its good they ve announced it so that come january 2015 and no implementation, the public know who to blame when a strike starts.

meanwhile this is one of the comments in reply to the above article

"Any country that takes her DOCTORS for granted deserve worse treatment than what the PATRIOTIC NMA members did. Is only doctors that are asked to COMMIT SUICIDE OFFICIALLY and no one frowns at it. In fact the Nigerian Doctors are the most humble and efficient healthcare professional in the whole world, a group of elites that has not complained of any ill treatment form the FG and citizens alike.

As Folake stated, If anybody is unhappy with NMA the person should go to any Medical School of his/her choice and study Medicine. BUT NOTE THAT MEDICAL SCHOOL SELECTS ONLY THOSE WHO ARE FIT FOR IT!

FG should not allow NMA or Doctors at any level to strike, Doctors have not been troublesome until it became obvious that FG rates Doctors just as any other group of professionals. NMA forfeited N257.03bn(22years relativity arrears, allowed agreement to be reached in 2009, 2013, etc but Nigerians and FG are not satisfied.

The doctors can leave Nigeria other countries with enabling enviroNment and attend to NIGERIAN POLITICIANS WHEN THEY COME THERE FOR THEIR OWN MEDICAL NEEDS AND THE CITIZEN WOULD BE HERE CASTIGATING THEIR MEEK DOCTORS!"
Health › NMA Strike: New Salary Structure For Doctors Takes Off January 2015 by phantom(op): 8:46pm On Aug 26, 2014
The House of Representatives on Monday disclosed that the new salary structure for doctors would be reflected in the 2015 budget and takes effect from January 2015.

Ndudi Elumelu, chairman, House Committee on Health, gave the assurance while reacting to the resolution of the Nigerian Medical Association (NMA) to suspend the 55-day old nationwide strike on Sunday.

According to him, the parties during the reconciliatory meetings attended by Federal Government’s team resolved “that the Federal Ministry of Health will grant the request of NMA for a new circular as demanded by NMA.

“That the Federal Government shall pay two months’ salary arrears to members of NMA on or before August 31, 2014; that balance of salary arrears would be reflected in the 2015 budget and paid to members of NMA.

“That the new salary structure of medical doctors would be reflected in the 2015 budget and medical doctors will begin to get the new salary structure effective from January 2015.”

During the overview of the suspended industrial action declared by the association, Elumelu stressed the need for the Federal Government and organised labour unions to honour various agreements reached in the bid to forestall future strike action and ensure industrial harmony in various sectors of the nation’s economy.

“One of such lessons is the need to obey agreements. The law is pacta sunt servanda meaning: agreements must be obeyed. If parties had obeyed previous agreements executed between NMA and representatives of the Federal Government, the strike would have been averted. The lesson to learn here is that we must at all times obey contents of agreements freely entered into in order to avert crisis,” Elumelu said.

The lawmaker, who expressed displeasure over the unpatriotic attitude of the association towards the plight of the citizens in the face of the outbreak of Ebola virus and other life-threatening diseases that claimed the lives of several Nigerians during the strike period, noted that NMA “acted contrary to the revered oath of the medical profession and the code of medical ethics (2004) for medical dental practitioners in Nigeria.

“The leadership of NMA has been described as unpatriotic even by other Nigerian doctors as well as members of the public in view of various health challenges confronting the nation and the scourge of Ebola virus disease, which erupted during the strike period. Patriotic Nigerians both home and abroad have passionately condemned the action of the current leadership of the NMA. Comments have been heard and read from various media platforms concerning the …actions of the NMA president,” he said.

Politics › President Lacks Powers To Sack Resident Doctors, Says SAN by phantom(op): 8:32pm On Aug 26, 2014
A Senior Advocate of Nigeria (SAN), Mr. Sebastine Hon, has declared the sack of 16,000 resident doctors by President Goodluck Jonathan as both unconstitutional and unlawful. “It is indeed null and void and of no effect whatsoever,” Hon. said.

He said that Section 40 of the 1999 Constitution as amended, guaranteed the right of “every person” (in this case, including members of the Nigerian Medical Association (NMA) to “assemble freely and associate with other persons, and in particular” to “belong to any political party, trade union,” etc, “for the protection of his interests.”
“The affected medical practitioners, therefore, committed no wrong when they, coming under the umbrella of the NMA, embarked on a strike for the protection of their interests,” he added.

He also explained that the right to embark on a strike was a common law right, recognised by Nigerian law.
“It was Lord Wright who stated in Crofter Harris Tweed & Co. vs. Veitch (1942) 1 All ER 142 at 158 that ‘Where the rights of labour are concerned, the rights of the employers are conditioned by the rights of men to give or withhold their services. The right of the workman to strike is an essential element in the principle of collective bargaining. It is, in other words, an essential element not only of the union’s bargaining process itself, it is also a necessary sanction for enforcing agreed rules,”

He stated that case law in Nigeria had also legitimised strike.
According to him, the Court of Appeal of Nigeria accepted that embarking on a strike was acceptable in law, when it held in Union Bank of Nigeria Ltd. vs. Edet (1993) 4 NWLR (Pt. 287) 288, that when negotiations between an employer and his employees fail, resort could lead to a strike by such employees, for the purpose of pressing home their demands.

He noted that even though the Trade Disputes (Essential Services) Act, Cap. T9, Laws of the Federation of Nigeria, 2004, penalised strike by persons rendering essential services, including in this case, members of the NMA, he however said that this legislation did not imbue the president with any modicum of power to sack any person who had acted in breach of the Act.

