Tetehjewels:You are speaking nonsense. Can the President suspend a sitting Governor? |
NgeneUkwenu:The order of the COA suspended all activities and orders of the CCT. By the way, the CCT does not even have the powers to suspend any judge at any point. So that point is even null. If we can't move beyond this, I think I will pass. Can't continue to do back and forth that is meaningless. |
pinacole1:Please don't say we had you do not know. The CCT has powers equal to a Federal high court. It is not a special court. There are no special courts in Nigeria. It is bound to obey the order of superior court. The Appeal court is clearly superior to it. In fact, the chairman of CCT 2 days ago clearly said what I just wrote above himself. Again, plzz don't say want you don't know again |
NgeneUkwenu:The order of the COA is binding on all persons and entity in Nigeria, and this includes any order that has emanated or will emanate from the CCT. |
Extremely ignorant, chap feeling funky. Did you read what you posted here. I mean properly. By the way, do you undertand what the constitution is and why any other law is null and void to the extent of their inconsistency with the constitution |
CoolAmbience:Enlighten me, your Lordship Before you do so plzz think hard and Long. I do not usually take prisoners |
akdjr:I believe Salami was removed on the recommendation of the NJC. No? Why are you equating it with this? Can you guys just jettison your political persuasions for once and THINK?? |
NgeneUkwenu:The Court of Appeal gave the order yesterday. Start with Section 292, subsection 2. I will be expecting your response after checking these info |
Like I have said in previous threads, Buhari has throw the nation into a serious constitutional crisis which could snowball into questioning the very existence of this nation. It is the most stupid decision ever taken by a head of state that I can remember. And I support groups and states to reject the authority of the President. He has by this very act lost legimacy in my view. An impeachment procedure should also start forthwith. Hopefully, this stupidity would not lead to severe violence- that's one thing am against. We must not allow this to stand. If we do, we are done. |
The CCT or the Supreme Court itself cannot give an order suspending or removing a judge. It has no such powers. The constitution is CLEAR on how a judge can be removed or suspended even when they CONTRAVENE code of conduct: through recommendation of the NJC or 2/3 majority of Senate. Moreover, this same CCT has bee ordered to stay proceedings by a superior court- the Court of Appeal. Good try. |
helinues:Only the NJC can do so. Eve the Supreme court itself does not have such powers |
A full blown constitutional crisis is on our hands in Nigeria now. And with it serious consequences on Nigeria security and very existence. By the way, as stated by the Premium Times article quoted, the President has no right to remove or even suspend any judge talkless of the CJN |
bayarobk:There is no difference. |
seunmsg:I do not know of any such order. Any ways, it does not matter cos the CCT has no such powers. The constitution is CLEAR on how a judge can be removed EVEN IF HE CONTRAVENES CODE OF CONDUCT. That was the clear statement in the constitution. Moreover, the CCT has been suspended by the Court of Appeal. You do know that the COA is higher than the CCT right?? And please dont quote any malaction of former President Jonathan when am arguing a point. I know it is a favourite fallback of you guys. I never supportwd everything GEJ did and you know that. |
wirinet:You have no argument legally speaking, my friend. And you know that. As for the consequence, wait and see. I will quote you when it starts. We are now in full blown anarchy. And it is so unfortunate. |
discusant:Good question. |
Tetehjewels:Which law, certainly not the constitution , says the President has the power to suspend a justice of the supreme court or even a magistrate court. You guys should be ashamed of yourselves for supporting this coup in any way. |
helinues:Don't be silly. Did you read the part of constitution in the OP. Or you have another constitution we dont know about. Even for contravention of code of co duct, the constitution is CLEAR on how the CJN can be removed. By the way, the President only appoints upon the recommendation of the NJC. The same body the constitution clearly says has the power to recommend a removal or suspension. |
somehow:You should own a copy. Check it youself |
seunmsg:I asked you when the CCT sat and gave such order cos I know they adjourned their sitting. Moreover, the CCT has been restrained by the Court of Appeal , which is a superior court, they cannot therefore give an lawful order. Buhari cannot discourtenance a superior court order for that of a lower court. All of this is besides the point, that the CCT or any court for that matter cannot even remove or suspend a serving CJN. The constitution was clear on the 3 ways a serving justice of Nigeria can be removed. My previous post appealed to the good in you- a side I assumed should be unaffected by your political views or persuasion. Maybe I should not have tried. Know this tho: there will be serious consequences for this silly move by the political rascals in the Presidency. |
seunmsg:An order of CCT CANNOT remove or suspend a CJN. They ha e no such powers. Only the NJC or the Senate has such powers. Except the CJN resigns himself. This is the constitution. It is unambiguous. Moreover, when did the CCT go e such an order. The CCT is not sitting at the moment and have been restrained by the Court of Appeal. I need you to think about how extremely dangerous this is. Even if you think it serves your political purpose now. Some things should be beyond politics. I expect t that some of you here should know that. |
wirinet:What are you talking about? Immunity is a constitutional provision which says a person cannot be prosecuted while in office. The CJN does not have such protection and that is why he is bee prosecuted in the courts while in office. The same constitution has also stipulated the ways by which a CJN can be suspended or removed from office and expressly forbids the executive to do so except on the recommendation of the NJC. This was expressly stated in the constitution. Just like with immunity of Govs there are no other interpretation. The President, if this news is true , has commuted a grave misconduct to the constitution and this will not stand. And yes this will certainly lead to this country try burning if true. If you think some forces will take this you are only dreaming. By the way when did CCT give such an order. The CCT is not sitting and has even been restricted by a superior court- the Court of Appeal. |
rexwalters:You are running your mouth any how on the internet. When it starts, and it will soon start, don't run away. I will remind you |
gabbytabby:Did the Gov of Kano resign after we saw him stuff dollars collected as bribe in babariga. There is a reason we have laws and the constitution. If this news is true, wait for the consequences. Cos Buhari and his minions would have bought serious market. |
Not possible..... Buhari and his minions cannot be that stupid. There are only 3 ways a serving CJN can leave office: 1. Removal by Prs5odent on the recommendation of the NJC. 2. Impeachment by the Senate. 3. Resignation by the CJN. There are no other way. And like I said: Buhari is not that stupid. |
Lolz....funny news When did CCT give the order. A court that is on recess and one that has bee restrained by the Court of Appeal. He does not even have such powers even if CCT gave such an order. Only the NJC and S3nate can remove a CJN. If this is true, then Buhari and his minions wants to plug this country to anarchy. Altho am sure it will not stand. |
This useless Gov, owing workers months of their salaries and abandoned road projects everywhere in Ibadan, is advising people on who to vote. SMDH |
Such a pity. Buhari....SMDH |
Can people just not turn this beautiful thread to "tribal" fights. And just imagine what are powerful incubation system the Economist was talking about. An example of the resilience of the Nigerian spirit. A fact that is so ironic compared to the terrible shenanigans of successive Govts. |
I will keep saying this and this is not been political: Buhari is the most useless Leader Nigerian ever had, and hopefully will ever have. |
SalamRushdie:Exactly!!! He played right into the hands of those clowns in APC. Such a pity. |
