ABUJA: Human rights lawyer and Senior Advocate of Nigeria (SAN), Femi Falana, has faulted the ongoing wave of demolitions in Abuja and Lagos, describing the exercises as unconstitutional, illegal, and a gross violation of citizens’ fundamental rights to property.



Falana, speaking during a live interview on The Morning Show, an Arise News program, insisted that no governor, minister, or political officeholder in Nigeria has the constitutional authority to unilaterally order the demolition of buildings, regardless of the alleged infractions.

According to him, both the Federal Capital Territory (FCT) and the Lagos State Government have acted outside the law in their demolition drives, which have rendered thousands of families homeless.

“Under our constitutional arrangement, no governor or minister has the power to wake up one morning and order that someone’s house be demolished. You must follow due process. The law requires that statutory notices be issued, complaints heard, and the proper tribunal or court must decide before any demolition can occur,” he declared.

He explained that Section 43 of the Nigerian Constitution guarantees every citizen the right to acquire and own property anywhere in the country, a right also reinforced by Article 14 of the African Charter on Human and Peoples’ Rights.

“The provisions of Chapter Four of the Constitution are sacrosanct. They cannot be breached under any guise — not even by ministers or governors claiming to restore order,” he said.

The senior advocate condemned the recent demolitions in Abuja ordered by the FCT Minister, Nyesom Wike, and the controversial midnight demolition of the Oworonshoki community in Lagos, describing both as “acts of executive lawlessness.”

He noted that in Abuja, the Urban and Regional Planning Tribunal, established by law to handle such matters, had been sidelined, while in Lagos a subsisting court order restraining demolition was allegedly ignored.

“In the Lagos case, our law firm obtained a restraining order from the High Court. The order was duly served on the government, yet, in the dead of night, bulldozers rolled into Oworonshoki. That was a clear contempt of court,” he added.


He vowed that the victims of the demolitions would seek redress, revealing that similar cases had previously led to heavy damages being awarded against government authorities.

“In Abuja, the court recently awarded ¦ 200 million against the FCT for unlawful demolition. In Lagos, ¦ 3.5 billion was awarded for the Makoko demolitions. The victims will get justice again,” he said.

Falana lamented that some government officials have become more reckless in a democracy than military dictators once were.

He said: “Even under the military, the courts insisted that due process must be followed. What we are seeing now is worse. You cannot demolish people’s homes while they are asleep, tear-gas their houses, and claim to be enforcing the law. We are not in Gaza.”


The senior advocate also reacted to the recent controversy surrounding the Presidential Committee on Prerogative of Mercy, chaired by the Attorney-General of the Federation.

He described the erroneous inclusion of unqualified names in the presidential pardon list as a national embarrassment and called for accountability.

“Those who recommended convicted persons for pardon when they were not eligible should face sanctions. It is not enough to quietly withdraw the names. The Attorney-General owes the nation an apology for this colossal embarrassment,” he declared.

Despite skepticism about enforcement, Falana insisted that the courts remain the ultimate avenue for justice and vowed to hold the violators accountable.

“Wherever victims of injustice come to us, we do not turn them away. We will ensure that justice is done, even if the heavens collapse. Nobody is above the law in this country,” he declared.

Peoples Democratic Party (PDP) has described the judgment delivered on Friday by a Federal High Court in Abuja stopping on its forthcoming convention as an ‘assault on Nigeria’s democratic process’.

The party’s National Publicity Secretary, Debo Ologunagba, in a statement in Abuja on Friday, maintained that the court order would not stop its planned national convention.

Ologunagba said that the party was appalled by the judgment delivered by the presiding judge, Justice James Omotosho, in a suit challenging the legality of the party’s processes leading to its planned Nov. 15 convention in Ibadan.

“PDP states that the judgment of the court does not vitiate its ability to proceed with the processes and activities towards the national convention to elect new national officers to pilot the affairs of the party for the next four years.

“Our party notes the recent judgment of the Supreme Court which affirms the supremacy of a political party in the management of its internal affairs,” he said.

Ologunagba urged party members, chapter and organs to remain steadfast and focused on preparations towards the holding of the national convention as scheduled.

“PDP, as the leading opposition party in Nigeria committed to the rule of law has, accordingly, directed its lawyers to take immediate action to appeal this judgment in our unwavering determination to uphold, defend and promote multi-party democracy in our country,” he said.

President Bola Tinubu displayed his personal philosophy and showed “where he is coming from” when he granted clemency to some drug traffickers and the murderess Maryam Sanda.

Mr Onanuga told ARISE TV on Thursday night that the president’s decision was informed by his “personal philosophy” of compassion, shaped by his life experience.

“Even the second list still contained some drug offenders, who were also given clemency, not pardon. Maryam too was given clemency,” Mr Onanuga said, addressing the criticisms that trailed Mr Tinubu’s first pardon for 175 people. “Their sentences were commuted, so to say. The president, on his own, is a compassionate person. Some of the things he does at times show where he is coming from, his own personal philosophy, attitude, and a lot of things. He has compassion.”

On October 11, Mr Tinubu announced a pardon for 175 convicts, including scores of drug traffickers and Ms Sanda, who murdered her husband, Bilyaminu Bello, in 2017, sparking public outrage. Following the outrage, Mr Tinubu made a reversal.

Mr Tinubu, 73, a politician perceived as benevolent and compassionate by his supporters, emerged as Nigeria’s president in 2023, despite his sordid antecedents, which included alleged cocaine trafficking and certificate forgery in the United States.

In 1993, Mr Tinubu’s involvement in narcotics trafficking saw him forfeit $460,000 to the U.S. government. In 2022, the U.S. District Court for the Northern District of Illinois released documents holding Mr Tinubu’s encounter with American authorities over allegations of narcotics trafficking and money laundering.

