no matter what angle he approaches it from they will loose because these members will always say they are PDP members. They have never claimed independence, so i wonder how they would want to frame them as decamping. If they are expelled from the party then they retain their seat because the constition under section 68 makes no provision for that.

Yet atiku still managed to slip in 805 votes, but he did'nt even win his home state which is now against jonathan. Let's see how jonathan will fare now with a divided party in a secret ballot.

section g said the lawmaker shall vacate his seat if "being a person whose election to the house was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that house was elected"....so which of these lawmakers have joined another party? Last time i checked they were still card carrying members of the PDP. If they truly have joined another party, that assumption will be made by inec and they shall vacate their seats. Inec has'nt made that call, and the PDP cannot prove it in any court that this people have joined another party.

don't missread this judgement. The reason ameachi was put in office was because he won as flagbearer for the party but was along the line ditched for omeahia. That is why the court ruled that when the rivers people voted for the PDP governorship candiate, they were not voting for omeahia but ameachi. In the cases of these lawmakers, they were elected fully from primary level up to general and no one challenge their validity. So the party has no power to remove them, that means the votes of the general public who elected them does not matter. It is essentially turning public office into PDP primaries. You totally misread that judgement because if it was as explicit as you just said, many many parties accross the country would have booted out of office, elcted officials who get elected as a member of their party but decamped.

don't confuse yourself dear, the delegates that went for that convention was obuah's list. It was the full list by all the LGA chairmen in rivers state. They choose to present a united front in abuja so as to elect uche secondus, a native of the state to the party executive council. Which they accomplished. Go and ask yourself why since the court installed obuah as party chairman, he has'nt held election for the party executive council? Because he knows he'll lose badly. Sunny_bobo: A precedent has been set by the supreme court ruling in the Amaechi vs Omehia case. If the lawmakers eventually leaves the PDP for another party or are expelled fir obvious anti party activities, they have no choice but to leave. Failure to do so, the arm of government responsible for the execution or enforcement of the laws of the Federal republic will swing into action and your guess is as good as mine.
