Amaechi’s suspension: Judge withdraws from suit

THERE was a twist yesterday in the suit by the Governor Rotimi Amaechi of Rivers State in which he is challenging his suspension by the ruling peoples’ Democratic Party (PDP).

The suit could not go on.

Reason: Justice Emmanuel Ogbuji of the State High Court, who was billed to hear the matter in Port Harcourt, the state capital, had withdrawn from it and returned the case file to the Chief Judge of the State for reassignment.

Amaechi’s suspension was announced early last month by the National Working Committee (NWC) of the PDP for alleged anti-party activities – a development that prompted the governor approach the court for redress.

He is asking the court to vacate the action.

PDP’s counsel Donald DENwigwe (SAN) filed a counter motion challenging the jurisdiction of the state court in dealing with the matter.

The lawyer insisted that the aspect of jurisdiction in the matter should be decided before any other issue.

At the last sitting, Justice Ogbuji assumed jurisdiction to determine whether or not he has full jurisdiction on the matter and fixed yesterday to hear the motion on jurisdiction.

But when the court resumed sitting yesterday, the matter was neither listed on the court’s cause list nor discussed in the open court.

None of the lawyers representing the parties was sighted in the court. The court premises were also devoid of the crowd of supporters that usually grace such sessions.

The Nation learnt that the case had already been reassigned to Justice Adolphus Enebeli and that the parties are now waiting for hearing notices.

Shortly after the court assumed jurisdiction in the case last month, one of the appellant counsels, Emenike Ebete said the judge acted in accordance with the law.

He said: “The court assumed temporary jurisdiction to hear the motion challenging its powers to deal with the entire application”.

“If a judge is faced with a case in which his jurisdiction is being challenged, the law says that the Judge should first assume jurisdiction to determine whether or not he has jurisdiction. If it is discovered at the end that he has no jurisdiction he should back out of the matter.”

Denwigwe told reporters after the last sitting: “Amaechi is saying that the party suspended him, and he is saying that the party should be restrained.

“At this stage, we cannot decide whether or not the party will be restrained. We are saying that the court has no jurisdiction to deal with the matter on the grounds we stated out in our motion papers and I told the court that until that is decided we cannot deal any other matter, so the matter is adjourned to deal with those matters.

“So, the court has not decided anything one way or the other, but he is saying that nothing should be done to affect his rights pending the hearing of the processes before the court which will now see whether the court has jurisdiction to hear the mater in the first instance or not.”

Adebayo Adelodun (SAN) and lead counsel to Amaechi said: “By the ruling, the suspension that had been handed over to our client should not be given any effect until the court decides the legality or otherwise of such suspension in the first instance.

“That means no further steps should be taken and he should not be denied any of his rights as member of PDP in consequence of that purported suspension.”

The Chairman House of Representatives Committee on Budget and Research, Mr. Opeyemi Bamidele, says he may leave the ruling Action Congress of Nigeria in Ekiti State to contest against Governor Kayode Fayemi in the 2014 governorship poll in the state.

In a statement on Sunday, the lawmaker said he was ready to leave the party if that was the only way he could realise his ambition.

Bamidele added that he was not only determined to participate in the election but was confident to oust Fayemi from the Government House.

The lawmaker was, however, silent on which party’s platform he is likely to contest.

Bamidele, a former Commissioner for Information in Lagos State, who alleged that some persons were trying to cause a strain in his relationship with former Governor Bola Tinubu, noted that the attempt would fail.

He said, “I am stating unequivocally that by the grace of God and the encouragement of the well meaning people of Ekiti State I, Opeyemi Bamidele, will be contesting election to be governor of Ekiti State in 2014. It is an irrevocable conclusion based on popular yearnings as well as my personal conviction and commitment to human capital development and the creation of a new and united Ekiti.

“The deliberate mismanagement of information of the meeting proceedings, no doubt, is in furtherance of a series of attempts to push me and my supporters out of the ACN. The purveyors of the information have forgotten that even if they had succeeded in doing that, it still would not deter me from pursuing my vision and ambition on other progressive party platforms based on divine guidance and the leading of Ekiti stakeholders home and abroad.”

The Chairman House of Representatives Committee on Legislative Budget and Research, Mr. Opeyemi Bamidele, has said his determination to contest the 2014 governorship election in Ekiti State was unstoppable.

Bamidele spoke in Ado Ekiti on Saturday while addressing his supporters who are members of the Action Congress of Nigeria.

Surprisingly, some members of the Peoples Democratic Party were seen at the event which was held along Basiri Road. The event was held under the platform of ‘Ekiti Bibire Coalition.’

