If you are suspended from a company, can you still parade yourself as CEO of the company?

Per the nature of our system, once the Supreme Court ratifies his suspension, they may need to approach a court to ask that he stops parading himself as chairman. If he refuses, any thing he does would be a nullity and can be reversed by another court. Obaseki left the APC too quickly.

BTW, Obaseki resigned, the faction of the APC that suspended Oshiomole is still in place.

If you are legally suspended as a CEO from a company, yes you cannot parade yourself as the CEO.

However, if you appeal the suspension and in the process the court order the stay of execution of your suspension pending the final determination of your appeal or suit, then you can continue to parade yourself as the CEO. Every thing you do as the CEO after the court order will be valid. Even if you FINALLY lose the appeal, all your decisions and actions as the CEO during the period you were covered by the stay of execution still remain valid, unless the new CEO appointed after you decide to reverse those decisions.

If it was a prerequisite to gain admission, is it a prerequisite to become a Governor in Nigeria? That's the relevance of the issue now. And I tell you that it isn't a prerequisite to become a Governor in Nigeria.

And mind you, having 5 credits has nerve been a general prerequisite for admission since 1960 as you have stated. Subjects and grades requirements for admission had always been determined by the kind of courses students intend to study or programmes they intend to run in the tertiary institutions. For Arts and Humanity related courses/programmes, students had not needed to have up to 5 credits in WAEC; they only needed credits in subjects relevant to their chosen courses of study. In the case of students like Obaseki then who put in for courses like Linguistics, they only needed credits in Arts subjects, whether up to 5 or not did not apply to them.

Mr Oshiomhole said after inaugurating the APC’s screening and appeal committees for the Edo election.

If the quoted statements were those made by Oshiomole about the Obaseki's certificate controversy and nothing more, I don't see where the statements indicate any intention to spite Obaseki by Oshiomole as reported by some sections of the media. Rather, the statements even helped to throw more lights on the possibility of graduating within three years from a University which some of Obaseki's detractors were hyping as impossible before now.

Oshiomole's statements above do not sound like a criticism of Obaseki's certificate qualification but rather a positive attempt to explain in favour of the Governor and calling on any doubter to approach the University to clear their doubts.

Good one. But what effect had the suspension actually had on them, in the first place? It didn't stop Okorocha and Amosun from being Senators. Up till now, they are even counted among APC senators. The suspension that couldn't stop Akeredolu from remaining an APC Governor and from seeking to contest for second term next year. I would have known if it was a serious punishment, if by next year the party refuse to allow Akeredolu to contest for the party's ticket in the primary because he is under suspension.

I believe the lift of the so-called suspensions is to give Oshiomole a soft ground to remain the Party Chairman, since stronger push for his removal is coming from some Governors and party bigwigs in recent time. Hope this would save him as planned.

What's the basis for the intended retrial? Is it not to disagree with the judgement of the tribunal, certifying the Governor's emergence?

The basis for intended retrial is not basically to disagree with the Tribunal's judgement certifying Makinde's election. That was not stated by the Court of Appeal in their judgement as stated above.

The Appellate Court did not actually make any finding invalidating the election that brought in Makinde as Governor. What they established was that APC/Adelabu's evidence tendered at trial were not evaluated by the Tribunal. The Tribunal dismissed Adelabu's evidence as mere documents dumped on the Tribunal. This was found perverse by Court of Appeal and as not giving Adelabu a fair hearing.

Since the Court of Appeal can not by law admit evidence and evaluate them on primary basis, the only resulting decision is to order a retrial mandating the Tribunal to admit and evaluate the evidence. But doing so would have made the Tribunal sit beyond 180 days stipulated by law.

It is not strange for Court of Appeal to order a retrial in an election and so there is nothing confusing here. It happened in the trial between the then Governor Oyinlola and Aregbesola in Osun State. The Court of Appeal ordered a retrial because Aregbesola's Police Report evidence was not admitted by the Tribunal. Retrial was possible then because the Constitution did not stipulate time limit for trial. The matter was retried but Aregbesola lost again at the Tribunal.

The task at the retrial would have been solely to admit and evaluate Adelabu's pieces of evidence, not to invalidate Makinde's election. It is another kettle of fish if the evidence would have been strong and substantial enough to invalidate Makinde's election. That is left for the Tribunal to decide, if retrial had taken place. The evidence can be evaluated and still be inadequate to nullify Mankinde's victory. The Court of Appeal has left this discretion to Tribunal by not finding any thing contrary in INEC's returning Makinde as Governor.

