NBA changed the venue cos of SOE, iba is the problem sef
You are working against Fubara and you want to take credit of his initiative ... who allows that 1. There is nothing like Ibas or Fubara before the Court on this issue. There is only Rivers State government represented by the Attorney General of Rivers State or whomsoever he may delegate. 2. This is 300mn of money belonging to Rivers State for the betterment of its people. It is not about taking credit for anything... What credit is there to be taken for giving the NBA money? Is that an achievement?? |

Politics › Re: ₦300m not a 'gift', refund or we recover through legal means - Ibas' replies NBA by SmartyPants(m): 7:32am On Apr 16, 2025 |
Walai: You can only enforce refunds on contractual agreement which can take any form. If not what are we arguing? Obtaining by false pretence does not apply here. NBA reserves the right to change the venue of their event at any time. Oh, thats what you think. There is a lot you don't know. Do you know that if someone gives you transport money to go somewhere and you dont go to that particular place(of course you reserve the right to change your destination), you can be sued successfully? You are not a lawyer. Stop debating law. |
Politics › Re: ₦300m not a 'gift', refund or we recover through legal means - Ibas' replies NBA by SmartyPants(m): 6:54am On Apr 16, 2025 |
Walai: It depends on the context. First the letter is a mere appeal and NBA can prove that if they wrote to other state govts and corporate agencies for support. For you to enforce it as a contractual agreement, RIVSG have to prove that the letter is a valid instrument of making an offer of which the acceptance of the offer is premised on the 300 million donation, I doubt if the content of the letter qualifies for that. The 300M is like money you give to your girlfriend with the understanding that she will be loyal, it has no legal backing in terms of refund when things go wrong. Did I mention contractual agreement? |

Politics › Re: ₦300m not a 'gift', refund or we recover through legal means - Ibas' replies NBA by SmartyPants(m): 10:49pm On Apr 15, 2025 |
Walai: Not true, there was no valid contractual agreement with respect to the money. It is a mere gift. What the Rivers State govt is holding unto is mere assumed understanding which does not qualify for a valid contract. The case is dead on arrival . FYI, I offered a law course on contract during school days Will you agree that the NBA likely wrote to Fubara and asked for donations on the grounds that they would be hosting the conference in Rivers? If yes, does changing the venue amount to obtaining by false pretense? |

That is a meaningless statement that may or may not be true but I think it's common knowledge that all political parties try to undermine each other.