Leaders of the ACN including Asiwaju Bola Tinubu and the National Chairman of the party, Chief Bisi Akande, had on Wednesday in Ado Ekiti, endorsed Governor Kayode Fayemi for second term.

Tinubu had asked Bamidele to drop his ambition saying the right time would come for him to contest but the lawmaker insisted that nothing could stop him from contesting the poll.

He said, “It started as a rumour, they were saying it in market places, inside taxi cabs and everywhere. Everybody was saying it but I waited to hear from God. As a child of God, I can’t be afraid. I listened to the voice of God through all of you. I will contest (governorship election) and I will not regret my decision. I know the implication of what I have said.

“I won’t come out in my name but I will come out in the name of the Father, in the name of the Son and the Holy Ghost. I won’t encourage violence but nobody should harass my people.

“If two siblings are contesting, it will be different from the way two outsiders would contest. I have made known my intention and I won’t renege on it. I won’t drop the name of Asiwaju Bola Tinubu and let nobody drop his name. Those doing that want to cause a rift between Asiwaju and I but that won’t be possible.

“I respect people and I celebrate relationships. The Asiwaju that I know won’t do anything to undermine democracy. What was reported in newspapers was not what happened at the meeting. You can ask some of the leaders present at the meeting.

“Nobody can stop me from contesting the governorship election. I cannot fight with Asiwaju Tinubu but it is not compulsory that we should agree on everything at all times.”

The lawmaker, who is representing Ekiti Federal Constituency 1 at the House of Representatives, said he had enormous respect for Tinubu whom he served for many years.

According to him, Tinubu would be happy to see somebody like him seeking to make the state a model in the country.

He said he was invited for the reconciliatory meeting held at the Ekiti State Government House on Wednesday but he said he got the text message on Thursday night.

“I was invited for the meeting but I got the text message late. But my argument still remains that Tinubu did not endorse Fayemi at the meeting,” he added

You said no leader will watch his member disobey Party rules so Opeyemi Bamidele suppose ambition to contest the guber election on ACN platform is indiscipline while Amaechi act and actions against his Party directives is not indiscipline? Rt. Hon. Aminu Tambuwal got the Speakership of the 7th House of Reps against the directives of his Party that zoned it to South-West. Hope you know Tinubu worked and mobilized the ACN members in the House to support Tambuwal against his Party to deny Yorubas the number four slot in government hierarchy, which is one of the reasons the Yorubas are shouting marginalization despite the huge support GEJ got from them. If Tinubu did not see anything bad in supporting these two fellows against their Party's directives he should see no evil in Opeyemi Bamidele wanting to contest on the ACN platform against the directives of his party leaders (Tinubu inclusive) don't forget that Opeyemi Bamidele was formerly a Commissioner in Tinubu's government in Lagos. Forget APC noise we have seen what has become the portion of the Brotherhood Party who have been in opposition for ages in Egypt whithin 1-year in office, some people/group of people are good being in opposition than in government such is APC they can't do better when place in authority. A good example is Professor Wole Soyinka and Dr. Tai Solarin of blessed memory. Soyinka was attacking IBB government then so Babangida made him the Head of Federal Road Safety Corp but he fail and was unceremoniously removed. Tai Solarin was accusing IBB of bad governance but when IBB made him Chairman of Peoples' Bank of Nigeria millions of naira in his care was embezzled and misappropriated by people working with him, he later resigned. Some of these so-called activists and social crusaders are bad manager of resources and people, so APC peopled by social crusaders/critics will be worst-off in government mark my word.

What is the duty of a Deputy Governor as stated in the 1999 Constitution of Federal Republic of Nigeria? Or better still what was the record of the 3 Deputy Governors that Tinubu used in his 8 year tenure in Lagos state? We all know deputies are like spare tyres in Nigeria politics many SSG are more powerful than their Deputy Governor.

The report says Tinubu was elated when Senator Smart was eulogizing him and he did not feel bad that they were not in a political gathering but when he got to the question aspect Asiwaju felt bad because he was caught napping.

If Tinubu was happy that an opposition Party man was praising him at a wedding reception and he did not feel bad about it why are people finding it hard to take that he was asked a salient question? If Smart Adeyemi ended at only showering praises on him, opposition party newspapers would have gone to town with a front page news of how a PDP man confimed Tinubu as the Asiwaju of Yorubaland politics. Take it or leave it APC does not have the structure on ground to defect PDP, the Party is only relying on some dissent PDP members' rigging machine. All this diaspora meeting/troubleshooting will not help APC if they don't put their house in order and let unity and progress be their watchword but i don't see them doing this so busy with politicking. 2015 will be very interesting ... intrigues ...

