Despite the fact that the NASS are seen by many as a rubber-stamped institution, but I still feel it has a little sense of independence from executive as compared to their counterparts at the state level.
Look at what these 3 senators did. They stood their ground and made their voices heard even though the majority carried the day.
But in the State Houses of Assemblies, you dare not try it.I repeat, you dare not try it.
The governor cannot send an executive bill to the SHA and you dare try to even ask question, your salary will be withheld, you will be evicted from the official residence quatres,in fact, your seat maybe declared vacant by the governor and nothing will happen.
Those people do not know what the term "separation of power" is in a federal system of government. And even if they do,they dare not try to practice it because they are in the strong crib of their various state governors.
They therefore make governors too powerful and untouchable while in power despite their excesses.

I doff my hat for that man called Enyinaya Abaribe anytime any day.He is not from my state nor from my region but he is far better than one senator like that representing my Senatorial District currently.
I have been following his stance on most of the national issues right from Buhari era till now,he always stood for what he believes.
A man that can go against the moving current to defend his stance in Nigeria daisy political arena without fear or intimidation,is a real man.is a real man.
Respect to you, Sir!

Am sure you don't even believe yourself.

If it's such a taboo for a democratically elected Fubara to spend Rivers money from a 4 man assembly... then how is it possible for a sole administrator from Abuja to spend money without any appropriation?

In what universe does this make any sense?
But the SHA has been suspended,so where and who do you want him to present the budget to?

There is provisions for state of emergency enshrined in section 305 of our constitution.
But the president does not have the power to collapse the entire democratic structure of the state.
What happened in Rivers State is a coup.
You cannot stop the function of the house of assembly.
When Goodluck Jonathan declared state of emergency in some northern states, the governor's were not removed.
But let me understand,if the governor and the Assembly are allowed to remain in power during state of emergency, what different things will the governor do under emergency that he didn't do when there was no state of emergency?
What and what will happen in the state during the declaration of state of emergency and what and what happened when there was no emergency ?

It is when people come out to actually believe people's Gazzette that I just shake my head cos you act like you don't understand English.

He said "she should get Capital Punishment under NYSC" this does not in anyway mean she should get the death Penalty.

It simply meams she should get the highest penalty under NYSC which is expulsion.

It is so easy to see
In the judicial term, capital punishment under the law doesn't mean what you wrote there.
It means death sentence anywhere in the world.
You didn't coin the word and so you have no moral right to give your personal interpretation to it other than what it's known for globally.

Politics › Re: Rivers Crisis: Judicial Panel Faults Supreme Court Judgement by Pacesetter123(m): 5:38am On Mar 18, 2025
bixton:
Gov. Fubara tactically and deliberately did not do that for he had only relied on the judgement given him by the Rivers State High Court for their defection and declared seat vacant.

There was no case of defection brought before them at the SC.
But like we all know, the FHC had in their judgment brushed that off and if you remember the same FHC in their judgment saying the SHC lacked jurisdiction in such matters also considered the 27 members as valid members of the SHA and that was why it ordered Gov. Fubara to re-present the 2024 State budget them.
It was that judgment that led to Gov. Fubara going to the Appeal Court......

Somewhere along the line there was adjustments and modifications on the cases filed and the 27 members asked for a consolidated judgment so it also say if they are still members of the RSHA and authentic Speaker is Ahmaewule.

Now, for whatever reasons Gov. Fubara withdrew the Appeal as we got into 2025 sin e he has passed the 2025 budget and said "events have overtaken it".
Yes, events have overtaken it since the expenditure time frame has elapsed for the 2024 budget, but he forgot or was ill adviced because the FHC ruling still stands and had not declared Ahmaewule and co illegitimate.

A withdrawal by Gov. Fubara from the Appeal Court also meant the FHC ruling is binding on him but I guess his lawyers and advisers didn't consider that as an over site thought and was still relying on their SHC judgment which the FHC had earlier said lacked jurisdiction.

So it was an easy task for the SC to do and the SC was only just giving credit to what the FHC had done on re-establishing the judgement of the FHC declaring that Ahmaewule and co remains members of the RSHA.

A lot of people were not actually following the case per se but were actually following the rhetorics, emotional and psychology pullings of Gov. Fubara who had a loop hole he created himself when he withdrew from the Appeal Court.

