The Nigerian Army has been ordered by a Federal High Court sitting in Port Harcourt on Friday ordered the to pay the sum of N1.25million to Nollywood actress Ebere Ohakwe as compensation after she was beaten up by men of the Nigerian Army in February 2017.

They were also ordered to publish a written apology in at least two national dailies to the actress, Punch Metro reports.

Ohakwe, popularly known as Jewel Infinity, was travelling in a public bus from Port Harcourt, Rivers State to Onitsha, Anambra State when operatives of the Nigerian Army stationed at Omagwa axis of the Port Harcourt Airport Road stopped the vehicle for a routine stop-and-search and, in the process, physically assaulted her.

The Federal High Court presided over by Justice Adamu Mohammed had earlier ruled on the matter in March 2018.

Mohammed had ordered the defendants (Nigerian Army) to pay the sum of N1m to the plaintiff as compensation for infringing on her fundamental human rights.

But the Nigerian Army through its counsel filed an application to the court to set aside the judgment and resume fresh hearing.

Counsel for the plaintiff, Chime Chime, in a counter-application, urged the court to dismiss the defendant’s submission.

Mohammed, however, struck out the application of the Nigerian Army, stating that it lacked merit.

The judge awarded N250,000 against the defendants in addition to N1m the security outfit was expected to pay to the victim, as well as a written apology to her to be published in at least two national dailies.

Korede Bello, who is a close associate of Tiwa Savage, has insisted that it doesn’t matter if the romance she shared in a recent video with Wizkid is real or not.

In a recent chat with a radio station, the Godwin singer said both Tiwa Savage and Wizkid were two consenting adults and there was no need for anyone to get emotional about the video. He stated,

“I don’t mind the free publicity I get from the video based on association (the same record company) with Tiwa Savage. To be honest with you, they are two consenting adults and they are entertainers. They are in the show business and it doesn’t matter if it (their romance) is real or not. They are getting the numbers; the video had over one million views within 24 hours. I feel sometimes Nigerians get too emotional about certain things.”

Bello, who just released two singles, Champion and Bless Me, insisted that he had to take a break from music to re-evaluate his life. He explained,

“I just took a nap, to be honest. I went into my room and I took a long needed nap. I had been ‘overthinking’ and I needed to clear my head. At some point, I was climbing and happy but didn’t know why I was climbing. I just lost sight of the reason I was doing certain things. I will say I got blinded by the spotlight. When you are in the spotlight, you don’t see anyone else and it is delusional. At times, you have to step out of the spotlight and see people who are watching you.”

He, however, said he had no regrets, insisting that everything that had happened to him was for a reason and as a result of choices he made at certain times.

“There will always be something you would wish you did better, but you cannot change the past. I only look back to motivate myself and I understand that my decision today affects tomorrow,” Bello said.

Speaking on hate comments on social media, he admitted that he always felt bad that people could attack a peaceful person like him. He said,

“It is a touchy one, but I am optimistic by nature. Human nature is designed in a way that we see negative things quicker than positive things. Of course, there was a time hate comments made me feel terrible. But now, I just count my blessings and try to appreciate every positive comment. At a time, I didn’t understand why someone would say something bad to me because I am peaceful. No matter how perfect you are, people will always attack you.”

Bello also rubbished claims that he had left Don Jazzy’s Mavin Records, saying people only came to such a conclusion because he had been quiet for a while.

You are a music star, at what point did you delve into acting?

I just got a call from Kunle Afolayan. He didn’t know before then that I wanted to act. I even asked him, ‘Why did you call me? I don’t understand.’

He told me: ‘You’re a musician; you shoot music videos,’ and from the way he saw me on screen, he thought that I would at least know a few things and if I had any challenges, he would definitely put me through. I got on set and it was one of the best things I’d ever done. I definitely loved the experience.

Can you recall some of your memorable moments since you hugged stardom?

