As expected, the Peoples’
Democratic Party and its
Presidential flag bearer in the
2019 election, Alhaji Atiku
Abubakar are in Court
challenging the victory of All
Progressives Congress and its
flag bearer, President
Muhammadu Buhari. Alhaji Atiku
and his party, the PDP had filed
146 pages petition before the
Presidential Election Petition
Tribunal sitting at the Court of
Appeal Complex, Abuja.
Alhaji Atiku and his party have
alleged irregularities, non-
qualification, violence,
intimidation, bias on the part of
Independent National Electoral
Commission and outright
rigging.
The Petitioners pray jointly and
severally against the
Respondents as follows:- (a).
That it may be determined that
the 2nd Respondent was not
duly elected by a majority of
lawful votes cast in the said
election and therefore the
declaration and return of the 2nd
Respondent by the 1st
Respondent as the President of
Nigeria is unlawful, undue, null,
void and of no effect. (b). That it
may be determined that the 1st
Petitioner was duly and validly
elected and ought to be returned
as President of Nigeria, having
polled the highest number of
lawful votes cast at the election
to the office of the President of
Nigeria held on 23rd February
2019 and having satisfied the
constitutional requirements for
the said election. (c). An order
directing the 1st Respondent to
issue Certificate of Return to the
1st Petitioner as the duly elected
President of Nigeria. (d). That it
may be determined that the 2nd
Respondent was at the time of
the election not qualified to
contest the said election. (e). That
it may be determined that the
2nd Respondent submitted to
the Commission affidavit
containing false information of a
fundamental nature in aid of his
qualification for the said election.
IN THE ALTERNATIVE (f). That the
election to the office of the
President of Nigeria held on 23rd
February 2019 be nullified and a
fresh election ordered.
To start with, Atiku had prayed
the tribunal to grant him access
to check the supposed INEC
server, the tribunal declined.
Pressed for evidence before the
tribunal to ascertain the
existence of the server, the
petitioner produced a video clip
showing Mike Igini, Resident
Electoral Commissioner of Akwa
Ibom State, speaking on a TV
program of the possibility of INEC
employing electronic
transmission of results during
the 2019 general elections; INEC
countered during one of the
tribunal sittings that Igini is its
not spokesperson.
The Petitioners listed about 400
witnesses to prove their petition
and have even gone ahead to
generate results of the said
election, purportedly from the
INEC server in which the
Petitioners won the 2019
election!
The Petitioners have opened
their case and have so far called
58 witnesses out of the 400
originally listed in 9 days out of
10 days allotted to them to prove
their case. It is now safe to
assess the witnesses called thus
far by the Petitioners to see if
and if, they will be able to
discharge the burden of prove
placed on them by our electoral
laws and jurisprudence. But
before them, let me pose a very
pertinent question, is 400
witnesses, taking into
consideration our electoral laws
and jurisprudence into
consideration, enough to
establish the case of the
petitioners? Our subsequent
discussion will provide answer to
this question.
Conventionally, once a case is
before the court or a legally and
fittingly constituted tribunal, it is
subjuidice to discuss facts of the
litigious matter within the
context of the law outside the
courtroom. Thank goodness, I
won’t be found wanting in this
regard as I am neither a lawyer
nor a worker in the temple of
justice.
Be that as it may, while this
article is not meant to be another
tribunal to adjudicate on the
matter, it is not out of place to
analyze some curious
developments pertaining to
Atiku’s presidential petition so
far for the number of times the
tribunal has sat. It is as dramatic
as it has come. Like stated above,
the Petitioners have thus far
called 58 witnesses from the 400
they listed. An assessment of the
performance of the witnesses
called thus far will show that the
Peoples’ Democratic Party and
Alhaji Atiku Abubakar are only
chasing shadows at the tribunal.
During one of the trials, the
Petitioners called one witness
from Enugu State. The witness
averred in his witness statement
on oath before the tribunal that
he did transmit the result of the
election in the area he officiated
to the INEC server with a code
provided by INEC. But during
cross-examination, the witness
could not provide the code as he
alleged that he left the code in
his phone. The witness could not

An expert witness subpoenaed by the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar has explained how results were produced from INEC server.
David Ayu Nyango N’jogu, an ICT data analyst from Kenya, on Friday told the Presidential Election Petitions Tribunal that he used scientific method that decrypted the information contained in the server which was made available to Atiku and PDP.

