What am saying is that FHC ABUJA or FHC anywhere in the country does not have power to stop the CCT from Sitting. That is the position of the Law. Let me use a familiar example. It is like a Dean of Faculty of Science issuing an Order that the Dean of Faculty of Law should not conduct exam. What we are saying is that the Deans are on the same level irrespective of the age of the individual holding that position. The only person that can issue an Order stopping the the Dean of Faculty of Law from doing anything is the VC or the The University Senate. So also we are saying the Only Court that can issue an Order that the CCT cannot but obey is the COURT OF APPEAL. QED. |

Even as a lawyer, if I don't have answer to a post, I can quickly go to google and seek answer. All you needed to do was to google code of conduct tribunal, you would have seen the ACT of National Assembly enacting it and in section 2 (4) and (5) as reproduced by someone above and that appeal from the CCT lies to COURT OF APPEAL, it also implied that it is ONLY the COURT OF APPEAL that can give an Order that the CCT would obey. By the way, you don't have to abuse people who hold different opinions from yours. |

baralatie:I disagree sir. Please note it is CCB (Organization ) and not CCT (Tribunal) that was summoned. It is like saying a Judge of High Court in Lagos summons a Judge of High Court of Osun. No judge can summon another except you are summoning the judge on his/her personal capacity. |

baralatie:I think it is an abuse of Court process for a Court to summon you and you appear telling the Court that you have an injunction restraining the Court from trying or inviting you. Except you had a case in a Court before hand and the same party in the case went to another court on the same cause of action. |

chukwudi44:A court can ignore another court's or tribunal's order but No individual can ignore a court's call most especially in a government that is ready to work. EXCEPT that person bolts out of Nigeria and stays outside until after the life of the government. The latter option may be better. |
adadadon:Thanks for your information but please let me add that it appears some of our senior lawyers when they have practiced for a long period like 10,15, 20 years do forget the fundamentals of the court system. I learnt in my days as an Undergraduate (100L) that under the Nigerian Legal System, the HIGH COURT, FEDERAL HIGH COURT, SHARIA COURT OF APPEAL and ANY TRIBUNAL as well as the Newly Accredited by the Constitution- The INDUSTRIAL COURT are courts of co-ordinate jurisdiction. What that means is that none of those courts above can issue an order against one another. Appeal from all those courts go to Court of Appeal. So it is the Court of Appeal that can stop the CCT and you know, Saraki cannot head to Court of Appeal as a court of first instance- so the gimmick is go to FHC and if it does not work, on the foundation of the FHC Ruling, either party can now go to Court of Appeal and later to Supreme Court, thereby delaying the arraignment. The best bet is for the CCT to disregard the FHC order as is only persuasive and not binding. FHC= Federal High Court CCT = Code of Coduct Tribunal. |

One of the challenges we have is the Judiciary, I have had cases in court where we need the court to hear an application for the release of inmate detained unjustifiably by asking for Fundamental Right, the fastest you will get hearing from the court is 2- weeks and above, simply because the person involved is not a VIP or wealthy. Saraki was served on Wednesday and he already had the audience of another court that same day. If this is how our court operates normally, by now our society would have been better. If you are privileged to know anybody working in the Prisons Service, tell them I told you a lie, that 30-40 % of people in our prisons Nationwide are AWAITING TRIAL (some of them are innocent and only need the court to fast tract their hearing until the court sets them free), some of them spend decades in the prison without conviction and sentence just because the Court would be dragging on their issues. If the court gives this kind of speed (24 hours) to cases concerning the poor, then we would have a just society. By the way, I thought he should have filed a Preliminary Objection at CCT instead of Ex -Parte application in another court. |

He should have done asked for advance salary and pay for apartment near his office. For example from Agege to Ikeja is N50, sometimes N70 or N100 and commuting time is between 30 mins to 50 mins. If he is unable to get around Orile Iganmu and he gets a good paying driving job in Ikeja, Ogba, Agege, please let him take it and strike a deal. They will give him advance salary to get an apartment and if he is honest, his original copy of driver licence can be used as a collateral. I will note this thread in case I see something good. |

Hello, I have 3 bedroom flats in County Estate, by Pen Cinema, Agege. It is a wonderfully arranged Estate of 29 blocks of 3 bedroom flats. I have a 3 bedroom with POP ceiling and A/C and neatly tiled for N22m. I have another one with basic things in a flat for N20m. Please speak to your client about it.
