The landlord has a right to legally evict the tenant. The tenant cannot "make trouble" as the courts are quick to rule on such matters. No be by force to be tenant. Also Nigeria is not as lawless as you think. If a Landlord follows due process with a lawyer, that tenant would be out of the place in not time. I'm currently dealing with a tenant like the Op. This man does not pay rent on time. Infact he's still owing last year's rent. I will be serving him a quit notice shortly. Let him go fight with his stupidity.

If in six months he doesn't get an apartment, should he put his load inside the gutter..... The way some landlords treat tenants sometimes is annoying and worrisome. You just increased the rent and the next thing is quit notice. Someone that has been paying , now couldn't pay within a month, you issue a quit notice...

If you know you can quit the apartment in that six months pls do. But sincerely, people like them needs to be dealt with... If e be say the person wey get the house don die self.....
As someone as said, don't think of staying in a house the landlord lives.

The landlord owns the property and has liberty to withdraw it anytime as long as she gives 6months notice as stipulated by law. His personal issues is really not the business of the landlord. Its his responsibility to sort himself out.
so ? If u know tenancy law very well, landlord doesn't have right to throw tenant property out side the house anyhow unless tenant do something unethical like unable to pay at least three months, fight in the compound, dirty the compound etc. before it warrant eviction.

There is no free rent anywhere under the law. That the landlady used her own money to build a house while others were stocking their stores does not stop her from making an income from her business.

It is an open market. If not satisfied with services somewhere, another place can be visited.

I know of a lady on Australia who defaulted on rent and apart from being evicted, she had her name on a blacklist of defaulters which made her getting a new place very difficult and at the end she was able to get a new place for an exceedingly high amount compared to the norm.

If the OP were to travel overseas and his landlady decides to play a village people monitor on his life, the OP will have himself to blame if his negative action follows him to the embassy. There are events that follow our actions.

The six months given to the OP are not free and any lawyer will tell you so. It is to be paid for. The norm is to give 7 days for a rent defaulter and then evict. Some Nigerian states require a one month notice before the 7 days notice. Giving the OP six months is a nice action by the landlady and if I were the OP, I would show my appreciation while looking for the new place one year rent. (I imagine the OP already has enough to cover for the 6 months he was graced.

I have been to court where a judgement was given against a defaulting tenant who was told to pay his outstanding, the money owed while case was still ongoing as well as the cost of the landlord on the court case. He lost all ways.

There is simply no point in overstating.

My brother has a lawyer and he kept going back and forth to court with his three tenants that chose to stress him. I won't get his type of stress if I don't get any tenant at all. I'm cool with that because I'm not even relying on the rent money for anything.

Im currently not in Nigeria and don't want the house to be empty, that's the reason I thought renting the flats out to some people might make it occupied, but when I started reading about tenants stressing their landlords, it's scary as hell.

I have a few friends that were landlords in Nigeria and relocated abroad. Suddenly, their tenants stopped paying their rents, saying they're ok, that's why they're abroad - without thinking if these people had other plans for these funds before relocating. Some of them ended up selling their houses cos it wasn't worth it keeping them for non-paying tenants.

Rather than paying their current rents to these landlords, the tenants are buying their lands, building their own and forget to pay their current landlords because they know theye not around and won't have time for prolonged court cases in Nigeria.

I actually think this can be described as being selfish on the parts of the tenants.

luk, I know a nice tenant way no get any problem with his landlord till his gf showed up..D gf has being doing funny stuff like placing trash on landlord's door, or going into landlord side to dry her laundry without permission from d landlords wife... d wife confronted her, she insulted d wife, when landlord came back, He said tenant must pack of his house since they don't even respect his family grin grin

Yes, i wanted to say you sounded like a landlord yourself. We know it's a union of property owners over tenants. The truth is NEVER reside in same compound with owner, you can never be right or said to have done well. Most times they get you through your wife or children, if you're the gentle type!

