Besides any such laws are almost ineffective. So unless you're oil rich Saudi Arabia - no need throwing your weight with african culture. It's a non issues. Corruption is not a problem that goes away. You have to build institutions that can independently fight corruption - for ages. Firing squad in this age of course is not acceptable. Death sentences are not even acceptable in Kenya anymore. The genesis of kenya state capture in 60s - with 1) Transfer of wealth from colonial settlers (kenya was direct colony unlike most of Ghana) - some political elite - basically transferred huge land/companies/wealth from colonial master to themselves - same thing happened in South Africa and Zimbwabwe. The Kenyatta for example simply took over 0.5 to even 1m acres of land - these were land meant to redistribute back to all the landless. 2) When they were done that grabbing the colonial era wealth - in mid 1970s - kenya had commission of inquiry popularly known as Ndegwa(Public Service Structure and Remuneration Commission (1970-71) - that basically because Africans were behind Asian and white in enteprise - civil servants who were often the only educated africans - would be allowed to own business. Something akin to South Africa BEEE thing. What Ndegwa commission did was basically make civil servants who suppose to be regulators and arbitrers in the market - the players - the conflict of interest - the regulatory capture - has meant we have capatalism that has not delivered. Most big companies are owned politicians - or top civil servants - who are suppose to be umpires in the market. Liberalization of the 90s - didnt help much - as the same crew took over the privatisaiton - added former state enterprise to their enormous wealth. The only saving grace and refuge for most kenyans then became the informal sector - jua kali in kenya - and this where we are. The solutions therefore is to 1) Fully embrace the informal sector (Hustler Revolution) - grow it to SMES - finally to have large formal sectors emerge from it 2) Kill the mostly fake formal sector by forcing them to compete equally, pay taxes equallyh and adhers to rules like everyone else. Fix the market failures. Kill monopolies and such anti-competition stunts. 3) Retain or attract only formal sector that trulys plays by the market rules. So Ruto manifesto is to spend money supporting informal sector - kill the state captured formal sectors by fixing the marke- only those can compete without state or incest - will thrive - and economy will finally realize the full promise and potential as capitalist economy. Yes their wild nomadic spirit is hard to be confined like in places Europe. They dont make excellent workers because of their pride - and are natural businessmen. Not of all of them get shelved. Kenya elections has been hailed as one world most transparent for example - it's product of international commission of inquiry. South Africa - Truth and Reconcilliation inquiry - has been hailed for solving many deep seated problems. Ghana state capture was largely dealt with by the strongman Rawling - who simply purged - killing and exiling - the entire political/economic elite of Ghana - without a due process - just mob lynching. Kenya has to deal with it's own challenges within the legal framework - and I cannot think of any other way - apart from quasi-judicial inquiry. Such a commission should be headed by eminent chief justices - and those names should be publicly shamed or tried - where the standards of proof is lower than in criminal trials - not convincted but recommend for criminal trials wherever possible but more importantly recommendation made to parliament and regulatory bodies to entangle the private and public sector from tiny elite in the future - by for example disallowing public servants and their relatives from engaging in private business. The voter scrutiny on 45 polling station have return 100% match with forms. So far from supreme court - so good - seem they have cut through a lot of BS already - and are more focussed than in 2017 on the real issues - the numbers. As for Kenyatta clan - they brought this to themselves. They understimated WSR. They keep digging - instead of trying to work out a deal - because either way they have lot to lose. Their last option is SCORK - but it appears Raila case is defective if not abuse of the court process - they presented 1) Fake Githongo logs - poorly copy-paste of 2017 logs - the audacity!!! 2) Fake form 34As -poorly photoshopped from online forms - not a single carbon copy from their agents- and 3) the last leg is the four rogue commissioners - who had no real role in the election - were okay with everything until last minute - and now are raising extranous issues starting from last year. Again the problem remain - Raila was granted in 2017 - Africa 1st and very rare nullification - but he gave the judges the middle finger and didnt go back for election. This time round he has said he will only go to ballot if Chebukati is out - Chebukati will remain until his term end in Jan 2023. The commission itself is in disarray and cannot organize anything. Yes until 5th Sept - next Monday - full hearing to start tomorrow and end on Sunday. Monday we get a verdict. So far it appears the request to retally or recount - and declare Raila winner has fallen. Only 15 polling stations will be recounted. They have a week to intimidate/bribe the supreme court of kenya - and then they are done. Ruto doesnt have mercy for lazy, stupid and saboteurs. They know it. They will be running out of kenya to exile. Ruto will crack the whip on political class on day one, public service day 2, and by day 3 - it will be very clear - there is law & order in kenya - and things will start to move smoothly. You cannot get things done if you're nice. This is Uhuru biggest failure...trying to get loved.For Ruto it simple - get it done or you're fired. You cant do meeting 5am until 10pm in evening go home. It's very tragic turn on events. Thankfully Chebukati stood tall and brave. Those are very unfortunate treasonous acts that will see Kenyatta, Mois and all their enablers being sent to cleaners. They underestimated Ruto - and now they have on week where they should pray for Supreme Court to listen to their intimidation/bribery - and occasion a constitutional crisis - by annualing Ruto win. I think Supreme Court will do the right thing - Raila had all the advantages one can hope for going into this election - he lost to an underdog by being lazy and overconfident as always- he didnt even do basic stuff like having agents - he doesnt want a re-run - he wants the court to make him president - and if not to occasion a constitutional crisis. It will be a constitutional crisis to allow re-run when Uhuru and Raila will intimidate IEBC or make it impossible for another re-run where they will lose. What will happen Uhuru continues as caretaker president with limited power...Ruto continues as deputy president with majority in parliament and senate. It will be total chaos...the limping economy will grind to halt...soon it will become a civil war and kenya will finally join other failed states in Africa. SO constitutional crisis when our economy is limping would be insane. Therefore I expect Ruto win will be validated. Raila was already given an opportunity in 2017 to run again - and he boycotted. Raila chose to exercise his right to challenge the election results at our Supreme Court. He has a weak petition and a bad reputation - so I doubt the Supreme Court of Kenya will help him engineer a constitutional crisis (his wish - as he is not ready for another walloping in the polls). We are therefore just a week and half from retiring 1) Raila - a political pest & sore loser and 2) Kenyattas-Mois - and destroying their tentacle that bestrides our public & private space - more like Nigeria Northern elite Dangote type of elites that have captured Nigeria too .
