Following the UN experts’ report, the Committee on the Elimination of Racial Discrimination held its 93rd session between July 31 and August 25, 2017. Acting under its “Early Warning and Urgent Action Procedure,” the Committee said it was deeply concerned “by the rise of racist hate speech and incitement to violence against the Igbo people, including through the recording and wide distribution of a song and audio message in Hausa language which describe the Igbos in hateful and derogatory terms.” It added that the Committee was “Alarmed by the public ultimatum issued by a number of northern youth groups, forums, and coalitions on 6 June 2017 calling all Igbos in northern Nigeria to leave their homes by 1 October 2017,” noting that the ultimatum “may have been recently withdrawn.”

The Committee decried “reports that other local elders and leaders have endorsed the ultimatum and expressed their support for such racist hate speech targeting and threatening the Igbos,” adding that it was “deeply worried by the information that some Igbo families have already started moving out from their villages and homes in northern Nigeria to avoid any possible harm to their personal integrity.”

The UN body drew attention to Nigeria’s membership of the Economic Community of West African States (ECOWAS) and of the African Union as well as a State party to the African Charter on Human and Peoples' Rights
. It stated that Nigeria must “increase its efforts in systematically rejecting and condemning, including by high-level and local public officials and leaders, any form of racist hate speech, incitement to hatred and violence, and the dissemination of ideas of ethnic superiority.”

The UN body recommended that Nigeria “take immediate action to stop and prevent the continued circulation and dissemination of the hateful song and audio message mentioned above,” and “to exercise due diligence to halt, prevent and investigate acts of racist hate speech and incitement to hatred and violence against the Igbo people, in accordance with international human rights standards, with a view to bringing perpetrators to justice, punishing them adequately if convicted, and compensating victims.”

The UN Committee urged Nigeria to “ensure the protection of all its citizens from ethnic hatred, and take effective measures to ensure that Igbo people can fully exercise their rights stipulated in the Convention, including the right to security of person and protection against violence or bodily harm, the right to freedom of movement and residence, and the right to own property.”
It finally called on “all local and national authorities in Nigeria to promptly and firmly address the underlying causes of the ethnic tensions in Nigeria, with a view to avoiding repeated ethnic-based violence, and to promote intercultural dialogue between different ethnic groups based on diversity, respect, and inclusiveness.”

According to the Committee, the United Nations High Commissioner for Human Rights had been mandated “to draw the attention of the Economic Community of West African States (ECOWAS) and the African Union to the human rights situation of the Igbo in northern Nigeria.”

Settling out of court is an admission of guilt, the court would have to determine if the case has any grounds, they would then have to determine if the defendants were culpable but even if they were I see no way that Buhari wouldn't step in and pay those financial compensations, chicken change if you ask me and finally I don't know where you got your facts that buratai has multi million dollars investments in the US but I would like to know your source grin

What if this huge crowd Nnamdi Kanu is mobilizing match straight to government house to demand good governance? Buratai and the army may have been a little high handed when dealing with IPOBs, but let's not forget the police officers that these so called peaceful protesters threw over the niger bridge to their deaths

This case is not just against some few people..
In the case, styled John Doe, et al v. Turkur Yusuf Buratai, et al (Civil Action No. 1:17-cv-0133), the plaintiffs are seeking compensatory and punitive damages to secure justice for the Igbo people, prevention of genocide, ethnic cleansing or extermination of Christians in Nigeria by radical Islamic Hausa-Fulani terrorists.
This American lawyers just tagged the whole Hausa Fulani has terrorist... To large extent the whole North as region of terror.

Lawyer from United States law firm, Fein & DelValle PLLC, have filed a suit against Major-General TY Buratai, the Chief of Army Staff; Mr. Willie Obiano, governor of Anambra State; Mr. Okezie Ikpeazu, Abia State governor and 13 others in the US District Court for the District of Columbia.


The suit is a sequel to a trip the lawyers undertook to Enugu between 19 and 24 August, during which they said they were able to gather facts and conduct research to advance the Torture Victims Protection Act (TVPA) lawsuit filed before the US District Court on behalf of 10 anonymous plaintiffs. The suit is against 16 individuals alleged to have had a hand in extra-judicial killings and torture of Igbo people, Christians, and those with critical political viewpoints.

In the case, styled John Doe, et al v. Turkur Yusuf Buratai, et al (Civil Action No. 1:17-cv-0133), the plaintiffs are seeking compensatory and punitive damages to secure justice for the Igbo people, prevention of genocide, ethnic cleansing or extermination of Christians in Nigeria by radical Islamic Hausa-Fulani terrorists.

The lawyers stated that they are convinced that Nigeria is the most dangerous country in the world for Christians. According to them the sanctity of churches in Nigeria is routinely defiled through the killing of children, whose corpses are hidden between pews.

This, in addition to the country's membership of the Organization of Islamic Countries (OIC), and the adoption of the Sharia code by 12 Northern states, they noted, constitutes a violation of Nigeria’s secular constitution.

They stated that the Christian Open Door Report of 2015 found that Boko Haram killed 11,000 Christians, destroyed 13,000 churches and 1,500 Christian schools, as well as internally displaced 2.6 million people, among who were 1.3 million Christians.

They equally recalled that on 11 July, a coalition of Northern groups ordered 11 million Igbo people residing in North to relocate to their home states by 1 October, something the lawyers alleged was endorsed by the Federal Government and state governments in the North.

"The Government of Nigeria and 19 Northern states have tacitly endorsed the threatened genocide of twice the number exterminated by the Nazis in the Holocaust," the lawyers alleged.

They noted that the federal and state governments in northern Nigeria refused to arrest those behind the chilling threat against the Igbo.

In the suit against the Chief of Army Staff and others, the lawyers said the US District Court issued an order granting the plaintiffs' motion to proceed anonymously because they reasonably feared lethal retaliation against themselves or families if their identities were revealed.

They argued that actions of the defendants in the suit amounted to crimes against humanity, which could be prosecuted in any jurisdiction in the world.
"Indeed, the Convention Against Torture mandates that signatory nations like the United States and Nigeria prosecute the crimes of torture or extrajudicial killings," the lawyers stated.

A total of 14 of the 16 individual defendants is Federal Government officials, while the other two are Messrs. Obiano and Ikpeazu, both governors of Anambra and Abia states. The Anambra State governor, they noted, has apologized for the killing of the plaintiffs perpetrated under his watch.

The defendants, the lawyers said, are yet to respond after 21 days of the service of the summons and complaint. They added that their chances of successful prosecution of the suit are bright.

"We are optimistic about our chances of victory at trial or earlier," they said.

The defendants are represented by a California-based Nigerian law firm, which said it has been contacted by the Federal Government but not by individual defendants.