The appointment of Mathias Olusegun Agboola into the High Court of Osun State is the most welcoming and most pleasing to me of all. It's been long overdue. He has made a success of private practice as one of the most exceptionally brilliant lawyers in Osun State.
His integrity as a practising Christian of repute is a uniform testimony of all people that know him both in private life and professional practice. He is a Pastor in Deeper Life Church and a leading figure in the Christian Lawyers Fellowship of Nigeria.
All these must have counted for him in this appointment no doubt. Moreover, having served as a Judge in the Republic of Gambia must have been an edge for him. M.O.Agboola is a brilliant inclusion into the Bench of Osun State. He is really going to make landmark impacts.

The Daura family insists nobody can separate President Muhammadu Buhari from his nephew, Mamman Daura, despite the feud between Buhari’s wife, Aisha, and his close associate’s immediate family.

Speaking during an interview with Sunday PUNCH at the family house of the Dauras in Shaishakowa Quarters in Daura, Katsina State, Mamman Daura’s younger brother, Usman Daura, said Buhari and Mamman Daura had both come a long way.

He said, “Mallam Mamman Daura is the eldest man in our family now. I am his younger brother. The gap between us qualifies him to be my father, despite being my elder brother. But you know Mallam Daura and President Muhammadu Buhari have come a long way right from their youth. Even when President Buhari was the military Head of State in Lagos, they were together. Nobody can separate them.

“If you go to the GRA (Government Reserved Area), where Mallam Mamman has his house in Daura, you will see that his building is next to that of President Buhari. That is how they have been all along. He built his house at GRA even before our father’s death. Our father died on October 3, 1993.”

A Daura-based legal practitioner, who also spoke on condition of anonymity, said, “Mallam Mamman Daura is from Daura, but he is better known in Kaduna since that was where he was based before President Muhammadu Buhari became President.

“Both men are very close. Mamman Daura’s father, Alhaji Dauda Daura, was the President’s elder brother, and they are very close in that family.”

The Chairman of Coalition of Associations in Daura, Alhaji Muhammed Saleh, described Mallam Daura as a disciplined gentleman who is modest and honest.

Saleh said, “Mallam Mamman Daura is a very simple man. He and President Muhammadu Buhari have come a long way. They are very close. Don’t forget, President Buhari is his nephew and their family is very close. Nobody can come between the President and Mallam Mamman Daura. They are like Siamese twins. They understand each other perfectly, having been together for over 70 years.

“It is a known fact that Mallam Mamman Daura has always been playing the role of a very loyal brother and friend to President Muhammadu Buhari. Daura has also been the last man standing even when others deserted the President. He is doing all these not because he is expecting anything in return from the President. But you know, people say blood is thicker than water. President Muhammadu Buhari is Mamman Daura and Mamman Daura is President Buhari. You cannot separate them.”

Another Daura-based legal practitioner and lecturer at the Federal University, Dutse in Jigawa State, Mr Ado Lalu, also said the duo had a very tight relationship.

Besides being close relations, Lalu said Mamman Daura had displayed loyalty and honesty to President Buhari.

He said, “Mallam Daura has demonstrated that in life, it is good to stand by whoever you believe in. He has shown that he believes in President Muhammadu Buhari, no matter what people say.

“Don’t forget that the two gentlemen were together when they did not even know that they would be popularly known personalities. They grew up together in the same family.

“Mallam Mamman Daura’s offence may be that he has not allowed people to poison his mind against President Muhammadu Buhari.

“Also, remember that during President Buhari’s travails shortly after he was ousted from power as military Head of State, Mallam Daura was there for him, playing the role expected of true, concerned and responsible relation. He has never disowned President Muhammadu Buhari.

“Although Daura may not like this being said because he is a modest man, I need to let Nigerians know. Long before President Buhari built his house in Kaduna, he was staying in Mallam Mamman Daura’s house there (Kaduna). Unless you are very close to them, you would not believe that they are not from the same mother, this is just to let you know the extent of their closeness. Nobody can separate them.

“For his closeness to President Buhari, Mallam Daura has suffered persecution, which he would not even make public. And naturally in life, if someone has proved his loyalty to you and all that are yours, you are bound to love him back. It is too late for anybody to come between President Buhari and Mallam Daura.”

In his Kaduna residence along the Inuwa Wada Road, a neighbour, who spoke on condition of anonymity, said Mamman Daura seldom visited the house, but added that domestic workers and guards took care of the expansive compound.