While allegations of forgery taint his Chicago State University certificate, Mr Tinubu has continued a fierce pushback against the demand for his record with the Federal Bureau of Investigationto be released.

In January, Peoples Gazette exclusively reported how Mr Tinubu dolled out $2.7 million to hire lobbyistsin the U.S. to help convince lawmakers and policymakers that he possesses acceptable personal probity to lead Nigeria, after suffering a reputational hit following reports of his involvement in illicit drug peddling and certificate fraud.

A Federal High Court in Abuja has sacked the member representing Gummi/Bukkuyum Federal Constituency in the House of Representatives, Abubakar Gummi for defecting from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC.


In a judgment, Justice Obiora Egwuatu, barred the Speaker, House of Representatives, Tajudeen Abbas, from further recognising Gummi as a member representing Gummi/ Bukkuyum Federal Constituency.

The Judge also made an order directing the Independent National Electoral Commission, INEC, to conduct a fresh election to fill the vacancy for the constituency within 30 days from the day of the judgment.


According to the News Agency of Nigeria, NAN, though the judgment was delivered on Thursday, the certified true copy was sighted on Friday.

The suit, marked: FHC/ABJ/CS/1803/2024, was filed by the PDP and its state’s Chairman, Jamilu Jibomagayaki, as 1st and 2nd plaintiffs.


Gummi, in his response through his lawyer, filed a notice of preliminary objection and a counter affidavit, arguing that his decampment was due to the crisis within the PDP.

According to him, contrary to the plaintiffs’ deposition, the lingering, unresolved internal and external crisis, both at the national level and in his constituency, is the reason for his defection from the party to the APC.

The federal lawmaker stated that the crisis resulted in a state in which he could no longer properly represent his constituents or ensure that they all benefit from the shared distribution of the dividends of democracy within the bounds of law, without undue interference from anyone or anything.


Delivering the judgment, Justice Egwuatu granted all the plaintiffs’ reliefs.

The judge condemned the attitude of some politicians who see defection as a normal practice.

The 2023 presidential candidate of the Social Democratic Party (SDP), Prince Adewole Adebayo, has criticised President Bola Tinubu’s approval of a 15 per cent import duty on refined petroleum products, describing it as an exploitative and anti-people policy.

Speaking on Channels Television’s Politics Today on Thursday, Adebayo accused the president of overburdening Nigerians with taxes, saying his administration was more interested in revenue collection than public welfare.


“President Tinubu is a clever tax collector. He wants to collect taxes from you for everything, including the oxygen tax very soon. If you’re not careful, yes, the air we breathe. Just give him time; he’s going to get there,” Adebayo said.

He described the newly approved import duty as unjust and inconsistent with the ideals Tinubu once espoused.

“It is an anti-people decision and a trend in the new Tinubu,” he said.

“Tinubu that used to be in SDP, following Abiola everywhere doing Hope 93, has practically changed to the side of the money people. They see you as a customer, not a citizen.”

Adebayo argued that the policy would worsen the hardship of Nigerians already grappling with rising living costs.

“If you put 15 per cent tariffs on imported petrol, who is going to pay for it? It’s going to be paid by the person who buys the petrol at the filling station,” he said.

The SDP flagbearer faulted the federal government’s continued reliance on imported fuel, blaming it for failing to rehabilitate the nation’s refineries despite repeated investments.

“You are the reason why we cannot meet our domestic consumption. The president is the Minister of Petroleum. What kind of chaotic system is this?” he asked.


He urged President Tinubu to prioritise refinery repairs instead of introducing new taxes. “Call Heineken Lokpobiri and Bayo Ojulari and say, ‘I want those refineries to work in six months.’ Reduce importation to zero,” he advised.


Although the federal government has defended the new tariff, saying it is meant to protect local refineries and stabilise the downstream sector, Adebayo believes the president should focus on fixing refineries rather than imposing more taxes

The recent government memo proposes a 15% tariff on fuel imports, claiming it will deliver “national energy security” and “market stabilisation.”

Let’s examine these generous fictions.

“This Will Reinforce Energy Security”
Apparently, energy security now means making fuel scarce and expensive. The Dangote Refinery produces far below Nigeria’s 66-million-litre daily demand, yet the solution is to tax the imports that actually keep vehicles running? Brilliant. Nothing says “security” like eliminating your backup supply before your primary source works.

“Imports Undercut Local Production”
Translation: our $20 billion refinery can’t compete with imported fuel, so instead of asking why, let’s just ban the competition. Global refineries face import competition daily without requiring their governments to kneecap rivals. But Nigerian consumers should pay premium prices to protect a facility that promised efficiency but delivered excuses.

“The Tariff Will Improve Affordability”
This might be the memo’s boldest lie. A 15% duty adds ₦95–₦100 per litre, which becomes ₦140–₦165 after transport, storage, and margins. Food costs rise. Transport fares jump. Businesses close.

But sure, let’s call economic strangulation “affordability.” Nigerians have already survived subsidy removal and currency collapse; why not add extortion to the list?

“This Serves Public Interest”
Twenty marketers sell Dangote fuel ₦100–₦120 above import prices—no competition, no consequence. The same refinery demanding protection from imports quietly imports its own blending components. The hypocrisy is remarkable: imports are dangerous unless we’re doing the importing.

This isn’t public interest. It’s a protection racket with legislative approval.

The Bottom Line
Nigeria is being asked to accept monopoly pricing, supply uncertainty, and economic hardship, all to protect a refinery that can’t deliver on its promises. True reform would allow competition to expose inefficiency, not reward it with tariffs.

If this passes, remember: it wasn’t policy. It was a heist, and the government held the door open.
