeyi described the incident as strange and condemnable. The monarch described the victim as peace loving individual who has been found wanting in his business. He explained the community had been thrown into a mourning mood since the news broke out . “The deceased is personally known to me in the Palace because he was a jovial person. Whenever he was going leading his cattle for grazing he would stop by and play with me. The whole community is very sad about this. Our community played host many tribes and ethnic groups and we have been living together peacefully.” Oba Ogundeyi ,who, appealed for calm ,however said that the Palace in collaboration with other stakeholders have swung into action with the view to unearth the mystery behind the incident. http://www.vanguardngr.com/2017/02/tension-ekiti-community-herdsman-beheaded/ Cc: Mynd 44, Lalasticlala |
NewsNew Zealand South Island: More whales stranded as hundreds die New group of 240 whales become beached in biggest stranding on record as volunteers struggle to return animals to sea. New Zealand has one of the highest rates of whale strandings in the world [EPA]New Zealand has one of the highest rates of whale strandings in the world [EPA] The fight to save scores of beached whales in one of New Zealand's biggest whale strandings on record was far from over as more of the animals washed up on the coast. A new pod of 240 whales became beached on Saturday just hours after volunteers managed to refloat a different group following an earlier mass stranding. Saturday's group brought to more than 650 the total number of pilot whales that have swum ashore along the 23km Farewell Spit since Thursday. About 335 whales have died on South Island's sands, 220 remain stranded and 100 were sent back to sea by volunteer rescuers. "We want to try and determine if there's an underlying reason why such a large number of whales stranded and died in such a short space of time," veterinary pathologist Dr Stuart Hunter told the New Zealand Herald. "It's not unusual for pilot whales to strand en masse, but this stranding is unusual due to the sheer number of whales involved and in such a small amount of time." Volunteer efforts Andrew Lamason, manager of the Department of Conservation Golden Bay, said on Saturday they are sure they are dealing with a new pod because they had tagged all the refloated whales from the first group and none of the new group had tags. The news was devastating for hundreds of volunteers who had come from around the country to help with the initial group of 416 stranded whales that were found early on Friday, many of them already dead. Volunteers are planning to return Sunday to help refloat as many healthy whales as they can to the waters. Lamason said conservation workers euthanised about 20 of the new group because they were in poor condition. More would probably need to be killed on Sunday, he said. Improved weather and crystal clear water had helped with the rescue attempt. Lamason said about 100 surviving whales from the initial group were refloated. Dozens of volunteers had formed a human chain in the water to prevent them from beaching again. Volunteers came from across the country to help the stranded whales [Reuters] Volunteers were warned about the possibility of stingrays and sharks after one of the dead whales appeared to have bite marks consistent with a shark. Farewell Spit, a sliver of sand that arches like a hook into the Tasman Sea, has been the site of previous mass strandings. Sometimes described as a whale trap, the long coastline and gently sloping beaches seem to make it difficult for whales to navigate away from once they get close. There are different theories as to why whales strand themselves, from chasing prey too far inshore to trying to protect a sick member of the group or escaping a predator. New Zealand has one of the highest rates of whale strandings in the world, and Friday's event was the nation's third-biggest in recorded history. The largest was in 1918, when about 1,000 pilot whales came ashore on the Chatham Islands. In 1985, about 450 whales stranded in Auckland. Prosecutor Dumps Justice Ngwuta’s N500m Fraud Suit Because AGF Malami Scuttled Bigger Corruption Case Against Northerners Prosecuting counsel, Mr. Charles Adeogun-Phillips, in a surprise move on Thursday, withdrew from the trial of a Justice of the Supreme Court, Justice Sylvester Ngwuta, who is being prosecuted by the Federal Government for money laundering charges involving over N500m. Adeogun-Phillips, a private legal practitioner and a former prosecutor at the International Criminal Court, announced his decision to withdraw from the suit when the case came up for the continuation of trial before Justice John Tsoho of the Federal High Court in Abuja on Thursday. by Ade Adesomoju, Abuja Feb 10, 2017 Prosecuting counsel, Mr. Sources close to the prosecution team confided in our correspondent that the withdrawal of Adeogun-Phillips from Ngwuta’s trial was “a mixture of protest and factors of the recent cold relationship between him and the Office of the Attorney General of the Federation”. The protest by the lawyer was said to be against Tuesday’s dropping of charges earlier led against the Chief Registrar of the Supreme