“He (Daura) rarely comes to his Kaduna residence. Whenever he comes, he spends at least three days. Before he comes back, it takes another seven or eight months. Nobody is staying in the expansive compound except domestic workers and guards,” he said.


The feud

The feud between the President’s wife and the Daura family became public following a video leaked online in which Aisha was heard complaining about being locked out of a room and demanding that some people should pack their belongings and leave the apartment. The video was recorded by Mamman Daura’s daughter Fatima, who accused the First Lady of attacking her at the Villa.

On return from her two-month holiday in the United Kingdom on October 13, Aisha confirmed in a 25-second voice clip on the BBC Hausa Service website that she was the person in the video in question. She accused Fatima of recording the incident while the security detail did nothing because the culprit was Mamman Daura’s daughter.

Although the wife of the President on October 16 apologised to her children, family members and the public for the embarrassment caused by the viral video, some legal practitioners have condemned Fatima’s action while some simply described the issue as a family affair.


Lawyers divided over the matter

A human rights lawyer, Mr Ebunoluwa Adegboruwa (SAN), in an interview with Sunday PUNCH, said the scuffle between Aisha and Fatima was destroying the President’s immunity and that it might cause a big distraction to him.

Adegboruwa said, “Aso Rock is the official residence of the President and I think it should be restricted to members of his (President) immediate family, but this may not be followed strictly.

“In terms of what has happened between the wife of the President and Fatima, daughter of Mamman Daura, it is quite appalling and scandalous that such has been going on within the precinct of the seat of power.

“First, there is no constitutional provision for the Office of the Wife of the President and that six aides were appointed for that office, it seems the President is the one encouraging the power play that has been going on.

“Second, this is creating a distraction for the President. The constitution envisages the President to be executive in the true sense of it; the President whose mind is at alert and that is why the immunity in Section 308 of the Constitution was created to give the President focus. That immunity is being destroyed now by that domestic and embarrassing scuffle between those close to the President

“I think the President should clear the Villa and get out all those who are not supposed to be there – those who were not voted into office by the people of Nigeria.”

But another Senior Advocate of Nigeria, Mr Nathaniel Oke, said there was nothing wrong with the Dauras living with the President in Aso Rock.

He said, “I don’t think Daura’s family members living with the President have contravened any law. I believe there are separate apartments where they live and the reality on the ground is that they are being accommodated and nothing more than that. There is nothing wrong with that.”

A professor of Law at the University of Jos, Nnamdi Aduba, also said there was nothing wrong with members of the President’s extended family living in Aso Villa.

“I believe the President, as a public officer, is also entitled to some privileges just like some of us in the university system. For example, I live in the professorial quarters and you cannot determine who comes to live with me there. All you can say is that when they come, they will be subjected to the rules here. They should know that they cannot bring any kind of friends and there are things that they cannot do.

“In my view, the President has the right to bring his relations to live with him there. We are in a traditional African society, so we shouldn’t forget this. The only thing is that when their relations visit or live with them in the official quarters, they must behave themselves. They must put on the best behaviour.”

Also, the President of the Nigerian Bar Association, Paul Usoro (SAN), said it was at the discretion of the President to determine those who could reside in the Villa.

“That one (living in the Presidential Villa) is not a legal thing. It is not in the constitution; no stipulation states the number of people who can live there,” he said.

Security guards, family mount pressure on Fatima

There are indications that Fatima has come under pressure by Aso Rock security and family members not to release the second part of the video of her clash with Aisha.

A source, who is privy to what he described as ‘‘ongoing efforts aimed at mending rough edges’’, told one of our correspondents that there were moves to make sure that the “video is stopped from being released at all costs.’’

He said Buhari and Daura families were shocked when the first part of the video was released by Fatima.

The source said, “It is difficult for the young lady to release the other part of the video. This is because the first one she released has put the Federal Government and President Buhari in a very bad light.

“Also, there are concerns within the security circle, families and friends that she should not be allowed to release the second or whatever part of the video.

“Therefore, she may not go further (in releasing the video). Already, you can see that Aisha has apologised for her action in the video. That is an indication that elders in the two families and government had successfully intervened in the feud.”

Villa face-off is a family affair — Security source

The altercation between Aisha and Fatima is being treated by the security services as a domestic affair, Sunday PUNCH has further learnt.

A senior government official who insisted on anonymity accused the media of trying to “make a mountain out of a molehill.”

He explained that it was normal for members of a family including that of the President to have disagreements, adding that there was nothing unusual about what transpired as was captured in the video in question.

