It described the bank’s actions as a gross violation of customer rights and a breach of fiduciary duty.
The judgment arose from an appeal filed by Ecobank against a decision of the trial court, which had earlier ruled in favour of the Respondent, its customer, and awarded N10 million in general damages.
Justice Ntong Ntong, who delivered the lead judgment, agreed with the lower court’s findings but reduced the damages to N5 million, deeming the original sum excessive in light of the evidence presented.
In resolving the first issue, Justice Ntong emphasised that no bank has the power to freeze or restrict a customer’s account without a valid court order, regardless of internal policies or compliance procedures such as the Central Bank of Nigeria’s Know Your Customer, KYC, regulations.
The court held that while Ecobank claimed it acted under regulatory obligations after a $65,000 cash deposit raised red flags, it failed to demonstrate that such compliance required unilateral restriction of the account.
It cited relevant precedents, including FBN v. DKN Investments Ltd and GTB v. Joshua, to reinforce the principle that banking institutions must operate within the confines of the law, warning against the use of internal policies to override constitutional rights.
On the second issue, the appellate court found that Ecobank had no legal or contractual basis to assert a right of lien over $10,000 in the respondent’s account, which was allegedly owed to a foreign trading partner, Unique International Trading Ltd.
The bank had argued that it restricted the funds to protect itself from potential litigation threatened by the trading firm.
However, the court ruled that Ecobank’s reliance on the threat of legal action by a third party could not justify the exercise of any lien, especially in the absence of any contractual agreement or court order to that effect.
“Self-help has no place in the civilized world,” the court warned, rejecting the bank’s justification as “misconceived and untenable in law.”
On the final issue, it affirmed that Ecobank had breached its duty of care by unlawfully restricting access to the customer’s funds and dishonouring cheques.
However, it found no sufficient evidence to support the customer’s claim of lost business and goodwill due to the restriction.

No fewer than six person reportedly died, while twelve sustained various degrees of injures in a motor accident in Ringim Local Government area of Jigawa State.
Eyewitness told DAILY POST that the incident happened on Sunday at around 3:00 pm along Ringim to Dutse road when the reckless driver rammed into a group of people welcoming the Governor on his way to Ringim to attend Citizens Engagement popularity called (Gwamnati da Jana’s).
He said the victims, including pregnant women and children, were evacuated and rushed to the Ringim General Hospital for medical attention.
He said three victims died on the spot, while three others died in the hospital.
Ringim FRSC Unit Commander, CRC ADO ADAMU confirmed the incident to DAILY POST.
He said the unit command received the accident reports and a rescue team rushed to the scene at Yakasawa village along Ringim-Dutse way on Sunday evening.
Adamu explained that the incident occurred when a reckless driver of Golf ash colour with FKJ 102BB lost control of the vehicle and rammed into a gathering of people.

Tracy has become the interim head of house (HoH) for the third week of BBNaija ‘Ten Over Ten’ edition.
Shortly after the live eviction show, Big Brother summoned all housemates to the arena for the HoH game.
The housemates were asked to take part in a three-course challenge within a limited time.
Denari, Kaybobo, Mensan, Tracy and Jason Jae all finished ahead of the others and advanced to the final round.
To get a winner, the five housemates were tasked with balancing three balls on a flat surface with one hand, with Tracy emerging victorious.
However, with the new twist in play, she will have to defend her title in a special HoH challenger match on Monday.
If another housemate outperforms her, she could lose the position.
The BBNaija season 10 edition kicked off with a two-day opening ceremony. The female housemates were unveiled first on July 26.
The male contestants were ushered into the show on July 27, making it a total of 29 housemates.
This year’s winner will take home a staggering N150 million — the highest grand prize in the show’s history since its debut in 2006.
Danboskid and Ibifubara became the first set of season 10 housemates to be evicted from the show.

A heated altercation unfolded at Murtala Muhammed International Airport, Lagos, on Sunday when a female passenger arriving on an Ibom Air flight from Uyo allegedly assaulted a flight attendant and confronted airport security officials.
The incident, captured in several videos shared on X by a user, @OHOgunbiyi, showed the visibly agitated passenger, dressed in a white top and black trousers, yelling at officials who attempted to pacify her.
In one clip, she appeared to physically attack a female air hostess, with eyewitnesses claiming she slapped the crew member.
Airport police later intervened to restore calm after the disturbance drew the attention of travellers and staff.
Reacting to the incident, Michael Achimugu, Director of Public Affairs and Consumer Protection at the Nigeria Civil Aviation Authority, NCAA, attributed the confrontation to the passenger’s refusal to comply with crew instructions.
He urged air travellers to take directives from cabin crew seriously, particularly routine safety procedures such as switching off mobile devices during takeoff and landing.
“When cabin crew ask you to turn off your phone before takeoff or landing, simply comply. I can’t understand why simple routine issues would lead to incidents like this.
“Passengers need to understand they have responsibilities, not just rights. More details will be addressed tomorrow,” Achimugu wrote on X late Sunday.

