The key phrase is "under a sentence" meaning a conviction has been established that resulted in a fine or imprisonment. But Tinubu was not sentenced or convicted hence the $460k seized was not the fine.

THE $460K WAS NOT A FINE WHICH MADE IT A NON CONVICTION TRAIL BUT A SEIZURE.

This is a niece piece that actually cleared Tinubu rather than nailed him. It shows clearly why USA didn't see him as a criminal as they understood people may fall victim if being in custody of drug money. Once they establish your innocence the USA government just seize the money first until you prove to them that the money eas not illegally obtained. .Since it dawned on Tinubu that the $460k was illegally obtained by the drug criminal that put it I his bank account he did not contend for the money not to be seized

Look at the encircled again, did you see anywhere the constitution said the fine must be criminal in nature?
Did the circle part not referring to Nigerian law? Was the forfeiture made under Nigerian law?. Also, the next section says any conviction must have happened within the last 10 years. This happened 30 years ago. So even if Tinubu was convicted he was now free to contest since the 10 years status bar was over

In a criminal matter arising from a trial and conviction.
Don't mind replying to the Obidients again. Firstly, this was a case in USA which the prosecutors who had all the details of the matter didn't convict Tinubu and they have officially established that in 2003 through the response to IGP Tafa then. The USA forfeiture case was to allow govt take the money belonging to the drug criminal that he put in Tinubu's account. This is after they have established that Tinubu was innocent in the entire saga.

so what is the 460000 dollars fine for? nothing concern us with the money...if you forsake 5k to frsc for traffic offense...why did tinubu pay a fine up to that amount
It was a forfeiture and not a fine. The USA government seized the $460k belonging to the drug trafficking criminal that put the money in Tinubu's account. Tinubu was not fined as it was established that he was not involved in the narcotics biz. So the hovt filed a civil case to seize the funds I Tinubu's account.

So traficking narcotics is not criminal and dishonet in nature?
That is the reason why the drug lord should have appealed the forfeiture since he was trading in a legal substance that is not criminal in nature.
The US prosecutors who tried the case and had all the facts already ruled that Tinubu did not commit a crime. That is what matters. And they opened a civil case for the forfeiture of the $460k which they already determined Tinubu has no hand in it as he was not among the actual criminals who traded in drugs and put that funds in Tinubu's account. All the acrobatics or conjectures by Obi's lawyers and any other interpretation on the matter by a third party is just an academic exercise. Moreover in 2003 President Obasanjo mandated the IGP Tafa Balogun to contact the USA online matter and they wrote back that Tinubu didn't commit a crime.

that's a strong point, I think the Obi Lawyers are actually doing a diligent work here, ....I have read over and over again the submission of the Tinubu group about the forfeiture, and I discovered that they have only been flogging over & over again their own interpretation, mere guessing & often imposing their own views on the Matter, but we all know that the case itself, and of course the res of the case, actually originated from a criminal proceeding, and since it hasn't been challenged to mean otherwise by any Court of jurisdiction, it can only humbly concluded that the case still sits on its originating status...that is ''criminal case''
You are partially right in the the primary case was of criminal nature. Investigations revealed that the criminals kept $460k with Tinubu who was not counted as one of the criminals. Typically the prosecutors approached the court to seize the funds and expectedly Tinubu raised no objection to the request because the money was not his. It was a civil case and fully determined and it is not at originating status. I believe that the primary criminal case end as well and the criminals jailed.

If you're way no pure you go sharp sharp ignore the forfeiture.

But if you sure say you pure , you will want to clear your name and integrity.

That's how innocent people approach injustice
In this particular case Tinubu knew he has been put on trouble by allowing his bank account to be used for receiving drug money. He was thankful that they didn't find him culpable for criminal offence. So, in this case Tinubu chose not to sue the government because in their records he had not committed a crime that would materially affect him which is why he could freely go to the USA and the USA ambassadors in Nigeria used to pay him visits even as a private citizen. Do you think USA will allow his officers associate with someone with a criminal past, especially a Nigerian?

The question is was VIO supposed to charge you a whopping N5million for mere traffic offense?

And this is a wrong analogy because Tinubu’s (not his bank account) offense was clearly written in the charge sheet - he was charged for narcotics. There’s nothing comparable between this and traffic offense.

Now, not only was he charged, he was ordered to forfeit a whopping $460,000 dollars and he never protested against it if he was truly innocent.

No legitimate hustler will allow the court confiscate his $10,000 dollars without threatening fire and brimstone, not to talk of when the money is above $400k.

Is Tinubu a Father Christmas?
You need to understand the source of the $460k. The funds belonged to his uncle with whom he stayed while in school and new in the USA. That person and others were the ones involved in the narcotics biz. When the funds were traced to Tinubu's account, the authorities seized it. However the investigators did not establish that Tinubu was involved in the narcotics biz in anyway which is why he was jot prosecuted criminally. So, it was up to the uncle and not Tinubu to challenge the seizure.

You must stop the job until the software issue is rectified; of course, you must annull whatever results thrown up by the faulty software.

