The 10th prosecution witness, PW10, in the trial of Nigerian singer, Azeez Fashola, (a.k.a Naira Marley), Dein Whyte, an investigator with the Economic and Financial Crimes Commission, EFCC, on Thursday, November 30, 2023, told Justice Nicholas Oweibo of the Federal High Court sitting in Ikoyi, Lagos how Visa, a card payment platform, flagged one of the credit card details found on a device belonging to the singer, due to fraudulent transactions.
Naira Marley is standing trial on 11-count charge bordering on conspiracy and credit card fraud brought against him by the EFCC.
Led in evidence by the prosecution counsel, Bilikisu Buhari, the PW10 said: “As part of the findings from the investigation, forensic analysis revealed that malicious programmes that are being used to illegally obtain credit card information, which can be used for card non-present transactions, were found on the device that was recovered from the defendant upon his arrest. Also revealed were malicious tools used to disguise the active location of an internet user when his or her devices are connected to the internet.”
Mr Whyte also disclosed that, “tools that are used to verify the validity, active state and accuracy of credit card credentials as well as the region of the issuer of that card were discovered on the defendant’s device. The analysis further revealed the website that had been accessed on the computer of the defendant through his browser history. The websites include sites where credit card information are illegally traded.”
He explained further that the phone and the laptop recovered from the defendant were both registered with his credentials, name and email address. When asked by the prosecution counsel to state the result of his findings on the credit card details on the defendant’s device, Mr Whyte responded, “With respect to the card details recovered from the device of the defendant, investigations revealed that he also exchanged those details with other persons.
He further stated that one of the cards was reported to have been fraudulently used for a transaction by Visa. According to him, the card details that were in possession of the defendant’s device neither belonged to him nor were issued to him by any financial institution.
Under cross-examination by the defendant’s counsel, Olalekan Ojo, SAN, Mr Whyte informed the court that a letter of investigation was written to Visa and that it confirmed that the card had been flagged for fraudulent transactions.
He, however, said that Visa didn’t link the credit card fraud to the defendant’s device “because the investigation was on the card and not on the device being used for the fraud.” He also stressed that Visa is a payment platform and not a telecommunication company.
Justice Oweibo adjourned the case to 6 and 7 March 2024 for continuation of trial.

The Bini people might have lived in riverine area in Lagos, and maybe they had the highest number of people living in the area. Founder of the defunct Niger Delta People’s Volunteer Force, Alhaji Mujahid Asari Dokubo, has lambasted those saying that Bini people founded Lagos.
The argument over ownership of Lagos was reignited after the Oba of Benin, Oba Ewuare II, visited Governor Babajide Sanwo-Olu of Lagos, on Sunday.
In his address, the traditional ruler said, ‘’It is in the history books that the Binis founded Lagos.”
The Oba’s statement has sparked reactions among Lagosians and Nigerians at large, which have forced some people to register their voices on the matter.
The Balogun of Eko, Abisoye Oshodi, was the first Lagos indigene to publicly fault the claim by the Oba of Benin.
In his reaction via a viral video on Thursday, Dokubo said what the monarch had succeeded in doing was sharing parasitic history.
He said the Bini people never founded Lagos, but added the history recorded that Benin Army attacked Lagos Island at a time.
The former Niger Delta militant said the army just attacked the Island, not the entire Lagos which include spread to the hinterland of the modern Lagos.
“Lagos belongs to the Bini people, look at how unintelligent you people are. You don’t even know the distance about Benin and Lagos. You don’t know history. Lagos was founded by Bini people, look at how stupid you people are,” Asari said.
“Useless argument. Dahomey attacked Lagos. Dahomey attacked Abeokuta. Dahomey people are in Benin Republic, will now say they own Lagos.
“You don’t know history. A Bini army attacked Ondo. Ijaw people ferried them. They went to attack Lagos Island. Not the whole of Lagos, just the Island.
“Lagos was made of five divisions. Four of these divisions were of former western region. You don’t know history, you just keep talking. Which Lagos belongs to Bini people?
“Which Oba of Benin? So he flew there to come and found Lagos or they carried the land of Lagos from Benin to go and put it amidst the Yoruba people in. Lagos?
“The Oba of Benin carried a parasitic history to Lagos. Most of these things did not even happen. People even say there was one said by Oba of Lagos, and they start chewing a narrative. The question I’m asking is the Oba of Benin and the people is that did the Bini now packaged the land of Lagos among Yoruba people and Egun people? It doesn’t make sense! Something is wrong with you people.

