ericdundee: I submitted a visa application for Renewal under drop box but got a 212G form when I went to pick up my passport. I was required to reschedule a visa appointment which was supposed to be in February 2019. But all of a sudden I was moved to a weekend in October 2018. I attended the interview and was accused of lying about reasons for procuring my original US visa. No documentation was requested from me by the interviewing officer. He just said he didn’t believe me and then he gave me the blue 214b slip and the 212(a)(6)(C)(i) Material Misrepresentation. I have read about the 212 Material Misrepresentation and it carries a lifetime ban. I have approached an immigration lawyer to write to the consulate and this has been done… but the US consulate has not responded. I am a law abiding citizen who notified the US consulate in writing well beforehand that I would be traveling to the US to have a baby and I paid all my bills. Does anyone know what I can do to get a solution as I believe I am the victim of discrimination, erroneous and arbitrary determination that I have made a material misrepresentation to the US government. I think u have to try and remember how ur interview went What u filled in your form Your place of work salary etc that your wrote there It might not necessarily mean that you had a baby I know a few who lies about been preg they where not given a ban just denial Pls check urself hopefully the immigration lawyer write up yields results |

KennyMKO: Good day folk, just to give back to this forum. My family and I landed in Houston Texas yesterday at precisely 4.05pm(11.05pm Nigerian time) on Emirates Airlines. Firstly, for those that need 'fit to fly' to travel to the US ensure you insist that your Dr states clearly your EDD on the letter as some Airlines(including Emirates) have some unwritten rules pertaining the letter now.If the EDD is not reflected on your 'fit to fly', make sure you have a very recent ultrasound scan to back the letter or have your Dr's mobile number handy to avoid being disallowed from embarking the aircraft. Again, get to the airport early to avoid unnecessary pressure and to create enough time for scrutiny by the airliners. On getting to IAH Houston POE, the following ensued:
Me: Good day CBP Officer: Passport Me: Forwarded my family passports CBP Officer: How many of you? Me: 5 CBP Officer: Ok CBP Officer: Why are you here? Me: For vacation and childbirth CBP Officer: Looks at my wife, your wife is pregnant right? Me: Yes CBP Officer: You have family here right? Me: No CBP Officer: How much do you have with you? Me: XYZ Dollars cash, ABC Dollars in card CBP Officer: Where do you work? Me: DEF company in Nigeria CBP Officer: How long have you been there? Me: 13 years CBP Officer: What's the company into? Me: It's into ..... CBP Officer: You have been here before? Is this their first time(pointing to my family)? Me:Yes I have been here over 10 times, was here in August. No my wife and first two children were here before, the last is coming for the first time CBP Officer: Are you coming to live here? Me: No CBP Officer: How long will you be here? Me: 5 weeks CBP Officer: Ok, four fingers on the scanner. My passport alongside my children's were stamped in for 6months after matching their passports with them one after the other. He then called my wife to fourprint her fingers. Afterwards, he gave me my children'spassports and my passport to me and told my wife to step aside while we should go and wait for her. We waited for 2 hours downstairs before she appeared. She was taken for secondary scrutiny. She said her interview was not more 5 minutes but people were many in the room. From her experience there, it's very important to have a believable story. One woman was about to be returned to Nigeria because her story was somehow awkward and easily faultable. The woman agreed that she is pregnant when asked but her return ticket is 25th December meanwhile she has about 12 weeks before her EDD. When asked if she intends to deliver in USA, she said she may if she enters labour before leaving. Another woman came with 3 children, one of them a US Citizen. She forgot her Zero balance and Itemized bills in Nigeria. Though they eventually stamped her in , but they warned her to never forget to travel with it next time. Another Permanent Resident was also taken for secondary interview because he has gone out of America for long. It's obvious that the Officers have stiffened up than before due to the Top Stance to Birth Tourism.
I wish everyone preparing to come or preparing for Visa Interview all the very best but preparation and overpreparation is extremely imperative.
What port of entry was this ? |

2. ask my husband to reapply lest they change their minds about you and the other children's visas.
my 2 cents I agree with you Let her just travel with her kids before she causes problem for herself |