Suspected members of the Eiye Confraternity have gruesomely murdered a man believed to be a member of a rival cult group in the Alaba area of Lagos State.
PUNCH Metro reports that the killing was the latest in a series of cult-related attacks that have claimed multiple lives across the state in recent weeks.
A video obtained from the Telegram channel of Naija Confra on Sunday showed the victim, later identified only as Hope, sitting on the floor during an interrogation by the suspected cultists.
In the footage, the visibly terrified man introduced himself, saying, “My name is Hope. I live on Abanise Street.”
A second, shorter clip, less than 25 seconds long, showed a bloodied Hope lying motionless on the floor, with deep machete cuts to his neck and face.
The caption accompanying the footage read in part, “We received a video showing Eiye cultists interrogating a man they later killed.”
The killing sparked outrage on social media, with many users expressing shock over the victim’s death.
Njokwu Onyekachi (@Kharchy) wrote, “This dude stays in my area… I watched him grow… a very quiet and easygoing person, ready to apologise even when not at fault.
“He never got involved in trouble.”
Another user, @itzpodoskii, said, “I watched this, and I felt pity and sorrow for this guy.
“Look how innocent he looks, not knowing that’s his last moment. Answering the questions incorrectly.”
Similarly, @Nobemedoyou lamented, “This is very sad. I know Hope very well. Who would have thought he’d be a victim of cultism? Being butchered like a chicken. A very calm and gentle boy who’s jovial. RIP bro.”
Calling for urgent action, Umeh Ikpeazu (@UmmehCassidy) wrote, “The security agencies should act because this is becoming unbecoming. This is so senseless.”
When contacted, the spokesperson for the Lagos State Police Command, Benjamin Hundeyin, did not respond to messages from our correspondent seeking information on whether any arrests had been made.
The killing comes just weeks after a similar incident happened on July 19, when gunmen shot a man dead at Ojo-Igbede in the Ojo area of the state.

The management of Obafemi Awolowo University, Ile-Ife, Osun State on Sunday said it has reported the case of a missing female student of the institution to the police.
A statement signed by the university’s Public Relations Officer, Abiodun Olarewaju, said Dorcas Oseghale, a student in the Department of Chemistry with Matric number CHM/2021/165, had not been seen for four days.
“The student, Dorcas Oseghale, of the Department of Chemistry with Matric number: CHM/2021/165, was last seen on the evening of 6th of August, 2025 at about 8 pm.
“When Dorcas, who resides at Adesanmi House, Ibadan Road, Ile – Ife, said that she was going out to buy food in front of the students’ village, along Ede Road axis of the university, did not return on time, her roommate then made several attempts to reach her on phone but surprisingly discovered that her two lines were not reachable,” he said.
The spokesperson said that at about 3pm on August 7, 2025, the university’s Security Unit began tracking discussions on a students’ social media platform after receiving a report of a missing female student.
“But around 6:10 pm on the same day, a group of students from the Department of Chemistry, in search of the missing student, alongside a female student (Akinkuade Omobolanle Beatrice), from the Department of Agricultural Extension, identified as her roommate, reported a case of a missing student at the Security Unit of the University,” Olarenwaju said.
After considering the complexity of the case and its limitations in terms of human and material resources, Olanrewaju said the Security Unit of the university subsequently detailed three of its personnel to lead the students and report its preliminary findings to the police.
Meanwhile, the Vice Chancellor of the university, Prof. Simeon Bamire, while reacting to the development, commended the students for their proactiveness, having quickly noticed that one of them was missing and promptly reported the same to the appropriate quarters.
He appealed to the police and other security agencies to do all within their power to help find the missing student.
He called on anybody who may have useful information that can assist the security agencies on the whereabout of Dorcas to report to the nearest police station, the VC also said such information can also be made available to the security unit of the university. Former Minister of Agriculture and Rural Development, Chief Audu Ogbeh, has passed away at the age of 78. He died on Saturday.
A statement by the Ogbeh family on Saturday said the elder statesman died peacefully on Saturday.
“It is with deep sadness that we announce the passing of our beloved husband, father and grandfather; Chief Audu Ogbeh.
“He passed away on the 9th of August 2025 at the fulfilled age of 78,” the statement read.
The family described Ogbeh as a man who “departed peacefully, leaving behind a legacy of integrity, service, and dedication to our nation and community.”
“We are comforted by the many lives he touched and the example he set,” the statement added.
The family stated that funeral details would be announced in due course and expressed appreciation to friends, colleagues, and well-wishers for their prayers and support.
