From the word go PMB told them that he does not want to intervene in NA matters but that the NA should work with the party to ensure that whoever comes into those offices must not be under any investigation, have any allegation or being tried in any court of law. Even though,Saraki has not been tried or convicted, there were enough allegations him. Even though nobody is a saint among the politicians, but let us have those who have not eaten dry the common pot to be on the management. That will effectively give Nigerians the impression that APC wants to fight corruption.

1. It's expressly stated in the constitution that CCT has jurisdiction to try politicians or public servants for these sorts of offences. Therefore, you can't get an order to prevent you from being charged for an offence at CCT. What you can do is raise preliminary objection when charged. You can accuse the judge of being bias and ask him to recuse himself or even challenge the competence of the court to hear your case.

2.Agbakoba is just blowing hot hair. These are the relevant sections of 1999 constitution:

An appeal from CCT lies to the Court of Appeal, not the High Court of a State or the Federal High Court. This is different from customary court where an appeal can lie to the High court. Since an appeal from both the CCT and the High Court (federal or otherwise) lies to the Court of Appeal, it follows that both CCT and High court are courts of coordinate jurisdiction on the specific issues that pertain to asset declaration. You need Court of Appeal, not High Court, to restrain CCT or overturn its verdict. There is nowhere it is written in the constitution that a High Court can overturn the verdict of CCT. So how can a court order from a high court restrain CCT? It's just like saying an Abuja high court has restrained a Calabar high court from taking a case, it doesn't make sense.

3.The charges against Saraki are weighty and criminal in nature. His actions are those of a man willing to use the courts to delay the wheel of justice. If he is truly innocent, he should submit himself to trial and present evidence to debunk or refute all allegations against him. It just doesn't make sense for him to say he should not be tried. It would make more sense for him to challenge the prosecution to prove its case. The onus is on the prosecution to prove its case, so why is he afraid?

4.Except he is sparkling clean, I don't see how he can come out of this unruffled. Even if he can somehow miraculously prove he owns all the assets legitimately, there is still another dimension of scrutinizing if he paid adequate taxes.

As much I respect Agabakoba, he is not the Court of Appeal or Supreme Court, thus all he is saying is Obiter. Until the 2 Upper court decides otherwise, we hold that CCT is on the same level with FCH/HC.

You still haven't said any judicial authority and obviously i didnt ask for a stay of execution definition or metamorphosis . Saraki would be arrested before Monday and even if not arrested the CCT would definitely sit before the Appeal court and number 2 most of Sarakis premises are faulty and not tenable for example looking at the premise that the AGF is needed before a suit can be filed or charges brought is bewildering as the Supreme Court killed this controversy to rest more than a decade ago in AG Federation v ANPP (2003) 18 NWLR (Pt. 851) 182, by holding that the office of the Attorney General is a body corporate with perpetual succession, and continues to function, irrespective of whether there is a sitting AG or not.
The federal High court can also not have a binding precedent on the code of conduct tribunal and his frivolous motions are mostly ballons being fired as cannonballs and only a very biased Appeal court will listen to his appeal or order a stay of execution based on a dispute he created with the aid of his lawyers

When you bring appeal against a ruling or judgement of a lower court to an upper court, the appeal in itself cannot operate as Stay to the said ruling or judgement. The proper thing is for the appellant to bring an application for Stay of execution for the ruling or judgement being appealed. Of course it one thing to file it is another thing for the Court above to grant. The Court above must look at the Merits of the application vis a vis the guidelines for granting a Stay. These are the things I expected a legal mind to postulate rather than coming to say the CA would not grant the Stay application. That was why I asked to cite your Authority in support of your position.

You meant dumb. Anyway, in this kind of situations, you cannot say a lawyer is dumb. It is always allowed that you should defend a person until the Court has found him/her guilty. I understand how you feel but like I said earlier in other threads, they are just looking for a way to buy time.

And like other folks have mentioned above, Appeal does not Stop an order of court being executed. It is only when you have an Order for Stay of Execution pending Appeal and in the word of the dbanj, Saraki is on long thing. Before he perfects all these applications, he would have been arrested. Excepts he chooses to stay outside of Nigeria until the Order for Stay of Execution is granted.

Since time immemorial Court/Tribunal have been fixing date and nobody can change it, except the Judge dies, there is war, holiday or any other thing beyond the Judges' control. The CCB had prepared its Charges, which was has a date for appearing for arraignment at the CCT, a copy was served on Saraki. He rushed to another Court to stop the Tribunal from sitting on that date, no now, if you have the opportunity to meet his lawyers, they will tell you IN CONFIDENCE that they are just buying time to be able to decide what they should do. It is pure delay tactics.