Corollary, Mahmood Yakubu should have no business resorting to the discarded system of manual collation of votes results when he saw his computer glitch or whatever. He should have stopped collation of votes results until the glitch is rectified, knowing full well that no reasonable person will accept the results he prepared from manual collation which the Electoral Act of 2022 discarded.

You got it wrong. Manual collation was never discarded. Manual collation is how all the candidates were pronounced to have won. IREV was more to ensure transparency and prevent rigging at the collation center should there be a discrepancy between what what recorded at the PU and transmitted and what is announced during collation.

It's only a baby who cannot see that Alhajis Bola Ahmed Tinubu, Abubakar Atiku and Rabiu Kwankwaso, shared the votes of their religious and ethnic constituencies and made Peter Obi win the last presidential election in Nigeria with a wide margin.
INEC on observing earlier that Obi was leading by a wide margin yanked off the system for electronic transmission of vote results of presidential election; concocted votes manually to pronounce Tinubu president-elect.

Yet your OBI could not bring to the tribunal the original PU results his agents got and prove that he won. Or at lest showed how many votes that INEC "alloted" to Tinubu that should be deducted. He failed to do this. It is the available result that is transmitted. So, if INEC failed to transmit you bring your original results to prove your case. Very simple. The reason why Obi did not do that is because he knew he did not win nor have any evidence to show INEC alloted votes to Tinubu.

A lot of Obidients thrive on conspiracy theories, lies and misinformation. Unfortunately, many unscrupulous elements are feeding on these weaknesses to grow their social media and YouTube following e.g. NedMedia.

We have been telling them that Obi didn't prove anything in court for the court to rule in his favor. He has not been able to show the court the number of votes that he was deprived of, the number of votes to be subtracted from Tinubu's and/or Atiku's votes. He has also not shown how the non-transmission of the votes to electronically has affected him. If you are familiar with court judgements about elections in Nigeria, you would know that these are usually the things judges base their decisions on.

I can bet with everything I have in this world that the court will not deliver victory for Obi, maybe a rerun at best. The very intelligent ones among the Obidients know this and that is why they are looking into disqualifying Tinubu based on other technicalities like the so called Shettima double nomination and so on.
The court will not also grant a rerun, because there is no basis for it. Obi and Atiiku just came to waste the court's time and entertain their followers. I know form the onset that Obi went to court just to still be relevant to the Obidients and for them to hang on hopeless hope. Obi is very wicked to take the Obidients for a ride.

Nigeria has a federal constitution which stipulates that for a candidate to emerge as the winner in the first ballot in a presidential election, they must garner at least 25% in FCT in addition to 25% of votes in at least 24 states.

Shallow-minded views...

The US uses sundry state caucuses to select party flag bearers of the two major political parties in addition to the electoral college.

The requirement of getting 25% in Abuja in the first ballot will only consolidate our democracy so keep your narrow-mindedness to yourself.

You should go and take a more balanced look at the provision of the constitution: the 25% in Abuja requirement does not apply in a runoff...

In any case, the law is sacrosanct and must apply...

Nigeria is bigger than any desperado...
You were using USA party flag bearer ((primary elections) selection to compare a general election requirement. That's not right. You should compare apple to apple. In Nigeria, it is the party's prerogative how they select their flag bearer in line with their constitution. And that is by the way, it is Nigeria Constitution that will apply here and the bone of contention is the 25% vote of FCT which every sane person knows that it is absurd to give FCT special treatment so definitely the Tribunal will rule in favour of PBAT on this. Olanipekun has put forward very sound points that cannot be overlooked.

In my years alive, I have never seen a more brainwashed set of people than the supporters of labour party.

Firstly, the problem been referred to here is the likely pandemonium the 25% in Abuja debate if ratified by the Court will create for future Elections.

> It will elevate Abuja voters above all other states in Nigeria.

> It will go against the constitution of Nigeria that states all votes cast in Nigeria are the same because it will mean casting your vote in Abuja is more important than casting it in Akure, Onisha or Kano.

Secondly, a runoff doesn't itself guarantee that the winner of the runoff will still get the 25% requirement in Abuja. So will we simply continue to go for runoffs until the winning candidate get 25% in Abuja even if he gets 25% in all the 36 states of the federation.

Furthermore, this will put a weird spotlight on the democraphics of Abuja in future Elections which might create an ugly situation. Politicians might just import people from other states to make up the 25% in Abuja which might create an unwanted national debate in the future. Tribes will begin to fight over who should be allowed to vote in Abuja etc.

In conclusion, Tinubu's lawyer in his final written argument to the judges is only pushing his legal points with real life likely scenarios that might [quote author=Sam1d2 post=124492213]??

In fact I am taken aback that LP as a party will issue this kind is statement when clearly it is a standard court process for a lwayer to bring forth arguments or pleas before the Court so that the justices can rule in the favour of his client.

To become president in Nigeria, you must have the highest votes and 5obtai 25% in at least 2/3 of the 36 states and FCT. Tinubu's camp is saying FCT is like any other state and as such it is 2/3 of 37 states and not 2/3 of 36 states and 25% of FCT which Is the position held by Obi and Atiku. Should FCT have a special status such that to become president you must score 25% in FCT is the bone of contention which this post is all about.
