Everybody just keeps talking about 'SUE' 'SUE' 'SUE' .

is it really that easy for someone who has been found to be Hiv positive to still sue for violations?

Nothing can be proven yet until they actually go to court. The woman will find out that it's not really easy as she thought it would be.

This doctor and his friend still have their own defense. At least they did it with a good intent. A reasonable judge with common sense will look into that matter and see sense in it.

The only serious punishment I see that Doctor getting is losing his medical certificate for being unethical. As for going to jail? I think not.

My candid opinion.

Some cases where consent were not sought before obtaining bodily fluid : The CIA obtained the DNA of Bin Laden's sister without her consent. Nothing happened to them bc of national security of the US.
Similarly, b4 the US security forces became fully convinced that their high value target was in that compound at Abbottabad, they conducted a phony immunisation programme through which they obtained the blood samples of Bin Laden's children and consequently the DNA, which matched that of Bin Laden 's sister.
In these two cases, the CIA and the doctor infringed upon the rights of those persons. But they were not tried because they did those things to save American people.

It has nothing to do with gender. To me its more about human control. Let's imagine this is Hepatitis B or C or some other virus that doesn't have a quick test. Isn't the man expected to walk away when the lady refused to get tested. Men should stop thinking with their penis, or else one day they will catch a disease that will take 48 hours in a lab to determine.
Hepatitis B and C can be tested as much as HIV can.. If the OP's a doctor, it'll be as easy as ABC for him to conduct the test cuz all he needs is the kits and the serum to mix the blood with.. Even Ebola can be easily tested. It's only when you start talk in about HIV, Hepatitis B and C "viral load" tests that so much is involved, including money and modern technology like real-time PCR testing technique..

Answer the question?
I've read the referred comment.

You see, HIV is a very sensitive issue and a serious ailment, nevermind liberal loonies who would say a carrier can live a normal life.

We don't know if the lady in question was aware she's a sufferer and if it happens she was privy of her status and insisting on unprotected sex then she's got nothing on the doctor poster. She's a criminal and can also be sued for criminal intent of infecting someone with a mortal disease.

On the flip side, if she isn't aware she's a carrier of the 'world most dreaded disease', then the doctor is culpable under criminal law of sedating and withdrawing her blood without her consent.

Without losing sight of the issue which led to his action and with the confirmation that his curiosity was positive, that the lady was HIV positive, I hold the strong view that his action was justifiable. It would have been different if she turns out negative.

But for me, to dismiss or berate is brave move even as it was a success will be foolish and a tacit support for the, deliberate or unintended, attempt to infect someone with HIV. Both circumstance are different and deserve divergent sifting and analysing.

Bantering words can never ever be my objective. Yes he deserves an applause for saving his friend, but whether you like it or not he got off easy. The day his friend will catch a bigger disease let me see the 2 minutes test he will use to detect it.

It's not every food one sees that he should eat. Thousands have left partners who wanted to go raw, nobody died.

First person that left all the legality out of the discussion.

Ok, I totally understand you point, and it still leads to what I'm talking about. The good doctor did only HIV! Imagine she was negative to that, but positive to a box load of other diseases. I don't care about the girl, or her broken Rights because I know that nobody is suing anybody. My concern is why the young man in question couldn't just leave the relationship.

Lol Nairalanders. I keep seeing 'sue here, sue there'. I bet that girl doesn't even know the road to a law chamber. Anyone that conniving and wicked must be totally ignorant of human rights. So please, if you love her that much, sue on her behalf cuz she ain't doing nothing. She's moved on to the next nigga without a doctor for a friend. Tamee I bet it's your brother. And beach, could you stop typing with all those horrible smileys?? You remind me of one other nitwit that does same. Do you both have the same imbecilic dad?
P.S. You really don't have to answer the question if you find it too personal. I really had to ask.

HiV/AIDS is not a death sentence. can you please edit your post? You are not doing much to support anti-stigmatisation of the movement.

His action cannot be justified for whatsoever reason because HE HAD A CHOICE

I am very biased o. My first reaction was serves her right but you cannot ignore what the guys did

LoL! The love was strong I guess, but not strong enough to withstand HIV virus. Well, that's the more reason why I doubted the op being a medical practitioner. This'd because he didn't write or talk like one, or even said he was one. If I were in Abj, it'd have been very very easy for me to lay my hands on any test kit and use it to run tests. Did you notice several people on here tagged him a doctor? Well, a doctor would have known that there are more deadly diseases that could be contracted via sexual intercourse apart from HIV but as laymen they are (just like me tho), they were so much concerned about HIV alone..

Yes true, I accept that, was just giving credence to my point. I'd modify asap and thanks for calling that to my attention.

About his action being justifiable or not, that's open for seamless debate.

Go to the emergency wards of most 9ja hospitals and see how people bleed to death coz of simple things like not enough money for deposit, no police report for gunshot injury(even with credible witnesses to testify to the person's innocence), refusal to "pay" the blood-bank guys coz of the sign that says BLOOD IS FREE, etc.

Heheundecided Those of us who think differently have been insulted, so now it's pertinent that we all agree that it's advisable to drug others just to achieve our aims.
I think it's wrong to violate anyone in such a way, especially by someone forming health worker who should know better. Such a person would have no scruples doing worse e.g date rape, murder, kidnap all in order to play "god".

A crime has been committed ma'm, and in saner climes he would have been investigated. Nairaland is not as faceless as we all want to believe. Everyone typing can be identified, and it just takes a little effort by the right people to do that.

Hope you know that being investigated doesn't mean being found guilty. Anyhow, you are right and the op was wrong, as he himself has acknowledged.

obviously na! cheesy

It's the way many of them are wired. Support the female gender and see any act done to a woman by a man as a sexist act no matter what is involved. Many of them cannot reason an issue without being particular about sexism.

And the irony of it all is that we guys would still have supported them if the persons were swapped. You wouldn't have heard us screaming 'violation of human rights' because it's a man involved.

In saner climes, he would be in Jail..and yes, he can be traced through is IP address by hackers.

And then the gal can claim they drugged her and infected her with the virus, showing the piercing on her thumb as proof. Even though she is quilty of carrying HIV, the traces of drugs in her bloodstream is enough to nail the Op.

The Ops action is totally wrong and no one should emulate him.