After winning the project fame, it gave me a much-needed musical experience and career advancement. The visuals for “Emi Ni Baller” made me the first female singer to get to the number 1 position on the Naija Top 10 by MTV. Collaborations with other talented singers and producers allowed me to create truly high-quality music which was appreciated by music lovers. Again in 2012, I won the Kora Awards in the category of Best Female Act. The prize was presented to me by Didier Drogba. In 2012, I was nominated for the Best New Act of the Year and Best Pop/RnB Artiste of the Year. In 2013, I was nominated for the Channel O Music Video Awards for the Most Gifted African West and at the Nigerian Entertainment Awards for the Best Collaboration. I was nominated at the City People Entertainment Awards for the Musician of the Year (female) and Best Collaboration of the Year (Oh Baby, featuring Flavor). In 2014, I was nominated at the Nigerian Entertainment Awards for the Best Pop/ RnB Artiste of the Year, Best Music Video of the Year (Artiste and Director) and Best Collaboration.

I was nominated at the MTV Africa Music Awards 2014 for Best Female, at the Headies for Best Collaboration Video of the Year (Emi ni baller, featuring Illbliss and Tha Suspect), Best Afro Hip Hop Video. I won the Best Pop Extra Video Awards at the Nigerian Music Video Awards (NMVA). I won the Student Choice Best RnB /Pop Artiste of the Year at the Nigerian Oscar Award 2015.

Share with us your journey to fame

In 2010, I dared to take part in the project fame casting. Like every other participant, I arrived at the studio where all other participants were and hoped for a chance. I was lucky to be among the 17 people selected. At the end, I won the contest smiling home with valuable prizes: N2.5 million, a fancy car, and a contract for work on my personal album. I felt lucky, I felt privileged and most of all I felt favoured. At that time, there were a lot of people that were more professional in music, that were a whole lot older, so I just felt, if I could be chosen, then I must be favoured.

What were your initial challenges after you won?

Waking up one day with a lot of responsibilities like going for rehearsals, studio sessions, shows and a whole initially tough. But, as time went on, I became used to them all and allowed myself through. It was a humble experience for me.

How were you able to handle scandals that came with the fame, especially the sex tape experience?

Bad PR is also PR. I wasn’t expecting it; I mean, I knew something was going to come up sometime but not that early and definitely not something that huge but, yeah, I saw it as one of those things.

I remember talking to Sound Sultan and he was like ‘welcome to the industry’. It is difficult for a popular person to avoid scandals and gossip.

What was your growing up like?

Growing up wasn’t much fun; really, it wasn’t. I have a very strict father. There was no time to hang around with friends. I didn’t have the opportunity at that time to do what my fellow young girls were doing. But I look back at those days and I just thank God for everything because if it had not been for that, probably I won’t be where I am today. The home training was really hard. Everybody in my family loves God; it’s a very strict Christian family.

However, my family has been very supportive.

Who influenced you while growing up?

My late dad. He taught us not to let anyone intimidate us. He was the only one that could intimidate me, only my father. No one can intimidate me. Absolutely no one.

What is your advice for upcoming acts?

They need hard work, consistence, persistence, humility and they should put God first in whatever they do. It takes a whole lot more than their talents. Respect those who are before you.

What is your take on reality shows?

I think it is a great idea to empower youths. The brains behind this project meant well for the younger generation to discover their talents and make use of them. The goal of the competition is to make one know the nitty-gritty of music and learn the process to become a complete and a professional singer.

You abandoned school for a talent hunt that you weren’t sure of your chances, why did you take such a risk?

My intention was just to give it a try; I never knew I would go so far. I thought I should just get the experience and move on with my life, and no doubt about it the academy was fun; I met people from different backgrounds. I learnt a lot from the teachers. They taught me how to control my voice because I have this very loud voice and I tried so much to tune it down.

You once shared the benefits of being single on your instagram. Are you happy being single?