Court, Mr. Mr. Ahmed Saleh, and two other officials of the apex court. The charges withdrawn by the Office of the Attorney General of the Federation against Saleh, Muhammed Abdulrahman Sharif and Rilwanu Lawal involved alleged diversion of N2.2bn belonging to the apex court. The three Supreme Court officials were also accused of receiving gratification totaling N74.4m from private contractors who were providing services to the Supreme Court between 2009 and 2016. Adeogun-Phillips was engaged by the Federal Government to also lead the prosecution of the apex court’s officials but was absent when a lawyer from the Federal Ministry of Justice, Mrs. Hajara Yusuf, announced the withdrawal of the charges before a High Court on Tuesday. A source familiar with the handling of the judges’ and court officials’ cases said, “The Chief Registrar case is the biggest among these cases concerning judges but if you notice they were never arraigned. “The claim that they dropped the charges so that he could be used as a witness in Ngwuta’s trial is just a facade. “The truth is that his evidence is not going to do much in Ngwuta’s case. “Adeogun-Phillips noticed that the government was not ready to prosecute the Chief Registrar and others because all the three are northerners. “He asked the authorities, ‘why do you prosecute one and leave the other? If we are fighting corruption, let us know we are fighting corruption, if we are not, let us know we are not’. “When he could no longer agree on some issues he had to quit. “That was why despite the fact that he was the lead prosecuting counsel, the Chief Registrar’s case was withdrawn in his absence on Tuesday.” But another source also told our correspondent that, “his withdrawal from Ngwuta’s trial on Thursday was an inevitable end because of recent, he disagreed more than he agreed with AGF office.” The spokesperson for the AGF and the National Prosecution Coordinating Committee, Mr. Salihu Isah, could not be reached for his comment on Thursday as repeated calls made to him indicated that his line was not available. Adeogun-Phillips had announced his withdrawal before the case was called by the court’s registrar on Thursday. After adjourning some other cases, Justice Tsoho had asked if both the prosecuting and the defense teams, were ready for the trial of the apex court’s judge. Adeogun-Phillips, in response, rose to tell the judge that he had decided to withdraw from the case. The lawyer gave no reason for his decision, but he sat back till when the case was eventually called by the court’s registrar. When the case was called, Mrs. Hajara Yusuf, a counsel from the Office of the Director of Public Prosecutions of the Federation, took over as the leader of the prosecuting team. Informing the judge of the change, she said, “I have been instructed to inform the court that Mr. Charles Adeogun-Phillips, the lead prosecuting counsel, will not longer be appearing in this matter. “given this change, myself and my colleagues will be appearing subject to the reconstitution of the team in due course.” The judge thanked Adeogun-Phillips for his “courtesy” of appearing in person to inform the court of his decision. “He is wished success in his further endeavors,” the judge said. The defense lead counsel, Chief Kanu Agabi (SAN), described the erstwhile prosecuting counsel as a man he loved and respected so much. Adeogun-Phillips remained seated with the new prosecuting team in the front row till the end of Thursday’s proceedings. He also declined to speak on his withdrawal from the case when asked about it by journalists at the end of the proceedings. The trial was adjourned till February 13, after the defense asked the rest prosecution witness, Mr. Nwamba Chukwuebuka, a few questions. Chukwuebuka, a building contractor, had in his evidence-in-chief on January 18, narrated to the court how he was paid a total amount of N313m within nine months by Justice Ngwuta for the building of three sets of houses. Chukwuebuka said the houses were built in the Abakaliki and Onicha areas of Ebonyi State, the apex court Justice’s home state. http://saharareporters.com/2017/02/10/prosecutor-dumps-justice-ngwuta%E2%80%99s-n500m-fraud-suit-because-agf-malami-scuttled-bigger

SOUTHERN KADUNA GENOCIDE The Southern Kaduna extermination is pure genocide. Perpetrators should be tried under the Genocide Convention in the International Criminal Court since justice is not certain in Nigeria. Raphael Lemkin in his masterpiece “Axis Rule in Occupied Europe” (1943) invented the term “genocide,”by combining “genos” (race, people) and “cide” (to kill). Lemkin defined genocide as follows: “Generally speaking, genocide does not necessarily mean the immediate destruction of a nation, except when accomplished by mass killings of all members of a nation. It is intended rather to signify a coordinated plan of different actions aiming at the destruction of essential foundations of the life of national groups, with the aim of annihilating the groups themselves. The objectives of such a plan would be the disintegration of the political and social institutions, of culture, language, national feelings, religion, and the economic existence of national groups, and the destruction of the personal