So it was Gov. Fubara who made it a lot more easier for the SC to give that judgment the moment he withdrew from the Appeal Court even though it seemed he may not likely get a favourable judgment from the Appeal Court. So no one can file as new case at the SC because it doesn't work like that.
It was what was passed from the FHC to the Appeal Court where amendments were done and to the SC since we still had aggrieved members and with the judgement of the SC all matters have been laid to rest.
Alright, the details you gave here is satisfactory.
Politics › Re: Rivers Crisis: Judicial Panel Faults Supreme Court Judgement by Pacesetter123(m): 7:22pm On Mar 17, 2025
bixton:
I believe you know what"stealing by tricks is". This panel alongside those who sponsored them knows what they are doing.
The SC court did not just come up from oblivion.
This case originated from the FHC and those who lost after they were to re-present the 2024 budget went to the Appeal Court to seek a judgment in their favour, I think if I'm not mistaken, there were certain amendments done on the case as filed by both the plaintiff an ls defendants unfortunately there was a withdrawal of suit by one party that "it has been overtaken by events" and even say it's according to law.....

Well, these are issues the SC looked into and came up with a comprehensive judgment to ensure all these back and forth schemes come to an end and that the Rivers State has a working SHA.

I do know that those who are on the loosing end have somewhat seen the handwriting on the wall that they may eventually lose, but they were hoping on what was imaginary.
Gov. Fubara wants to be allowed to operate like the way Wike did when he was governor but it will interest you to know that this constituted SHA legislators will not allow such for reasons best known to them.
They all knew the arrangements and agreements they had before coming on board, let everyone stick to the agreement.
a It's s simple as ABC rather than wiping up the people's emotional sympathy and support. These people did not support him in the first instance.
All those elders who were joining voices and insulting Wike rather than call for peace have all kept quiet. The cupboards will be opened and everyone will be exposed and the security agencies will get to work.
Yes,I know all this things.Thats why I don't sympathize with either of the party.
I am not in support of any political godfather nor godson cos both are enemies of democracy and good governance.
The godson knew the enslavement that awaits him for accepting all the terms and conditions set by his godfather, yet,he still went ahead to sign the slavery agreement.
The godfather too knew the danger that his godson can pose when entrusted with a position as big, lucrative and powerful as governor, yet,he when ahead and sign an agreement with him.
In all these, the "People" were not involved at all.
So now that they are fighting themselves, they now want the "people" to support them.
Me like this,I can't support any of them.
All this their fight is for their own selfish interests and not for the interest of the masses.

But my own is,I can make comments when there's any particular issue arising from this their fight.
For instance, the budget presentation saga, defection, declaration of seats vacant and High ,Appeal and Supreme Court judgement, and this recent issue of judicial panel faulting the SC judgement.

So like I was responding to the guy before you quoted me,I am not really sure whether there was a case of defection brought before them as the panel alledges, that's why I cannot comment on it yet.

So do you really have the evidence that there was and appeal to the SC on the matter of defection of the 27 lawmakers in particular?
If you do,pls kindly share with me here.
I don't really have the time since on that morning time to research on it yet.

callthefred:
Do you people read the constitution at all? So these so called panel believes that mere voice decamping is enough by Nigerian law? Why then are we supposed to have affidavit and even publish some things in the papers if just by voice is enough? Where is their signed letters to their party ward excos of decamping?. We saw that of El Rufai at least.

So these panel also expect that the governor can decide who are members and who are not abi? How come these is coming after judgements. Who dey finance these retired ones abeg?? Maybe there's another constitution but where is the common sense in running a state with 4 member lawmakers or who gave governor the power to destroy assembly building when we all know the lawmakers are to check the excesses of governors??
The Panel didn't say all these things you wrote up there.
It only says that the case of defection of the 27 lawmakers was not before the supreme Court.
That the Supreme Court only delved into it and commented on it.That, not that the Supreme Court really passed a comprehensive judgement on the matter, but that they just commented.
That they should have left it open until the matter is officially brought before then by any of the two parties involved before they would have delivered judgement.
But that since they have just commented on it ,that they have made themselves "Functus Officio" on the matter even though the case was not brought before them for judgement and that their decision is final. That government at all levels should always obey court judgement.
So that is the summary of their write-up.

It's now left for people like me who is neutral to this Fubara and Wike Rivers crisis to go back and look at it critically whether it's true that the case of defection wasn't yet brought before the Supreme Court as at the day the judgement was passed or not as alledged by the Panel.
Until I confirm it,I won't comment on it.

The write-up said he later contested the SDP presidential primaries with Abiola and Kingkigbe taking place in Jos.The leader of the party,Gen.(Rtd) Shehu Yar'dua asked him not to go for a re-run,that he should step down for Abiola which he did.
He was promised the V.P slot but was later given to Kingkigbe due to pressure from the governor's forum of their party.