When you are not married is the best time to develop a close relationship with God. While there is nothing wrong with wanting to get married, one also needs to wait on the Lord while worshiping him and ministering to him. There is a special relationship between God and the single believer. God has a special anointing for the woman who is free to seek Him. Her prayer life should explode in miracles.

Share with us why you speak against dating celebrity

I just think it is a lot of headache. I am actually not a fan of celebrity relationships. I don’t know how others feel about it, but for me I am not a big fan of it. It doesn’t work for me. It can be anything, not a musician. But if God says that’s what is going to be, then who am I to argue; but as human as I am, I don’t think I will like that.

But you have been linked to different male celebrities. How do you feel reading them?

The truth is, most people assume. The public has given me so many boyfriends, and funny enough, I haven’t met some or had a conversation with them. However, I have understood that things like these are part of the business and I just have to manage it.

Why are you revealing your charitable side?

For some years now, I have been using my foundation to do quite a lot of things. I have been able to take it to some places in Africa. The last time, I think I was in Togo and I was able to do a few things with the SOS village. I hope to do more of that.

Can you share your embarrassing moment(s) with us?

Before I actually started doing music, a lot of people used to talk to me like I was younger than my actual age and it used to be really annoying. The most embarrassing situation my stature brought me was when someone ordered me to sit down during a meeting. I had to confront the person.

Describe your style

Africanness. I wear mostly African prints – aso-oke, ankara, anything that has African prints. Because the style of my music is Nigerian, my dressing has to depict that I’m Nigerian, so that is why I wear African prints.

If not music

Music was never part of the big picture until Project Fame. I’d always seen myself as a broadcaster. I wanted to be on radio.

Why do you think people take you for granted?

I smile a lot and people sometimes tend to see that as a weakness. I want to smile less.

What lesson has life taught you?

I have learnt a lot about people and how to relate with them. I have learnt a lot about how to accommodate people. I’m not such an open person but I’ve met very nice people, I have met very terrible people, I have met people who always like to take advantage; but above all, I have learnt to love people the more even with their shortcomings.

The Leader of the Movement for the Actualization of the Sovereign State of Biafra, MASSOB, and Biafra Independence Movement, BIM, Chief Ralph Uwazuruike has thrashed Nnamdi Kanu, the controversial leader of the Indigenous People of Biafra, IPOB describing him as a 'coward'.

Uwazuruike attacked Kanu for deceiving Igbo youths and abandoning them, adding that people died because of his pro-secession rhetoric.

The Independent National Electoral Commission (INEC) has denied receiving any list of candidates for Zamfara State from the All Progressives Congress (APC) as claimed by the party.

The electoral body had disqualified APC from fielding candidates for the 2019 general elections in Zamfara State on the grounds that the party did not conduct primary elections in the state within the time it stipulated in its guidelines.

But the APC National Publicity Secretary, Mr. Lanre Isa-Onilu, had told THISDAY after the deadline for submission of candidates’ for the presidential and National Assembly elections on October 18, 2018, that the party submitted candidates for all positions in all states of the federation, including Zamfara.
“We submitted applications for all the positions in all the states, including Zamfara,” Isa-Onilu told THISDAY.

However, INEC National Commissioner on Voter Education and Information, Mr. Festus Okoye, told THISDAY on phone yesterday that the commission did not receive the list of candidates from Zamfara State from the ruling party.

He said based on the provisions of Section 31 and 87 of the Electoral Act 2010 (as amended), “the commission does not expect that your party will submit names of any candidates from Zamfara State.”

Okoye added, “For clarity, our position is that the APC, will not be fielding candidates for the governorship, National Assembly and state assembly elections in Zamfara State for the 2019 for the general elections.

“There are two matters relating to the party primary election conducted in Zamfara State pending before the State High court and Federal High Court in Zamfara. Those two matters are yet to be decided.
“So APC did not submit any list from Zamfara and INEC did not release any list of candidates from Zamfara.”