He said: “Indeed, the Minister of Labour, upon being given notice of an intended strike; or even as the strike action is ongoing, ought to have taken the following proactive steps stipulated in section 5 of the Act, namely:
“5. Where any trade dispute exists or is apprehended and it appears to the Minister that the dispute is one to which persons employed in any essential service are a party or might become a party, the minister may, whether or not a report in respect of the dispute has been received by him under section 6 of the Trade Disputes Act, refer the dispute for settlement to the Industrial Arbitration Panel established under section 9 of the Trade Disputes Act....”

He said there was nowhere in the entire Trade Disputes (Essential Services) Act where the President of Nigeria or the office of the Secretary to the Federal Government was mentioned.

“There is also nowhere in the entire Act where it is stipulated that when any person rendering essential service embarks on a strike action, he should be sacked from office,” he added.

He also contended that all members of the NMA were resident doctors, whose employments were regulated and indeed protected by the provisions of the University Teaching Hospitals (Reconstitution of Boards, etc) Act, Cap. U15, Laws of the Federation of Nigeria, 2004.

He said: “It is settled law without any dispute that the employment of such persons cannot be terminated save by due process established under the Act, the most essential of which is, as stipulated under section 9 of the Act.
“This section is to the effect that the affected medical doctors be issued written queries and that complaints against them be tried by independent administrative committees.

“Even when such committees find them culpable, the only competent body to terminate the employment of members of the NMA are the respective Hospital Management Boards and not the Presidency.”
He cited section 9 of the University Teaching Hospitals (Reconstitution of Boards, etc) Act, Cap. U15, Laws of the Federation of Nigeria, 2004 and the case of University of Nigeria Teaching Hospital Management Board vs. Nnoli (1994) 10 SCNJ 71.

Hon said that nowhere in this Act was the President assigned the duty of terminating the employment of any medical doctor employed in any of the University Teaching Hospitals.
He declared the pronouncement by the presidency sacking those medical doctors as unconstitutional, null and void.

“And the law is well settled that any act or action that is null and void is deemed not to have existed at all; hence should be ignored. NMA members can, therefore, ignore such purported mass sack; and if their salaries and emoluments are withheld or if they are denied ingress into and egress out of their respective hospitals, they can enforce those rights in court with 100 per cent probability of success,” he added.
He, however, appealed to the NMA members to accede to reasonable offers from the government and end the strike action soonest, for humane reasons.

they would rather die than blame their government or ask for accountability.

soldiers complain of equipment and go AWOL-> soldiers are cowards.

lecturers complain of terrible academic environment -> lectures are lazy and incompetent

doctors complain of equipment and poor health funding->
doctors are greedy,wicked and egotistic.

they blame everyone BUT the cause of their problems....akin to trying to bring down a tree by cutting its branches.

......then they come on nairaland and open threads everyday about how the country hasn't moved an inch.

it serves us right as doctors, when we have decided not to properly inform the public.
we stay in our clinics and wards reading giant sized books, and taking things for granted.
we live in a society where 85-90% of our populace are GROSSLY IGNORANT.
look on naira land, where one reads only 1sensible post out of a 100.
even much of our middle/upper class are ignorant.
we have a Herculean task in front of us and we must not relent to go on a massive public relation campaign anyway we can.
never underestimate the power of a large number of IGNORANT people. it can do and undo.

NaMe4: Really, I'm just learning that MOST Nigerian doctors went through the university tuition-free. Maybe it depends on the part of the Country or maybe certain States. I am a practising medical doctor and I recall at least 40% of my class were not sponsored by any government. From the beginning of my education till graduation, government has had nothing to do with sponsoring my education, and that has been samefor a large number of mycolleagues.
So the argument about government sponsoring virtually all doctors holds no water as far as I am concerned.

Just a clarification though!
their argument is that the 50,000 fees i paid in UNN is free tuition compared to the 700,000 fees another pays in Madonna university. funny arguement.

what of comparing my tuition in medical school to that of a student of library education in the same university?

bumfem: Re-read your post and see how bias you are. I really don't know why u or some folks think health professionals are not proud of their jobs. This is not true and u know it. Most health professionals love what they do and very proud of it. But what happens is that an average Dr in Nigeria is not happy that Nurse X or Pharmacist B are earning Y amount of salary. They beleive govt is overpaying other health prof. So Dr become dissatisfied with their own wages. They by virtue of their position suppress others, will negotiate wages and like to stay back to tell govt what to pay others. They have done this for years until the days of President Yaradua of blessed memory, that gave birth to CONMESS and CONHESS. Both are salary scale for physicians and health professionals. Both made provision for Consultant position and how to renumerate individuals designated as such.
Dr are not happy at this very normal progress because other health professionals are beneficiaries. It is like walking with a friend who wants to see your face but never happy with your progress. So JOHESU was born to protect others from what look like common enemy who is always happy at your Dow fall and love to call out strike when u succeed.

NMA overstretched their relevance by going on strike because the govt was set to obey the court ruling on consultancy and directorship. NMA wanted the govt to disobey court ruling and set aside the rule of law. They behaved so foolishly and unintelligently by insisting on reversal of court judgment extra judicially. No govt will do that.

Ebola outbreak shld be a safe face and reason to call off the unnecessary strike, they failed bc of desperation and hatred they have against health professionals. Govt mustdo tthe needful. He that hire can fire.

I know the strike would be hurriedly called off. Over dribbling has inventually destroyed the NMA mislead by overzealous NARD.

NMA went on strike with very outdate and weak weaponry........ NMA is not a union.... so cannot approach court for redress on any union matters...... Govt knew this and took advantage of it..........Court ruling is court ruling..... It takes court of high jurisprudence to up turn it. Not the govt or big men in the Senate.

NMA can now swallow its pride in shame.
Unfortunately 80percent of those demands will die a naturally death as NMA struggle for call back of its members.
how far with your consultancy and directorship?
