This is a lost case. There's no place in the constitution where they said one can't be president for more than eight years. Even in the Marwa and 1 other v. Admiral Murtala Nyako and others (SC 141/2011) case, the court held that ‘the constitution has no room for a cumulative tenure exceeding eight years.’ Emphasis on the word "tenure". Jonathan has only done one tenure of four years. The previous tenure wasn't his but that of Yar adua. Thus Jonathan is eligible for his shot at second tenure of four years.

Also if you look critically at section 137 (1), subsection b, it says: A person shall not be qualified for election to the office of President if he has been elected to such office at any two previous elections. Emphasis on the word "elected". Jonathan has only been elected into office once. The previous opportunity he had at been a president wasn't via election but via Yar adua's death. Thus Jonathan is eligible to seek to be elected into office for the second time.

The courts don't just grant stay of execution like that oh! You have to show among other things that if the judgment is enforced the rem in it would not be persevered. I don't see anything the courts need to preserve here.

Since the Ag Governor Umar Fintri has appeal the judgement. The question is,will the election still hold on Saturday? And will Supreme court be able to give accelerated hearing and judgement before saturday? This is a serious constitutional crisis. We are learning democratically, and the Adamawa political game is getting more intresting.

That someone appeals a court decision is not final. You are expected to file a stay of execution of the judgment pending the determination of the appeal and the stay must be heard and granted.

However, while your appeal and your stay of execution are still pending, the judgment must be obeyed. No story. No constitutional crises. For me that guy would be sworn in and that would be the end. The house should not have accepted that letter. Except they do judicial abracadabra, the outcome would always be the same in Court of Appeal and finally in Supreme Court.

Let me add that it is not likely they would issue exemption to you once you are 30+, since their record will show that you were mobilized.

I see that you have likes for your quote. That is good. Please if you meet those criterion don't hesitate to apply. Workforce is like a training ground. They recruit an average 50/70 companies' entry level in Nigeria (with the exception of Oil & Gas/ Servicing). 'I run my own law office', so please don't think I am a marketer for them or something. I just feel if you have an information others don't have it is not bad to pull it out. It does not mean I am pleased with the criterion either.

Your position seems to be alright, most importantly when I see about 6 likes. But let me give you an Idea about how the Constitution runs, even though it appears as if there is generally lawlessness ever in the land. In a normal country setting, the Constitution is supreme. That is the basis upon which other laws are made. Thus, the SSS came into existence by the instrumentality of a LAW/ACT of the National Assembly, if there is any provisions binding on DSS as they are sometimes called, it is the provisions of the Constitution first before any other law.

The implication is that the SSS is bound by the Constitution. The Fundamental Human Right as enshrined in the Constitution and other codification is inalienable, once you can prove that it has been breached, you do not need to bribe a judge before they will grant your reliefs/prayers.

Thanks for your post? Nobody is asking any question? What is the Air Marshall doing in Nigeria? Who attacked him? Was it in the company of other Marshall? How come he was immediately flown back to the US? Can someone who does not know a Marshall from the US attack them? How come it is only the Marshall that was attacked despite that we have hundreds of white skin folks trooping into Nigeria daily? There are enough questions and like someone said, if you have been to the airport lately and see the hordes of security agents there, it would be difficult to believe this story.

The problem is that they don't trust that SME can give them as much return as the Big wig. How much would they possibly make from someone whose profit is not guaranteed? The CBN need to put in place measures to ensure SME can on a normal basis access funds from our Banks. Not setting aside a huge sum like they recently did (the gesture is appreciated but hope the fund would not be embezzled).

Goodluck Jonathan had better use his thinking cap and ensure there is a primary, it's better he rigs it and win, that way he has shown small democratic tendencies but if he uses veto power to impose himself he would only create more enemies and further alienate himself from the northerners.

Am waiting for someone who would say the North doesn't matter.

Yes you are right! But I think we should allow the government do their work. Please do you have children? Have you been to their school? Do you know the ratio of teacher to pupil most especially in these private schools who are making terrible money? The issue is this, the population of children in religious places and markets cannot be compared to that of schools. Even at that parents can still help their wards in those places, in terms of washing hands, sanitizing hands etc. If they are in school, who would do that for them? I see this cry as that of revenue loss and not concern for the children. Like someone said, mine would be at home for now.