A Federal High Court sitting in Abuja presided over by Hon. Justice John Tsoho in a landmark judgment delivered on Monday 22nd October, 2018 has ordered the Nigeria Police Force, the Inspector General of Police and the Commissioner of Police F.C.T. Command to pay the sum of 50 Million Naira and publish an apology in two national newspapers to popular musician and activist, Mr. Charles Oputa alias Charly Boy.

In the suit filed on the 29th of March, 2018 by his lawyer and human rights activist, Mr. Inibehe Effiong to enforce his fundamental rights, the 67-year-old popular musician gave a graphic account of how policemen numbering over 100 from the F.C.T. Police Command invaded the Unity Fountain in Abuja on the 8th day of August, 2017 and attacked him and his group with teargas canisters, hot water cannon and wild police dogs during the Resume or Resign protest when he led other activists to protest the prolonged absence of President Muhammadu Buhari from Nigeria on account of his medical vacation in the United Kingdom.

Charly Boy further narrated that the attack by the policemen was so severe that he collapsed in the process and was rushed to the hospital.wHe also stated that the police attacked them because of claims that their protest over the President’s absence, which had exceeded 90 days on the second day of their daily sit-out protest, had gone international and brought serious embarrassment to the country.

Delivering judgment on Monday in the case marked as Suit No. FHC/ABJ/CS/343/2018 between Charles Oputa versus The Inspector General of Police & 2 others, Justice Tsoho held that there was no evidence that miscreants invaded or stormed the premises of the protest as alleged by the police.

On whether the applicant is entitled to stage the protest, the court held that protest is a constitutionally guaranteed right provided it is done peacefully and that even if miscreants were on the scene to hijack the protest, the respondents possess enough security measures to dislodge such persons and maintain law and order.

‘’The Respondents (the Police) need not exercise an uncommon aggression and mayhem to wade off alleged miscreants’’ Justice Tsoho ruled.
According to the court, the Respondents admitted in their Counter Affidavit that it was in the bid to protect members of the public and public properties from the ‘’miscreants’’ who suddenly took over the protest that the men and officers of the Respondents had to use teargas canisters and hot water Canon in order to disperse the hoodlums. But that the Respondents stated that the teargas and water Canon were not directed at the Applicant.

This assertion according to the court, lacks substance as teargas circulates and affects all persons within the premises. And the atmosphere generally affected which causes cough.

The court found that the applicant has disclosed a reasonable cause of action against the respondents and that the respondents violated the fundamental rights of the applicant  to dignity of the human person, freedom of expression, peaceful assembly and association as enshrined in Sections 34, 39, and 40 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

‘’The law is that the court has the right to grant redress to anyone whose right is violated and the Applicant is entitled to a remedy.’’ said Justice Tsoho.

‘’Relief 4 is granted and the Respondents are ordered to publish an apology to the Applicant in 2 National Newspapers for violating his Fundamental rights. The sum of 50 Million Naira is awarded against the Respondents as General and Exemplary damages.’’

The court also ordered perpetual injunction against the respondents from violating the fundamental rights to dignity of the human person, freedom of expression and peaceful assembly and association.

Reacting to the judgment, the applicant’s counsel, Inibehe Effiong described the judgment as a resounding victory for democracy, freedom of expression and peaceful assembly in the country.

‘’This judgment sends unequivocal message to the Nigerian Police that they have no power to stop or disrupt peaceful protests by Nigerians. The police by this judgment cannot invent flimsy excuses to stop citizens from exercising their fundamental rights to freedom of expression and peaceful assembly. I am highly elated by this victory for democracy.’’ Effiong said.
Reacting to the judgment, the Secretary of the OurMumuDonDo Movement, Comrade Raphael Adebayo, in a statement said that the judgment has raised the confidence of Nigerians in the judiciary.

‘’The OurMumuDonDo Movement wishes to express satisfaction over the judgment of the Federal High Court in Abuja on the unprovoked attack of the police on its members during the ResumeOrResign Protest. This development is a sign that the Nigerian judiciary is indeed committed to upholding the supremacy of our country's Constitution.’’