Shiebi: Hubby and I were also denied visa in May this year.
I had no change of intention frm the visiting visa to the medical visa. But we were not denied on that ground. Ours was that we didn't take our bills and receipts along, and because we were still on a payment plan.
We applied again in July, and got a date in Nov. Applied for an expedited interview date but was declined that child birth is not a real emergency.
Exactly, one week ago, we were before another VO, we had our bills and reciepts and zero balances this time. And we were honest about the failure to procure a change of Intention for the previous birth, and apologised. She stated categorically that there's nothing wrong in having a baby with a visiting visa. We were shocked!
She asked their usual questions. She handed us the white sheet and added that they'll need time to go through the payment documents we handed her for the previous birth, and that we'll receive an e-mail or sms expressing their decision on our application. I was so nervous at this point that I'm not sure I included all my itemised bills. DH said he heard her say that the visa decision will be made in a day or two. But the white sheet says within 60days. It's a week now no info.
Am really worried for the following reasons; 1. My EDD is middle of nxt month, and am really big and exhausted by now. (P.S. I'll be going with a 2yr old toddler). 2. Have cancelled my appointment with my doctor severally. 3. Am considering writing the Embassy, to inform them about the urgency of my case, and to add that the visa will be useless to me if it's approved after this period. Cause I refused buying ANYTHING for my LO's birth cause I planned to shop there. Didn't want to carry much load. OR Should I give up on the visa and start plan B of having the LO here, and start shopping for him.
4. My mom had already traveled in October to wait for me, cause she said she can't travel in d cold.
Am very sorry for the long post. Pls help! Am not together at all. This happened to my sister Don’t worry they know ur edd and wud give u before then just pray U get it before then |

Oleayo22: I went fory 221G interview this week and here are few things I can remember. Brief summary of my journey I applied for b1b2 visa in 2014 and I traveled for vacation. Did drop box in 2016 and I applied using b2 and stated childbirth as my intention. Visa was issued and I traveled in 2016 to give. Applied via drop box again in August when visa expired to use it for another birthing purpose which I stated in my form.
VO: hello and how are you? Me: I am fine thank and you Ask for my passport and I passed it to her. VO: why do you want to travel to the US? Me: for vacation and childbirth. She type for a few seconds after going through my passport and mentioned that I traveled in 2016 and asked what for. Me: yes I did, to have my baby. VO: asked how much the whole thing cost Me : I told me $8000 She then went on about if I know how much it cost to birth in the US normal delivery not to talk of me that did C-section. That it's not possible that I will get a bill that small. That they are passing it to government without me knowing. Me: I told her I didn't know that, when I called the financial counselor to inquire. I asked for what they charge self paying patients and I was sent that document which is in your hand. I told them that I don't want to use medic aid and for every service rendered I ensured I pay cash. VO: asked my intended date of travel and when am due. Me: so and so day. Then gave her my edd but explained that this might come earlier than cos of the way my first came due to a health condition that I developed. She now capitalised on that saying didn't I know that I was going to give birth that I left naija in October that I should have known. I was shocked at what she was saying and I had to reiterate what I had told her earlier about applying with a b2 visa and stating my intention both in my drop box and at the POE. VO: typed for a while, looked at my receipts that I gave her and said, OK let's do the maths cos what I have here is not totaling how much you said you spent. She did and said what she had was just 4k dollars. Me: I don't have doctors itemized bill as well as that of the anaesthesia ,just zero balance letter. VO: apologised for the trouble but that she will like to see all my itemized receipts for previous birth. She also asked if I had applied for visa in another country recently . Me: yes VO: which country? Me: Canada Vo: is it for citizenship reasons bla, bla? Me : yes and that's one of the reasons am applying for this visa as well. Vo: brought the white paper and asked me to take my receipts to DHL without my passport. Me: thanked her and left. What I have learnt from this Insist on itemized bill from everyone that is involved I.e from doctor, to pediatrician, to hospital, to anaestologist . Zero balance is not cutting it again.
U are one lucky babe Please putt everything together am sure they want to issue u the visa and have given u a good opportunity don’t mess it up Wish u all the best |

Seyeedat: Hello everyone. I think the VO's don't want to be giving out Visas to expecting mom especially first time travelers even with strong ties here. I was denied yesterday, in fact 99% of the people that that came yesterday was issued blue papers without looking at documents. I saw people with travel experience that were denied and yes they hardly look at documents, it's just one old woman that was issued white paper.
I thought my case would be different as most people were for Visiting Visa, but NO, the officer only asked why I want to go to the US, where I'm going, where I work and what hubby does for a living which I answered. That was just what he asked then gave me the blue paper. Same as another preggy lady too, and that they don't look at documents is alarming coz it seem they've decided not to grant Visas yesterday.
A lady made a scene and was cursing the female VO that denied her, saying she chose not to give her Visa as she didn't even look at her documents. Moving on as I trust God's plan for my little one. That the problem with Nigerians entitlement mindset If they don’t give u try again! what wud cursing do than affect future chances Let’s be wise Abeg |
