Abure should know that most people use the platform of LP to get into elective positions, not because they believe in the ideas and philosophy of the party called LP.... OP should also know that you can't establish forgery against someone only at the supreme court level... There should be a forgery case that must pass through HIGH COURT and APPEAL COURT.... Supreme court is the court of final appeal and not the court of first instance. |

I am.not a lawyer but got this bellow from a lawyer A sitting president or governor does not enjoy immunity with respect to petitions challenging his/her election or eligibility to contest elections while public officers who enjoy immunity can be investigated and indicted by the police and anti-graft agencies. An independent counsel may also be appointed by the Chief Justice of Nigeria (CJN) to conduct an inquiry into allegations of corruption involving public officers who are protected by the immunity clause.
Is not going to be an easy ride The David Lyon case was before the electoral act was amended. The case started from the High Court and it was initiated by a PDP Member. You can search for more information concerning that case. It was a Pre-election case and it moved from high court to Appeal and the Supreme Court deliver judgment a day before he was sworn in. In this Atiku case it is different because the case in the Supreme Court is not a pre-election matter but a post election matter and the case didn’t start from a court but a tribunal. Also be aware that if forgery has been established against Tinubu, the case can’t just appear at the Supreme Court without starting from the high court. This is the position of the constitution, the Supreme Court is not a court of first instance. |

And as it stands you can’t initiate a criminal case against a sitting President, VP, Governors and Deputy Governors because they enjoy immunity. Even if you file the case the judge will adjourn the case indefinitely until their tenure elapse. Also for a case that has to do with election matters, the new electoral act states that it must be initiated by a party member who participated in the party primaries… Before now any citizen can initiate pre-election court cases. Without bias or emotion nothing will change this issue on ground. |

Let’s view this without emotions and bias. Unfortunately Tinubu will not be removed by the court because of Atiku’s findings in USA. 1) Tinubu has not been found guilty in any Nigerian court. 2) The appeal in front of the SC is not about criminal case but Election Matters. 3) Atiku is supposed to have initiate a forgery case against Tinubu long before the election and by now the case will be at either the Appeal Court or Supreme Court. 4) The Supreme Court is not the court of first instance. This are my own personal views and understanding of the matter on ground. |