‘’We also wish to thank the Judge for his sagacity in handling this case, just as we are grateful to our team of young, vibrant, and courageous lawyers who have tirelessly worked on this case to get us to where we are right now.’’

‘’We wish to state unequivocally, that this victory is not only for the OurMumuDonDo Movement but also for every Nigerian who believes that a new and better Nigeria is achievable. We strongly hope that by virtue of this victory, Nigerians will feel more emboldened to speak truth to power, hold leaders accountable, and resist fear in advocating for issues of social order and social justice in our great country.’’ The statement read.

The respondents were represented in the case by O. M. Atoyebi and M. D. Podos while Inibehe Effiong along with S. M. Oyeghe represented Charly Boy.

A mother has vowed not to leave her infant son with anyone again after a hidden camera caught her nanny maltreating her 7-month-old son.

Didi Horsefall said her son was rapidly losing weight and they had no idea the maid was eating his food. She also alleged that a video caught the maid kicking the boy and slapping him.
Not only that, the maid is said to have left the baby with the gateman a number of times while she brought her boyfriend into the house for sex.

The mother said she is not willing to release the video because her son's face was visible in it. She said watching the video left her depressed for days and she can now trust only her sister with her child. Ndigbo have been advised to treat the touted disappearance and resurfacing of Mazi Nnamdi Kanu, the leader of the Indigenous Peoples of Biafra, IPOB, as “a non-issue because it was carefully prearranged by the Department of State Security, DSS”.

The protagonist of the Movement for the Actualization of the Sovereign State of Biafra, MASSOB, and Biafra Independence Movement, BIM, Chief Ralph Uwazuruike, stated this Monday, at a press conference in Owerri, to react to Kanu’s reappearance in Isreal and broadcast.

“Not many of his ardent followers truly know that Kanu is not sincerely working for the Independence of Biafra. His coming to Nigeria, his arrest, detention, trial, release on bail and his alleged disappearance and resurfacing, were all prearranged by the DSS”, Uwazuruike said.

It was the considered opinion of the MASSOB/BIM leader that if Mazi Kanu was sincere, he should have disclosed how he was spirited away from his Afara Ukwu country home, when the soldiers struck.

“How did he disappear from his country home? How did he survive the onslaught, even when he claimed that about 28 people were killed during the military operation in his home? How did he leave Nigeria and what document did he use to traverse all the nations before arriving Israel? We couldn’t have forgotten so soon that the DSS seized all his travel documents”, Chief Uwazuruike asked.

After giving a graphic account of the number of times he was arrested, detained and tried in court, Uwazuruike also reasoned that “a freedom fighter donates his life for the struggle he believes in.

“This is not the case with Nnamdi Kanu. Running away from the struggle means that he is a fake freedom fighter. This young man does not consult anybody and he has no adviser. Kanu erroneously believe that President Buhari can wake up any day and call for a referendum that is not even captured in the Constitution”, Uwazuruike said.

Continuing, the MASSOB/BIM boss recalled that “when Kanu was declared missing, I knew that it was a ruse”, stressing that “when Governor Okezie Ikpeazu of Abia State said that Kanu would resurface before the end of the year, he spoke from the point of knowledge and not speculation”.

Directing his mind to some of the directives issued by Kanu in his broadcast, Uwazuruike passionately appealed to Ndigbo to “completely disregard them”.

Answering a question, Uwazuruike said he was aware that the DSS conscripted Kanu to degrade MASSOB and it’s struggle
“Nnamdi Kanu is calling for effective boycott of elections, referendum and sit at home, which MASSOB/BIM abandoned long ago, because of its adverse effects on Ndigbo. These issues are not practicable and the young man does not and cannot have effective control over them”, Uwazuruike said.

While reiterating that Ndigbo disregard the directives, Chief Uwazuruike equally reasoned that “even if the people obey the order, the Nigerian Constitution empowers President Buhari to appoint anybody to run the affairs of any state, where elections were not held”.