The official said, “I don’t see the issue here. They had a normal face-off over some domestic issues. How does that translate into a national emergency?

“Let me ask you, don’t members of your family have disagreements from time to time? The first family are humans too, they can agree and disagree on any issue just like normal families do.”

An All Progressives Congress chief in Niger State, Jonathan Vatsa, has said the emergence of Nigeria’s President from the South-East in 2023 is a right and not a privilege.

Addressing journalists in Minna, Niger State capital on Friday, Vatsa, who is a former Niger State commissioner for Information, Culture and Tourism, said every well-meaning Nigerian, good Christian and Muslim must support a President of Nigeria of South-East extraction.

“If Nigerians have conscience, equity and justice demand that they should allow the Igbo to produce the next President in 2023.

“I am convinced that the Igbo have made their consultations from the North, South and the majority of them are in support of a Nigerian President of Igbo extraction.”

He expressed displeasure that some politicians from the North had called for the cancelation of rotational presidency between the North and South for what they termed meritocracy.

Vatsa said Ndigbo were highly detribalised and could be found in the remotest villages in Nigeria, living peacefully and doing their businesses and paying taxes.

He condemned the Arewa agitation for power to remain in the north, saying, “A lot of Arewa officials have been speaking that power should remain in the North as if it is their birthright; Nigeria belong to all of us and it is bigger than what we think it is. In the spirit of fairness, if we really want to be together, the Igbo should be given a chance in 2023.

“Apart from the time of Dr Nnamdi Azikwe and General Aguiyi Ironsi, we have never had Igbo President; so the Igbo should rise up and take what is due to them. The northerners are ready to support them and I am calling on the Igbo to speak with one voice if they must win in 2023. They must come together and forget their differences.”

He however warned that the Igbo should watch out for those who would collect money either from the north or South-West to sell their conscience, adding that the Igbo man should not be treated as second citizens in Nigeria.

A caucus of the People’s Democratic Party (PDP) in the House in Representatives has suggested that Justices Ibrahim Tanko, Rhodes-Vivour, Mary Odili, Sylvester Ngwata, Olukayode Ariwoola, Musa Mohammed and Kumai Akaahs be appointed to hear and determine the appeal filed by the PDP Presidential candidate, Atiku Abubakar challenging the judgement of the Presidential Election Petition tribunal declaring President Muhammadu Buhari as the winner of the 2019 Presidential election.

The caucus backed by the PDP leadership accused the leadership of the Supreme Court of trying to subvert the convention of selecting the most senior Justices of the Supreme Court to hear and determine the appeal.

They said that the Supreme Court and the Chief Justice of Nigeria must stick to set precedent and resist the pressure being brought to bear on him to appoint justices who are likely to favour the Governing All Progressives Congress (APC) and its presidential candidate, President Muhammadu Buhari in deciding the appeal.

In a statement signed by Hon. Kingsley Chinda (PDP Caucus Leader), Hon. Chukwuma Onyema (deputy leader), Hon. Umar Barde (Caucus Whip) and Hon. Muraina Ajibola (deputy caucus whip), the PDP caucus said post of Chief Justices of Nigeria since 1979 has set the precedent of appointing the most senior Justices to hear the Presidential election appeal.

They believe that the first seven senior Justices should be appointed to hear the appeal and listed them to Justices Ibrahim Tanko (CJN), Justice Rhodes Vivour, Justice Mary Odili, Justice Syvester Ngwata, Justice Olukayode Ariwoola, Justice Musa Mohammed and Justice Kumai Akaahs

The statement reads: “the hearing of the appeal on the decision of the Presidential Election Petition filed by Alhaji Abubakar Atiku and our great party, the People’s Democratic Party, (PDP), begins a few weeks at the Supreme Court.

“The practice of selecting Justices to hear the appeal is expected to precede the hearing, going by age-long convention. What isn’t conventional is the present attempt to influence Chief Justice Ibrahim Tanko, going by reports in the media, to subvert the age-long and time-tested practice, precedent and convention of selecting the most senior Justices of the Supreme Court to hear the presidential election appeal.

“Chief Justices of Nigeria through time have never in the selection of the Supreme Court’s Election Petition Appeal Panel surrendered to the phoney dictates of the ruling parties.

“We are proud to state here that never in our great party’s time in power, did it or its personages, dictate selection of panel members to Chief Justices; NEVER.

“In 2008 when President Buhari, defeated by late President Umaru Yar’Adua, appealed the decision of the Presidential Election Petition Tribunal, the then Chief Justice, Legbo Kutigi, empaneled Justices Katsina-Alu, Aloma Mukhtar, Dahiru Musdapha, Walter Onnoghen, George Oguntade and Niki Tobi to hear the appeal that year.