He said the results of the February 23 presidential election domain were registered on March 29 on the www.factsdontli eng.com website while his search on ‘Whois’ tool revealed the operator of the site was a whistleblowing INEC staff.

However, under cross examination by counsel to APC, Lateef Fagbemi (SAN), N’jogu admitted that he did not grant access to the site by INEC chairman.

He also admitted that the same scientific method, without authorisation, can be used to alter the information contained on the website.
Under cross examination by counsel to Buhari, Wole Olanipekun (SAN), the witness admitted that he did not attach any of his academic or professional certificate on the statement on oath.
Also in his evidence, Joseph Gbenga, a data analyst testified that he was engaged by the PDP to analyse data from the EC8 series in 11 states which showed that the party won the February 23 election.
But when Olanipekun questioned why he awarded higher margin of victory to the PDP more than it is claiming, including in Katsina which it conceded to have won, the witness said, “I worked on documents made available to me, I am not aware that the petitioners conceded defeat in Katsina.”

The Senate has approved the nomination of Aliyu Saidu Abubakar as non-executive commissioner of the Nigerian Communications Commission (NCC).
Abubakar who is to represent the Northeast geopolitical zone in the commission was rejected in 2016 when Senator Bukola Saraki was the Senate President.

Also confirmed are Eng Uba Maska, executive commissioner (North West) for reappointment, Professor Millionaire Abowei, non-Executive director (South South) and Abdulazeez Mohammed Salman (North Central).

I totally support the government of Taraba State on this one. Other States should do the same. What annoys me about kidnappers is that the politicians stealing our collective wealth are not being kidnapped. It is innocent and struggling Nigerians that are suffering in their hands.

The Federal High Court sitting in Kaduna on Thursday upheld the nomination of Malam Nasiru El-Rufai as the All Progressives Congress (APC) governorship candidate for Kaduna state in the last general election.
Yahaya Shinko, a former member of the APC, had filed a suit at the court challenging the nomination of Malam Nasir El-Rufai and prayed the court to set aside the said nomination.

Delivering judgement today, the presiding Judge, Justice Zainab Abubakar, ruled that Yahaya Shinko’s case lacks merit and affirmed the validity of the APC primaries that produced El-Rufai.

Justice Zainab noted that the suit was filed beyond the 14 days given to institute an action challenging the outcome of the said election.

The Federation of International Football Association (FIFA) will spend 1.2
million dollars on the establishment of a football technical centre in Kebbi,
an official said in Birnin Kebbi on Friday.
Mohammed Sanusi, the General Secretary of Nigeria Football Federation
(NFF), said Kebbi was chosen for the project because NFF appreciated
the zeal and commitment of the state government to sports development.

He spoke when he led an NFF delegation to the state to inspect and take
possession of the four hectares of land for the establishment of the
football technical centre.
The NFF General Secretary said the Kebbi state government did this by
ensuring sports men and women received adequate training to compete at
national and international levels.

“I think we need to commend Gov. Atiku Bagudu for providing the
necessary support to the state’s Ministry of Youths and Sports to perform
its functions efficiently.
“FIFA is aware of the efforts being made in the area of sports
development in the state, and this motivated NFF to provide support to the
state through the establishment of the technical centre in the state,”
Sanusi said during a visit to Gov. Bagudu.
While responding, Bagudu welcomed the establishment of the centre by
FIFA and said it would enhance the promotion and development of sports
in the state.
“In the last four years, the state ministry of sports has done well and this
enabled the state to host several national and international competitions.
They also played host to former foreign-based professionals such as
Peter Rufai and Tijjani Babangida,’’ the governor said.
He added that the state’s football team also emerged winners at a beach
soccer competition held in Lagos.
“About 15 students from the state have been sponsored to receive
training at the Kwara Football Academy in Ilorin in furtherance of efforts