The Peoples Democratic Party, Lagos state chapter, has raised the alarm over the alleged plans by the All Progressives Congress (APC), never to hand over power to the PDP, especially in Lagos state if they lose in the forthcoming general elections.

According to the Lagos State PDP, the APC which is now obviously politically haemorrhage and cannot survive the 2019 governorship election in Lagos state is now concluding its plans to use INEC, security agencies, thugs, identified election observers and ‘activists’ who are APC apologists to rig the 2019 general elections in Lagos state.

Defending the assertions, the PDP referred to the statement credited to Mr Joe Igbokwe, Lagos APC spokesman, that Buhari will never hand over power to Atiku as not only undemocratic & provocative but indeed a pre election rigging plan that should interest the relevant security agencies to arrest and prosecute Mr Igbokwe.

“The Lagos APC is terminally divided and cannot win any election in the state. We had garnered information from different sources indicating that the APC is not willing to let go the control of Lagos State in particular. So much that the Party leaders in Lagos at one of their meetings analysed that keeping only Lagos state is worth more than having all other southwest states. Thus the desperation and frustration exposed by Mr Igbokwe has confirmed our information and vindicated our assertions that the APC has never won any fair elections in the state.

“We will mobilise all legal means and supports to seriously resist this plan to rig us out in 2019. Interestingly, the confessions of the APC leaders that Governor Ambode has neglected and not funding party structures account for why the sitting governor has been rejected for a second term. Invariably, any State development without funding APC leaders is not welcomed by the APC.

Indeed Lagosians now know that the APC in Lagos state think more of themselves than the inhabitants. That the APC is only interested in sharing state funds amongst themselves. Such party cannot be trusted with public funds and no doubt Lagosians will reject them in 2019”
Meanwhile, the PDP warns that the APC will be held responsible for any attack on any of her candidates.

On the Voluntary Offshore Assets Regularization Scheme (“VOARS”)

Whereas the Constitution imposes a duty on every citizen to declare his/her income and assets fully and honestly to appropriate and lawful agencies and pay taxes promptly;

Whereas every taxable person is under obligation to voluntarily declare his/her income and assets from all sources including outside Nigeria, file annual tax returns and pay the tax due to the tax authority;

Aware that it is desirable to inculcate in all Nigerian citizens the ethics of responsibility to the nation, accountability, and honesty;

Aware that there are significant offshore assets of Nigeria origin that have not been declared to the relevant authorities, and that are also not tax compliant;

Aware that the Government(s) owe citizens the duty of ensuring security, welfare and development; and

Consequent upon the determination to provide an opportunity for taxpayers who are in default under all relevant Statutes to voluntarily declare their offshore assets and income and pay taxes due on them and in return obtain some benefits.

Now Therefore, Pursuant to the Authority Vested in me by the Constitution as the President of the Federal Republic of Nigeria, I Hereby Order as Follows:

1. The Office of Attorney General of the Federation and Minister of Justice shall set up a Voluntary Offshore Assets Regularization Scheme in Switzerland (hereinafter referred to as “the Scheme”) for all categories of taxpayers who have defaulted in declaration of their offshore assets, payment of taxes due and collectible subject to the fulfillment of the terms and conditions as may be stipulated in this Order and other subsequent complementary regulations.

2. The Scheme shall provide a twelve (12) month period commencing from ……………day of……………… 2018 for taxpayers who are in default to declare their offshore assets and income from sources outside Nigeria relating to the preceding thirty (30) years of assessment.