“He was never dictated to, nor was any attempt made by our great party to influence CJN Justice Legbo Kutigi, who stuck to a conventional practice that consistently secured the seal of approval of past Chief Justices: CJN Fatai Williams, 1979; CJN George Sowewimo, 1983; and CJN Muhammad Uwais, 2003.

“CJN Katsina-Alu also followed CJN Kutigi’s steps in 2011 and kept to the age-long conventional practice. If there is any arm of government that regards precedents and practices as almost sacrosanct, it is the judiciary. Nigerian Judiciary cannot reverse that internationally accepted practice of stare decisis just to please A.P.C government and serve the interest of a select individual or group.

“Selecting the Supreme Court Panel isn’t about witch-pricking-pricking Justices who suck blood out of justice isn’t about going outside the order of seniority to select Justices, witch-prickers, without independent jurisprudential thoughts and whose singular attribute for selection is that they demonstrate permanent dislike for justice and passion for doing the bidding of power.

“Surely, selection, Shorn off pressure and influence of the government and the present ruling party, is about demonstrating and holding firm to the constitutional powers of the Supreme Court to conduct its own affairs and not succumb to pervasive power and corrosive external influences.

“To sidestep precedents and convention is to provide legitimacy to the ruling party whose stock-in-trade is ridiculing the judiciary. Chief Justice Ibrahim Tanko must Sticks to precedents and conventions to preserve the integrity of the courts as the last hope of the common man and of citizens of our great country.

“We are however, gladdened that on Monday 14th October, 2019 through its Director, Press and Information, Dr. Festus Akande, the Supreme Court refuted this intent and reassured the Nigerian public that it is out to “Serve the interest of the generality of the Nigerian masses and not select individuals or groups”. We therefore, pray and hope that the Supreme Court does not allow itself to fall into this gobble trap.

“We wish to state that selection of Justices to hear the appeal of our great party’s presidential candidate, Alhaji Abubakar Atiku, must be in accordance with the conventional practice admitting only of the selection of the first seven most senior Justices of the Supreme Court: CJN Ibrahim Tanko, Justice Rhodes-Vivour, Justice Mary Odili, Justice Sylvester Ngwuta, Justice Olukayode Ariwoola, Justice Musa Muhammad and Justice Kumai Akaahs. NO MORE.”

For those complaining about price still more expensive, it should be understood that it will be so for now because foreign rice that had dominated our market before now is just being wiped out of market by government's deliberate efforts at border closure.

More attention is just being shifted to local rice and volume of production has not measured up to the population of consumers.

Once more and more cultivation is done, more Rice Mills established and heathy competition encouraged, it's a matter of time, price will automatically adjust to bearable level. It was like that at the inception of Mobile telecommunication in Nigeria. I remember when I made calls at N75 per minute!

FG kè? Government needs not be involved in every thing. Establishing Rice Mills should be purely private-driven. All government needs do is to provide enabling atmosphere and strictly regulate it to prevent exploitative entrepreneurs from business.

Dear Seun and his Editors, It looks like the motive of bringing drug related offences, where igbo are complicit, to the front page of your blog is stereotypical to say the least. I have gone through your crime section and found out that other crimes especially those committed abroad involving other tribes are grossly underreported in the manner drugs and igbo boys happen here. This is getting out of hand and we are going to make a serious case out of this. This is calumny of the highest order against a people and has no justification whatever. It is not wrong yo report crime as deterrence to further commission by unscrupulous elements but this is obviously targeted against discrediting a group of people, hence ill motivated.
A fellow countered me by citing example of reports on front page of scull mining and other rituals by predominantly Yorubas to establish impartiality on the part of the reports but you and I know that this has never been like the igbo drug thing and name checking and calling on Nairaland. Mr Seun, this is a kind entreaty, kindly call your editors to order or we are going to make big issues out of this. We may have to start with the mainstream media before seeking redress from appropriate quarters.

What if "Fulani terrorists" come in an aircraft, will anyone have noticed or treat them the same way?
Any person trying to come into any space through the airways will not move without a thorough checking and profiling at both the points of entry and exits; not to talk of a number of people of such magnitude.
If any group of terrorists, whether Fulani or not, try to enter through the airspace of any serious country or state and they are recognized as such; of course, they would not only be treated similar way, they would be decimated instantly. That is how serious security issue is all over the world.
