The constitution immunized Ganduje against prosecution while the suspended CJ other is not. Against prosecution, Yes. But not against refusing to submit his name as Gov candidate of APC once that video surfaced. That is if APC was serious about fighting corruption. The constitution didn't stop them from doing so. Plzz don't bother to quote me again of you are going to keep repeating something am not saying nor arguing. |

If the Kano House of Assembly can impeach him and make him lose the immunity then he can be prosecuted Why should Buhari tamper with the constitution and the judiciary cos someone is accused of not fully declaring his assets? Silly question |

MrAJQ: He shouldn't have went to Kano for his campaign? APC primaries were concluded before the video surface. APC could have disqualified Ganduje after the primaries. It should not have submitted his name to INEC as it's Gov candidate if it is serious about fighting corruption. This happened way after the release of the video |

Why is Ganduje the Gov candidate of APC in Non in the next elections? How did he pass through the screening committee of a party that says it fights corruption? Are you aware that when a party presents a candidate, it is a declaration that it can verge for the integrity, character and competence of that candidate? Can you say that APC can do so for Ganduje? |

Charge him to court? Remove him from his seat? Or what? Saraki their Mentor was always welcome by Buhari despite having case in court. Gov. Udom was caught transferring 1.2billion naira from state account to Usoro yet his not charged to court. Despite all insults on Buhari from Obj yet he welcome him. He should have as the leader of APC denied him the opportunity of been Governorship candiddate of Kano. And he show not have gone to Kano to endorse him as Gov. |

kahal29: Op do you know more than the CCT chairman, justice Danladi who issued the order? Do you think he doesn't know the section you are quoting or do you think he has not read it over and over again? See before he issued that order of suspension he knew that Onnoghen is going down and there is no way he will extricate himself from the allegations.
Besides if Onnoghen forgot to declare maybe one or two of the accounts maybe it wouldn't have been necessary to continue the case but in this instance he forgot to declare five different accounts which contained various huge sums of moneies in local and foreign currencies.
Haba..... Lolz.... Bros, you are the one who doesn't undertand what that section is saying. The last statement clearly says it is no longer necessary to take the person to CCT. Full stop. That is where it ends. Before the CJN admitted his "forgetfulness" do you think he didn't check the law? He is a fuccking CJN for Goodnews sake. The CJN will not be convicted by CJN, that's for sure. If corrupt practices is linked to those accounts, only high courts can determine that. However, I don't like that aspect of the law. It is a serious lacuna. |

They are beginning to realise Buhari's setting aside of the constitution cannot stand... You dey mind them. They have been totally isolated on this matter like I said they would. Let them play with the core of the Law profession and see if they will survive. And like I said yesterday, no lawyer even those in Buhari Govt would ever openly support what he did. To remove a CJN the way it was done is akin to sticking a knife in the heart of every lawyer. They will start to get a feeling of their misguided ways tomorrow after NBA Emergency meeting |

The CJN does not need and should not step aside( if that means he should resign) cos that would mean that the people who wanted him out for clearly political reasons would have won.
He should RECLUSE himself on matters relating to the investigation once a petition gets to the NJC ( by the way, am still not aware of any petition to the NJC on this matter which speaks volumes).
What of if he resigns and he is later found out to be innocent, does he get back his position as CJN? |

Ivoryd1: Wrong!!!!!!!......... Buhari by law has the right to suspend anyone he appoints, but may not be able to sack or remove them totally.....so dont confuse suspension with sacking or removal....truly he needs senate approval to remove him permanently or sack him....so if u read his orders carefully, you'll agree with me he said 'suspended' till after investigation which can either nail him or acquit him.....moreover the position of cjn requires high level of morality n 'holiness'.....he himself alluded to the fact d@ he forgot to list those items in his declaration form,...my brother I FORGOT NO DEY FOR LAW, OF WHICH HE SHOULD KNOW BETTER AS CJN.....he should have resigned honorably instead of being hounded out of office....I'm not taking sides with anyone, mine is lets condemn his own grave offense being the cjn The CJN is NOT am appointee of the President. Should I repeat that for you so it sticks in? I honestly do not know where some of you keep bringing some of the arguments you guys have been using since day before yesterday. Kapish? |
Politics › Re: Lawyers Say CCT, Ex-parte Order May Be Fraudulent by nameo: 5:03pm On Jan 27, 2019 |
Remember, I raised this yesterday.
I asked where Buhari got the ex parte order from since the CCT adjourned its last sitting and on that sitting did not issue any order. I also asked show come only 2 justices instead of 3 signed the so called order and how come no lawyer was mentioned in the order. Even for a novice in law, these question I was asking is very clear.
Thank God senior lawyers are now beginning to ask same questions.
See there is no doubt here: apart from the fact that an order from the CCT can NEVER remove a sitting CJN, the said order Buhari relied upon was obtained fraudulently. No doubts about that. And this is Corruption and fraud of the highest kind.
Which was why I also said yesterday that no lawyer in Buhari Govt would ever try to defend what Buhari did- have anyone heard from Osibanjo, Keyamo, Fashola or even Malami since yesterday. Shebi Osibanjo is currently running away from scheduled media interview programmes.
Now, those people shouting "anti corruption" when it comes to Buhari can now come and explain how the same Buhari obtained a fraudulent order and based on that removed a sitting CJN for clearly political reasons.

Tetehjewels: You are clearly confused.
First you said removed and I corrected you and now you switch to suspend despite our constitution being silent about suspension.
Pick a hustle.
Suspension and removal are legally different There is a Supreme Court judgement that clearly state that only the NJC has powers to suspend a sitting judge. A judgement of the SC is law in Nigeria except that same court discharged it. This was in the case where a State Gov suspended a judge I think. Do you undertand now or do I need to spoon fill you before you undertand. Depending on your response, I woukd decide wheter to continue engaging you. Don't know how to waste my time. |
Politics › Re: A Lawyers Submission On The Suspension Of The CJN. Must Read. by nameo: 10:31am On Jan 27, 2019 |
Tetehjewels: Yes due process was followed because he was not REMOVED as you erroneously claimed. HE WAS SUSPENDED.
Those words are legally different Don't engage in word gymnastics on issues you know little about. The law and traditions is clear: nobody has the powers to SUSPEND a sitting judge except on the recommendation of the NJC. This is a supreme court decision on this and that is the subsiting law operative in Nigeria(see the response of Falana SAN as eluciated yesterday). It is also the tradition of the NJC. Moreover, if the constitution wanted a situation where a judge can be suspended using a different means, it would have stated it clearly. So those persons who differentiate between Removal and Suspension are either extremely ignorant of the law Or are be wickedly disingenuous of the law. |