3. The Scheme shall encourage and provide an opportunity for eligible taxpayers to:

a. regularize their offshore assets held anywhere in the world;
voluntarily elect to regularize their tax status for all the relevant years by paying to FGN a one-time levy of 35% of their offshore assets in lieu of all outstanding taxes, penalties and interest;

b. voluntarily elect to access the facility in Switzerland by paying the 2% facility access fees and submitting to compliance procedures required by Swiss authorities in order to obtain an Eligibility certificate to declare offshore assets through the Scheme;

c. establishes a Swiss nexus for their offshore assets held anywhere else in the world or its management in Switzerland or through its financial system and institutions in order to use the Scheme;

d. avoid and stop tax evasion; and

e. ensure full tax compliance on their residual offshore assets after accessing the Scheme by paying taxes to FGN on income earned thereon.

Eligibility to Participate

4. The Scheme is open to and targeted to all persons, entities and their intermediaries who are holding offshore assets and are in default of their tax liabilities in any way whatsoever, including those who:

a. are not already under investigation by law enforcement agencies in Nigeria or any other country and have not been charged with any crimes including theft of public funds or obtaining offshore assets through corrupt practices;

b. own offshore assets but are yet to declare them with the relevant authorities; such offshore assets by definition include:
liquid assets (bank balances), stocks and bonds held in portfolios, insurance policies, shares in listed or unlisted offshore companies, property assets and all manners of assets held directly or indirectly through corporate entities, trust structures and non-Nigerian resident companies and intermediaries;

c. earn income on offshore assets but are yet to declare such income to relevant tax authorities;

d. are registered taxpayers who have additional disclosures to make or need to amend prior disclosures; and/or are registered but have not been filing returns;

e. have not been fully declaring their taxable income and offshore assets;

f. have been underpaying or under remitting;

g. are under a process of tax audit or investigation with the relevant Tax Authority and/or engaged in a tax dispute with the relevant Tax Authority but are prepared to settle the tax dispute out of court;

h. have applied for and received FGN Special Clearance to access the Scheme; and

i. have been determined to be innocent after investigations or legal proceedings.

Requirements for Valid Declaration

5. In order for an offshore assets disclosure pursuant to the Scheme to be valid, the following requirements must be met:

a. the disclosure by the taxpayer should be made voluntarily;

b. the disclosure must be full, honest, complete and verifiable in all material respects;

c. the disclosure must be made through the Voluntary Offshore Assets Regularization Facility in Switzerland (VOARFS), the qualified intermediary of FGN rendering sovereign advisory services for this purpose;

d. the disclosure must be made in accordance with compliance procedures required by Swiss authorities through the processes established by the Voluntary Offshore Assets Regularization Facility in Switzerland (VOARFS) or in any other form or manner as may be prescribed by Regulations governing the Scheme; and

e. consent that a one-time levy of 35% of offshore assets will be paid to FGN in the manner prescribed by regulations governing the Scheme; and

f. consent that the assessments of future taxes payable will be carried out by the relevant Tax Authority on income earned on residual offshore assets.

Reliefs/Benefits

6. Any taxpayer who truthfully and voluntarily declares his/her offshore assets and income, complies with the regulations and guidelines governing the Scheme, pays to FGN a one-time levy of 35% on the total offshore assets and consents to tax compliance on the residual offshore assets shall obtain the following benefits:

a. permanent waiver of criminal prosecution for tax offences and offences related to the offshore assets, penalties and interests concerning such declared offshore assets;

b. immunity from tax audit of the declared and regularized offshore assets;

c. waiver of interest and penalties on the declared and regularized offshore assets;

d. receive from FGN an Offshore Assets Regularization Compliance Certificate on the declared and regularized offshore assets; and

e. be free to use or invest their duly regularized residual offshore assets in any manner in Nigeria or overseas, and be subject only to annual tax to FGN on the income earned on such residual offshore assets, provided however that the above mentioned reliefs are obtained only if the remission or waiver granted under the Regulations governing the Scheme shall not prejudicially affect or invalidate any court order or judgment already obtained in respect of any default in payment of tax for which interest and/or penalty have already accrued.