I just moved into this new apartment and within a month to the expiration of my rent, I got a call from the caretaker to see him and he told me they would be is increasing the rent unless I renew before it expires but I didn't have it at that moment and pleaded but he said that's the decision of the owners of the house.

The landlady leaves in the building as well but the caretaker receives rent payment and all for reasons best known to them.

I went to see the landlady and she stood her ground that if I can't pay I should leave. Well, I could deduce her actions for doing this as she had a quarrel with my fiancee and it has been settled but she still had it in her mind.

I don't why people have dumb mentality. A landlady and a tenant cannot quarrel and settle in peace anymore.

I choose to pay the rent increase last year in order to let peace reign. On a norms, I would never pay for such an increase( I mean from 200k to 250k) Now, I just got a letter delivered to me this morning which is a notice to quit as my rent just expired last month.

Normally, when my rent expires or about to, the caretaker will call me and ask when will I be renewing it but this time I didn't get anyone at all which means they actually planned it before now.

They didn't even call me for a meeting to discuss, who does that?

And on the letter, there was no reason stated on the quit notice and it's a 6 months eviction notice. I spoke to my lawyer and she said that's how they do these days issuing quit notice without prior notification even when you're paying constantly.

When I went to see the caretaker, he told me it was because I was absent in the last meeting that was held in the compound. What trash! I rained curses on him to the extent that he couldn't voice out a word again. Apparently, he was shocked as I'm always very gentle.

Are they sharing money in the meeting or what? Or I would leave my business and be in a meeting on a weekday when I can always get what was discussed in the meeting from people that were there.

The reason didn't even go down well with me as it got me really annoyed. I have decided to park out but I want to make sure they see pepper.

the meeting was not important to you,the other tenants that attended shared money abi or they have no businesses, now you need suggestions.
Please before you pack in to the next property, caution your fiance or wife,there is a reason why lords are attached to the owners of the properties,those who ignores that experience the same fate that now confront you.

I am Igbo and one of our biggest issues is we have no regard for constituted authority. We stayed on our own and invalidated the value of our traditional rulership, because every man is a king in his own house. Especially the one that has money.

I am far from an asslicker. In fact, I am a very rebellious entity. However, I have respect for leadership. There is how you handle a landlord/landlady, they would know underneath you are a mad person, but you are just giving them their respect. Except the owner of the house is plain difficult, then you shouldn’t even be living there. The time you use in fighting them, use it to build your own house or move out. I've seen some people doing the most silly things at work just because they don't want to lose their job but will complain bitterly about it in secret.

Nobody will wake up one day and just decide to cause trouble, talking about building your own house cause your land lord is being difficult,let me tell you this, everyone won't be a landlord or land lady, and moving out is not as easy as you put it.

Still ask your lawyer whether you can stay up to that number of months, but it will be unwise for you to do that.

Every landlord has the right to take a tenant and ask the tenant to leave, within the tenancy law of your state.
A yearly tenant has to be given 6 months notice. You got the 6 months notice.

BUT, it was wrongly served. So you can go to court and get an order to pay for the new year.

You were supposed to be given 6 months notice before your rent expired, not 1 month to the expiration.

But expect that year to be a tumultuous year in the property. Another thing you can do is to pay for 6 months and use the 6 months to find another property and raise the funds

1. Never you, I repeat never you live in same compound with the owner (landlord or landlady).

2. From your post, you're still single as most land ladies use charms to control their husband and might decide to use those charms on you if you continue to provoke them.

3. My sincere advise to you is to pack out there even before the grace-period.

You have just described my predicament. I currently live abroad. My tenant told me to my face that he doesn’t know when he would pay me rent. I’m currently in the process of evicting the tenant. The lesson has taught me never to invest in Nigerian real estate. I’d rather buy properties abroad where I’m fully protected by the law than waste my money in Nigeria. And yet, our people wonder why the economy is stagnant. No single trust and integrity. Diaspora Nigerians would rather keep money in the bank than invest in Nigeria. What a shame.
