But no! You need to read the funniest ruling ever on this application. You need to see what descending into the arena of justice actually means.
By the very next day Notices and Grounds of Appeal in the two suits were filed and served on AMCON. They never made an appearance at the Court of Appeal Enugu in total disregard of several hearing notices. Certain prayers were granted in the matter before the Superior Court and others were struck out. Micmerah Int'l obtained the leave to put their house in proper order. Records were retrieved, recompiled and retransmitted back to the Court of Appeal.
All these long while, no date was given by the Federal High Court to continue the matter on the merits of same. No. Its was just a means to an end. A means to snuff out a business without fair hearing. Why? They had purchased a bad debt with tax payers money. They just have to justify their ineptitude by all means. All means. Once they succeed what else is left to adjudicate on?
Two days after the Records of Appeal was retransmitted, a Motion for the Stay of Execution was filed (one don't take chances in law especially when you are against the Government,not minding that by law the Order is void). Guess what? They refused to acknowledge service of the Motion on them. They notified the Police and misled them to act on a dead order of Court. There is a filed Motion for Stay!! There is an agreement between parties to pay AMCON 70 Million Naira part having been paid!! AMCON in its gross incompetence and ineptitude has become a DRAGON.
