A very Good example is the case of former Italian prime minister Silvio Berlusconi who was charged to court for the crime of 'Paying a girl under the age of 18 for sex' which is illegal in Italy. He beat the charge at appeal by claiming that though the girl was under 18, the sex was consensual and non-transactional which isn't an illegal act in Italy. She was 17, he was 74.

3. Italy does have an age-restriction clause, but that applies to girls/boys already under the age of consent limit, and is subsequently irrelevant to this discussion.

Secondly, Even though sex between two adults(e.g two 40 year olds) is legal, the law most definitely has a clause requiring it to be consensual, so I'm not exactly sure what point you're trying to make here.

Your post makes numerous references to trusting behaviour. "She trusted", "She assumed" "They were friends for two years"

Your problem is that you're attempting to intellectualize a situation that calls for common sense instead. To assume that Nigerian society is benign is to be infinitely ignorant of the nature of the beast.

It's better to be careful and avoid situations that put you in this kind of scenario, than to willing put yourself in vulnerable position, under a foolish assumption that everyone else respects your human rights.

The law is clear. In Spain, Consensual sex with a 13 year old is legal with no age restrictions. In Italy, Consensual sex with a 14 year old is legal, whilst consensual sex with a 13 year old has age restrictions.

In Spain the legal age of consent is 13(Though this goes up to 16 next month). The only caveat to this is if the adult was found to have used 'deception' to gain an advantage with the minor. That's a link to the Spanish penal code dealing in sexual harrasment. Help yourself.

As with all cases of sex, there are conditions that determine it's legality. I'm sure you don't think sex with a 21 year old is illegal, simply because in some cases(non-consenting) it can be deemed illegal.