security, liberty, health, dignity, and even the lives of the individuals belonging to such groups.” When Lemkin proposed a treaty against genocide to the United Nations in 1945, he defined it as follows: “The crime of genocide should be recognized therein as a conspiracy to exterminate national, religious or racial groups. The overt acts of such a conspiracy may consist of attacks against life, liberty or property of members of such groups merely because of their affiliation with such groups. The formulation of the crime may be as follows: “Whoever, while participating in a conspiracy to destroy a national, racial or religious group, undertakes an attack against life, liberty or property of members of such groups is guilty of the crime of genocide.” The crime of genocide is defined in international law in the Convention on the Prevention and Punishment of Genocide. “Article II: In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: (a) Killing members of the group; (b) Causing serious bodily or mental harm to members of the group; (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; (d) Imposing measures intended to prevent births within the group; (e) Forcibly transferring children of the group to another group. Article III: The following acts shall be punishable: (a) Genocide; (b) Conspiracy to commit genocide; (c) Direct and public incitement to commit genocide; (d) Attempt to commit genocide; (e) Complicity in genocide.” The Genocide Convention was adopted by the United Nations General Assembly on 9 December 1948. The Convention entered into force on 12 January 1951. More than 130 nations have ratified the Genocide Convention and over 70 nations have made provisions for the punishment of genocide in domestic criminal law. The text of Article II of the Genocide Convention was included as a crime in Article 6 of the 1998 Rome Statute of the International Criminal Court. Punishable Acts The following are genocidal acts when committed as part of a policy to destroy a group’s existence: Killing members of the group includes direct killing and actions causing death. Causing serious bodily or mental harm includes inflicting trauma on members of the group through widespread torture, rape, sexual violence, forced or coerced use of drugs, and mutilation. Deliberately inflicting conditions of life calculated to destroy a group includes the deliberate deprivation of resources needed for the group’s physical survival, such as clean water, food, clothing, shelter or medical services. Deprivation of the means to sustain life can be imposed through confiscation of harvests, blockade of foodstuffs, detention in camps, forcible relocation or expulsion into deserts. Prevention of births includes involuntary sterilization, forced abortion, prohibition of marriage, and long-term separation of men and women intended to prevent procreation. Forcible transfer of children may be imposed by direct force or by through fear of violence, duress, detention, psychological oppression or other methods of coercion. The Convention on the Rights of the Child defines children as persons under the age of 14 years. Genocidal acts need not kill or cause the death of members of a group. Causing serious bodily or mental harm, prevention of births and transfer of children are acts of genocide when committed as part of a policy to destroy a group’s existence: It is a crime to plan or incite genocide, even before killing starts, and to aid or abet genocide: Criminal acts include conspiracy, direct and public incitement, attempts to commit genocide, and complicity in genocide. The crime of genocide has two elements: intent and action. “Intentional” means purposeful. Intent can be proven directly from statements or orders. But more often, it must be inferred from a systematic pattern of coordinated acts. Intent is different from motive. Whatever may be the motive for the crime (land expropriation, national security, territorial integrity, etc.,) if the perpetrators commit acts intended to destroy a group, even part of a group, it is genocide. The phrase “in whole or in part” is important. Perpetrators need not intend to destroy the entire group. Destruction of only part of a group (such as its educated members, or members living in one region) is also genocide. Most authorities require intent to destroy a substantial number of group members — mass murder. But an individual criminal may be guilty of genocide even if he kills only one person, so long as he knew he was participating in a larger plan to destroy the group. The law protects four groups - national, ethnical, racial or religious groups. A national group means a set of individuals whose identity is defined by a common country of nationality or national origin. An ethnical group is a set of individuals whose identity is defined by common cultural traditions, language or heritage. A racial group means a set of individuals whose identity is defined by physical characteristics. A religious group is a set of individuals whose identity is defined by common religious creeds, beliefs, doctrines, practices, or rituals. If no immediate action is taken by the Federal Government, I will personally file a petition against the perpetrators in the International Criminal Court.