It Doesn’t Make Sense To Export Crude And Not Supply Dangote Refinery — Rewane
The Managing Director of Financial Derivatives Company Limited made this known during a live appearance on Channels Television's Business Morning show.
Renowned economist, Bismarck Rewane, says it makes no sense for the country to export crude on Forward Contract and not supply indigenous firm, Dangote Refinery.
He said by securing its first cargo deal of about six million barrels, the Dangote Refinery will be able to get crude in Nigeria, refine it in Nigeria and export refined petroleum products to West African countries.
The economist said, “It doesn’t make sense for Nigeria to be exporting crude on Forward Contract and not be able to refine its own product for its own citizens and for West and Central Africa, it doesn’t make sense.
“This refinery is likely to be listed in the Nigerian Stock Exchange 2024-2025. By listing this $19bn to $20bn investment, it increases market capitalization of the Nigerian Stock Market by 60 percent.
“Not only that, the Dangote Group itself pays taxes of over N146bn a year and pays dividends to share holders of N357bn a year.
“So, N146bn a year and N357bn a year taxes; It is not a capitalistic investment but it is democratising the process of shareholders just like when MTN was a private company.
“When MTN declares a dividend today, everybody in town is happy because its ownership is democratised. It is now considered to be Nigerian and that’s transformation. The same thing is happening for these kind of companies which are dominant and leaders in all industries.”
The refinery sited in Lagos and owned by Africa’s richest man, Aliko Dangote, is expected to commence operations in December with 350,000 barrels a day.

The SW and Northern Governors cater to too much population in their respective states than the SE Governors who do nothing but to divert monies into their private pockets while their little population are being neglected. With a little population and a large expanse of empty and ungoverned areas and a large number of empty and unoccupied buildings scattered across the SE, it is safe to say these economic burdens are being transferred to the Governors of others regions. Davido objects to Pinnick’s suit over ‘breach of contract’
Nigerian-American superstar singer, David Adedeji Adeleke (Davido), has filed a preliminary objection to challenge the N2.3 billion breach of contract suit instituted against him and his music label, Davido Music Worldwide Limited, by Brownhill Investments Company Limited and its Chairman, Mr. Amaju Pinnick.
Pinnick, a former President of the Nigerian Football Federation (NFF), had instituted the N2.3 billion suit before the High Court of Delta State, Effurun, against Davido for an alleged breach of agreement/contract.
The claimants are asking the court to award the amount as general damages against Davido, following his refusal to honour a contract reached with him to perform at the 19th edition of the “Warri Again” event on October 6, 2023.
The claimant said he failed to appear after collecting the sum of US$94,500 (an equivalent of a million).
They stated that they also incurred additional expenses of $18,000 to secure the private jet chartered to convey Davido (first defendant) and his team, yet he refused to show up for the show.
At the resumed hearing of the suit, Davido had challenged the jurisdiction of the court to entertain the matter.
In his preliminary objection, the artiste premised his response on the grounds that the case is a debt recovery matter and that the claimant ought to have written a letter of demand first before rushing to court.
He further claimed that Sosoberokon is not his agent and does not negotiate performance contracts on his behalf.
While the singer claimed that he was not paid for the show and denied the agent, he however admitted receiving the payment of $94,500 but stated that the sum was payment for only promotion of the show.
In the sister case bordering on criminal defamation, Davido through his team of lawyers led by Mr. Norrison Quakers (SAN), also filed a preliminary objection challenging the jurisdiction of the court on the grounds that the defamatory statements were published online, but the claimant did not show that the defamatory statements were downloaded and viewed in Delta State to give the court jurisdiction.
Both matters have been adjourned to December 14, 2023, for the court to rule on the preliminary objections filed in both cases.
Also, in the N500 million defamation case filed against Israel, Davido’s Staff, no defence was filed on behalf of Israel and the court has already granted the application for an injunction restraining Israel from making any defamatory statements against Pinnick.
Pinnick’s legal team is led by Mr. Kelechi Onwu, a senior partner in Alegeh & Co., the law firm of the former President of the Nigerian Bar Association (NBA), Mr. Austine Alegeh (SAN).
Strong indications have emerged that Davido has enlisted many Nigerians to help prevail on Pinnick to withdraw the suit.
It was gathered that many Nigerians, including three eminent personalities, are already in talks with Pinnick to settle out-of-court.
It was gathered that Pinnick is insisting on going ahead with the suit due to the attempt by Davido to tarnish his hard-earned reputation despite the unblemished and transparent career he had both as former President of NFF and current role with FIFA, which requires integrity and honesty.
It was further gathered that since Davido is also an American, pressures have intensified by Pinnick’s friends, associates and international partners for him to file a suit in the United States against Davido and his associates.
