When you asked a lawyer to sue someone on your behalf, he files let us a say a process asking the court to help you recover money- this is called the Substantive suit. Now while you are trying to recover the money, you heard that the person wants to sell all his properties. If he does that you won't be able to recover nothing. So your lawyer rushes to the Court to file what we call interlocutory application to stop him from selling his properties pending the determination of the substantive. Now, you cannot have interlocutory if you don't have substantive. In this present case, the interlocutory was filed on January 9, 2019 while the substantive was filed on January 11, 2019. How is that possible? It is like you have a house and you are now putting a foundation on it. Now to the Order, when a court gives an Order, it is usually like , Upon the motion on Notice/Ex Parte dated .... And upon hearing Ojike Ebere Esq (that is the lawyer that came to court to argue ) for the plaintiff, It is hereby Ordered.... Now the Order did not satisfy this rule. |

Tetehjewels: Prior to the CJN being tried he has to by way of honour step aside from his office. He is not an ordinary lawyer he is the head of all legal institutions In the land and thus cannot be a judge in his own case. This is simple natural law.
He refused to step aside and instead went ahead to suspend the meeting of the NJC which he is the chairman just to ensure they do not meet to remove him.
He also went to so many courts to get stay of order ruling even as far as the Nigerian industrial court to get a stay of order. Imagine that.
It was only right for the CCT to order his suspension and not his removal pending the outcome of his case.
Besides, the constitution only places limitations on Mr president when it comes to removing the CJN but not when it comes to suspending him.
Mr President did not break the law by suspending him, if he had removed him then would he have gone against he constitution.
Suspension and Removal are not the same thing.
Our constitution empowers the CCT to issue punishments as interpreted thus

The CCT has power to try any Public Office in relation to offences of non declarations of assets or assets that is not commensurate with your salary and the CJN judgment ON the CCT is okay. 3. Section 7 of the CCT Act prohibits having foreign account. 4. Look at section 23 of that Act. Sub section 1 says....' Where the Tribunal finds any Public Officer GUILTY...... Then punishment includes Vacating that office. So what we are saying is that the CCT has not followed that provision. A man has not been tried, he has not been found GUILTY and you are issuing an Order that he should be suspended. Under which provision of the law? |