7. The benefits referred to in paragraph six (6) above are granted to any taxpayer in full compliance with the following conditions:

a. the taxpayer accesses and provides full co-operation to the voluntary offshore assets disclosure facility in Switzerland;

b. the taxpayer pays the prescribed 35% levy to FGN in accordance with procedures governing the Scheme; and

c. the taxpayer consents to tax compliance on the residual offshore assets and full co-operation with relevant Tax Authority in Nigeria concerning future taxes on income earned on such residual offshore assets;

Consequences of Failure to Comply

8. Failure of any defaulting taxpayer to truthfully and promptly take advantage of this Scheme shall at the expiration of the Scheme result in the following consequences:

a. investigation, charges and enforcement procedures concerning offshore assets held anywhere in the world pursuant to information now readily available through automatic exchange of information between Nigeria and foreign countries;

b. loss of right to plea bargain;

c. liability to pay in full, the principal sum due;

d. liability to pay 100% of all interest and penalties arising therefrom;

e. liability to be prosecuted in accordance with relevant existent laws for tax offences;

f. withdrawal of any reliefs, which may have been granted to the participant;

g. liability to undergo comprehensive tax audit; and

h. any sum paid in relation to the Scheme may be counted as part payment of any further outstanding tax in respect of undisclosed information.

Confidentiality of Information

9. All information provided by the taxpayer under the Scheme shall be treated with utmost confidentiality in accordance with the provisions of the relevant laws save where it is stated otherwise.

10. Any Nigerian official or persons duly authorized to receive information under the Scheme who breaches the confidentiality of information received or exchanged under the Scheme in breach of relevant laws shall be liable to prosecution.

General

11. This Executive Order is valid only for the period in which the Scheme shall subsist, and relates to only persons who have voluntarily declared their offshore assets and income for the purpose of regularizing their offshore assets and ascertaining their outstanding tax liability.

Any rights and status properly acquired by any participating taxpayer pursuant to the Scheme shall vest to the benefit of the taxpayer to the extent provided for by law.

12. This Executive Order shall be read in conjunction with all extant Tax Laws, Regulations and Guidelines as well as those that may be issued pursuant to the Scheme.

13. This Executive Order shall take effect from the …………day of……………………….2018.

Workers at the headquarters of the National Health Insurance Scheme, NHIS, early morning today clashed with the Police allegedly protecting the suspended Executive Secretary of the scheme, Prof. Usman Yusuf who showed up at office.

The police, however, fired teargas canisters at workers of the National Health Insurance Scheme (NHIS). 

The workers had taken over the place at about 8am but a team of police officers tried to dispel the workers as they led the suspended Executive Secretary to his office.

The protesting workers were over powered by the police who fired teargas canisters in the air to dispel them. Some of the workers sustained injuries as the scampered in different directions after inhaling the tear gas. 

Yusuf was, last week, suspended by the scheme’s governing board for allegedly inflating the scheme’s 2018 budget.

A housewife, Ochinya Onya Maria, has delivered a set of thoraco-omphalogus, conjoined twins.

Mrs. Onya, a native of Otukpo LGA of Benue State, and her husband, a painter welcomed the bundle of joy through a Caesarian section at the Federal Medical Centre, Keffi, some days ago.

According to Dr. Mukhtar Yola, Chief Consultant Neontologist of the National Hospital, Abuja where the mother and her babies are currently admitted, “Examination findings showed babies conjoined at the thorax and abdomen with a single umbilical cord. Other examination findings were normal. The current conjoined babies weight is 7.1h5kg. The babies were found to be conjoined with a ruptured omphalocoele, which was repaired. The gram also showed separate skeletal bones including thoracic cavity. Babies are being worked upon for subsequent separation.”

Speaking exclusively with DAILY POST on Monday morning, the young woman said the twins were her second issue in the marriage.

She said, “This is my second issue. I am a house wife and my husband is a painter.

“For now, we need to raise funds to ensure their survival by a successful surgery to separate them. The doctors said the surgery would cost us N8m and we don’t even know where to raise the money from.

“We are calling on well-meaning Nigerians to come to our aid. God bless you richly.”