NEWLY formed opposition political party, the All Progressives Congress (APC) has mapped out a formidable strategy to dislodge the ruling Peoples Democratic Party (PDP) from power come 2015, Sunday Tribune can reveal.

Despite that the opposition party has, for sometime, blocked avenues of information leakage as a result of the embarrassing experience it had over the issue of its registration, some dissidents in the party who are embittered by possible flocking of PDP members into the APC unwittingly revealed the grand plan to Sunday Tribune.

According to the plan, the opposition has created a geopolitical map of Nigeria with marking of areas of its strength and weaknesses. The first approach, which is already in operation, is the targeting of the major electoral and population centres of the federation with a view to securing plurality advantage over the ruling party’s candidate in 2015.

It was learnt that the map specifically targets Kano and Lagos states, as the two most populous in the country with a likely combined strength of between 12 and 14 million votes. As the Action Congress of Nigeria (ACN) already controls Lagos, the opposition is reported to be investing heavily in snatching Kano from the ruling party, a reason said to be behind the ongoing push to get the Kano State governor to defect to the APC
Insight into the plan also revealed that the pressure on Governor Rabiu Musa Kwankwaso to defect has grown so much that the governor is alleged to be in communication with General Muhammadu Buahri. A defection by Kwankwaso, it was gathered, would leave the opposition with the control of three dominant political caucuses in Kano State, namely the Buhari group, the Ibrahim Shekarau group and the Kwankwasiya group of Governor Kwankwaso.

The opposition, with such control, could then claim close to 80 per cent of the votes in the state. While the governor is yet to embrace the signals, reports indicated that collaboration may have gone far ahead as recent interactions among the trio of the state governor, Buhari and Senator Bola Tinubu indicated.

The map, aside focusing on the population centres, also reportedly identifies the core North, spreading from upper North-East to North-West and the South-West, including parts of Edo and Delta axis as zones of influence. The listed states include Sokoto, Kebbi, Zamfara, Jigawa, Borno, Yobe, Niger, Kano, Katsina, Kaduna, Bauchi and Gombe, including parts of Adamawa. The document indicates that the opposition is banking on the cult, like support of General Buhari and planned defection by some PDP chieftains to its fold.

For the South, the political map is said to include the six states of the South-West, namely Osun, Oyo, Ogun, Lagos, Ekiti and Ondo, in addition to Edo and a substantial part of Delta State where the document believes opposition support is growing on a daily basis. The expectation is that the alleged marginalisation of the Yoruba in the Goodluck Jonathan-led government will dissuade any Yoruba voter from supporting him come 2015, just as the strategists also hold that the core North will politically work against the president as a group.

The optimism of the opposition on the South-West, Sunday Tribune learnt, has been strengthened by the rift between the president and former President Olusegun Obasanjo. The opposition is said to believe that the anger within Obasanjo group in the South-West will work to its (opposition’s) advantage.

bakynes: I believe APC can win PDP in 2015 Presendential Elections, if they organize themselves properly.The population of the North and d SW is larger than the East and SS.The North doesn't want Jonathan which is very clear considering how the Northern Governors are teaming up against him and the SW which gave jonathan d edge over Buhari in d 2011 elections are nt happy with the way he is ruling d affairs of the Nation. So APC can win come 2015 if they conduct themselves properly.

The North has since to be in the past what we have now is North-East, North-West and North-Central and the cabal that rules the then North (Hausa/Fulani) don't their lordship on the North-Central as we speak now. please be aware that their is nothing like One Northern Nigeria again, if you think i am wrong let GEJ decide not to run come 2015 and return power to the 'so-called' North in the person of David Mark who is from Benue State then you will hear stories, these Northern Elders will come up with another theory. So i simply mean to say that there won't be block vote for any Northerner candidate in 2015.

Come to South-West where i hail from the Easterners have a large chuck of their brethren here (Lagos in particular) and they will definitely vote GEJ. Have you consider Ondo State where Olusegun Mimiko is tending towards PDP? His Labour Party will adopt GEJ as their presidential candidate in 2015 just for self-preservation and survival. I think you are aware that Oyo State where Govvernor Ajimobi of ACN have to go into partnering Ladoja's Accord Party to stabilizer his government are at loggerhead now and PDP has started courting Ladoja's robust grassroot support, APC presidential candidate will have a rough ride in that state. The only State in South-West that i think can deliver 80% of their vote to APC is Osun. GEJ will have a jolly ride in South-West not minding the present cry of marginalization of the zone as we all know that we lost the House of Reps Speakership as a zone to Tinubu and his bands.

Just as Dele Momodu rightly said despite the state of the nation if the election holds even now GEJ will carry the day.
