Inec shouldn't make the mistake of taking audu off the supplementary elections...even if they are notified of the death, it should have been before the elections started. The electoral act says that can only happen if the elections has not been started. He was alive when it started. Even if it takes 1-month to complete the election, so far as he was alive when it started, he can't be taken off as a contestant. If they call for another election, which law will they base their decision on? I am not a lawyer, but I think the best decision here is to go into the supplementary election with audu as the candidate, since there was is no basis to take him off...if he wins, the section that takes care of death of an elected official without certificate if return be invoked. |

The electoral act has handled this. He is said to have seemingly die after the elections started, so he is a valid contender, and if he wins, his deputy should be sworn in. The pdp will have to prove that he died before the start of the election to have a rerun. Section 36 of the electoral act |
